But they&#8217;re claiming they shouldn&#8217;t be held responsible because of a severe mental health condition. The insanity defense is unrelated to a defendant&#8217;s current mental health. Rather, it applies to their mental state at the time of the crime.<\/p>\n\n    <\/div>\n\n<p>The <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-insanity-defense-history-and-background.html\" target=\"_self\">insanity defense<\/a> is an <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-is-an-affirmative-defense\/\" target=\"_self\">affirmative defense<\/a> against criminal charges. You may have heard of someone being found not guilty by reason of insanity.<\/p>\r\n<p>This defense is often confused with <a href=\"https:\/\/dictionary.findlaw.com\/definition\/diminished-capacity.html\" target=\"_self\" rel=\"noopener\">diminished capacity<\/a>. However, diminished capacity is not an affirmative defense that allows someone to plead not guilty in a criminal trial. Instead, the defendant may plead to a lesser crime based on their mental capacity because they were not capable of having the intent to commit the original crime with which they were charged.<\/p>\r\n<p>The insanity defense is also different from <a href=\"https:\/\/dictionary.findlaw.com\/definition\/competency.html\" target=\"_self\" rel=\"noopener\">competency<\/a> to stand trial. If someone cannot understand the charges being brought against them, they cannot be tried at all.<\/p>\r\n<p>Wondering how courts test for insanity? Read on for basic information and legal issues related to the insanity defense and criminal responsibility.<\/p>\r\n<h2>Background<\/h2>\r\n<p>An English legal treatise from 1581 first records insanity as a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/defending-yourself-against-a-criminal-charge.html\" target=\"_self\">defense to criminal charges<\/a>. The treatise stated that &quot;a madman or a natural fool, or a lunatic in the time of his lunacy&quot; could not be culpable for killing someone.<\/p>\r\n<p>Two centuries later, British courts came up with the <a href=\"https:\/\/www.pbs.org\/wgbh\/pages\/frontline\/shows\/crime\/trial\/history.html\" target=\"_blank\" rel=\"noopener\">&quot;wild beast&quot; test<\/a>. A defendant who could not understand their actions any more than an &quot;infant, brute, or wild beast&quot; would not be culpable for their crimes. In other words, the defendant would be found not guilty by reason of insanity.<\/p>\r\n<p>While the terms &quot;lunatic&quot; or &quot;wild beast&quot; have fallen from use,<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/current-application-of-the-insanity-defense.html\" target=\"_self\"> current laws that allow the insanity defense<\/a> follow a similar logic. As a result, the legal basis for insanity was codified into British law in the mid-19th century.<\/p>\r\n<p>The M&#8217;Naghten Rule (sometimes spelled as M&#8217;Naughten) was also codified. This rule was created based on the case of Daniel M&#8217;Naghten. The Scottish woodcutter killed the secretary of the British prime minister under the belief that he was conspiring against M&#8217;Naghten.<\/p>\r\n    <section class=\"simple-video\">\n        <div class=\"cmp-embed\">\n            <iframe loading=\"lazy\" title=\"John Hinckley Jr.  and the Insanity Defense\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/5SVQBiSYX8k?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n        <\/div>\n    <\/section>\n\n\r\n<h2>How Courts Test for Legal Insanity<\/h2>\r\n<p>Depending on the jurisdiction, courts use one or more of the following tests to establish legal insanity:<\/p>\r\n<ul>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-m-naghten-rule.html\" target=\"_self\">The &quot;M&#8217;Naghten Rule&quot;<\/a>: Here, a defendant either did not understand what they did or failed to distinguish right from wrong because of a &quot;disease of the mind.&quot; Most jurisdictions that switched to this rule <a href=\"https:\/\/open.lib.umn.edu\/criminallaw\/chapter\/6-1-the-insanity-defense\/\" target=\"_blank\" rel=\"noopener\">switched the burden of proving insanity<\/a> from the prosecutor to the defense.<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/crimes\/more-criminal-topics\/insanity-defense\/irresistible-impulse-test.html\" target=\"_self\">The &quot;Irresistible Impulse Test&quot;<\/a>: As a result of mental disease, a defendant was unable to control their impulses at the time of the offense, which led to a criminal act\/criminal conduct.