It urges the court to offer a remedy if the judge agrees with this claim. This writ reflects the national commitment to freedom and justice for all people, including prisoners.<\/p>\n<p>In many countries, authorities may incarcerate someone for months or years without charging them. Those imprisoned have no legal means to protest or challenge the imprisonment. Many prisoners use a writ to challenge the <span data-term-id=\"55385990\">legality<\/span> of their confinement.<\/p>\n<p>The framers of the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">United States Constitution<\/a> wanted to prohibit this kind of abuse of power in the United States. Therefore, they included a\u00a0<a href=\"https:\/\/constitution.findlaw.com\/article1.html\" target=\"_blank\" rel=\"noopener\">specific clause<\/a> in the U.S. Constitution to safeguard the right, known as <a href=\"https:\/\/dictionary.findlaw.com\/definition\/writ-of-habeas-corpus.html\" target=\"_blank\" rel=\"noopener\">habeas corpus<\/a>.<\/p>\n<p>Habeas corpus has roots in <span data-term-id=\"55386026\">English <\/span><span data-term-id=\"55385994\">common law<\/span>, tracing back to 1215. The 39th clause of the <span data-term-id=\"55386016\">Magna Carta<\/span>, signed by King John, provided that &#8220;no man shall be arrested or imprisoned &#8230; except by the lawful judgment of his peers and by the law of the land.\u201d In Latin, it translates to \u201cyou should have the body.\u201d<\/p>\n<h2>Filing a <span data-term-id=\"55385984\">Writ of Habeas Corpus<\/span><\/h2>\n<p>The rules for filing a federal <span data-term-id=\"55385984\">writ of habeas corpus<\/span> are found in the <a href=\"https:\/\/codes.findlaw.com\/us\/title-28-judiciary-and-judicial-procedure\/28-usc-sect-2241\/\" target=\"_blank\" rel=\"noopener\">U.S. Code<\/a>. In general, a person cannot file a <span data-term-id=\"55385984\">writ of habeas corpus<\/span> unless they can demonstrate that the government has detained them. <span data-term-id=\"55385986\">State prisoners<\/span> cannot file a federal writ unless they have already exhausted all available state remedies. A <span data-term-id=\"55385985\">federal court<\/span> will likely dismiss the writ if the <span data-term-id=\"55385991\">petitioner<\/span> has not done so.<\/p>\n<p>Often, the court holds a\u00a0hearing on the matter. The inmate and the government may\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/law-of-criminal-evidence-background.html\">present evidence<\/a> during the hearing questioning whether a <span data-term-id=\"55386004\">legal basis<\/span> exists for jailing the person. The court may also issue and enforce\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-subpoena.html\"><span data-term-id=\"55386031\">subpoenas<\/span><\/a> to obtain additional evidence.<\/p>\n<h2>What Happens if a Court Grants a <span data-term-id=\"55385984\">Writ of Habeas Corpus<\/span>?<\/h2>\n<p>There are several types of <span data-term-id=\"55386028\">habeas relief<\/span> available. Depending on what the evidence reveals, the judge may grant the inmate <span data-term-id=\"55385993\">post-conviction<\/span> relief, such as:<\/p>\n<ul>\n<li>An immediate release from prison<\/li>\n<li>A reduction of their\u00a0sentence<\/li>\n<li>An order halting the illegal conditions of confinement<\/li>\n<li>A declaration of rights<\/li>\n<\/ul>\n<p>The type of <span data-term-id=\"55386028\">habeas relief<\/span> granted depends on the evidence presented during the habeas hearing.<\/p>\n<h2><span data-term-id=\"55385984\">Writs of Habeas Corpus<\/span> vs. Appeals<\/h2>\n<p>Habeas corpus differs from the right of\u00a0<span data-term-id=\"55386013\">direct appeal<\/span>. In a\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/appealing-a-court-decision-or-judgment.html\">criminal appeal<\/a>, defendants may challenge their criminal convictions or sentences. The appellate court reviews the <span data-term-id=\"55385997\">district court<\/span>\u2019s rulings. The defendant may file\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appeals-appellate-courts-and-costs.html\">another appeal<\/a> to a higher court, such as their state\u2019s <span data-term-id=\"55385987\">supreme court<\/span> or the U.S. <span data-term-id=\"55385987\">Supreme Court<\/span>.<\/p>\n<p>A defendant may use the appeals process to challenge their lower court conviction for the following reasons, among others:\u00a0<\/p>\n<ul>\n<li><a href=\"https:\/\/archive.findlaw.com\/blog\/what-is-prosecutorial-misconduct\/\" target=\"_blank\" rel=\"noopener\">Prosecutorial misconduct<\/a> at the\u00a0trial court level<\/li>\n<li>Ineffective assistance of counsel during their trial<\/li>\n<li>An\u00a0error of law by the trial judge, such as misinterpreting a <span data-term-id=\"55386011\">federal law<\/span> or the relevant <span data-term-id=\"55386033\">case law<\/span>, which may entitle them to a\u00a0new trial<\/li>\n<li>The prosecution failed to adhere to the federal or state code of\u00a0<span data-term-id=\"55386019\">criminal procedure<\/span><\/li>\n<\/ul>\n<p>By contrast, habeas corpus provides a separate avenue for challenging imprisonment. It\u2019s often utilized by prisoners after their challenge to the <span data-term-id=\"55386027\">court of appeals<\/span> fails. Habeas corpus often serves as a last resort for inmates who insist that the government has unjustly imprisoned them.