It should come as no surprise, then, that <span data-term-id=\"57832556\">capital defendants<\/span> who receive the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty.html\">death penalty<\/a> have a right to appeal the jury or <span data-term-id=\"57832527\">trial court<\/span>\u2019s decision.<\/p>\n<p>The <span data-term-id=\"57832558\">death penalty <\/span><span data-term-id=\"57832528\">appeals<\/span><span data-term-id=\"57832558\"> process<\/span> is different from traditional <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/criminal-appeals-overview.html\"><span data-term-id=\"57832544\">criminal appeals<\/span><\/a>. A <span data-term-id=\"57832539\">death row<\/span> inmate can file an appeal at different stages of their case. However, since the start of the 20th century, the <span data-term-id=\"57832535\">United States <\/span><span data-term-id=\"57832517\">Supreme Court<\/span> has <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/history-of-death-penalty-laws.html\">restricted the use of the death penalty<\/a>. Likewise, a majority of state governments have either abolished it, declared moratoriums on executions, or simply abandoned the practice altogether.<\/p>\n<p>Advocates claim that <span data-term-id=\"57832553\">capital punishment<\/span> deters <a href=\"https:\/\/archive.findlaw.com\/blog\/types-of-violent-crime\/\" target=\"_blank\" rel=\"noopener\">violent crime<\/a>. The\u00a0research data, however, is mixed. Opponents argue that execution is immoral and argue for <span data-term-id=\"57832550\">life imprisonment<\/span> instead.<\/p>\n<p>Despite its decline in usage, some states still sentence people to death and execute them. Even in states that have <span data-term-id=\"57832553\">capital punishment<\/span>, very few people are put to death. The path from a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/what-is-capital-murder.html\"><span data-term-id=\"57832546\">capital murder<\/span><\/a> conviction to execution is long and rife with many opportunities for the prisoner to appeal their <span data-term-id=\"57832519\">death sentence<\/span>.<\/p>\n<h2>Types of Appeals in a <span data-term-id=\"57832523\">Death Penalty Case<\/span><\/h2>\n<p>There are different types of appeals a person can file if they\u2019ve received a sentence of death. The type of appeal filed depends on several factors, such as the basis for the appeal and the stage of the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appeals-appellate-courts-and-costs.html\"><span data-term-id=\"57832528\">appeals process<\/span><\/a>.<\/p>\n<p>The main types of appeals in <a href=\"https:\/\/deathpenaltyinfo.org\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832523\">death penalty cases<\/span><\/a> include <span data-term-id=\"57832520\">direct appeals<\/span>, state <span data-term-id=\"57832568\">habeas corpus proceedings<\/span>, and <span data-term-id=\"57832525\">federal <\/span><span data-term-id=\"57832568\">habeas corpus<\/span><span data-term-id=\"57832568\"> proceedings<\/span>. Let\u2019s examine each one.<\/p>\n<h3><span data-term-id=\"57832520\">Direct Appeal<\/span><\/h3>\n<p>All defendants sentenced to death are entitled to an automatic review of their case. This is referred to as a \u201c<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/the-number-of-criminal-appeals.html\"><span data-term-id=\"57832520\">direct appeal<\/span><\/a>\u201d because the review almost always goes to the <span data-term-id=\"57832557\">state&#8217;s highest court<\/span>, bypassing the other courts.<\/p>\n<p>At the <span data-term-id=\"57832520\">direct appeal<\/span>, you can only raise issues about things that occurred during the trial. For example, if you believe the judge <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/evidence-the-concept-of-admissibility.html\">admitted evidence<\/a> that they should have excluded, the time to raise this issue is on <span data-term-id=\"57832520\">direct appeal<\/span>. At this level, your attorney can ask the court to overturn your conviction, grant a <span data-term-id=\"57832565\">retrial<\/span>, or offer a <span data-term-id=\"57832562\">resentencing<\/span> hearing.<\/p>\n<h3><span data-term-id=\"57832555\">Post-Conviction Review<\/span><\/h3>\n<p>If a <span data-term-id=\"57832520\">direct appeal<\/span> doesn\u2019t work, the next step is filing a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/writ-of-habeas-corpus.html\"><span data-term-id=\"57832551\">habeas corpus petition<\/span><\/a> with your <span data-term-id=\"57832522\">state court<\/span>, the highest <span data-term-id=\"57832524\">court of appeal<\/span> in your jurisdiction. This type of <span data-term-id=\"57832555\">post-conviction review<\/span> allows you to raise issues other than what happened at trial.