In that case, courts will look at the&nbsp;totality of the circumstances.&nbsp;Courts use the&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/reasonable-person.html\" target=\"_blank\" rel=\"noopener\">reasonable person<\/a>&nbsp;standard in their determination. The analysis involves whether a reasonable person would consider law enforcement&#8217;s actions as restricting their freedom of action.<\/p>\n<h3>Custodial Interrogation and Miranda Rights<\/h3>\n<p>The concept of custodial interrogation is important. Before a law enforcement officer can interrogate a suspect, they must inform the suspect of their&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-warnings-and-police-questioning.html\">Miranda rights<\/a>. The Miranda rights, also known as Miranda warnings, come from the Supreme Court case&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/384\/436.html\" target=\"_blank\" rel=\"noopener\"><i>Miranda v. Arizona<\/i><\/a>.<\/p>\n<p>The Miranda rights inform a suspect of the following&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">constitutional rights<\/a>:<\/p>\n<ul>\n<li>The right to remain silent (<a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment right against self-incrimination<\/a>)<\/li>\n<li>The right to an attorney (<a href=\"https:\/\/constitution.findlaw.com\/amendment6\/annotation07.html\" target=\"_blank\" rel=\"noopener\">Sixth Amendment right to counsel<\/a>)<\/li>\n<\/ul>\n<p>A suspect must&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/right-to-counsel.html\">invoke&nbsp;their right to counsel<\/a>. To do so, a criminal suspect must state something like, \u201cI want a lawyer.&quot; But, if&nbsp;a suspect invokes this&nbsp;right but&nbsp;makes incriminating statements to law enforcement that were not prompted by police questions&nbsp;before their counsel arrives,&nbsp;this may constitute a&nbsp;waiver&nbsp;of their right. In this situation, the prosecution may use the statements in the suspect&#8217;s criminal trial.<\/p>\n<h2>Sixth Amendment Right to Counsel<\/h2>\n<p>The Sixth Amendment right to counsel only applies in&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/the-differences-between-a-criminal-case-and-a-civil-case.html\">criminal cases<\/a>. In&nbsp;civil cases, parties to a lawsuit do not have a Sixth Amendment right to counsel. The Sixth Amendment right to counsel takes effect when the government charges the defendant with a crime. The Fifth Amendment right to counsel only applies during law enforcement&#8217;s custodial interrogation of a suspect.<\/p>\n<p>To invoke their Fifth Amendment right to counsel, a suspect must clearly <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/right-to-counsel.html\">invoke the right<\/a>. Once the suspect invokes their right, police must cease questioning the suspect. They can resume questioning once the suspect&#8217;s attorney arrives if the suspect still agrees to speak with interrogators.<\/p>\n<h3>When Does the Sixth Amendment Right to Counsel Attach?<\/h3>\n<p>The Sixth Amendment right to counsel attaches when law enforcement formally&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-happens-when-you-re-charged-with-a-crime.html\">charges someone with a crime<\/a>. This occurs when someone is either&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/indictment.html\" target=\"_blank\" rel=\"noopener\">indicted<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/arraign.html\" target=\"_blank\" rel=\"noopener\">arraigned<\/a>. To be clear, if law enforcement takes an arrestee to jail, that is not a formal charge.<\/p>\n<p>The Sixth Amendment right to counsel may also begin when adversarial proceedings start. In&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/475\/625.html\" target=\"_blank\" rel=\"noopener\"><i>Michigan v. Jackson<\/i><\/a><i>&nbsp;<\/i>(1986), the U.S. Supreme Court determined what police are prohibited from doing once someone invokes their Sixth Amendment right to counsel and the right&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/attach.html\" target=\"_blank\" rel=\"noopener\">attaches<\/a>.&nbsp;Once the right attaches, the police are forbidden from interrogating the defendant without counsel present.<\/p>\n<p>The Supreme Court overruled&nbsp;<i>Michigan v. Jackson<\/i>&nbsp;in a&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/556\/778.html\" target=\"_blank\" rel=\"noopener\">2009 case (<i>Montejo v. Louisiana<\/i>)<\/a>. In the subsequent case, the defendant waived his right to counsel after the government appointed him a lawyer.