It begins with the arrest and a police report. Arraignment decides whether you&#8217;ll face charges. From there, the process varies, and it sometimes leads to a criminal trial.<\/p>\n\n    <\/div>\n\n<p>After an arrest, there are a few legal steps before the case goes to a trial. What happens during each step could influence the outcome of your case.<\/p>\r\n<p>Understand the process a person goes through from being arrested to being charged with a crime:<\/p>\r\n<ul>\r\n<li>Arrest and police report<\/li>\r\n<li>Arraignment<\/li>\r\n<li>Grand jury indictment<\/li>\r\n<li>Preliminary hearing<\/li>\r\n<li>Criminal trial<\/li>\r\n<li>Criminal charges<\/li>\r\n<\/ul>\r\n<p>This article explains what happens during a typical criminal case. You can start building a strategy to protect your rights at every stage of your case.<\/p>\r\n<h2>The Arrest<\/h2>\r\n<p>However, for many crimes, including&nbsp;any serious crime like a felony charge, there will be an arrest. You can either be arrested at the scene of the crime&nbsp;or an arrest warrant will be issued in your name once law enforcement has collected sufficient evidence to establish probable cause that you committed the crime. In this case, a judge will issue an arrest warrant, listing the crime(s) you have been charged with.<\/p>\r\n<p>Regardless of whether a judge issues an arrest warrant or you are arrested at the scene of the crime, you will be booked at the police station and entered into the law enforcement agency&#8217;s database. Criminal law requires that the police present you with a copy of the arrest warrant before they arrest you.<\/p>\r\n<h2>The Arrest Report<\/h2>\r\n<p>After making an arrest, the police officer writes an arrest report and forwards it to the district attorney. The report summarizes the events leading up to the arrest and the details of the arrest (dates, time, location, witnesses, etc.). The police officer &quot;charges&quot; the person with a crime, but those charges are subject to review by the district attorney.<\/p>\r\n<p>The district attorney will then review the arrest report along with the evidence collected and can:<\/p>\r\n<ul>\r\n<li>Decline to press charges,<\/li>\r\n<li>Modify the charges,&nbsp;or<\/li>\r\n<li>Enhance the charges to make it a more serious offense.<\/li>\r\n<\/ul>\r\n<p>This happens before the first court appearance, otherwise known as the arraignment.<\/p>\r\n<h2>Deciding Whether or Not To Prosecute<\/h2>\r\n<p>Just because you were arrested does not mean the government will necessarily pursue criminal charges. Prosecutors have a lot of discretion on whether or not to file&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-criminal-charges-brought-against-someone.html\">charges against a defendant<\/a>.<\/p>\r\n<p>Some of the most important factors prosecutors consider include:<\/p>\r\n<ul>\r\n<li><b>Beyond a reasonable doubt:&nbsp;<\/b>First, a prosecutor will likely evaluate the evidence and decide whether they will be able to prove you committed the crime&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/beyond-a-reasonable-doubt.html\" target=\"_blank\" rel=\"noopener\">beyond a reasonable doubt<\/a>.<\/li>\r\n<li><b>Conservation of judicial resources: <\/b>Every case requires work from multiple branches of government, from police and courtroom security to court clerks and office staff. Most courts simply cannot prosecute every case they receive, so the prosecutor has to prioritize them.<\/li>\r\n<li><b>Office policies:&nbsp;<\/b>Prosecutor&#8217;s offices often have policies regarding which crimes they want to prosecute and which crimes they consider less important.<\/li>\r\n<li><b>The prosecutor&#8217;s notion of justice:&nbsp;<\/b>Just like everyone else, prosecutors have beliefs and ideas about right and wrong. Those beliefs may lead a prosecutor to pursue a case more aggressively than may be warranted based on the facts. Or it may lead the prosecutor to file lesser charges, or choose not to pursue the case if&nbsp;the prosecutor thinks justice will be served even if no one is charged with the crime (for example, in cases where the &quot;guilty&quot; party suffered a great loss as a result of their actions).<\/li>\r\n<li><b>Political aspirations:&nbsp;<\/b>Prosecutors with an eye toward political office may be keenly aware of their public image. They may choose to prosecute a high-profile case when there is community outrage or when it &quot;sends a message,&quot; even if the evidence is questionable.<\/li>\r\n<\/ul>\r\n<p>Once the prosecutor has decided to pursue a case, they must decide whether to file the charges in a complaint with the trial court or to take the case to a grand jury. Federal felony prosecutions must go through a grand jury. Some states require serious criminal charges to go through a grand jury, as well.<\/p>\r\n<h3>Can I Sue a Prosecutor for Pursuing Incorrect Charges?