<\/p>\n<h2><span data-term-id=\"55385984\">Writs of Habeas Corpus<\/span> in Immigration Cases<\/h2>\n<p><span data-term-id=\"55385992\">Habeas corpus petitions<\/span> can play a crucial role in challenging immigration detention, which is a civil rather than a criminal matter. Individuals <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/overview-of-removal-procedures.html\">facing <span data-term-id=\"55386023\">deportation<\/span><\/a> or being held by Immigration and Customs Enforcement (ICE) may file habeas petitions when detention becomes unreasonably prolonged or when removal is not reasonably foreseeable.<\/p>\n<p>The rules governing your detention depend on the stage of the <span data-term-id=\"55386023\">deportation<\/span> process you are in. If immigration authorities haven&#8217;t yet decided whether to deport you, <span data-term-id=\"55386011\">federal law<\/span> allows you to be held while your case is pending. The law allows the government to release you on a bond of at least $1,500 or conditional parole. However, certain categories of people are subject to mandatory detention without bond.<\/p>\n<p>If authorities have already issued a final order to remove you, the law requires the government to remove you from the United States within 90 days. During the removal period, the attorney general can order your detention.<\/p>\n<p>The U.S. <span data-term-id=\"55385987\">Supreme <\/span><span data-term-id=\"55386014\">Court<\/span><span data-term-id=\"55386014\">\u2019s decision<\/span> in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/533\/678.html\" target=\"_blank\" rel=\"noopener\"><em>Zadvydas v. Davis<\/em><\/a> established critical protections against indefinite detention. This case involves two <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigrants-your-rights-as-a-permanent-resident.html\">lawful permanent residents<\/a> who remained in custody after the 90-day removal period had ended. They were detained because no country would accept them. The <span data-term-id=\"55386020\">Supreme Court<\/span><span data-term-id=\"55386020\"> of the United States<\/span> ruled that immigration law does not allow indefinite detention simply because <span data-term-id=\"55386023\">deportation<\/span> becomes difficult. Any detention made after the removal period should be reasonably necessary in carrying out the <span data-term-id=\"55386023\">deportation<\/span> order.<\/p>\n<p>The Court also established the six-month benchmark with this ruling. After the six-month detention period, a detainee can challenge continued detention. As such, the <span data-term-id=\"55386018\">judicial branch<\/span> receives a flood of <span data-term-id=\"55385992\">habeas corpus petitions<\/span> each year, including some prepared by inmates without the assistance of a lawyer. Strict procedures govern which petitions judges may consider. Rules bar inmates from repetitively filing petitions about the same matter.<\/p>\n<p>Both state and <span data-term-id=\"55385985\">federal courts<\/span> may consider <span data-term-id=\"55385992\">habeas corpus petitions<\/span>. <span data-term-id=\"55385998\">Federal prisoners<\/span>\u00a0typically file their petitions in federal\u00a0<span data-term-id=\"55385997\">district courts<\/span>, whereas\u00a0<span data-term-id=\"55385986\">state prisoners<\/span>\u00a0must exhaust their state remedies before seeking <span data-term-id=\"55386008\">federal <\/span><span data-term-id=\"55386028\">habeas<\/span><span data-term-id=\"55386028\"> relief<\/span>. <span data-term-id=\"55385985\">Federal courts<\/span> sometimes find that a state has unjustly imprisoned someone and order their release. Congress has imposed restrictions on <span data-term-id=\"55385985\">federal courts<\/span>\u2019 authority to overrule <span data-term-id=\"55385989\">state courts<\/span> in this manner.<\/p>\n<p>Constitutional protections for habeas corpus are found in <a href=\"https:\/\/constitution.findlaw.com\/article1\/annotation46.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55386003\">Article I<\/span> of the U.S. Constitution<\/a>. This law states that Congress cannot suspend the <span data-term-id=\"55385984\">writ of habeas corpus<\/span> except in <span data-term-id=\"55386009\">cases of rebellion<\/span>, invasion, or when the public safety requires it. During the <span data-term-id=\"55385996\">Civil War<\/span>, President Lincoln suspended the <span data-term-id=\"55385995\">privilege of the <\/span><span data-term-id=\"55385984\">writ of habeas corpus<\/span> without the authorization of Congress to detain Confederate sympathizers, which sparked constitutional debate. This historical tension highlights the delicate balance between national security and liberty that the <span data-term-id=\"55386018\">judicial branch<\/span> continues to navigate today.