<\/p>\n<p>The case described the differences between the Fifth and Sixth Amendments&#8217; rights to counsel. If&nbsp;a defendant does not invoke their Fifth Amendment right but does rely on their Sixth Amendment right to counsel,&nbsp;police may begin another round of interrogation after they read the defendant their Miranda rights.<\/p>\n<h2>Violation of Right to Counsel<\/h2>\n<p>The court will&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-to-suppress-evidence.html\">exclude statements<\/a>&nbsp;obtained in violation of a defendant&#8217;s Sixth Amendment rights. But, there is a critical exception to the Sixth Amendment exclusionary rule.<\/p>\n<p>At trial, law enforcement may use such evidence to&nbsp;impeach&nbsp;the defendant&#8217;s testimony if they take the stand. In this context, &quot;impeach&quot; means to discredit the defendant&#8217;s credibility by presenting evidence or asking questions that undermine their testimony. Impeachment allows the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics.html\">criminal prosecution<\/a> to attack the defendant&#8217;s credibility.<\/p>\n<h2>Judicial Proceedings<\/h2>\n<p>Knowing the judicial process as a whole can help you better understand custodial interrogations and your rights. The following sections describe different aspects of judicial proceedings.<\/p>\n<h3>Due Process: Grand Juries, Indictments, and Arraignments<\/h3>\n<p>Per the&nbsp;Fifth Amendment&nbsp;to the&nbsp;U.S. Constitution, the government must <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/what-is-an-indictment.html\">seek an indictment<\/a> to prosecute someone for a&nbsp;felony. A grand jury&nbsp;decides whether to indict someone after reviewing evidence. Arraignments follow an indictment.<\/p>\n<p>If law enforcement arrests a suspect for a lesser felony or a misdemeanor, the prosecutor will often file a criminal complaint or petition against them. The suspect&#8217;s first court appearance <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arraignment.html\">is an arraignment<\/a>.<\/p>\n<p>Arraignments often occur when a suspect is summoned to court. If the person charged was not released by the magistrate or other authority when they were arrested, they will face the judge either in person or by video from jail. At an arraignment hearing, the judge informs the suspect of the following:<\/p>\n<ul>\n<li>Their formal charges<\/li>\n<li>Their right to counsel<\/li>\n<li>If they cannot afford an attorney, the court will appoint one<\/li>\n<li>The preliminary hearing date<\/li>\n<li>The current status of their bond, if they are being held in jail<\/li>\n<\/ul>\n<p>At the arraignment, the suspect will enter their&nbsp;plea&nbsp;of either&nbsp;guilty or not guilty. If the suspect proves they are&nbsp;indigent&nbsp;the court <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/are-you-entitled-to-a-court-appointed-attorney.html\">will appoint a public defender<\/a>. In some state courts, a plea is not taken at arraignment but&nbsp;at the trial date instead. This allows the defendant time to confer with an attorney to decide whether it is best to plead guilty or not guilty.<\/p>\n<h3>How Does a Grand Jury Work?<\/h3>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-does-a-grand-jury-work.html\">Grand jury<\/a>&nbsp;proceedings are typically reserved for serious crimes, like felonies. The grand jury procedure differs from state to state.<\/p>\n<p>In general, federal grand juries are comprised of between 16 to 23 citizens. Grand jury proceedings are relatively secretive. The prosecutor introduces the law and evidence to the grand jury. The prosecutor may also present witnesses to&nbsp;testify.<\/p>\n<p>The grand jury does not decide guilt or innocence. Instead, they decide whether to indict the defendant. If the grand jury indicts a defendant, the defendant may be charged at an arraignment hearing.<\/p>\n<h3>Arrest, Booking, and Bail<\/h3>\n<p>Police arrest someone when they take them into custody and restrict their freedom to act. Following an arrest, police will <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/booking.html\">book the arrestee<\/a>.<\/p>\n<p>Booking refers to law enforcement&#8217;s process of collecting information from the arrestee. This can include collecting fingerprints and identification. Subsequently, a judge will often set the arrestee&#8217;s&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/posting-bail.html\">bail&nbsp;amount<\/a> at the arraignment. In some cases, arrestees may pay some money to release themselves from custody.<\/p>\n<h3>Searches and Seizures: The Limitations of the Police<\/h3>\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-fourth-amendment.html\">Fourth Amendment<\/a>&nbsp;protects citizens from unreasonable government&nbsp;searches and seizures.
