They can explain how state and constitutional laws apply in your case and walk you through your options.<\/p>\n<h2>Understanding Your <span data-term-id=\"56434925\">Fourth Amendment<\/span><span data-term-id=\"56434925\"> Rights<\/span><\/h2>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment4.html\" target=\"_blank\" rel=\"noopener\"><u><span data-term-id=\"56434917\">Fourth Amendment<\/span><\/u><\/a>\u200b states that:<\/p>\n<p><em>&#8220;<span data-term-id=\"56434961\">The right of the people<\/span> to be secure in their persons, houses, papers, and effects, against <span data-term-id=\"56434921\">unreasonable searches and seizures<\/span>, shall not be violated, and no Warrants shall issue, but upon <span data-term-id=\"56434919\">probable cause<\/span>, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.&#8221;<\/em><\/p>\n<p>Let\u2019s take a look at what that means.<\/p>\n<h3>When <span data-term-id=\"56434932\">Fourth Amendment<\/span><span data-term-id=\"56434932\"> Protections<\/span> Apply<\/h3>\n<p>For the <span data-term-id=\"56434917\">Fourth Amendment<\/span> to protect you, two requirements must be met:<\/p>\n<ul>\n<li><strong>The search must be conducted by government officials<\/strong>: These officials include <span data-term-id=\"56434922\">police officers<\/span>, FBI agents, or state troopers. Private security guards or store employees are not bound by the <span data-term-id=\"56434917\">Fourth Amendment<\/span>, so a mall security guard can search your bag and turn over evidence to police without violating your <span data-term-id=\"56434929\">constitutional rights<\/span>.<\/li>\n<li><strong>You must have a &#8220;<span data-term-id=\"56434928\">reasonable expectation of privacy<\/span>&#8221; in the place or item being searched<\/strong>: This is a key concept that determines whether the <span data-term-id=\"56434917\">Fourth Amendment<\/span> applies to a particular situation. If something illegal is left in plain sight, you\u2019re giving up an expectation of privacy.<\/li>\n<\/ul>\n<p>Under the <span data-term-id=\"56434917\">Fourth Amendment<\/span>, police must have at least one of the following to conduct a legal search:<\/p>\n<ul>\n<li>A valid <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\"><u><span data-term-id=\"56434933\">search warrant<\/span><\/u><\/a>\u200b<\/li>\n<li>A <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arrest.html\"><u>valid arrest<\/u><\/a>\u200b warrant<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/criminal\/crimes\/criminal_rights\/probable-cause.html\"><u><span data-term-id=\"56434919\">Probable cause<\/span><\/u><\/a>\u200b to believe you&#8217;ve committed a crime<\/li>\n<li>Your voluntary consent<\/li>\n<\/ul>\n<p>The <span data-term-id=\"56434918\">Supreme Court<\/span> has ruled that some circumstances permit the government to perform <span data-term-id=\"56434926\">warrantless searches<\/span>.<\/p>\n<h3>Where You Have a <span data-term-id=\"56434928\">Reasonable Expectation of Privacy<\/span><\/h3>\n<p>Whether you have a <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-is-the-reasonable-expectation-of-privacy.html\"><u><span data-term-id=\"56434928\">reasonable expectation of privacy<\/span><\/u><\/a>\u200b depends on the specific circumstances and location. Courts consider factors like whether you took steps to keep something private and whether society recognizes that privacy interest as reasonable.<\/p>\n<p>You have an expectation of privacy in these situations:<\/p>\n<ul>\n<li><strong>Your home<\/strong>: Your strongest expectation of privacy is inside your own home. The property around your home, called the &#8220;curtilage,&#8221; may be private to the extent it cannot be seen from the street. Open territory is usually not private, even if you have &#8220;No Trespassing&#8221; signs posted.<\/li>\n<li><strong>Personal property<\/strong>: Bags, purses, briefcases, and backpacks are considered private, even in public places. Police must have permission to search these containers, unless they are open when found. If you have left any item in a public area, it may be considered &#8220;abandoned&#8221; and opened by\u00a0<span data-term-id=\"56434920\">law enforcement<\/span>\u00a0if it poses a hazard.<\/li>\n<li><strong><span data-term-id=\"56434965\">Cell phones<\/span> and laptops<\/strong>: In general, <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/cell-phone-privacy-and-warrant-requirements.html\"><u>your devices are private<\/u><\/a>. You do not have to provide access to them without a warrant or court order. However, you do have to provide access when crossing a U.S. border or entering Customs.