The person then has to pay a fine.\u00a0These fines\u00a0usually range from $25 to $1,000, depending on where you are and the violation involved.<\/p>\n<p>For example, in Washington State, a Class 4 civil <span data-term-id=\"56101352\">infraction<\/span> could result in\u00a0a <a href=\"https:\/\/codes.findlaw.com\/wa\/title-7-special-proceedings-and-actions\/wa-rev-code-7-80-120\/\" target=\"_blank\" rel=\"noopener\">fine of $25<\/a>. A more serious Class 1 civil <span data-term-id=\"56101352\">infraction<\/span> could result in a fine of up to $1,000.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/infractions.html\"><span data-term-id=\"56101352\">Infractions<\/span><\/a>\u00a0usually involve little to no time in court and almost no risk of imprisonment. Class B and C <span data-term-id=\"56101337\">misdemeanors<\/span> carry progressively shorter maximum sentences. <span data-term-id=\"56101354\">Jail time<\/span> is not the only consequence you might face from a <span data-term-id=\"56101337\">misdemeanor<\/span> offense. A <span data-term-id=\"56101337\">misdemeanor<\/span> conviction can also mean probation, mandatory counseling or treatment programs, community service, and payments to victims.<\/p>\n<p>Even though <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\"><span data-term-id=\"56101337\">misdemeanors<\/span><\/a> are less serious than felonies, you will still have a permanent <span data-term-id=\"56101356\">criminal record<\/span>. This can create problems when you&#8217;re applying for work, professional licenses, renting an apartment, or pursuing educational opportunities. Many employers also run background checks that will show your <span data-term-id=\"56101337\">misdemeanor<\/span> conviction. This can be especially limiting if you&#8217;re applying for jobs that require security clearances or positions where trust is essential.<\/p>\n<h3><strong>Felonies<\/strong><\/h3>\n<p><span data-term-id=\"56101364\">Felony offenses<\/span> are the most serious <span data-term-id=\"56101362\">type of crime<\/span>. They are often classified by degree, with a <span data-term-id=\"56101340\">first-degree<\/span> felony as the most serious and a <span data-term-id=\"56101338\">third-degree<\/span> felony as the least serious. Felonies typically include\u00a0<span data-term-id=\"56101368\">violent crimes<\/span> and serious property crimes, such as:<\/p>\n<ul>\n<li>Larceny<\/li>\n<li>Treason<\/li>\n<li><span data-term-id=\"56101372\">Arson<\/span><\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/homicide.html\">Murder<\/a><\/li>\n<li>Rape<\/li>\n<li>Robbery<\/li>\n<li>Burglary<\/li>\n<li>Kidnapping<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-trafficking-distribution.html\">Drug trafficking<\/a><\/li>\n<\/ul>\n<p>Federal law <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-3559\/\" target=\"_blank\" rel=\"noopener\">classifies <span data-term-id=\"56101341\">criminal offenses<\/span><\/a> into five classes depending on the amount of prison time you could face.\u00a0<\/p>\n<ul>\n<li><strong><span data-term-id=\"56101348\">Class A<\/span> felonies<\/strong>: up to <span data-term-id=\"56101345\">life imprisonment<\/span> or death<\/li>\n<li><strong>Class B felonies<\/strong>: 25 years or more<\/li>\n<li><strong>Class C felonies<\/strong>: less than 25 years but at least 10 years<\/li>\n<li><strong>Class D felonies<\/strong>: less than 10 years, but at least five years<\/li>\n<li><strong>Class E felonies<\/strong>: more than one year to less than five years<\/li>\n<\/ul>\n<p>How states classify felonies varies. Some use degree systems like <span data-term-id=\"56101340\">first-degree<\/span>, <span data-term-id=\"56101339\">second-degree<\/span>, and <span data-term-id=\"56101338\">third-degree<\/span>. Others use alphabetical classes similar to federal law.\u00a0<\/p>\n<h2><strong>Degrees and Classes of Crimes<\/strong><\/h2>\n<p>States employ two distinct organizational methods for categorizing <span data-term-id=\"56101341\">criminal offenses<\/span>: degree systems and class systems. These approaches serve different purposes, and jurisdictions may use one, both, or certain elements of both.