<\/p>\n<p>Some of the most common issues raised at this level include:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/5-signs-you-may-have-ineffective-counsel\/\"><span data-term-id=\"57832547\">Ineffective assistance of counsel<\/span><\/a><\/li>\n<li>Juror misconduct<\/li>\n<li><span data-term-id=\"57832545\">New evidence<\/span> that came to light after your trial was over<\/li>\n<li>The prosecution failed to share exculpatory evidence with your defense team<\/li>\n<\/ul>\n<p>Other issues may apply.<\/p>\n<h3><span data-term-id=\"57832525\">Federal <\/span><span data-term-id=\"57832568\">Habeas Corpus<\/span><span data-term-id=\"57832568\"> Proceedings<\/span><\/h3>\n<p><span data-term-id=\"57832559\">Federal law<\/span> requires that you exhaust all options at the state level before you pursue a <a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/federal-criminal-appeals-10-things-you-should-know.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832560\">federal appeal<\/span><\/a>. You would first file a <span data-term-id=\"57832551\">habeas corpus petition<\/span> with the <span data-term-id=\"57832572\">United States <\/span><span data-term-id=\"57832526\">District Court<\/span>. If your appeal is not successful, you can pursue a review with the <span data-term-id=\"57832573\">United States <\/span><span data-term-id=\"57832524\">Court of Appeals<\/span>.<\/p>\n<p>This is the last level of review before the <span data-term-id=\"57832534\">U.S. <\/span><span data-term-id=\"57832517\">Supreme Court<\/span>. Since the <span data-term-id=\"57832517\">Supreme Court<\/span> doesn\u2019t agree to review many <span data-term-id=\"57832523\">death penalty cases<\/span>, your best chance of winning an appeal is at the <span data-term-id=\"57832518\">federal court<\/span> level.<\/p>\n<p>Just as with a state habeas proceeding, a <a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/federal-habeas-corpus-review.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832525\">federal habeas corpus<\/span> hearing<\/a> allows you to raise issues beyond what occurred at the trial level. When you file your case with the <span data-term-id=\"57832542\">Circuit <\/span><span data-term-id=\"57832524\">Court of Appeals<\/span>, you can only argue that the <span data-term-id=\"57832569\">district court<\/span><span data-term-id=\"57832569\">\u2019s decision<\/span> was wrong or unfair. The federal <span data-term-id=\"57832521\">appellate<\/span> judge will not entertain issues you didn\u2019t raise with the <span data-term-id=\"57832563\">lower courts<\/span>.<\/p>\n<h2>Appealing a Death Penalty Sentence in <span data-term-id=\"57832522\">State Court<\/span><\/h2>\n<p>Where you file your appeal depends on whether you were sentenced by a <span data-term-id=\"57832522\">state court<\/span> or a <span data-term-id=\"57832518\">federal court<\/span>. If you wish to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appealing-a-conviction-after-pleading-guilty.html\">appeal your conviction<\/a> or sentence in <span data-term-id=\"57832522\">state court<\/span>, your defense team has several options. These include:<\/p>\n<ul>\n<li>Post-trial motions for acquittal<\/li>\n<li>Requesting a reduced sentence<\/li>\n<li>Filing a motion for a <a href=\"https:\/\/archive.findlaw.com\/blog\/legalese-101-what-is-a-mistrial\/\" target=\"_blank\" rel=\"noopener\">mistrial<\/a><\/li>\n<li>Requesting a <span data-term-id=\"57832537\">new trial<\/span><\/li>\n<\/ul>\n<p>If none of these actions are successful, your next option is to file a <span data-term-id=\"57832520\">direct appeal<\/span>. A <span data-term-id=\"57832520\">direct appeal<\/span> is not a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-right-to-a-jury-trial.html\"><span data-term-id=\"57832537\">new trial<\/span><\/a>. Your criminal defense attorney cannot submit any <span data-term-id=\"57832545\">new evidence<\/span>. The only issue the <span data-term-id=\"57832521\">appellate<\/span> judge considers is whether the <span data-term-id=\"57832563\">lower court<\/span> made the right decision in your <span data-term-id=\"57832561\">criminal case<\/span>.<\/p>\n<p>Depending on where you live, you will file your first appeal in your state\u2019s <span data-term-id=\"57832533\">appellate<\/span><span data-term-id=\"57832533\"> court<\/span>. If the <span data-term-id=\"57832521\">appellate<\/span> judge doesn\u2019t rule in your favor, your attorney can appeal to the <span data-term-id=\"57832557\">state\u2019s highest court<\/span> to hear the case. In some states, the highest court has no choice but to review\u00a0every\u00a0case involving a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty-laws-by-state.html\"><span data-term-id=\"57832519\">death sentence<\/span><\/a>. In other states, the court has discretion as to whether it wants to hear your case.<\/p>\n<h2>Appealing a Death Penalty Sentence in <span data-term-id=\"57832518\">Federal Court<\/span><\/h2>\n<p>Once all avenues at the state level have been exhausted, an <span data-term-id=\"57832521\">appellant<\/span> can\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appeals-appellate-courts-and-costs.html\">appeal their case at the federal level<\/a>. They do this by filing a <span data-term-id=\"57832530\">writ of habeas corpus<\/span> in a <span data-term-id=\"57832540\">federal <\/span><span data-term-id=\"57832526\">district court<\/span>.