Let\u2019s take a closer look at what it means.<\/p>\n<h3>What Is <span data-term-id=\"56179471\">Probable Cause<\/span>?<\/h3>\n<p>Police cannot base an arrest on a hunch or a guess. A <span data-term-id=\"56179482\">law enforcement<\/span><span data-term-id=\"56179482\"> officer<\/span> must have an objectively reasonable basis for their belief based on the facts and circumstances in the criminal case.<\/p>\n<p>For example, a <span data-term-id=\"56179469\">police officer<\/span> hears a report that a man in a yellow shirt just robbed a liquor store with a gun. When they arrive shortly thereafter, they spot a man in a yellow shirt running away from the scene of the crime. The officer can stop and search the man, as there is <span data-term-id=\"56179483\">reasonable suspicion<\/span> that he could be the suspect. If a search reveals a gun and a wad of cash in his pocket, the <span data-term-id=\"56179469\">police officer<\/span> has the legal authority to arrest him, given the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\">totality of the circumstances<\/a>. An officer may have acted with\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-reasonableness-requirement.html\">a reasonable good-faith belief<\/a>\u00a0that they had <span data-term-id=\"56179471\">probable cause<\/span>, but a judge could later determine they were incorrect.<\/p>\n<p>The judge will deny the warrant if they do not find\u00a0<span data-term-id=\"56179471\">probable cause<\/span>. Otherwise, the warrant will be issued, and the police may take the suspect into custody and <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arrest.html\">arrest them<\/a>. An arrestee can challenge an arrest on the grounds of lack of <span data-term-id=\"56179471\">probable cause<\/span>. If they prevail, the court may release the suspect from custody.<\/p>\n<h2>Arrest Warrants<\/h2>\n<p>An arrest warrant is a court order authorizing <span data-term-id=\"56179472\">law enforcement<\/span> to arrest someone. <span data-term-id=\"56179472\">Law enforcement<\/span> must obtain a warrant from a neutral\u00a0judge\u00a0or\u00a0magistrate. The warrant must be based on a showing of <span data-term-id=\"56179471\">probable cause<\/span>.<\/p>\n<p>Many arrests do not occur from freshly committed crimes or\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/hot-pursuit.html\" target=\"_blank\" rel=\"noopener\">hot pursuits<\/a>, but from police investigations. During these investigations, the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-fourth-amendment.html\"><span data-term-id=\"56179492\">Fourth Amendment<\/span><\/a>\u00a0protects people against unreasonable searches or seizures by <span data-term-id=\"56179472\">law enforcement<\/span>. This requires officers to obtain a\u00a0warrant\u00a0that specifies,\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/oath.html\" target=\"_blank\" rel=\"noopener\">under oath,<\/a>\u00a0where they may search and the persons or things they may seize. Under the <span data-term-id=\"56179492\">Fourth Amendment<\/span>, a person has a reasonable expectation of privacy in their home.<\/p>\n<p>If the police have <span data-term-id=\"56179471\">probable cause<\/span> to believe a person committed a crime and that evidence will be in a particular location, they can ask a judge for a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\">search warrant<\/a>. To bring someone in for questioning about a crime they may have committed, the police can ask for an arrest warrant to take the suspect into legal custody. They must have <span data-term-id=\"56179471\">probable cause<\/span> to support a valid warrant being issued.<\/p>\n<p>An arrest warrant typically:<\/p>\n<ul>\n<li>Identifies the crimes committed and the corresponding statutes<\/li>\n<li>Identifies the individual suspected of committing the crimes<\/li>\n<li>Specifies the locations and dates of the offenses<\/li>\n<li>Identifies any victims of the criminal activity<\/li>\n<li>Commands any <span data-term-id=\"56179469\">police officer<\/span> to take that person into custody<\/li>\n<\/ul>\n<p>The arrest warrant authorizes any\u00a0<span data-term-id=\"56179469\">police officer<\/span>\u00a0or\u00a0<span data-term-id=\"56179472\">law enforcement<\/span>\u00a0agency\u00a0to arrest the suspect. It does not have to be the officers who are investigating the crime. This information is usually spread statewide (or nationwide) through police databases. When an officer checks the person\u2019s identification and arrest record, they will learn about the warrant and can take them into custody.