Contact a <a href=\"https:\/\/lawyers.findlaw.com\/civil-rights\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"56111413\">civil rights<\/span><span data-term-id=\"56111413\"> attorney<\/span><\/u><\/a> in your area to protect your rights and explore potential legal remedies.<\/p>\n<h2>The Text and Development of Section 1983<\/h2>\n<p>Often referred to simply as Section 1983, <a href=\"https:\/\/codes.findlaw.com\/us\/title-42-the-public-health-and-welfare\/42-usc-sect-1983.html\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"56111388\">42 U.S.C<\/span>. \u00a7 1983<\/u><\/a> allows a person to sue state and <span data-term-id=\"56111417\">local <\/span><span data-term-id=\"56111395\">government<\/span><span data-term-id=\"56111395\"> officials<\/span> for violating their <span data-term-id=\"56111382\">civil rights<\/span>.<\/p>\n<p>Section 1983 states:<\/p>\n<p><em>&#8220;Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law \u2026&#8221;<\/em><\/p>\n<p>To summarize, any person is liable when they act under the <a href=\"https:\/\/www.justice.gov\/crt\/deprivation-rights-under-color-law#:~:text=For%20the%20purpose%20of%20Section,pretending%20to%20act%20in%20the\" target=\"_blank\" rel=\"noopener\"><u>color of law<\/u><\/a> in such a way that it deprives either a U.S. citizen or a person within the United States jurisdiction of the rights, privileges, or immunities guaranteed to them by the Constitution or by federal or <span data-term-id=\"56111407\">state law<\/span>. <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/have-your-civil-rights-been-violated.html\"><span data-term-id=\"56111383\">Civil rights<\/span><span data-term-id=\"56111383\"> violations<\/span><\/a> occur when a person or entity deprives another of the rights, privileges, or immunities guaranteed by the <span data-term-id=\"56111426\">U.S. Constitution<\/span> or by law. These violations can lead to <span data-term-id=\"56111410\">legal action<\/span> under Section 1983, allowing individuals to hold responsible parties accountable through <span data-term-id=\"56111419\">civil rights<\/span><span data-term-id=\"56111419\"> claims<\/span>.<\/p>\n<h3>What Does &#8220;Acting Under Color of Law&#8221; Mean?<\/h3>\n<p>Acting under color of law means a person was using power or authority granted by a government entity. When they misuse it, they may expose themselves to civil action.<\/p>\n<p>For example, an off-duty <span data-term-id=\"56111422\">police officer<\/span> who uses their badge and authority to make an unlawful arrest is still acting under color of law. A state official who enforces an unconstitutional policy while performing their official duties acts under color of law.<\/p>\n<h3>Historical Development of Section 1983<\/h3>\n<p>Although enacted in 1871,\u00a0<span data-term-id=\"56111388\">42 U.S.C<\/span>. \u00a7 1983 did not become a tool to prevent abuses by <span data-term-id=\"56111395\">government officials<\/span> for almost 90 years. In 1961, the U. S. Supreme Court decided the case of <a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/365\/167.html\" target=\"_blank\" rel=\"noopener\"><em><u>Monroe v. Pape<\/u><\/em><\/a>. In its ruling, the Supreme Court listed three uses for the statute:<\/p>\n<ul>\n<li>Overriding <span data-term-id=\"56111407\">state laws<\/span><\/li>\n<li>Providing <a href=\"https:\/\/dictionary.findlaw.com\/definition\/remedy.html\" target=\"_new\" rel=\"noopener\"><u>remedies<\/u><\/a> where <span data-term-id=\"56111407\">state laws<\/span> are inadequate<\/li>\n<li>Providing federal remedies where state remedies are available in theory but not in actuality<\/li>\n<\/ul>\n<p>Section 1983 has evolved and expanded since 1961. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/436\/658.html\" target=\"_blank\" rel=\"noopener\"><em><u>Monell v. New York City Department of Social Services<\/u><\/em><\/a>, the U.S. Supreme Court expanded Section 1983 to permit civil suits against municipal entities and <span data-term-id=\"56111417\">local governments<\/span>, as well as individual state actors. Municipalities can be held liable only when the constitutional violation results from an official policy, custom, or practice. It does not automatically apply because they employed someone who committed the violation.