<\/p>\n<p>Many <span data-term-id=\"56101363\">state laws<\/span> classify a single criminal act into different degrees. Each <span data-term-id=\"56101371\">degree of crime<\/span> has different elements that prosecutors must prove to get a conviction.<\/p>\n<p>Let\u2019s use <a href=\"https:\/\/www.findlaw.com\/state\/new-york-law\/new-york-assault-and-battery-laws.html\">New York assault charges<\/a> as an example:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-120-00\/\" target=\"_blank\" rel=\"noopener\">Assault in the <span data-term-id=\"56101338\">third degree<\/span><\/a>\u00a0requires proof that the defendant intentionally or recklessly caused physical injury. It also applies if they negligently caused physical injury to another using a dangerous instrument or deadly weapon.<\/li>\n<li>The <span data-term-id=\"56101355\">criminal charge<\/span> escalates to\u00a0<a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-120-05\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56101339\">second-degree<\/span> assault<\/a>\u00a0if the defendant committed the crime against protected persons. These include healthcare workers, first responders, or a minor child.<\/li>\n<li><span data-term-id=\"56101340\">First-degree<\/span> assault is the most serious charge. The law considers whether the person intended to cause serious and permanent disfigurement to another person. <a href=\"https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-120-10\/https:\/\/codes.findlaw.com\/ny\/penal-law\/pen-sect-120-10\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56101340\">First-degree<\/span> assault<\/a>\u00a0also applies when the circumstances of the case show depraved indifference to human life.<\/li>\n<\/ul>\n<p>As illustrated in this example, the degree system organizes variations of the same crime into levels. Each level requires prosecution to prove increasingly serious factors such as the harm you caused, your intent, the vulnerability of the victim, or the weapon used. The prosecution must prove every element of the degree level to secure a conviction.<\/p>\n<p>Class systems work differently. Instead of levels, they group all offenses into broad categories based on severity, regardless of type. Classifications may be\u00a0<span data-term-id=\"56101348\">Class A<\/span>, Class B, and Class C felonies, Class 1, 2, 3, and so on.<\/p>\n<p>In Kentucky, Class D felonies include crimes that are completely unrelated. It includes\u00a0<a href=\"https:\/\/apps.legislature.ky.gov\/law\/statutes\/statute.aspx?id=41857\" target=\"_blank\" rel=\"noopener\">forgery in the <span data-term-id=\"56101339\">second degree<\/span><\/a>,\u00a0<a href=\"https:\/\/apps.legislature.ky.gov\/law\/statutes\/statute.aspx?id=19818\" target=\"_blank\" rel=\"noopener\">theft of identity<\/a>, and\u00a0<a href=\"https:\/\/apps.legislature.ky.gov\/law\/statutes\/statute.aspx?id=39691\" target=\"_blank\" rel=\"noopener\">wanton abuse or neglect of an adult<\/a>. These crimes do not share common elements, but they are all considered Class D offenses under Kentucky law. All Class D felonies in Kentucky carry a punishment range of one to five years.<\/p>\n<h2><strong>Factors That Determine Degree<\/strong><\/h2>\n<p>While crimes may fall into broad categories like assault, theft, or homicide, most states divide these crimes into degrees or classes. The degree assigned to a charge depends on specific factors that make the crime more or less serious. Understanding these factors helps explain why two similar acts can result in very different <span data-term-id=\"56101343\">criminal cases<\/span> and penalties.<\/p>\n<h3><strong>Premeditation and Mental State<\/strong><\/h3>\n<p>A well-known 1997 case illustrates how a defendant&#8217;s mental state can determine the degree of a\u00a0<span data-term-id=\"56101355\">criminal charge<\/span>, even when the basic facts aren&#8217;t disputed.