<\/p>\n<p>For example, under\u00a0<a href=\"https:\/\/codes.findlaw.com\/nc\/chapter-15a-criminal-procedure-act\/nc-gen-st-sect-15a-401.html\" target=\"_blank\" rel=\"noopener\">North Carolina criminal law<\/a>, an officer can arrest a defendant with an outstanding warrant, even if the warrant isn\u2019t in their possession. The officer must inform the person about the outstanding warrant and serve it upon them as soon as possible.<\/p>\n<h2>Detention vs. Arrest<\/h2>\n<p>Police\u00a0detention\u00a0is not necessarily an arrest. If the police\u00a0detain\u00a0you, they may gather enough evidence during the detention to arrest you.<\/p>\n<h3>What Is the Difference Between Detention and Arrest?<\/h3>\n<p>In general, police detention refers to police stopping a person and informing them that they cannot leave. A stop is not necessarily an arrest, but can lead to one.<\/p>\n<p>The main difference between detention and arrest is based on the amount of evidence and the level of certainty <span data-term-id=\"56179472\">law enforcement<\/span> has that you\u2019ve committed a violation or broken a law:<\/p>\n<ul>\n<li>Detention is a temporary stop based on <span data-term-id=\"56179483\">reasonable suspicion<\/span>, such as being pulled over for speeding<\/li>\n<li>An arrest means someone is taken into custody based on <span data-term-id=\"56179471\">probable cause<\/span>, such as spotting illegal drugs in plain view during a traffic stop<\/li>\n<\/ul>\n<p>Different constitutional protections apply at each stage.<\/p>\n<h3>When Can Police Stop or Detain You?<\/h3>\n<p>The police may detain a person in a public or private area if they have\u00a0<span data-term-id=\"56179483\">reasonable suspicion<\/span>\u00a0that the person has been involved in a crime. At that point, <span data-term-id=\"56179472\">law enforcement<\/span> has not arrested them. Nothing prevents a <span data-term-id=\"56179469\">police officer<\/span> from speaking to a person under ordinary circumstances. The law allows police to ask questions.<\/p>\n<p>In general, you are not required to answer questions from the police. You can decline to answer questions and ask, \u201cAm I free to leave?\u201d If they say you can\u2019t go, you\u2019re being detained<\/p>\n<p>Detention only requires <span data-term-id=\"56179483\">reasonable suspicion<\/span>, a lower standard than <span data-term-id=\"56179471\">probable cause<\/span>. In many cases, police question someone and release them without making an arrest.<\/p>\n<h3>How Detention Can Lead To Arrest<\/h3>\n<p>During the detention, the police may look for\u00a0evidence\u00a0that would give them\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\"><span data-term-id=\"56179471\">probable cause<\/span><\/a>\u00a0to make an arrest. For example, if during questioning the officer observes evidence of a crime or receives information that elevates <span data-term-id=\"56179483\">reasonable suspicion<\/span> to <span data-term-id=\"56179471\">probable cause<\/span>, the encounter can escalate from detention to arrest.<\/p>\n<p>If police decide to arrest you, they must inform you of the charges. If they continue to question you while under arrest without reading your <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-rights-and-the-fifth-amendment.html\"><em>Miranda<\/em> rights<\/a>, any statements you make may be excluded from trial.<\/p>\n<h2>Your <span data-term-id=\"56179481\">Constitutional Rights<\/span> During an Arrest<\/h2>\n<p>When you have been detained or arrested by the police, the <a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">U.S. Constitution<\/a> grants you certain fundamental rights. Commonly known as \u201c<em>Miranda<\/em> rights,\u201d these rights apply whenever you are being questioned by <span data-term-id=\"56179472\">law enforcement<\/span>. When <span data-term-id=\"56179497\">police arrest<\/span> someone, they may read a formal <em>Miranda<\/em> warning to the suspect. This is a legal notification to the police and the suspect that their rights are in effect.<\/p>\n<p>Several of the Constitution\u2019s Amendments offer you protections. Knowing which ones they are and what they entail can make sure you\u2019re aware of your rights.<\/p>\n<h3><span data-term-id=\"56179492\">Fourth Amendment<\/span><\/h3>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment4.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56179492\">Fourth Amendment<\/span><\/a> requires a warrant whenever <span data-term-id=\"56179497\">police arrest<\/span> individuals or search their property. Case law provides exceptions, which evidence must fall under to be admissible in court. For instance, a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-warrant-requirement.html\">search incident to arrest<\/a> (an inventory search) may yield admissible evidence.