<\/p>\n<p>State officials found liable under Section 1983 have included <span data-term-id=\"56111422\">police officers<\/span>, other <span data-term-id=\"56111385\">law enforcement<\/span> officers, state and <span data-term-id=\"56111417\">local <\/span><span data-term-id=\"56111395\">government<\/span><span data-term-id=\"56111395\"> officials<\/span>, and private parties acting under color of law. In certain situations, injunctive relief against a state official may be granted.<\/p>\n<h3>Bivens Claims Against Federal Officials<\/h3>\n<p>Section 1983 applies only to state and <span data-term-id=\"56111417\">local government<\/span> actors. Under a <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/403\/388.html\" target=\"_blank\" rel=\"noopener\">separate Supreme Court ruling in 1971<\/a>, federal agents may be sued for constitutional violations in limited circumstances through what are called <em>Bivens<\/em> claims. These are distinct from Section 1983 claims and have been significantly limited by the Supreme Court in recent years.<\/p>\n<h2>What Is Considered a Violation of <span data-term-id=\"56111382\">Civil Rights<\/span>?<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/what-are-civil-rights.html\"><u><span data-term-id=\"56111382\">Civil rights<\/span><\/u><\/a> are intended to protect people from unfair treatment. They concern the rights, privileges, and immunities enumerated in the Constitution.<\/p>\n<p><span data-term-id=\"56111384\">Federal law<\/span> and U.S. Supreme Court precedent address the <span data-term-id=\"56111382\">civil rights<\/span> of individuals. <span data-term-id=\"56111382\">Civil rights<\/span> protect people from discrimination based on their personal characteristics. Examples of federal <span data-term-id=\"56111382\">civil rights<\/span> protections include:<\/p>\n<ul>\n<li>The right to secure housing without unfair treatment or discrimination<\/li>\n<li>The right to public education<\/li>\n<li>The right to vote<\/li>\n<li>The right to be free from discrimination or harassment in the workplace<\/li>\n<\/ul>\n<p>In 1964, the <span data-term-id=\"56111408\">federal government<\/span> passed the <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-is-the-civil-rights-act-of-1964\/\"><u><span data-term-id=\"56111409\">Civil Rights<\/span><span data-term-id=\"56111409\"> Act<\/span> of 1964<\/u><\/a>. It prohibits discrimination in areas such as employment, education, voting, and public accommodations. It prohibits discrimination on the basis of the following:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Color<\/li>\n<li>Religion<\/li>\n<li>Sex<\/li>\n<li><span data-term-id=\"56111393\">National origin<\/span><\/li>\n<\/ul>\n<p>For example, denying an Asian American employee a promotion due to their race is a <span data-term-id=\"56111383\">civil rights<\/span><span data-term-id=\"56111383\"> violation<\/span>. An employer who denies a worker a promotion based on race or ethnic considerations has committed unlawful <span data-term-id=\"56111390\">employment discrimination<\/span>. Other examples include:<\/p>\n<ul>\n<li>A prison guard&#8217;s unlawful use of force against a prisoner<\/li>\n<li><span data-term-id=\"56111392\">Police misconduct<\/span>, such as unlawful arrest, racial profiling, or the use of <span data-term-id=\"56111398\">excessive force<\/span><\/li>\n<li><span data-term-id=\"56111395\">Government officials<\/span> restricting free speech in the workplace<\/li>\n<\/ul>\n<p>This is not an exhaustive list.<\/p>\n<h3><span data-term-id=\"56111382\">Civil Rights<\/span> vs. Civil Liberties<\/h3>\n<p>Although the terms are often used interchangeably, there is a difference between <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/civil-rights-vs-civil-liberties.html\"><u><span data-term-id=\"56111382\">civil rights<\/span> and civil liberties<\/u><\/a>. <span data-term-id=\"56111382\">Civil rights<\/span> protect individuals from discrimination based on personal characteristics. Civil liberties involve basic <span data-term-id=\"56111399\">constitutional rights<\/span> and freedoms. Civil liberties do not consider personal characteristics (race, gender, etc.) like <span data-term-id=\"56111382\">civil rights<\/span>. They are designed to protect people from unwarranted or overreaching government action.