In 1963, the Court held in Gideon v. Wainwright<\/i><\/a> that indigent defendants had a constitutional right to an attorney at all critical stages of their case. The Supreme Court ruled in Miranda v. Arizona<\/i><\/a> (1966) that police must inform suspects they have a right not to incriminate themselves. This is your right to remain silent.<\/p>\r\n

When To Invoke Your Miranda Rights<\/h2>\r\n

Using these rights is important for your case and for your attorney later. Despite what you see on TV and what armchair attorneys tell you, police do not have to read suspects their Miranda rights at the moment of arrest. Police only need to read Miranda rights when questioning suspects about their crimes.<\/b><\/p>\r\n

A suspect must state that they want to remain silent. Remaining silent without saying, \u201cI do not want to answer questions," is not enough.<\/p>\r\n

When To Invoke Your Right to an Attorney<\/h2>\r\n

You are not entitled to make a phone call to get a lawyer. If you want an attorney, asking for one means the police cannot continue any interrogations or procedures until you have legal representation.<\/p>\r\n

Suspects must ask for an attorney themselves.<\/b> The dramatic TV show interlude where an attorney bursts into the interrogation room and announces, \u201cI’m the lawyer, and this interrogation is over!" does not happen in real life. A suspect must tell police they want a lawyer and either get an opportunity to contact one or tell the judge they need court-appointed counsel.<\/p>\r\n

Indigent Defense Options<\/h2>\r\n

You’ll also need to tell someone you need an attorney at your first court appearance, also known as your arraignment. This is the first time you stand before the judge and hear the formal charges against you. The judge will also ask if you have an attorney and if you want one appointed.<\/p>\r\n

To qualify for court appointment of counsel, defendants must meet income-based requirements. The judge will ask the defendants if they have a job and about their other assets and expenses. Being unemployed may not be enough to qualify for a public defender or other court-appointed attorney. Courts have several alternatives for low-income defendants.<\/p>\r\n

Public Defender’s Office<\/h2>\r\n

The public defender’s office handles most criminal cases when defendants cannot afford their own attorneys. Eligibility for a public defender depends on the defendant’s household income and other assets. It is set by state law. For instance, in New Jersey, a defendant may make no more than 25% above the poverty level based on the number of people in the household.<\/p>\r\n

Public defenders are usually good attorneys with extensive courtroom experience. They have longstanding relationships with prosecutors and judges in their jurisdictions. On the flip side, public defenders have large caseloads, small staffs, and pressure to keep their cases moving.<\/p>\r\n

Alternate Public Defender<\/h2>\r\n

In large cities and counties, the public defender may share duties with private attorneys who have agreed to work with the courts. These lawyers are \u201calternate public defenders." Alternate defenders work with the public defender in conflict of interest cases, where the public defender represents another defendant in the same case. Alternate defenders also work overflow cases when indigent defendants need attorneys for arraignments and hearings.<\/p>\r\n

Legal Aid and ‘Partial Indigency’<\/h2>\r\n

It’s always better to have an attorney than to appear \u201cpro se<\/a>," that is, to represent yourself. However, some legal issues do not need the services of an expensive private attorney. Not all criminal defendants need a high-priced lawyer. State and municipal courts recognize this, and many infractions<\/a> and misdemeanors<\/a> can be handled in a single day without an attorney.<\/p>\r\n
