As the name describes, a <span data-term-id=\"55879871\">no-knock<\/span> warrant allows police to bypass announcing their presence and simply make a forcible entry into the residence or location.<\/p>\n<p>To obtain these warrants, police must show a judge that announcing their presence could:<\/p>\n<ul>\n<li>Endanger the officers<\/li>\n<li>Lead to the <span data-term-id=\"55879866\">destruction of evidence<\/span><\/li>\n<li>Result in the escape of suspects<\/li>\n<li>Place neighbors or other citizens at risk<\/li>\n<\/ul>\n<p><span data-term-id=\"55879871\">No-knock<\/span> warrants are only issued when police can demonstrate a <span data-term-id=\"55879874\">reasonable suspicion<\/span> that either the suspect may be heavily armed and likely to shoot back, there is a great risk of <span data-term-id=\"55879866\">destruction of evidence<\/span> if they know the police are coming, or both. Some states have banned <span data-term-id=\"55879871\">no-knock<\/span> warrants because of the risk to police and residents alike.<\/p>\n<h2>What Can Police Search During a <span data-term-id=\"55879872\">Warrant Execution<\/span>?<\/h2>\n<p><a href=\"https:\/\/constitution.findlaw.com\/amendment4.html\" target=\"_blank\" rel=\"noopener\">The <span data-term-id=\"55879873\">Fourth Amendment<\/span> of the Constitution<\/a> states that a <span data-term-id=\"55879851\">search warrant<\/span> must \u201cparticularly describ[e] the place to be searched, and the persons or things to be seized.\u201d Case law has recognized exceptions to what police may do during a search for\u00a0<span data-term-id=\"55879882\">public safety<\/span>\u00a0and officer safety.<\/p>\n<h3>Limitations Based on the Warrant<\/h3>\n<p>The search cannot go outside the scope of the warrant itself. Police may only search in places and for things described in the warrant. A warrant may not say, \u201cgo to 123 Main Street and search everything for <span data-term-id=\"55879879\">criminal activity<\/span>.\u201d It must describe what the officers can look for and where they may look.<\/p>\n<p>For instance, if the warrant is for illegal narcotics, police may look in places illegal narcotics are likely to be found. Criminals have stashed illegal drugs in a wide range of places, so a warrant will permit police to search almost everywhere. On the other hand, a warrant for a stolen car limits the search to places where a car could reasonably be hidden.<\/p>\n<p>Warrants may limit the search to particular locations. If the warrant states \u201c123 Main Street\u201d but does not include any sheds or outbuildings, then police may not search there. In some cases, police may not be permitted to open locked doors or safes on the property. If the warrant authorizes police to search \u201call property belonging to John Smith at 123 Main Street,\u201d and John\u2019s tenant has locked their room, police need a separate warrant to enter and search that room.<\/p>\n<h3>When Officers Can Expand the Search<\/h3>\n<p>Before executing the\u00a0<span data-term-id=\"55879851\">search warrant<\/span>, police can conduct a protective sweep of the premises. During the sweep, they may look for other people on the property or weapons in plain sight. This sweep is not a search, but to ensure the property is clear before the search begins.<\/p>\n<p>Officers can expand the search zone under certain circumstances. These include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"55879877\">Reasonable belief<\/span> that other individuals are concealed on the property<\/strong>: Police may look in places where someone might be concealed, such as closets or under beds, to find these individuals<\/li>\n<li><strong>Weapons or <span data-term-id=\"55879876\">contraband<\/span> within plain view<\/strong>: If police reasonably suspect that the subject has other weapons within reach, they may search the nearby area for additional weapons out of concern for their own safety (sometimes called an \u201carm\u2019s length\u201d or \u201cwingspan\u201d search)<\/li>\n<li><strong>The possibility that evidence could be destroyed or removed before a warrant can be issued<\/strong>: If\u00a0<span data-term-id=\"55879876\">contraband<\/span>\u00a0is seen during the protective sweep, it may be collected without a warrant if it is likely to be gone by the time a second warrant can be issued<\/li>\n<\/ul>\n<p>Other exceptions may apply.<\/p>\n<h2>What Happens When Police Violate <span data-term-id=\"55879851\">Search Warrant<\/span> Rules?<\/h2>\n<p>When police violate the terms of the <span data-term-id=\"55879851\">search warrant<\/span>, it\u2019s a good time to consult with a <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">criminal defense attorney<\/a>. At his trial, Weeks argued that this violated his <span data-term-id=\"55879873\">Fourth Amendment<\/span> right to be secure in his \u201cpapers and effects.\u201d The government claimed that if evidence was otherwise admissible, it should not matter how it was obtained. The <span data-term-id=\"55879854\">Supreme Court<\/span> rejected the government\u2019s argument, creating the \u201cexclusionary rule.\u201d<\/p>\n<p>The exclusionary rule was expanded to the states through the 14th Amendment in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/367\/643.html\" target=\"_blank\" rel=\"noopener\"><em>Mapp v. <span data-term-id=\"55879863\">Ohio<\/span><\/em><\/a>. Mapp was arrested on an obscenity charge after police entered her home without a warrant, looking for a suspect in a recent bombing. The <span data-term-id=\"55879854\">Supreme Court<\/span> ruling made it clear that the exclusionary rule is meant to curb police misconduct and prevent arbitrary searches of property.<\/p>\n<h3>Fruit of the Poisonous Tree<\/h3>\n<p>The \u201cfruit of the poisonous tree\u201d doctrine is a serious legal principle that accompanies the exclusionary rule. This rule was established by the\u00a0<span data-term-id=\"55879854\">Supreme Court<\/span>\u00a0in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/371\/471.html\" target=\"_blank\" rel=\"noopener\"><em>Wong Sun v. U.S.<\/em><\/a><\/p>\n<p>Wong Sun was arrested and convicted on drug charges, following an illegal arrest of a confederate. The other individual made incriminating statements against Wong Sun, and evidence was found based on those statements.<\/p>\n<p>The Court held that since the initial arrest was unlawful, everything that flowed from that arrest, including the statements, the <span data-term-id=\"55879876\">contraband<\/span>, and Wong Sun\u2019s arrest and subsequent statements, was also unlawful and could not be admitted into trial.<\/p>\n<p>The \u201cfruit of the poisonous tree\u201d doctrine means that whenever a <span data-term-id=\"55879857\">police officer<\/span> violates the terms of a <span data-term-id=\"55879851\">search warrant<\/span>, any evidence obtained from that warrant becomes suspect. The effects of the doctrine can be felt far downstream of any unlawful search.<\/p>\n<h2>Challenging an Illegal Search<\/h2>\n<p><span data-term-id=\"55879855\">Criminal procedure<\/span> is a complex mix of case law and legal doctrine.
