It prevents the use of gossip to convict someone.<\/p>\n\n        <\/div>\n    <\/div>\n<\/div>\n\r\n<p>This article discusses the definition of hearsay and some of the most common exceptions to the rule.<\/p>\r\n<h2>Hearsay Rule Defined<\/h2>\r\n<p>Hearsay is an out-of-court statement used&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/hearsay.html\" target=\"_blank\" rel=\"noopener\">to prove the truth of what was said.<\/a>&nbsp;For example, a&nbsp;police officer testifies about what an eyewitness said to them at a crime scene. In general, prosecutors&nbsp;can&#8217;t use this testimony to actually prove what happened.<\/p>\r\n<p>These out-of-court statements are not limited to only spoken words. They can also be documents,&nbsp;written statements,&nbsp;or body language. For example, nodding is non-verbal conduct to indicate yes.<\/p>\r\n<h2>Exceptions to the Rule Against Hearsay Evidence<\/h2>\r\n<p>Under the general rule, hearsay is not&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/evidence-the-concept-of-admissibility.html\">admissible in court<\/a>&nbsp;unless a statute or rule provides otherwise. So, even if a statement is hearsay&nbsp;that was&nbsp;made out of court and not under oath, it may still be admissible if an exception applies. The&nbsp;<a href=\"https:\/\/www.rulesofevidence.org\/article-viii\/\" target=\"_blank\" rel=\"noopener\">Federal Rules of Evidence<\/a>&nbsp;(FRE) contain nearly thirty exceptions to the hearsay rule.<\/p>\r\n<p>Generally, state criminal law follows the&nbsp;<a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/evidence-law.html\">rules of evidence<\/a>&nbsp;as provided in the Federal Rules of Evidence, but not in all cases. The states can and do vary as to the exceptions that they recognize.<\/p>\r\n<h2>Most Common Hearsay Exceptions<\/h2>\r\n<p>There are&nbsp;<a href=\"https:\/\/www.rulesofevidence.org\/article-viii\/rule-803\/\" target=\"_blank\" rel=\"noopener\">twenty-three exceptions in the federal rules.<\/a>&nbsp;These allow for the admission of out-of-court statements, even if the person who made them, known as&nbsp;the&nbsp;declarant,&nbsp;is available to appear in court. However, only a handful of these are regularly used. The three most popularly used exceptions are:<\/p>\r\n<ul>\r\n<li><b>Present Sense Impression<\/b>:&nbsp;A statement about what the declarant perceived when it describes or explains an event or condition and was made during the event or immediately after it. For example, when a bystander exclaims, &quot;That car is driving pretty fast,&quot; shortly before a car crash.<\/li>\r\n<li><b>Excited Utterance<\/b>:&nbsp;This exception applies during or shortly after a startling event, and the declarant made the statement while under the excitement or stress of the event. For example, when a victim of a crime makes a statement to a police officer about a purse snatching in the grocery store.<\/li>\r\n<li><b>Then-Existing Mental, Emotional, or Physical Condition<\/b>:&nbsp;A statement that is not offered for its truth but instead to show the state of mind, emotion, or physical condition exhibited. For instance, testimony that there was a heated argument offered to show a person was angry and not for what was said.<\/li>\r\n<\/ul>\r\n<h2>Other Exceptions to Rule Against Hearsay Evidence<\/h2>\r\n<p>There are several other statements not excluded by the rule against hearsay. These apply regardless of whether the declarant is available as a witness and fall into three categories:<\/p>\r\n<ul>\r\n<li><b>Medical<\/b>:&nbsp;Statements made to a medical provider for the purpose of diagnosis or treatment<\/li>\r\n<li><b>Reputation<\/b>: Statements about the reputation of the person, their family, or land boundaries<\/li>\r\n<li><b>Documents<\/b>: These&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/documentary-evidence.html\">documents<\/a>&nbsp;typically