<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-durham-rule.html\" target=\"_self\">The &quot;Durham Rule&quot;<\/a>: Regardless of clinical diagnosis, a defendant&#8217;s &quot;mental defect&quot; resulted in a criminal act. Most state courts and federal courts abandoned this rule in 1972. As of 2023, New Hampshire courts place a strict <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/who-has-the-burden-of-proof-3-things-you-should-know\/\" target=\"_self\">burden of proof<\/a> on the defendant when using the insanity plea. Additionally, the federal appellate judge in the Durham case decided to <a href=\"https:\/\/www.law.cornell.edu\/wex\/insanity_defense\" target=\"_blank\" rel=\"noopener\">use the case <\/a>to reform the M&#8217;Naghten rule.<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-model-penal-code-test-for-legal-insanity.html\" target=\"_self\">The &quot;Model Penal Code&quot; test for legal insanity<\/a>: Because of a diagnosed mental illness, a defendant either failed to understand the criminality of their acts or was unable to act within the confines of the law. There is <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/mens-rea-a-defendant-s-mental-state.html\" target=\"_self\">a lack of mens rea<\/a> or lack of a \u201cguilty mind.&quot; A rule found in <a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-636-insanity-prior-law\" target=\"_blank\" rel=\"noopener\">Section 4.01<\/a> of the Modal Penal Code says that a defendant lacks culpability if they did not possess a &quot;substantial capacity either to appreciate the criminality of (their) conduct or to conform (their) conduct to the requirements of the law.&quot;<\/li>\r\n<\/ul>\r\n<p>The applicable test determining criminal liability will vary from state to state depending on the state&#8217;s criminal laws and individual criminal justice system.<\/p>\r\n<p>In states such as New Jersey, the defendant may have to prove their insanity to a <a href=\"https:\/\/dictionary.findlaw.com\/definition\/preponderance-of-the-evidence.html\" target=\"_self\" rel=\"noopener\">preponderance of the evidence<\/a>. In other states and the federal court, the requirements of the law call for <a href=\"https:\/\/dictionary.findlaw.com\/definition\/clear-and-convincing-evidence.html\" target=\"_self\" rel=\"noopener\">clear and convincing evidence<\/a>. Clear and convincing evidence is a higher standard than a preponderance of evidence and, thus, harder to prove.<\/p>\r\n<p>A minority of states place the burden of proof on the prosecution. In these states, it is up to the prosecutor to prove sanity <a href=\"https:\/\/dictionary.findlaw.com\/definition\/beyond-a-reasonable-doubt.html\" target=\"_self\" rel=\"noopener\">beyond a reasonable doubt<\/a>, the highest standard when it comes to burdens of proof.<\/p>\r\n<h2>State Law Discrepancies<\/h2>\r\n<p>A few states <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-insanity-defense-among-the-states.html\" target=\"_self\">don&#8217;t allow the insanity defense<\/a> against criminal charges: Idaho, Kansas, Montana, and Utah. All of those states, with the exception of Kansas, allow &quot;guilty but insane&quot; verdicts instead of the defense of insanity. This means a defendant with a mental disorder is sent to a mental institution instead of prison.<\/p>\r\n<p>Most states that recognize legal insanity for criminal cases use either <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-m-naghten-rule.html\" target=\"_self\">the M&#8217;Naghten Test<\/a> (sometimes in combination with the Irresistible Impulse Test) or the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-model-penal-code-test-for-legal-insanity.html\" target=\"_self\">Model Penal Code<\/a>. Only New Hampshire uses <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-durham-rule.html\" target=\"_self\">the Durham Rule.<\/a><\/p>\r\n<p>A key fact to note is that the insane cannot be executed. This is a common law rule that the U.S. Supreme Court upheld in 1986 in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/477\/399.html\" target=\"_self\" rel=\"noopener\"><i>Ford v. Wainwright<\/i><\/a><i>.<\/i><\/p>\r\n<h2>Cases Involving the Insanity Defense<\/h2>\r\n<p>One famous case involving the insanity defense ended in the acquittal of John Hinckley. He was on trial for attempting to assassinate then-President Ronald Reagan. Hinckley&#8217;s acquittal in 1982 was received with mixed reactions, and as a result, some states <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/current-application-of-the-insanity-defense.html\" target=\"_self\">toughened their standards<\/a> to make it more difficult for an acquittal to occur.<\/p>\r\n<p>Then, in 1994, came the Lorena Bobbitt case. Faced with charges of mutilating her husband, Bobbitt had to stand trial. She was found not guilty by reason of insanity.
