They can do so under any of the following circumstances:<\/p>\n<ul>\n<li>You have given the officer consent<\/li>\n<li>The officer has\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\"><span data-term-id=\"56111627\">probable cause<\/span><\/a>\u00a0to believe there is <span data-term-id=\"56111630\">evidence of a crime<\/span> in your vehicle<\/li>\n<li>The officer reasonably believes a search is necessary for their protection, such as for a hidden weapon<\/li>\n<li>Police made an arrest, and the search is related to that arrest (such as a search for illegal drugs)<\/li>\n<\/ul>\n<p>Police may stop an automobile if they possess a reasonable and articulable suspicion that the motorist has violated a\u00a0<a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/what-to-do-during-traffic-stops.html\">traffic law<\/a>.<\/p>\n<p>If the reason for the stop is a minor <span data-term-id=\"56111652\">traffic violation<\/span>, such as <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/fight-a-speeding-ticket-is-speeding-always-speeding.html\">speeding<\/a> or a faulty taillight, the officer likely would not be permitted to search your car without more reason. When your conduct after a <span data-term-id=\"56111631\">traffic stop<\/span> leads to an arrest, a <span data-term-id=\"56111671\">search of your vehicle<\/span> will usually be considered reasonable. This is called a\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment4\/annotation06.html#arrest\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56111657\">search incident to arrest<\/span><\/a>.<\/p>\n<h3>Consent To Search<\/h3>\n<p><span data-term-id=\"56111635\">Law enforcement<\/span> can request to search your vehicle. Motorists have a <span data-term-id=\"56111667\">legal right<\/span> to refuse <span data-term-id=\"56111635\">law enforcement<\/span>\u2019s request to do so. If police disregard your refusal and search your car, it may be an <span data-term-id=\"56111637\">illegal search<\/span>.<\/p>\n<p>If they seize evidence during an <span data-term-id=\"56111637\">illegal search<\/span>, a judge will exclude the evidence from your criminal case. The\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-and-the-exclusionary-rule.html\"><span data-term-id=\"56111670\">exclusionary rule<\/span><\/a>\u00a0excludes evidence obtained by illegal or <span data-term-id=\"56111639\">unreasonable searches<\/span>.<\/p>\n<p>If you allow <span data-term-id=\"56111635\">law enforcement<\/span> to search your vehicle, you have consented to a search. Because you agreed to the search, police can use any evidence they find against you in a criminal case.<\/p>\n<h3><span data-term-id=\"56111627\">Probable Cause<\/span><\/h3>\n<p>If police develop <span data-term-id=\"56111627\">probable cause<\/span> during a <span data-term-id=\"56111631\">traffic stop<\/span>, they can search your vehicle. <span data-term-id=\"56111627\">Probable cause<\/span> is a legal basis that allows <span data-term-id=\"56111635\">law enforcement<\/span> to conduct a search, seize property, or arrest someone. The\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-fourth-amendment.html\"><span data-term-id=\"56111629\">Fourth Amendment<\/span><\/a>\u00a0to the\u00a0<span data-term-id=\"56111666\">U.S. Constitution<\/span>\u00a0requires police to have <span data-term-id=\"56111627\">probable cause<\/span> before they search a vehicle. Officers have <span data-term-id=\"56111627\">probable cause<\/span> when they believe a crime has been or is being committed.<\/p>\n<p>Police do not need <span data-term-id=\"56111627\">probable cause<\/span> to pull over a motorist. There, the standard is <span data-term-id=\"56111644\">reasonable suspicion<\/span>.\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-reasonableness-requirement.html\"><span data-term-id=\"56111644\">Reasonable suspicion<\/span><\/a>\u00a0means the <span data-term-id=\"56111640\">police officer<\/span> knows specific facts or acts on inferences regarding the person or vehicle. It uses the\u00a0reasonable person standard. This means the officer\u2019s actions are judged based on what a &#8220;reasonable person&#8221; would believe under similar circumstances.