<\/p>\n<p>In what\u2019s known as\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/ma-supreme-judicial-court\/1470821.html\" target=\"_blank\" rel=\"noopener\">the \u201cNanny Case,&#8221;<\/a>\u00a0a Massachusetts family hired an 18-year-old au pair to care for their toddler. In early 1997, the au pair allegedly violently shook the toddler and slammed him against the floor. The child died days afterward. There was no question that the nanny caused the death, but the level of homicide charges she faced needed to be determined.<\/p>\n<p>There were three possible charges available for this act:<\/p>\n<ul>\n<li><strong><span data-term-id=\"56101376\">First-degree<\/span><span data-term-id=\"56101376\"> murder<\/span><\/strong>\u00a0required proof of premeditation and &#8220;malice aforethought&#8221;<\/li>\n<li><strong><span data-term-id=\"56101353\">Second-degree<\/span><span data-term-id=\"56101353\"> murder<\/span><\/strong>\u00a0required proof that she acted with malicious disregard for human life<\/li>\n<li><strong>Involuntary manslaughter<\/strong>\u00a0required proof that she acted recklessly but without malice<\/li>\n<\/ul>\n<p>The jury initially convicted the au pair of\u00a0<span data-term-id=\"56101353\">second-degree<\/span><span data-term-id=\"56101353\"> murder<\/span>, resulting in a mandatory life sentence. However, the judge later reduced the conviction to involuntary manslaughter. In his opinion, the evidence showed her actions were &#8220;characterized by confusion, inexperience, frustration, immaturity, and some anger, but not malice.&#8221; Her sentence was reduced from life to 279 days.<\/p>\n<p>This case illustrates how the same physical act can result in drastically different charges depending on the defendant&#8217;s mental state<strong>\u00a0<\/strong>(or &#8220;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\">mens rea<\/a>&#8220;). The degree determination determined whether the nanny would spend 279 days or life in prison.<\/p>\n<h3><strong>Use of Weapons<\/strong><\/h3>\n<p>The presence or use of a weapon often elevates a crime to a higher degree. For example:<\/p>\n<ul>\n<li><strong>Assault without a weapon<\/strong>\u00a0might be classified as\u00a0<span data-term-id=\"56101338\">third-degree<\/span>\u00a0assault (a\u00a0<span data-term-id=\"56101337\">misdemeanor<\/span>\u00a0in some states)<\/li>\n<li><strong>Assault with a deadly weapon<\/strong>\u00a0typically becomes first- or\u00a0<span data-term-id=\"56101339\">second-degree<\/span>\u00a0assault (a felony)<\/li>\n<\/ul>\n<p>A &#8220;deadly weapon&#8221; can include firearms, knives, or any object used in a manner likely to cause death or serious bodily harm. Some states also have specific enhancements for certain weapon types, such as firearms or explosives.<\/p>\n<p>The weapon doesn&#8217;t need to be used to apply. Possessing or displaying it during the commission of a crime can increase the degree of the crime. For instance, showing a gun during a robbery often elevates the charge from simple robbery to armed robbery, even if the weapon is never fired.<\/p>\n<h3><strong>Victim Type and Vulnerability<\/strong><\/h3>\n<p>Crimes committed against certain categories of victims often carry higher degrees and harsher penalties. Protected classes commonly include:<\/p>\n<ul>\n<li><strong>Law enforcement officers and first responders<\/strong>: Assaulting a\u00a0<span data-term-id=\"56101369\">police officer<\/span>\u00a0is typically a higher-degree felony than assaulting a civilian<\/li>\n<li><strong>Children<\/strong>: Many states elevate charges when the victim is a minor, particularly for sex crimes and assault<\/li>\n<li><strong>Elderly or disabled persons<\/strong>: Abuse or theft targeting vulnerable adults often results in enhanced charges<\/li>\n<li><strong>Certain professionals<\/strong>: Some states have specific protections for teachers, judges, or healthcare workers performing their duties<\/li>\n<\/ul>\n<p>For example, <a href=\"https:\/\/www.findlaw.com\/state\/minnesota-law\/minnesota-assault-laws.html\">Minnesota&#8217;s assault laws<\/a> contain five different degrees. Assaulting a correctional officer or judge can elevate what might otherwise be a lower-degree charge to a <span data-term-id=\"56101339\">second-degree<\/span> assault. This is a felony carrying a penalty of up to seven years in prison.