<\/p>\n<h3>The <span data-term-id=\"55386029\">Antiterrorism<\/span> and Effective <span data-term-id=\"55386015\">Death Penalty<\/span> Act of 1996 (<span data-term-id=\"55386030\">AEDPA<\/span>)<\/h3>\n<p>Congress passed the <span data-term-id=\"55386029\">Antiterrorism<\/span> and Effective <span data-term-id=\"55386015\">Death Penalty<\/span> Act of 1996 (<span data-term-id=\"55386030\">AEDPA<\/span>), a federal statute, in the aftermath of 1995\u2019s\u00a0<a href=\"https:\/\/www.fbi.gov\/history\/famous-cases\/oklahoma-city-bombing\" target=\"_blank\" rel=\"noopener\">Oklahoma City bombing<\/a>. The <span data-term-id=\"55386030\">AEDPA<\/span> and the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/prison-litigation-reform-act.html\">Prison Litigation Reform Act<\/a> (PLRA) sought to reduce the number of <span data-term-id=\"55385992\">habeas corpus petitions<\/span> and <span data-term-id=\"55386017\">civil rights<\/span> complaints in <span data-term-id=\"55385985\">federal court<\/span>, respectively.<\/p>\n<h3><span data-term-id=\"55386029\">Antiterrorism<\/span> and Effective <span data-term-id=\"55386015\">Death Penalty<\/span> Act<\/h3>\n<p>The <span data-term-id=\"55386030\">AEDPA<\/span> narrowed a defendant\u2019s ability to file a <span data-term-id=\"55385992\">habeas corpus petition<\/span>. The <a href=\"https:\/\/codes.findlaw.com\/us\/title-28-judiciary-and-judicial-procedure\/28-usc-sect-2254\/\" target=\"_blank\" rel=\"noopener\">restrictions provide the\u00a0<span data-term-id=\"55386032\">legal authority<\/span><\/a>\u00a0for <span data-term-id=\"55385985\">federal courts<\/span> to review <span data-term-id=\"55385989\">state <\/span><span data-term-id=\"55386014\">court<\/span><span data-term-id=\"55386014\"> decisions<\/span> in habeas cases. Among others, it sets out the following rules:<\/p>\n<ul>\n<li>If a <span data-term-id=\"55385989\">state court<\/span> decided the defendant\u2019s case on the\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/merit.html\" target=\"_blank\" rel=\"noopener\">merits<\/a>, a <span data-term-id=\"55385985\">federal court<\/span> would not grant a <span data-term-id=\"55385984\">writ of habeas corpus<\/span> unless the <span data-term-id=\"55385989\">state <\/span><span data-term-id=\"55386014\">court<\/span><span data-term-id=\"55386014\">\u2019s decision<\/span> was contrary to the law<\/li>\n<li>A <span data-term-id=\"55385985\">federal court<\/span> reviewing a <span data-term-id=\"55385992\">habeas corpus petition<\/span> presumes that the <span data-term-id=\"55385989\">state <\/span><span data-term-id=\"55386014\">court<\/span><span data-term-id=\"55386014\">\u2019s decisions<\/span> regarding factual issues are correct, placing the onus on the defendant to rebut the presumption by\u00a0clear and convincing evidence<\/li>\n<li>A person filing a <span data-term-id=\"55385992\">habeas corpus petition<\/span> in <span data-term-id=\"55385985\">federal court<\/span> must exhaust all state remedies before doing so<\/li>\n<\/ul>\n<p>Other conditions may apply.<\/p>\n<h3>Time Limits for Habeas Corpus<\/h3>\n<p>The <span data-term-id=\"55386030\">AEDPA<\/span> imposes a\u00a0one-year time limit from the defendant\u2019s\u00a0judgment date to file a <span data-term-id=\"55385992\">habeas corpus petition<\/span>, although\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-28-judiciary-and-judicial-procedure\/28-usc-sect-2255\/\" target=\"_blank\" rel=\"noopener\">other dates<\/a> may apply. This <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/time-limits-for-charges-state-criminal-statutes-of-limitations.html\">statute of limitations<\/a> varies from state to state.<\/p>\n<p>Research indicates that the <span data-term-id=\"55386030\">AEDPA<\/span>\u2019s goal of reducing the number of petitions filed in <span data-term-id=\"55385985\">federal court<\/span> has not been effective. The total number of filings doubled from 1982 to 2013. Given the increase in the prison population during that time, the number of <span data-term-id=\"55386008\">federal <\/span><span data-term-id=\"55385992\">habeas<\/span><span data-term-id=\"55385992\"> corpus petitions<\/span> per inmate may be more accurate than the total number of petitions filed.\u00a0<a href=\"https:\/\/www.repository.law.indiana.edu\/cgi\/viewcontent.cgi?article=1150&amp;context=ijlse\" target=\"_blank\" rel=\"noopener\">Research indicates<\/a> that the number of <span data-term-id=\"55385992\">habeas corpus petitions<\/span> filed per prisoner has remained about the same.<\/p>\n<h3>Prison Litigation Reform Act<\/h3>\n<p>Under the PLRA, inmates contesting conditions generally must first attempt to resolve the matter through available grievance procedures.