<\/p>\n<p>The <span data-term-id=\"56111634\">plain view<\/span> doctrine allows <span data-term-id=\"56111653\">law enforcement<\/span><span data-term-id=\"56111653\"> officers<\/span> to seize <span data-term-id=\"56111630\">evidence of a crime<\/span> without a <span data-term-id=\"56111638\">search warrant<\/span>, provided the evidence is in <span data-term-id=\"56111634\">plain view<\/span>. For example, suppose an officer pulls over a motorist for speeding. The officer sees an open duffel bag appearing to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-charges.html\">contain illegal drugs<\/a> in the backseat. In that case, the officer may seize the bag.<\/p>\n<p>The police may then conduct a legal <span data-term-id=\"56111643\">warrantless search<\/span> for other drug-related items in the vehicle. This is because the officer has <span data-term-id=\"56111627\">probable cause<\/span> that other <span data-term-id=\"56111646\">contraband<\/span> or <span data-term-id=\"56111648\">illegal items<\/span> may be in the <span data-term-id=\"56111661\">motor vehicle<\/span>.<\/p>\n<h3><span data-term-id=\"56111655\">Exigent Circumstances<\/span><\/h3>\n<p>Police can perform a <span data-term-id=\"56111643\">warrantless search<\/span> when they determine urgent circumstances exist (<a href=\"https:\/\/dictionary.findlaw.com\/definition\/exigent-circumstances.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56111655\">exigent\u00a0circumstances<\/span><\/a>). For example, if the car matches the description of a vehicle used in a bank robbery, <span data-term-id=\"56111655\">exigent circumstances<\/span> may justify a <span data-term-id=\"56111643\">warrantless search<\/span>. Again, <span data-term-id=\"56111635\">law enforcement<\/span> would need to show they have <span data-term-id=\"56111627\">probable cause<\/span> to believe <span data-term-id=\"56111655\">exigent circumstances<\/span> exist.<\/p>\n<h3><span data-term-id=\"56111657\">Search Incident to Arrest<\/span><\/h3>\n<p>If a <span data-term-id=\"56111653\">law enforcement<\/span><span data-term-id=\"56111653\"> officer<\/span> pulls you over and ultimately arrests you, they may also search your vehicle. A\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment4\/annotation06.html#arrest\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56111657\">search incident to arrest<\/span><\/a>\u00a0is considered a reasonable search because the officer has <span data-term-id=\"56111627\">probable cause<\/span> to believe the search\u2019s subject has committed a crime. The rationale is that searching the vehicle may uncover further evidence of <span data-term-id=\"56111662\">criminal activity<\/span>.<\/p>\n<p>However, a <span data-term-id=\"56111657\">search incident to arrest<\/span> is limited by the <span data-term-id=\"56111654\">Supreme Court<\/span>\u2019s ruling in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/556\/332.html\" target=\"_blank\" rel=\"noopener\"><em>Arizona v. Gant<\/em><\/a> (2009). Under this precedent, police may only search a vehicle incident to arrest when:<\/p>\n<ul>\n<li>The suspect is \u201cunsecured\u201d (hasn\u2019t been handcuffed or otherwise restrained) and within reaching distance of the vehicle, posing a potential threat to officer safety or preservation of evidence<\/li>\n<li>Officers reasonably believe the vehicle contains evidence of the specific crime for which they\u2019re arresting the suspect<\/li>\n<\/ul>\n<p>If you hire a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56111642\">criminal defense lawyer<\/span><\/a>, do your best to provide every detail you can remember about the arrest and how it was conducted.<\/p>\n<h2>Scope of <span data-term-id=\"56111635\">Law Enforcement<\/span>\u2019s Right To Search a Suspect\u2019s Vehicle<\/h2>\n<p>While the law gives <span data-term-id=\"56111653\">law enforcement<\/span><span data-term-id=\"56111653\"> officers<\/span> the right to search suspects\u2019 vehicles, this right is not absolute. As you can see, there are limits to what a <span data-term-id=\"56111640\">police officer<\/span> can do during a routine <span data-term-id=\"56111631\">traffic stop<\/span>. It\u2019s important that you know these limits. This way, if an officer does conduct an <span data-term-id=\"56111636\">unlawful <\/span><span data-term-id=\"56111671\">search<\/span><span data-term-id=\"56111671\"> of your vehicle<\/span>, you\u2019ll know your rights.