<\/p>\n<h3>Fifth Amendment<\/h3>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment<\/a> guarantees your right against self-incrimination. In other words, you are not required to provide evidence against yourself. You can refuse to answer any questions beyond your name and basic identification.<\/p>\n<p>The Supreme Court has ruled that <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/08-1470.html\" target=\"_blank\" rel=\"noopener\">subjects must state this right<\/a> before it applies. You cannot simply refuse to talk.<\/p>\n<h3>Sixth Amendment<\/h3>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment6.html\" target=\"_blank\" rel=\"noopener\">Sixth Amendment<\/a> grants suspects the right to counsel. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/372\/335.html\" target=\"_blank\" rel=\"noopener\"><em>Gideon v. Wainwright<\/em><\/a> (1963), the Supreme Court ruled that indigent suspects could be appointed an attorney at no cost. All suspects have the right to retain an attorney and to have them present at critical stages of the court process. This includes the arraignment and bond hearing,\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/judicial-proceedings-and-custodial-interrogation.html\">custodial interrogation<\/a>, and all pretrial hearings.<\/p>\n<h3><em>Miranda<\/em> Rights<\/h3>\n<p>Police do not have to read suspects their <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-warnings-and-police-questioning.html\"><em>Miranda<\/em> warning<\/a> when they are arrested. Despite what TV and movies lead us to believe, it isn\u2019t a \u201cget out of jail free\u201d card if police fail to read you your rights when you\u2019re arrested. Although your <span data-term-id=\"56179481\">Constitutional rights<\/span> attach whenever you are in police custody, police only have to let you know about them when they are interrogating you about the crime itself.<\/p>\n<p>Anything you say to the police at any time can be used against you. This includes statements you make during detention prior to arrest. For instance, if a suspect runs out of a building shouting, \u201cI killed my wife!\u201d but later denies it, both statements are admissible. Keep it simple by clearly stating that you choose to say nothing in the absence of your attorney.<\/p>\n<h2>Common Reasons Arrests Are Found Unlawful<\/h2>\n<p>Although people often use \u201c<span data-term-id=\"56179474\">false arrest<\/span>\u201d and \u201c<span data-term-id=\"56179473\">wrongful arrest<\/span>\u201d interchangeably, they can have different legal meanings. <span data-term-id=\"56179474\">False arrest<\/span>, also referred to as <span data-term-id=\"56179475\">false imprisonment<\/span>, is a civil tort claim that can be brought against anyone who unlawfully detains or restrains you without legal authority. This includes private citizens, <span data-term-id=\"56179494\">security guards<\/span>, or <span data-term-id=\"56179472\">law enforcement<\/span>.<\/p>\n<p>A <span data-term-id=\"56179473\">wrongful arrest<\/span> typically refers to an <span data-term-id=\"56179470\">unlawful arrest<\/span> by <span data-term-id=\"56179472\">law enforcement<\/span> that may involve constitutional violations or <span data-term-id=\"56179480\">police misconduct<\/span>. Some common reasons an arrest may be unlawful include:<\/p>\n<ul>\n<li><strong>Lack of <span data-term-id=\"56179471\">probable cause<\/span><\/strong>: <span data-term-id=\"56179471\">Probable cause<\/span> is a <span data-term-id=\"56179484\">reasonable belief<\/span> supported by articulable facts that an individual may commit or has committed a crime. <span data-term-id=\"56179482\">Law enforcement<\/span><span data-term-id=\"56179482\"> officers<\/span> cannot make arrests based on hunches or bias.<\/li>\n<li><strong>Abuse of authority<\/strong>: Arrests based on racial profiling, social bias, or other improper reasons may lead to <span data-term-id=\"56179470\">unlawful arrests<\/span>. This increases the likelihood that the charges will be dismissed.<\/li>\n<li><strong><span data-term-id=\"56179478\">Civil rights<\/span> violations<\/strong>: These are often coupled with allegations of <span data-term-id=\"56179495\">police brutality<\/span> or other violations. Police may use unlawful methods to effect an arrest if the suspect resists or attempts to flee.<\/li>\n<li><strong>Lack of a <span data-term-id=\"56179501\">valid arrest warrant<\/span><\/strong>: If the warrant itself is facially invalid, the arrest is also invalid. A \u201cgood faith\u201d exception may apply if the officer could not reasonably have known the warrant was invalid.<\/li>\n<\/ul>\n<p>In some jurisdictions, <span data-term-id=\"56179494\">security guards<\/span> may arrest individuals for <span data-term-id=\"56179502\">misdemeanor<\/span> offenses committed in their presence.