<\/p>\n<p>Examples of civil liberties include:<\/p>\n<ul>\n<li>Freedom of speech (<a href=\"https:\/\/constitution.findlaw.com\/amendment1.html\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"56111418\">First Amendment<\/span><\/u><\/a>)<\/li>\n<li>Freedom of religion (<span data-term-id=\"56111418\">First Amendment<\/span>)<\/li>\n<li>Freedom of the press (<span data-term-id=\"56111418\">First Amendment<\/span>)<\/li>\n<li>Freedom from unreasonable searches and seizures (<a href=\"https:\/\/constitution.findlaw.com\/amendment4.html\" target=\"_blank\" rel=\"noopener\"><u>Fourth Amendment<\/u><\/a>)<\/li>\n<li>The right to a fair trial (<span data-term-id=\"56111396\">due process<\/span>) (<a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\"><u>Fifth Amendment<\/u><\/a> and <a href=\"https:\/\/constitution.findlaw.com\/amendment14.html\" target=\"_blank\" rel=\"noopener\"><u>14th Amendment<\/u><\/a>)<\/li>\n<\/ul>\n<p>There are many other types of civil liberty violations.<\/p>\n<h2>Civil Lawsuits vs. Criminal Prosecution for Violations<\/h2>\n<p>The person deprived of their rights may file a <a href=\"https:\/\/www.findlaw.com\/civilrights\/enforcing-your-civil-rights\/filing-civil-rights-claims.html\"><u><span data-term-id=\"56111406\">civil rights<\/span><span data-term-id=\"56111406\"> lawsuit<\/span><\/u><\/a> against the person who denied them. <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/civil-cases-vs-criminal-cases-key-differences.html\"><u>Civil cases differ from criminal cases<\/u><\/a>. A criminal case is a lawsuit filed by the federal or state government on behalf of the United States public. <span data-term-id=\"56111395\">Government officials<\/span> prosecute the defendant in a criminal case in either state courts or federal district courts. A victim in a criminal case does not have a responsibility to press charges against the offender.<\/p>\n<p>A civil case arises when the plaintiff alleges that the defendant failed to perform a legal duty owed to the plaintiff. For example, if the plaintiff <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/slip-and-fall.html\"><u>slipped and fell<\/u><\/a> on a defendant&#8217;s property, the plaintiff could file a personal injury civil action (a tort claim) against the defendant.<\/p>\n<p>Respecting one&#8217;s rights established by the Constitution, or under federal or <span data-term-id=\"56111407\">state law<\/span>, is a legal duty. A <span data-term-id=\"56111383\">civil rights<\/span><span data-term-id=\"56111383\"> violation<\/span> is a civil action initiated in either state or <span data-term-id=\"56111411\">federal court<\/span>. A <span data-term-id=\"56111382\">civil rights<\/span> suit brought under <span data-term-id=\"56111388\">42 U.S.C<\/span>. \u00a7 1983 is a civil action, even though the same conduct might also result in criminal prosecution.<\/p>\n<p>There are situations in which violating an individual&#8217;s <span data-term-id=\"56111382\">civil rights<\/span> may result in criminal charges being filed against the state actors responsible. These cases are typically prosecuted in <span data-term-id=\"56111411\">federal court<\/span> under <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-242.html\" target=\"_blank\" rel=\"noopener\"><u>18 U.S.C. \u00a7 242<\/u><\/a>.<\/p>\n<p>The same conduct can give rise to both a criminal prosecution under \u00a7 242 and a civil lawsuit under \u00a7 1983. These are separate proceedings with different burdens of proof. Criminal cases require proof beyond a reasonable doubt, while civil cases require proof by a preponderance of the evidence.<\/p>\n<h2><span data-term-id=\"56111406\">Civil Rights<\/span><span data-term-id=\"56111406\"> Lawsuits<\/span> and Sovereign Immunity<\/h2>\n<p>Under common law, <a href=\"https:\/\/dictionary.findlaw.com\/definition\/immunity.html\" target=\"_blank\" rel=\"noopener\"><u>sovereign immunity<\/u><\/a> bars actions against the state and its agents. To sue the <span data-term-id=\"56111408\">federal government<\/span> or a state or <span data-term-id=\"56111417\">local government<\/span>, the government entity must waive its sovereign immunity.<\/p>\n<p>In <a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/2\/419.html\" target=\"_blank\" rel=\"noopener\"><em><u>Chisholm v. Georgia<\/u><\/em><\/a>, the U.S. Supreme Court permitted the lawsuit brought by an out-of-state resident against the state of Georgia. The court held that Georgia lacked sovereign immunity in this case. In response, Congress passed the <a href=\"https:\/\/constitution.findlaw.com\/amendment11.html\" target=\"_blank\" rel=\"noopener\"><u>11th Amendment<\/u><\/a><u>,<\/u> which bars private citizens from suing states in\u00a0<span data-term-id=\"56111411\">federal court<\/span>\u00a0under the doctrine of\u00a0sovereign immunity.