<\/p>\n<p>Generally, the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-reasonableness-requirement.html\"><span data-term-id=\"56111629\">Fourth Amendment<\/span><\/a> defines the scope of <span data-term-id=\"56111635\">law enforcement<\/span>\u2019s right to search your vehicle. This amendment protects you against <span data-term-id=\"56111639\">unreasonable searches<\/span> and seizures. Over the years, there have been hundreds, if not thousands, of cases that have challenged the police\u2019s ability to conduct a\u00a0<span data-term-id=\"56111643\">warrantless search<\/span>\u00a0of a suspect\u2019s vehicle.<\/p>\n<p>Some of the situations that have been at the center of these cases include the following:<\/p>\n<ul>\n<li><strong>Items in <span data-term-id=\"56111675\">plain sight<\/span>: <\/strong>Under the \u201c<a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/vehicle-search-and-seizure.html\"><span data-term-id=\"56111634\">plain view<\/span>\u201d doctrine<\/a>, the police can seize any items in <span data-term-id=\"56111634\">plain view<\/span>, as long as they have a <span data-term-id=\"56111669\">reasonable belief<\/span> that the items are <span data-term-id=\"56111646\">contraband<\/span>. For example, if the police stop somebody they believe committed a robbery, they could seize any items in <span data-term-id=\"56111675\">plain sight<\/span> that they reasonably believe were used in the robbery. They can also seize items that are illegal on their own, such as illegal drugs and drug paraphernalia.<\/li>\n<li><strong>Trunk:<\/strong> As the <span data-term-id=\"56111654\">Supreme Court<\/span> held in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/456\/798.html\" target=\"_blank\" rel=\"noopener\"><em>United States v. Ross<\/em><\/a> (1982), the police must have <span data-term-id=\"56111627\">probable cause<\/span> that your vehicle was involved in illegal activity to search the trunk of your car. For instance, if they suspect you are involved in drug trafficking, it makes sense that you would hide evidence of that crime in the trunk. It is also reasonable to believe that the suspect used the car to commit drug trafficking.<\/li>\n<li><strong>Glove compartment:<\/strong> The <span data-term-id=\"56111629\">Fourth Amendment<\/span>\u2019s protection against <span data-term-id=\"56111639\">unreasonable searches<\/span> and seizures extends to places like the glove compartment and other locked containers in your vehicle. However<em>, <\/em><span data-term-id=\"56111635\">law enforcement<\/span> can search these locations if they have <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\"><span data-term-id=\"56111627\">probable cause<\/span><\/a> that they contain <span data-term-id=\"56111630\">evidence of a crime<\/span>.<\/li>\n<li><strong>Closed and locked containers:<\/strong> In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/267\/132.html\" target=\"_blank\" rel=\"noopener\"><em>Carroll v. United States<\/em><\/a>, the <span data-term-id=\"56111654\">Supreme Court<\/span> held that <span data-term-id=\"56111635\">law enforcement<\/span> can search closed and locked containers in your vehicle as long as they have <span data-term-id=\"56111627\">probable cause<\/span> that they contain evidence or <span data-term-id=\"56111646\">contraband<\/span>. This extends to <span data-term-id=\"56111643\">warrantless searches<\/span> of purses and other personal belongings.<\/li>\n<\/ul>\n<p>If you believe the police conducted an <span data-term-id=\"56111636\">unlawful search<\/span> of one of these areas in your vehicle, seek <span data-term-id=\"56111641\">legal advice<\/span> right away. If your <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56111633\">criminal defense attorney<\/span><\/a> can prove that the search was illegal, the court must exclude any evidence related to that search.<\/p>\n<h2>Does the Law Protect Passengers From <span data-term-id=\"56111636\">Unlawful Searches<\/span> and Seizures?