The <a href=\"https:\/\/constitution.findlaw.com\/amendment5\/annotation01.html#1\" target=\"_blank\" rel=\"noopener\">Fifth Amendment<\/a> to the U.S. Constitution requires the federal government to seek an indictment or presentment from a grand jury to prosecute someone for a felony case or &quot;otherwise infamous&quot; crime.<\/p>\n<p>A <a href=\"https:\/\/dictionary.findlaw.com\/definition\/presentment.html\" target=\"_blank\" rel=\"noopener\">presentment<\/a> is an accusation of crime initiated by grand jury members on their own without a bill of indictment. Since an indictment comes after grand jury proceedings but typically before an arrest, it may be &quot;sealed&quot; for as long as needed. This prevents the defendant (accused person) or other suspects from fleeing, destroying evidence, or evading the criminal justice system.<\/p>\n<p>A grand jury indictment is the product of sworn witness testimony or physical evidence analyzed by a jury of local citizens. A prosecutor will present evidence, and the grand jury&#8217;s role is to determine whether there is probable cause to file charges.<\/p>\n<p>Generally, this carries much more weight than a simple criminal complaint.&nbsp;A criminal complaint involves testimony by a law enforcement officer or witnesses. Grand juries convene secretly and don&#8217;t involve judges or criminal defense lawyers. If a grand jury does find probable cause, the prosecutor will file criminal charges.<\/p>\n<p>A grand jury indictment doesn&#8217;t mean&nbsp;someone is guilty of a crime. The defendant still has the right to argue their case at trial. In district court, the prosecution must prove their case <a href=\"https:\/\/dictionary.findlaw.com\/definition\/beyond-a-reasonable-doubt.html\" target=\"_blank\" rel=\"noopener\">beyond a reasonable doubt<\/a> \u2014 a much higher standard than probable cause&nbsp;\u2014 for a guilty verdict.<\/p>\n<p>The Fifth Amendment rule does not extend to state criminal charges. A state prosecutor can bring felony charges under state law without getting a grand jury indictment. However, many states follow a similar procedure for prosecuting serious felonies (and even some misdemeanors).<\/p>\n<h2><a id=\"crimes\"><\/a>What Crimes Are Prosecuted by Indictment?<\/h2>\n<p>Prosecution by indictment only applies to felony offenses punishable by death or imprisonment for more than one year.<\/p>\n<p>Per the <a href=\"https:\/\/www.law.cornell.edu\/rules\/frcrmp\/rule_7\" target=\"_blank\" rel=\"noopener\">Federal Rules of Criminal Procedure, Rule 7<\/a>, misdemeanors don&#8217;t need indictment. For suspects charged with lesser crimes (such as <a href=\"https:\/\/dictionary.findlaw.com\/definition\/misdemeanor.html\" target=\"_blank\" rel=\"noopener\">misdemeanor charges<\/a> or lower-level felonies), the process usually&nbsp;begins with the prosecutor filing a <a href=\"https:\/\/www.law.cornell.edu\/rules\/frcrmp\/rule_3\" target=\"_blank\" rel=\"noopener\">criminal complaint<\/a> (a brief written statement of facts about the offense charged). An arrest and arraignment often follow this, but only when there is <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\">probable cause<\/a> for the charges.<\/p>\n<p>Some courts use <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/preliminary-hearing.html\">preliminary hearings<\/a> instead of grand juries to determine probable cause for lower-level felony charges. Here, the prosecutor may call witnesses (e.g., law enforcement) or present evidence, such as a failed field sobriety test after a driving under the influence arrest (DUI). A judge decides whether there is enough evidence for the case to go to trial.<\/p>\n<p>Former New York Appellate Judge Solomon Wachtler famously said that a prosecutor can get a grand jury to &quot;<a href=\"https:\/\/history.nycourts.gov\/biography\/sol-wachtler\/#:~:text=When%20he%20was%20an,of%20The%20Vanities.\" target=\"_blank\" rel=\"noopener\">indict a ham sandwich<\/a>.&quot; This is because prosecutors generally only call for grand juries when they&#8217;re confident in the strength of their cases.<\/p>\n<h2><a id=\"information\"><\/a>What Information Is Included in an Indictment?<\/h2>\n<p>The indictment must contain <a href=\"https:\/\/www.law.cornell.edu\/rules\/frcrmp\/rule_7\" target=\"_blank\" rel=\"noopener\">the following information<\/a>:<\/p>\n<ul>\n<li>A plain, concise, and definite written statement of the essential facts on the charged offense, signed by the prosecuting government attorney<\/li>\n<li>The accused person&#8217;s identity or description<\/li>\n<li>The statute, rule, or regulation violated<\/li>\n<\/ul>\n<h2><a id=\"waive\"><\/a>Can a Defendant Waive Their Right to a Grand Jury?<\/h2>\n<p>Defendants may choose to waive their right to a grand jury. But, doing so amounts to an agreement that the prosecution has enough evidence to take the case to trial.<\/p>\n<p>Some defendants may waive prosecution by indictment if offered an attractive plea bargain. You&nbsp;should not waive your constitutional rights without weighing all options and seeking legal advice from an experienced <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/\" target=\"_blank\" rel=\"noopener\">criminal defense lawyer<\/a>.<\/p>\n<h2><a id=\"decisions\"><\/a>How Do Grand Juries Reach a Decision?<\/h2>\n<p>While in many ways a formality, grand juries give a preview of what to expect at trial. Defense attorneys are not allowed but may wait outside the grand jury room and field witness questions during breaks.<\/p>\n<p>While a&nbsp;<a href=\"https:\/\/www.law.cornell.edu\/rules\/frcrmp\/rule_6\" target=\"_blank\" rel=\"noopener\">grand jury is in session<\/a>, only the following people are present:<\/p>\n<ul>\n<li>Attorneys for the government<\/li>\n<li>The witnesses<\/li>\n<li>Interpreters when needed<\/li>\n<li>A court reporter<\/li>\n<\/ul>\n<p>The 16-23 member grand jury does not have to decide unanimously. At least 16 members must be present, and 12 or more must concur to get a <a href=\"https:\/\/corporate.findlaw.com\/litigation-disputes\/federal-grand-jury-crash-course.html\" target=\"_blank\" rel=\"noopener\">federal indictment<\/a>. So, if a simple majority decides that the case and evidence have merit, it will return a &quot;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/true-bill.html\" target=\"_blank\" rel=\"noopener\">true bill<\/a>&quot; and go to trial. Since the grand jury determines whether there is probable cause and not guilt, the <a href=\"https:\/\/dictionary.findlaw.com\/definition\/standard-of-proof.html\" target=\"_blank\" rel=\"noopener\">standard of proof<\/a> is much lower than for criminal trials.<\/p>\n<p>To determine probable cause, grand jury members must decide through the evidence and facts presented whether &quot;a federal crime has probably been committed by the person accused,&quot; according to the <a href=\"http:\/\/www.ndd.uscourts.gov\/jury\/jury_handbook_grand_jurors.pdf\" target=\"_blank\" rel=\"noopener\">Handbook for Federal Grand Jurors<\/a>.<\/p>\n<h2><a id=\"states\"><\/a>What Is the Difference Between Indictments at the Federal and State Level?<\/h2>\n<p>Since states are not required to use a grand jury to get felony indictments, those who do are free to follow their own rules.