<\/li>\n<li><strong>Automobiles<\/strong>: Courts recognize a reduced expectation of privacy in vehicles due to their mobile nature and extensive regulation. <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/can-the-police-legitimately-search-my-vehicle-without-a-warrant.html\"><u>Police may search a car without a warrant<\/u><\/a> if they have <span data-term-id=\"56434919\">probable cause<\/span> to believe it contains evidence of a crime (the &#8220;automobile exception&#8221;). However, police still generally need <span data-term-id=\"56434930\">reasonable suspicion<\/span> to initiate a <span data-term-id=\"56434927\">traffic stop<\/span>.<\/li>\n<\/ul>\n<p>This is not an exhaustive list, and the details of each situation may affect the legality of a search.<\/p>\n<h3>When Does the <span data-term-id=\"56434917\">Fourth Amendment<\/span> NOT Apply?<\/h3>\n<p>The <span data-term-id=\"56434917\">Fourth Amendment<\/span> does not cover you in any situation where you do not have a <span data-term-id=\"56434928\">reasonable expectation of privacy<\/span>. If you or your belongings are in public and what you are doing can be seen by anyone, including the police, then they don&#8217;t need a warrant to arrest you. Below are a few examples:<\/p>\n<ul>\n<li><strong>Public places<\/strong>: You generally have little to no expectation of privacy in what you knowingly expose to public view. This includes your own yard if it is visible from the street. The <span data-term-id=\"56434936\">U.S. <\/span><span data-term-id=\"56434918\">Supreme Court<\/span> has held that unless you have taken steps to conceal your actions, they are considered public.<\/li>\n<li><strong>Your mail<\/strong>: Police can examine the outside of mail without a warrant, but sealed first-class mail requires one before they can open it. Private carriers like FedEx and UPS may open packages and report contents to <span data-term-id=\"56434920\">law enforcement<\/span>.<\/li>\n<li><strong>Your garbage<\/strong>: Once you place trash at the curb for collection, courts consider it &#8220;abandoned property&#8221; with no <span data-term-id=\"56434928\">reasonable expectation of privacy<\/span>. This allows <span data-term-id=\"56434926\">warrantless searches<\/span> involving the garbage.<\/li>\n<li><strong>Your social media accounts<\/strong>: Recent <span data-term-id=\"56434924\">court cases<\/span> have held that anything posted on social media is in the public eye. Many criminals have discovered that police monitor Facebook and Instagram and can use posts as evidence for warrants and prosecution.<\/li>\n<\/ul>\n<p>Keep your privacy in mind whenever possible.<\/p>\n<h2>Common <span data-term-id=\"56434917\">Fourth Amendment<\/span> Violations<\/h2>\n<p><span data-term-id=\"56434917\">Fourth Amendment<\/span> violations occur when <span data-term-id=\"56434920\">law enforcement<\/span> exceeds its constitutional authority during searches, seizures, or arrests. While there are several exceptions to the <span data-term-id=\"56434962\">warrant requirement<\/span>, each has specific limitations. When officers exceed those boundaries, they violate your <span data-term-id=\"56434929\">constitutional rights<\/span>. Below are some of the most common types of <span data-term-id=\"56434917\">Fourth Amendment<\/span> violations.<\/p>\n<h3>Unlawful Arrest<\/h3>\n<p>An unlawful arrest is a broad category that encompasses invalid warrants, insufficient <span data-term-id=\"56434919\">probable cause<\/span>, and police misconduct. A <span data-term-id=\"56434955\">police search<\/span> conducted after an unlawful arrest is also a <span data-term-id=\"56434917\">Fourth Amendment<\/span> violation. Any evidence discovered is considered &#8220;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\"><u>fruit of the poisonous tree<\/u><\/a>\u200b&#8221; and can be inadmissible in court.<\/p>\n<h3><span data-term-id=\"56434926\">Warrantless Searches<\/span><\/h3>\n<p>A number of <span data-term-id=\"56434937\">Supreme <\/span><span data-term-id=\"56434924\">Court<\/span><span data-term-id=\"56434937\"> cases<\/span> have provided<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\"><u> <\/u><u>exceptions to the <span data-term-id=\"56434917\">Fourth Amendment<\/span> <span data-term-id=\"56434962\">warrant requirement<\/span><\/u><\/a><strong>\u200b<\/strong>. These <span data-term-id=\"56434926\">warrantless searches<\/span> all require <span data-term-id=\"56434919\">probable cause<\/span> for an officer to conduct a search. The <span data-term-id=\"56434924\">court cases<\/span> limit the circumstances under which a\u00a0<span data-term-id=\"56434926\">warrantless search<\/span> is permitted. If an officer exceeds those conditions, the search becomes a violation. These can include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"56434944\">Stop and frisk<\/span><\/strong> <strong>(Terry stops)<\/strong>: An officer must reasonably believe, based on articulable facts coupled with the <span data-term-id=\"56434963\">totality of the circumstances<\/span>, that a crime is occurring or about to occur. The officer may only perform a surface pat-down of the subject&#8217;s clothing to search for weapons. Any further search is a violation.