<\/h3>\r\n<p>Even if you feel the prosecution wasn&#8217;t justified in charging you, there&#8217;s typically little you can do unless the prosecution engaged in serious misconduct. It is very rare that a prosecutor ever faces legal trouble for their decision whether to prosecute. This is because prosecutors have&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/424\/409.html\" target=\"_blank\" rel=\"noopener\">absolute immunity<\/a>&nbsp;from civil lawsuits related to decisions made in their capacity as prosecutors. Similarly, it is rare that prosecutors will face sanctions or criminal charges for declining to prosecute, although it is not unheard of.<\/p>\r\n<h2>The Grand Jury<\/h2>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-does-a-grand-jury-work.html\">grand jury<\/a>&nbsp;is a check on the power of the prosecutor, preventing prosecutors from inventing serious charges out of thin air. The grand jury&#8217;s job is to decide whether charges should be brought and what those charges should be. It does not decide whether the person who may go to trial is guilty or innocent. Some prosecutors use the grand jury proceedings as a rehearsal for a real jury trial, but others see it as just another work task that needs to be completed.<\/p>\r\n<p>Grand juries generally have more jury members. Some grand juries have as many as 23 members, while trial juries have between 6 and 12 members.<\/p>\r\n<h2>How Grand Juries Work<\/h2>\r\n<p>Unlike regular juries, grand juries work behind closed doors. These proceedings are secret, but transcripts may be obtained after the fact. The potential defendants aren&#8217;t present during grand jury proceedings, and neither are their lawyers.<\/p>\r\n<p>The prosecutor gives the jurors a &quot;bill&quot; of charges \u2014 that is, a list of the potential charges. The prosecutor then presents&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/evidence-the-concept-of-admissibility.html\">evidence<\/a>&nbsp;and witnesses. Unlike trial jurors, jurors on a grand jury can ask questions of the prosecutor or of witnesses. They will see the evidence the jury is likely to see, but they can also view evidence that might not be admissible in court.<\/p>\r\n<p>Grand juries are not required to arrive at a unanimous decision. A simple majority is sufficient. Regular juries require a unanimous decision. The grand jury will return a decision on whether the case should go to trial and which of the prosecution&#8217;s charges should proceed (the prosecutor may have many charges).<\/p>\r\n<p>If the grand jury&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/what-is-an-indictment.html\">indicts<\/a>&nbsp;a defendant, it returns a &quot;true bill.&quot; If the grand jury decides not to indict, it returns a &quot;no bill.&quot; The prosecutor can still file criminal charges even if the grand jury returns a &quot;no bill,&quot; but can likely only proceed on misdemeanor charges.<\/p>\r\n<p>Even if the grand jury chooses not to indict, the prosecutor can return (within a certain amount of time) to the same grand jury to present additional evidence. Or they can call a new grand jury.<\/p>\r\n<p>If the case is a&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\">felony case<\/a>&nbsp;and the prosecutor bypasses a grand jury, then a preliminary hearing is held. (Some states do not allow this.) If the case proceeds based on a grand jury indictment, then no preliminary hearing is required.<\/p>\r\n<h2>The Preliminary Hearing<\/h2>\r\n<p>If needed, a judge might hold a&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/preliminary-hearing.html\">preliminary hearing<\/a>. This is when the judge decides whether the state has enough evidence to proceed to trial.<\/p>\r\n<p>Prosecutors generally file criminal charges within two to three days. Because prosecutors must file so quickly, the criminal charges can change significantly over time.<\/p>\r\n<p>Before trial, the prosecution may try to get a defendant to agree to a plea bargain or enter into a plea agreement. A plea bargain can reduce a defendant&#8217;s sentence or eliminate some of the criminal charges against the defendant. However, this may mean the defendant will have to plead guilty to a charge in order for the prosecution to drop a different charge.<\/p>\r\n<h2>Criminal Trial<\/h2>\r\n<p>Very few cases will ever actually make it to trial. It is more likely that the prosecution and the defendant will reach some form of plea agreement before the trial starts.<\/p>\r\n<p>If it does make it to trial, the prosecution will have the burden to prove, beyond a reasonable doubt, that the defendant committed the crime. The defendant&#8217;s counsel, who may be a public defender or private attorney, will then have the opportunity to contest the prosecution&#8217;s evidence and make the case for why the defendant is innocent.<\/p>\r\n<p>At the end of the trial, if it is a jury trial, the jury will deliberate the evidence and return a verdict of guilty or not guilty.<\/p>\r\n<h2>Get Legal Advice<\/h2>\r\n<p>A criminal defense lawyer who knows the ins and outs of the criminal justice system can provide crucial assistance regardless of where your case is in the criminal process.