<\/p>\n<h3><strong>Aggravating and Mitigating Circumstances<\/strong><\/h3>\n<p>Courts also consider additional factors that may increase (aggravate) or decrease (mitigate) the severity of a charge:<\/p>\n<p><strong>Aggravating factors<\/strong>\u00a0that may increase the degree include:<\/p>\n<ul>\n<li>Prior criminal history or repeat offenses<\/li>\n<li>Committing a crime while on probation or parole<\/li>\n<li>Particular cruelty in how the crime was committed<\/li>\n<li>Commission of the crime for hire or for gang-related purposes<\/li>\n<li>Violation of a protective order<\/li>\n<\/ul>\n<p><strong>Mitigating circumstances<\/strong>\u00a0that may reduce the degree include:<\/p>\n<ul>\n<li>Lack of criminal history<\/li>\n<li>Acting under duress or coercion<\/li>\n<li>Mental illness or diminished capacity<\/li>\n<li>The defendant&#8217;s age (particularly for juvenile offenders)<\/li>\n<li>Cooperation with law enforcement<\/li>\n<li>Showing genuine remorse or making restitution<\/li>\n<\/ul>\n<p>These factors give prosecutors and judges flexibility to ensure the charge and punishment fit the specific circumstances of each case. They help the criminal justice system make important distinctions. The system can distinguish between a first-time offender who shows remorse and a repeat offender who shows no regard for the law.<\/p>\n<h2><strong>Wobbler Offenses<\/strong><\/h2>\n<p>Some states recognize \u201cwobbler\u201d offenses. These are crimes that prosecutors can charge as either felonies or <span data-term-id=\"56101337\">misdemeanors<\/span>, depending on the details of the case. This flexibility enables them to consider your individual circumstances rather than applying rigid rules.<\/p>\n<p>Wobbler crimes cover a wide range of offenses, including certain assault charges, vehicular manslaughter, and burglary. When deciding on wobbler offenses, the prosecution considers several factors. These factors include your criminal history, the seriousness of the crime, whether you used a weapon, and the victim&#8217;s vulnerability.<\/p>\n<h2><strong>How Classifications Affect Your Case<\/strong><\/h2>\n<p>The classification of your charge shapes nearly every aspect of your case. Felony charges often carry higher bail amounts, while <span data-term-id=\"56101337\">misdemeanor<\/span> charges typically mean lower bail. Classification also sets the maximum <span data-term-id=\"56101350\">possible punishment<\/span> you could face. Felonies could result in years of imprisonment, <span data-term-id=\"56101345\">life imprisonment<\/span>, or even the <span data-term-id=\"56101349\">death penalty<\/span>. In most jurisdictions, a <span data-term-id=\"56101337\">misdemeanor<\/span> limits your <span data-term-id=\"56101354\">jail time<\/span> to one year or less in a county jail.\u00a0<\/p>\n<p>The consequences of a <span data-term-id=\"56101344\">felony conviction<\/span> reach far beyond your <span data-term-id=\"56101347\">prison sentence<\/span>. In every state except Maine and Vermont, you <a href=\"https:\/\/www.findlaw.com\/voting\/my-voting-guide\/felon-voting-laws-by-state.html\">lose your voting rights<\/a> if you&#8217;re convicted of a felony. If and when you get those rights back depends on where you live.<\/p>\n<p>Federal law prohibits some people with <span data-term-id=\"56101344\">felony convictions<\/span> from <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-922\/\" target=\"_blank\" rel=\"noopener\">owning or possessing firearms<\/a> or ammunition. This prohibition applies if you have a prior criminal conviction for a crime punishable by more than one year in prison. You may also lose eligibility for certain government benefits and face difficulties when applying for professional licenses. Many employers reject applicants with <span data-term-id=\"56101356\">criminal records<\/span>. This makes it difficult to find work after serving a <span data-term-id=\"56101347\">prison sentence<\/span>.<\/p>\n<h2><strong>Hiring a\u00a0<span data-term-id=\"56101360\">Criminal Defense<\/span><span data-term-id=\"56101360\"> Attorney<\/span><\/strong><\/h2>\n<p>The classification of your <span data-term-id=\"56101355\">criminal charge<\/span> can dramatically affect the possible penalties you may face.