<\/p>\n<h3>How Section 1983 Works With Sovereign Immunity<\/h3>\n<p>While Section 1983 creates rights for private citizens under <span data-term-id=\"56111384\">federal law<\/span> <a href=\"https:\/\/www.findlaw.com\/hirealawyer\/do-you-need-a-lawyer\/before-you-sue-10-things-to-think-about.html\"><u>to initiate lawsuits<\/u><\/a>, the Eleventh Amendment&#8217;s sovereign immunity protections still apply. This means:<\/p>\n<ul>\n<li><strong>States themselves<\/strong> generally cannot be sued for monetary damages under Section 1983<\/li>\n<li><strong>State officials<\/strong> can be sued in their individual capacity for damages<\/li>\n<li><strong>State officials<\/strong> can be sued in their official capacity for injunctive relief (a court order to stop unconstitutional conduct)<\/li>\n<li><strong>Municipalities and <span data-term-id=\"56111417\">local governments<\/span><\/strong> can be sued directly for damages under Section 1983, as they do not enjoy the same sovereign immunity as states<\/li>\n<\/ul>\n<p>State and local officials are granted <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/court-perspectives--police-misconduct--section-1983--and-civil-r.html\" target=\"_blank\" rel=\"noopener\"><u>qualified immunity<\/u><\/a>. This means they are immune from individual liability unless plaintiffs show that the official violated a clearly established <span data-term-id=\"56111399\">constitutional right<\/span>.<\/p>\n<p>The test is &#8220;would a reasonable person have known that their actions violated the plaintiff&#8217;s statutory or <span data-term-id=\"56111399\">constitutional rights<\/span>?&#8221; As a practical matter, if a <span data-term-id=\"56111422\">police officer<\/span> holds a reasonable belief that their actions were lawful, they most likely will not be held liable for their actions pursuant to Section 1983.<\/p>\n<h2>Requirements for Section 1983 Relief<\/h2>\n<p>The U.S. Supreme Court has interpreted Section 1983 to mean that a plaintiff must prove two elements to prevail on their claim:<\/p>\n<ul>\n<li>The defendant acted under the color of <span data-term-id=\"56111407\">state law<\/span><\/li>\n<li>The act(s) (or failure to act) of the defendant deprived the plaintiff of their particular rights under either the laws of the United States or the <span data-term-id=\"56111426\">U.S. Constitution<\/span><\/li>\n<\/ul>\n<p>Whether a government employee acted under the color of law depends on whether the person acted, or purported to act, in the performance of their official duties under any applicable law.<\/p>\n<p>When <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/have-your-civil-rights-been-violated.html\"><u><span data-term-id=\"56111382\">civil rights<\/span> issues arise<\/u><\/a> under the <span data-term-id=\"56111426\">U.S. Constitution<\/span> or federal statutes, it can be difficult to establish that a right exists or that the person infringing that right was acting &#8220;under color of law.&#8221; Those bringing suit against the government must also comply with the applicable <span data-term-id=\"56111401\">statute of limitations<\/span>. <span data-term-id=\"56111384\">Federal law<\/span> does not have a limiting statute for Section 1983 claims. Instead, claims must be brought under the <a href=\"https:\/\/www.findlaw.com\/state\/statutes-of-limitations.html\"><u>state&#8217;s <span data-term-id=\"56111401\">statute of limitations<\/span><\/u><\/a> for personal injury claims. The average <span data-term-id=\"56111404\">time limit<\/span> is two years in most states, although the statute ranges from one to seven years depending on the jurisdiction.<\/p>\n<h2>Proving Damages in a 1983 Case<\/h2>\n<p>Proving an injury in a government case requires showing that your <span data-term-id=\"56111382\">civil rights<\/span> were violated and that the accused was acting under instruction of a <span data-term-id=\"56111394\">government agency<\/span>. The most common defense against a 1983 case is that the officer acted outside the scope of their authority and violated department policy.<\/p>\n<p>To establish the <span data-term-id=\"56111414\">facts of your case<\/span>, you need evidence of a violation and proof that the officer was following government policy. You may need witness statements, internal documentation, and proof of actual damages.<\/p>\n<p>The Supreme Court case <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/435\/247.html\" target=\"_blank\" rel=\"noopener\"><em><u>Carey v. Piphus<\/u><\/em><\/a> held that plaintiffs must prove actual damages beyond the constitutional violation itself.
