As\u00a0<a style=\"font-size: inherit\" href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/355\/184.html\" target=\"_blank\" rel=\"noopener\">the U.S. Supreme Court noted<\/a><span style=\"font-size: inherit\">, the &#8220;underlying idea&#8221; of double jeopardy is as follows:<\/span><\/p>\n<p><i>\u201c[T]hat the State with all its resources and power should not be allowed to make repeated attempts to convict an individual for an alleged offense, thereby subjecting him to embarrassment, expense and ordeal and compelling him to live in a continuing state of anxiety and insecurity, as well as enhancing the possibility that even though innocent he may be found guilty.&#8221;<\/i><\/p>\n<p>Additionally, the double jeopardy clause gives due deference to a jury&#8217;s verdict. It also forces prosecutors to bring all <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges.html\">relevant charges<\/a>\u00a0against a defendant. It, thus, requires them to review and prosecute a case competently.<\/p>\n<p>This article describes the basis of double jeopardy protections and why these protections exist in criminal proceedings.<\/p>\n<h2>Double Jeopardy and the Fifth Amendment<\/h2>\n<p>Double jeopardy has a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-concept-of-double-jeopardy-background.html\">long history<\/a>\u00a0in criminal law. It is based on the\u00a0Fifth Amendment\u00a0to the U.S. Constitution.<\/p>\n<p>The\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment<\/a>\u00a0to the\u00a0U.S. Constitution\u00a0guarantees that no\u00a0criminal defendant\u00a0shall &#8220;be twice put in jeopardy of life or limb&#8221; for the same criminal offense. This means the government cannot prosecute a criminal defendant again after a case concludes. A case typically ends in\u00a0acquittal\u00a0or\u00a0conviction. It also prevents the government from imposing multiple punishments for\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/lesser-included-offense.html\" target=\"_blank\" rel=\"noopener\">lesser-included offenses<\/a>.<\/p>\n<p>The Fifth Amendment prohibition against double jeopardy only applies to federal\u00a0criminal cases. The\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment14.html\" target=\"_blank\" rel=\"noopener\">Fourteenth Amendment&#8217;s<\/a>\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation03.html\" target=\"_blank\" rel=\"noopener\">due process clause<\/a>\u00a0applies this protection to state courts. Even if the prosecution does not intentionally intend to wear down the defendant, successive prosecutions would likely\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/355\/184.html\" target=\"_blank\" rel=\"noopener\">have that effect<\/a>.<\/p>\n<p>If not for double jeopardy protections, the government could use its first trial as another\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/fact-finding-and-discovery.html#\">discovery\u00a0period<\/a>. This is a crucial stage in legal proceedings, allowing both sides to learn about each other&#8217;s evidence and arguments. Theoretically, this would allow the government to use the first trial as practice for its next prosecution.<\/p>\n<h3>The Toll of Successive Prosecutions<\/h3>\n<p>Double jeopardy recognizes the strain one\u00a0criminal trial\u00a0may cause and seeks to minimize such damages. It does so by preventing further prosecutions for the same offense.<\/p>\n<p>Even if a jury acquits a defendant of any wrongdoing, both the monetary and emotional toll of the case can be significant. Again, the government has nearly unlimited means to prosecute compared to a defendant. Suppose, further, that prosecutors could begin the same case again. This prosecution would undercut that <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-the-role-of-a-jury-in-a-criminal-case.html\">jury&#8217;s verdict<\/a> entirely. The same can be said for bench trials, where a judge determines guilt.<\/p>\n<p>Another issue arises if the government could bring successive prosecutions after an acquittal. Without double jeopardy, the government could simply keep prosecuting the defendant.
