This is why so many states have similar <span data-term-id=\"55730079\">prison sentences<\/span> for <span data-term-id=\"55730089\">serious crimes<\/span>. For example, the penalty for first-degree murder in many states is life imprisonment (or death in those states that still have the <span data-term-id=\"55730087\">death penalty<\/span>).<\/p>\n<p>The <a href=\"https:\/\/www.ussc.gov\/guidelines\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55730122\">United States Sentencing Commission<\/span><\/a> enacted <span data-term-id=\"55730110\">federal <\/span><span data-term-id=\"55730080\">sentencing guidelines<\/span>, which became effective in 1997. Until 2005, federal judges had no choice but to follow them. They also carry lighter sentences, such as <span data-term-id=\"55730084\">community service<\/span> and house arrest.<\/p>\n<p><span data-term-id=\"55730081\">Types of sentences<\/span> courts apply in our <span data-term-id=\"55730094\">criminal justice<\/span> system include:<\/p>\n<ul>\n<li>A <strong><span data-term-id=\"55730113\">concurrent sentence<\/span><\/strong> is one that a defendant serves simultaneously with another <span data-term-id=\"55730079\">prison sentence<\/span> the judge imposes earlier or at the same <span data-term-id=\"55730096\">sentencing hearing<\/span><\/li>\n<li>A <strong><span data-term-id=\"55730112\">consecutive sentence<\/span><\/strong> occurs when the sentences for multiple crimes are added together so that each sentence begins immediately upon the defendant completing the previous one<\/li>\n<li>A <strong>deferred sentence<\/strong> happens when the judge postpones its beginning<\/li>\n<li>A <strong><span data-term-id=\"55730101\">determinate sentence<\/span>\/<\/strong><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/suspended-sentences.html\"><strong><span data-term-id=\"55730086\">suspended sentence<\/span><\/strong><\/a> is for a fixed period, and stays in effect as long as the offender completes all the alternative sentencing requirements imposed by the judge, they will not have to serve time in jail or prison<\/li>\n<li>A <strong>final sentence<\/strong> puts an end to a <span data-term-id=\"55730097\">criminal case<\/span><\/li>\n<li>An <strong><span data-term-id=\"55730091\">indeterminate sentence<\/span><\/strong> occurs when the judge imposes a sentence range (such as three to five years), and the defendant&#8217;s total prison time depends on other factors, such as good behavior<\/li>\n<li>A <strong><span data-term-id=\"55730090\">life sentence<\/span><\/strong> requires the convict to spend the rest of their <span data-term-id=\"55730098\">life in prison<\/span>, although some defendants can earn an early release through probation, parole, or other means<\/li>\n<li>A <strong>mandatory sentence<\/strong> means the judge must impose the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/mandatory-sentences-uniformity-and-consistency.html\">&#8220;mandated&#8221; sentence<\/a> and cannot suspend the sentence <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/probation-faq.html\">or offer probation<\/a><\/li>\n<li>A mandatory <strong><span data-term-id=\"55730095\">maximum sentence<\/span><\/strong> represents the outer limit of punishment, beyond which a convicted person may not remain in custody<\/li>\n<li>A <span data-term-id=\"55730083\">mandatory <\/span><strong><span data-term-id=\"55730099\">minimum<\/span><span data-term-id=\"55730099\"> sentence<\/span><\/strong> requires the offender to serve a minimum <span data-term-id=\"55730116\">amount of time<\/span> in prison before becoming eligible for parole or probation<\/li>\n<li>A <strong>presumptive sentence<\/strong> specifies an appropriate sentence for each offense as a baseline for the judge during sentencing before <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/factors-considered-in-determining-sentences.html\">other relevant factors<\/a> are considered, including aggravating or mitigating circumstances<\/li>\n<li>A <strong>straight or flat sentence<\/strong> is one that is firm, without a maximum or minimum<\/li>\n<\/ul>\n<p>What type you may face depends on the jurisdiction and the nature of the crime.<\/p>\n<h2>Which States Still Have the <span data-term-id=\"55730087\">Death Penalty<\/span>?<\/h2>\n<p>The most <span data-term-id=\"55730119\">severe sentence<\/span> of all is the <span data-term-id=\"55730087\">death penalty<\/span>. In some of these states, there hasn&#8217;t been an execution in years (or decades).
