If they do so, they violate the individual&#8217;s <span data-term-id=\"56188529\">Sixth Amendment<\/span><span data-term-id=\"56188529\"> rights<\/span>.<\/p>\n<h2>Factors the Court Considers<\/h2>\n<p>The <span data-term-id=\"56188521\">Speedy Trial<\/span><span data-term-id=\"56188521\"> Act of 1974<\/span>, along with <span data-term-id=\"56188543\">case law<\/span>, makes it clear that judges lack discretion in determining whether a trial delay is acceptable.