include business records and public records but can include learned treatises, family records, and church records<\/li>\r\n<\/ul>\r\n<h2>Hearsay Exceptions if the Declarant Is Unavailable To Testify in Court<\/h2>\r\n<p>There are exceptions to the rule against the admissibility of hearsay evidence that apply only when the&nbsp;<a href=\"https:\/\/www.rulesofevidence.org\/article-viii\/rule-804\/\" target=\"_blank\" rel=\"noopener\">declarant is unavailable<\/a>. The court will consider a declarant unavailable when the declarant:<\/p>\r\n<ul>\r\n<li>Is not required to testify by law, e.g.,&nbsp;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-the-spousal-or-marital-privilege\/\">spousal privilege<\/a><\/li>\r\n<li>Refuses to testify<\/li>\r\n<li>Does not remember what happened<\/li>\r\n<li>Is either dead or has a physical or mental illness that prevents testimony<\/li>\r\n<li>Is absent from the trial and cannot be located<\/li>\r\n<\/ul>\r\n<p>If the declarant is unavailable, then the following&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/rules\/fre\/rule_804\" target=\"_blank\" rel=\"noopener\">types of evidence<\/a>&nbsp;are admissible in court. This includes:<\/p>\r\n<ul>\r\n<li><b>Former testimony<\/b>:&nbsp;Admissible because of the prior opportunity for cross-examination<\/li>\r\n<li><b>Dying declarations<\/b>:&nbsp;Statements made&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/rules\/fre\/rule_804#:~:text=Exception%20(2).%20The%20exception%20is%20the%20familiar%20dying%20declaration%20of%20the%20common%20law%2C%20expanded%20somewhat%20beyond%20its%20traditionally%20narrow%20limits.\" target=\"_blank\" rel=\"noopener\">under the belief of imminent death<\/a><\/li>\r\n<li><b>Statements against a person&#8217;s own interest<\/b>:&nbsp;The court assumes a reasonable person would not say it unless true<\/li>\r\n<li><b>Statements of personal or family history<\/b>: Familiarity can make these admissible<\/li>\r\n<\/ul>\r\n<h2>Catchall Exception to the Rule Against Hearsay<\/h2>\r\n<p>The last exception is the so-called&nbsp;<a href=\"https:\/\/www.rulesofevidence.org\/article-viii\/rule-807\/\" target=\"_blank\" rel=\"noopener\">&quot;catchall&quot; rule<\/a>. It provides that evidence of a hearsay statement not included in one of the other exceptions may nevertheless be admissible if it meets the following conditions:<\/p>\r\n<ul>\r\n<li>It has sound guarantees of trustworthiness<\/li>\r\n<li>It helps prove a material fact<\/li>\r\n<li>It is more probative than other equivalent and reasonably obtainable evidence<\/li>\r\n<li>Its admission would forward the cause of justice<\/li>\r\n<\/ul>\r\n<p>The other parties must receive reasonable notice about the intent to offer this kind of evidence.<\/p>\r\n<h2>Defenses Against Hearsay Evidence<\/h2>\r\n<p>If the court admits hearsay evidence under an exception,&nbsp;the other party can attack the&nbsp;<a href=\"https:\/\/www.rulesofevidence.org\/article-viii\/rule-806\/\" target=\"_blank\" rel=\"noopener\">credibility of the person<\/a>&nbsp;offering the statement. The process of discrediting a witness&#8217; testimony is&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/impeachment-evidence.html\" target=\"_blank\" rel=\"noopener\">impeachment<\/a>. You can undermine the opposing party by introducing prior inconsistent statements, bias, or&nbsp;some other evidence that would show that the declarant has a reason to lie or not to remember accurately.<\/p>\r\n<h2>Is It Just Hearsay or Actual Evidence? Get Help From a Defense Attorney<\/h2>\r\n<p>If you&#8217;re facing a criminal trial or other criminal proceeding, the government may rely on several pieces of evidence to prosecute your case. However, that doesn&#8217;t mean that the evidence is admissible in court.