<\/p>\n<p>The reason <span data-term-id=\"57832521\">appellants<\/span> cannot take their cases directly to\u00a0<span data-term-id=\"57832518\">federal court<\/span>\u00a0is that the judicial system gives\u00a0<span data-term-id=\"57832522\">state courts<\/span>\u00a0an opportunity to correct any mistakes they may have made. Your <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">defense team<\/a> must raise all issues of defective processes or rights violations in <span data-term-id=\"57832522\">state court<\/span>. If they fail to do so, they will be barred from pursuing <span data-term-id=\"57832518\">federal <\/span><span data-term-id=\"57832552\">court<\/span><span data-term-id=\"57832552\"> proceedings<\/span>. If a defendant loses their appeal in the <span data-term-id=\"57832540\">federal <\/span><span data-term-id=\"57832526\">district court<\/span>, they can file a petition for a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/writs.html\"><span data-term-id=\"57832536\">writ of certiorari<\/span><\/a>\u00a0with the federal <span data-term-id=\"57832533\">appellate<\/span><span data-term-id=\"57832533\"> court<\/span>.<\/p>\n<h2>Can You File an Appeal With the <span data-term-id=\"57832535\">United States <\/span><span data-term-id=\"57832517\">Supreme Court<\/span>?<\/h2>\n<p>In the movies, it\u2019s common to see a <a href=\"https:\/\/bjs.ojp.gov\/taxonomy\/term\/death-row\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832539\">death row<\/span> inmate<\/a> appealing their conviction or sentence to the <span data-term-id=\"57832534\">U.S. <\/span><span data-term-id=\"57832517\">Supreme Court<\/span>. In the real world, the <span data-term-id=\"57832517\">Supreme Court<\/span> rarely agrees to review a case, even one involving a <span data-term-id=\"57832519\">death sentence<\/span>.<\/p>\n<p>There are situations in which your defense attorney can ask the <span data-term-id=\"57832517\">Supreme Court<\/span> to review their client\u2019s case for alleged violations of their <a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832549\">constitutional rights<\/span><\/a>. Your defense team can also bring up issues outside the <span data-term-id=\"57832566\">trial record<\/span>, such as:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-right-to-adequate-representation.html\"><span data-term-id=\"57832547\">Ineffective assistance of counsel<\/span><\/a><\/li>\n<li>Juror misconduct<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/law-of-criminal-evidence-background.html\">Newly discovered evidence<\/a><\/li>\n<li><a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/373\/83.html\" target=\"_blank\" rel=\"noopener\">Brady violations<\/a> (claims that the prosecution failed to disclose exculpatory evidence that would have been favorable to the defense)<\/li>\n<\/ul>\n<p>Due to the different types of appeals and the exhaustion of all options at both the state and federal levels, <a href=\"https:\/\/deathpenaltyinfo.org\/state-and-federal-info\/federal-death-penalty\/case-summaries-for-modern-federal-death-sentences\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832553\">capital punishment<\/span> cases<\/a> can take decades to work their way through the <span data-term-id=\"57832548\">criminal justice<\/span> system.<\/p>\n<h2>Can You Apply for Relief Outside of the <span data-term-id=\"57832548\">Criminal Justice<\/span> System?<\/h2>\n<p>In certain situations, a <span data-term-id=\"57832539\">death row<\/span> inmate can find relief outside of the <span data-term-id=\"57832541\">appellate<\/span><span data-term-id=\"57832541\"> process<\/span>, such as filing a petition for <a href=\"https:\/\/codes.findlaw.com\/cfr\/title-28-judicial-administration\/cfr-sect-28-1-1.html\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57832543\">executive clemency<\/span><\/a>. In these cases, <span data-term-id=\"57832539\">death row<\/span> prisoners appeal to their state\u2019s Governor or to the president to commute their sentence due to an unfair sentence, severe injustices, or other grounds for a pardon or clemency.<\/p>\n<p>In some <span data-term-id=\"57832523\">death penalty cases<\/span>, an individual may ask a governor or the president to show mercy on them for rehabilitating themselves. Whether the person receives <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/presidential-pardon-power-and-its-limits.html\">clemency<\/a> depends on several factors, which include:<\/p>\n<ul>\n<li>The facts of their case<\/li>\n<li>Whether the laws have changed since their conviction<\/li>\n<li>Remorse and rehabilitation on the part of the <span data-term-id=\"57832539\">death row<\/span> inmate<\/li>\n<li>Whether the Governor is trying to gain favor for political reasons<\/li>\n<\/ul>\n<p>Requesting clemency is not easy.