<\/li>\n<li><strong>Automobile exception<\/strong>: Police may conduct <span data-term-id=\"56434927\">traffic stops<\/span> when a driver has broken any traffic law. They may perform a visual search of the vehicle under the &#8220;plain view&#8221; doctrine. Courts have held that because a vehicle is mobile and evidence can be driven away and removed, or destroyed, cars can be searched if police have a reasonable belief that contraband or weapons may be within.<\/li>\n<\/ul>\n<p>These searches can be legal, but without <span data-term-id=\"56434919\">probable cause<\/span>, they are unreasonable <span data-term-id=\"56434934\">violations of the <\/span><span data-term-id=\"56434917\">Fourth Amendment<\/span>.<\/p>\n<h3>Pretext Stops<\/h3>\n<p>A &#8220;pretext stop&#8221; is usually a <span data-term-id=\"56434927\">traffic stop<\/span>, although it can be a street stop. These stops are conducted without\u00a0<span data-term-id=\"56434919\">probable cause<\/span>\u00a0to allow officers to perform a visual search of the car and driver for criminal violations. Pretext stops are not inherently <span data-term-id=\"56434917\">Fourth Amendment<\/span> violations, but they can lead to further violations.<\/p>\n<p>For example, let&#8217;s say an officer makes a pretext stop that ends with the officer returning the driver&#8217;s license and registration, telling them they can leave, and then saying, &#8220;You wouldn&#8217;t mind if we searched your car, would you?&#8221; This is coerced consent. Once the encounter is over and the driver is free to leave, the only way police may search is with consent. Failing to advise the driver they can leave, or implying such refusal is &#8220;obstructing,&#8221; is a type of coercive behavior that violates the driver&#8217;s civil rights.<\/p>\n<h3>Invalid Warrants<\/h3>\n<p>A <span data-term-id=\"56434941\">valid warrant<\/span> has three elements: the location of the search, a description of the thing the police are looking for, and a judge&#8217;s signature affirming that the warrant is based on a sworn affidavit. Without these elements, the warrant is not valid. The warrant must specify an exact location and describe what the officers may look for.<\/p>\n<p>For example, a <span data-term-id=\"56434941\">valid warrant<\/span> might say &#8220;the office at 123 Main Street, Suite A, for a file containing evidence of tax fraud,&#8221; which allows a search of that office for anything that could contain the file. An overbroad warrant saying &#8220;123 Main Street for any files&#8221; would allow police to seize files from every office in the building. Overbroad warrants are similar to &#8220;general warrants,&#8221; which the Constitution prohibits.<\/p>\n<p>A warrant may be invalid if the affidavit contained errors or omissions, if the officer who swore it out lied or used an unreliable informant, or if the judge &#8220;rubber-stamped&#8221; the warrant and did not review it for facts. The &#8220;good faith&#8221; exception may protect the officer executing the warrant if they could not reasonably have known the warrant was defective.<\/p>\n<h3>Exceeding the Scope of the Warrant<\/h3>\n<p>Once police enter a home to execute a search or arrest warrant, they are limited in what they may do. They may search for the listed items, arrest the individual, and conduct a protective sweep for hidden accomplices or weapons. Officers may exceed the warrant&#8217;s scope only in <span data-term-id=\"56434939\">exigent circumstances<\/span>. This means they must believe there is an emergency situation that justifies going beyond the warrant.<\/p>\n<p>Police may make a <span data-term-id=\"56434966\">warrantless entry<\/span> into a home under the same conditions. If they believe a suspect will destroy evidence, flee, or that another person could be harmed, they can enter a home without a warrant to prevent further harm.