<\/h2>\n<p>The constitutional right against <span data-term-id=\"56111636\">unlawful searches<\/span> and seizures extends to <a href=\"https:\/\/supreme.findlaw.com\/legal-commentary\/the-supreme-courts-recent-decision-regarding-whether-a-car-passenger-is-seized-in-a-traffic-stop.html\" target=\"_blank\" rel=\"noopener\">passengers in a vehicle<\/a>. If you&#8217;re a passenger in a car and the police stop the vehicle, they have the same authority to search your belongings as they would the driver&#8217;s.<\/p>\n<p>At the same time, you enjoy the same <a href=\"https:\/\/constitution.findlaw.com\/amendment4.html\" target=\"_blank\" rel=\"noopener\">protections under the <span data-term-id=\"56111629\">Fourth Amendment<\/span><\/a> as the person driving the car or SUV. If you believe the police illegally searched your purse, backpack, or other property, you can challenge the search.<\/p>\n<p>You may wonder why you would have to challenge the <span data-term-id=\"56111636\">unlawful search<\/span> and seizure. Imagine that you\u2019re riding in a car with three of your friends. You\u2019re going to spend the weekend at the beach, and you decided to pack some <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-charges.html\">marijuana and cocaine<\/a> in your purse for the trip.<\/p>\n<p>The person driving you to the beach has a warrant out for suspected <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-trafficking-distribution.html\">drug trafficking<\/a>. The police pull the car over, suspecting that the driver may have drugs in the vehicle. This is a reasonable assumption given that there are pending drug trafficking charges against them.<\/p>\n<p>During the stop, the officers will likely ask if they can see what\u2019s in your purse. You can refuse to let them search your pocketbook. However, they will have <a href=\"https:\/\/constitution.findlaw.com\/amendment4\/annotation04.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56111627\">probable cause<\/span><\/a> to do so given the outstanding warrant.<\/p>\n<p>When they search your bag, they find large quantities of illegal drugs. They arrest you for drug <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/possession-with-the-intent-to-distribute.html\">possession with intent to distribute<\/a>. If you feel the search was unlawful, you should contact a <span data-term-id=\"56111633\">criminal defense attorney<\/span> immediately. They can challenge the constitutionality of the search and, if they are successful, the state will likely dismiss the charges.<\/p>\n<h2>Can the <span data-term-id=\"56111664\">Police Search<\/span><span data-term-id=\"56111664\"> My Car<\/span> Using Drug-Sniffing Dogs?<\/h2>\n<p>One question a lot of drivers have is whether the police can conduct a search using drug-sniffing dogs during a routine <span data-term-id=\"56111631\">traffic stop<\/span>. In 2015, the U.S. <span data-term-id=\"56111654\">Supreme Court<\/span> had to address this question in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/13-9972.html\" target=\"_blank\" rel=\"noopener\"><em>Rodriguez v United States<\/em><\/a>.<\/p>\n<p>The court held that <span data-term-id=\"56111635\">law enforcement<\/span> does have the authority to conduct a K-9 search during a <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops.html\"><span data-term-id=\"56111631\">traffic stop<\/span><\/a>. However, the scope of this authority is limited. Generally, the police cannot conduct a K-9 search if it would unreasonably extend the duration of the <span data-term-id=\"56111631\">traffic stop<\/span>.<\/p>\n<p>If the police have <span data-term-id=\"56111627\">probable cause<\/span> to believe the driver (or passenger) has illegal drugs in their possession, they can lawfully conduct a search using a <a href=\"https:\/\/www.findlaw.com\/education\/student-rights\/using-drug-sniffing-dogs-and-canine-units.html\">drug-sniffing dog<\/a>. Of course, if your attorney can demonstrate that the officer did not have <span data-term-id=\"56111627\">probable cause<\/span> to believe you committed a drug-related crime, the state will have to dismiss the <span data-term-id=\"56111649\">criminal charges<\/span>.<\/p>\n<h2>Police Can Search Impounded Cars Without a Warrant<\/h2>\n<p>If the police have towed and impounded your car, they can search your vehicle.