<\/p>\n<h2>Searches That May Not Violate the <span data-term-id=\"56434917\">Fourth Amendment<\/span><\/h2>\n<p>There are some types of <span data-term-id=\"56434926\">warrantless searches<\/span> that seem highly intrusive but do not necessarily violate your legal rights. Examples include:<\/p>\n<ul>\n<li><strong>Border searches<\/strong>: Anyone entering or leaving the United States has no reasonable right of privacy. Recent <span data-term-id=\"56434940\">court decisions<\/span> have upheld border agents&#8217; right to search almost everything, including social media sites. Your rights entering or leaving a foreign nation depend on the laws of that nation, not the United States.<\/li>\n<li><strong>Administrative searches<\/strong>: Code inspections, OSHA inspections, and similar regulatory searches are not &#8220;searches&#8221; under the <span data-term-id=\"56434917\">Fourth Amendment<\/span> and do not implicate your personal privacy. The inspectors are authorized to conduct their search.<\/li>\n<li><strong>Sobriety checkpoints:<\/strong> The <span data-term-id=\"56434918\">Supreme Court<\/span> held that the general public&#8217;s right to safe roads outweighs a driver&#8217;s right to drive drunk. <a href=\"https:\/\/www.findlaw.com\/dui\/arrests\/dui-checkpoints.html\"><u>DUI checkpoints<\/u><\/a>\u200b must follow strict guidelines and may not be used for any purpose other than locating drunk drivers.<\/li>\n<li><strong>School searches<\/strong>: <span data-term-id=\"56434951\">Public <\/span><span data-term-id=\"56434935\">school<\/span><span data-term-id=\"56434935\"> officials<\/span> can search students and their belongings under a &#8220;<span data-term-id=\"56434930\">reasonable suspicion<\/span>&#8221; standard, which is lower than the <span data-term-id=\"56434919\">probable cause<\/span> required for police. Students still retain some privacy rights.<\/li>\n<\/ul>\n<p>This is not an exhaustive list.<\/p>\n<h2>Legal Remedies for <span data-term-id=\"56434917\">Fourth Amendment<\/span> Violations<\/h2>\n<p>When someone is arrested on a faulty warrant or for another\u00a0<span data-term-id=\"56434917\">Fourth Amendment<\/span>\u00a0violation, they may need\u00a0an attorney. Not all civil rights violations result in a case being dismissed. It is possible to be arrested on an invalid warrant and still be convicted at trial. <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">An attorney<\/a> can work to minimize the damage and possibly have the case dismissed, but the defendant must move quickly. The following are some of the approaches they may employ in your defense:<\/p>\n<h3>Motion to Suppress Evidence<\/h3>\n<p>The first step is filing a Motion to Suppress Evidence. Although the specifics vary by state, the<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-and-the-exclusionary-rule.html\"> <u><span data-term-id=\"56434931\">exclusionary rule<\/span><\/u><\/a>\u200b prohibits the use of any evidence obtained unlawfully or in\u00a0<span data-term-id=\"56434934\">violation of the <\/span><span data-term-id=\"56434917\">Fourth Amendment<\/span>\u00a0at trial. A Motion to Suppress may be based on:<\/p>\n<ul>\n<li><span data-term-id=\"56434948\">Unlawful search<\/span> and seizure<\/li>\n<li>Lack of<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-rights-and-the-fifth-amendment.html\"><u> <\/u><em><u>Miranda <\/u><\/em><u>warnings<\/u><\/a>\u200b<\/li>\n<li>Coerced or forced confessions<\/li>\n<li>Chain of custody problems with the evidence<\/li>\n<li>Invalid warrants<\/li>\n<\/ul>\n<p>The Motion to Suppress is critical because if the prosecution lacks sufficient evidence to support its case, the case may be dismissed or the charges reduced.<\/p>\n<h3>Motion to Dismiss<\/h3>\n<p>A defense attorney files a Motion to Dismiss if they believe the prosecutor lacks sufficient evidence to make their case. A Motion to Dismiss may be filed together with the Motion to Suppress, or it may come later in the pretrial proceedings. Your attorney may also request a dismissal or reduction of charges as part of a plea bargaining negotiation, especially if it appears that the prosecutor is willing to deal and their case is weak.<\/p>\n<h3>Habeas Corpus Petitions<\/h3>\n<p>Latin for &#8220;produce the body,&#8221; a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/writ-of-habeas-corpus.html\"><u>writ of habeas corpus<\/u><\/a>\u200b requires the government to release someone who has been imprisoned in violation of their civil rights. A writ of habeas corpus is often filed in immigration cases and other instances when an individual is held by the federal government for an unreasonable length of time.
