These include searches incident to <span data-term-id=\"55882296\">lawful arrest<\/span>, the <span data-term-id=\"55882300\">automobile exception<\/span> during traffic stops, consent searches, <span data-term-id=\"55882269\">exigent circumstances<\/span>, certain roadside checkpoints, Terry stops for suspected <span data-term-id=\"55882275\">criminal activity<\/span>, and good faith reliance on defective warrants.<\/p>\n\n    <\/div>\n\n\n\n<p>Police generally need a warrant to search your property, but the <span data-term-id=\"55882263\">Fourth Amendment<\/span> allows numerous exceptions. Understanding when police can conduct <span data-term-id=\"55882272\">warrantless searches<\/span>, and why courts consider them reasonable, is crucial for protecting your rights. The <span data-term-id=\"55882263\">Fourth Amendment<\/span> protects citizens against <span data-term-id=\"55882267\">unreasonable searches and seizures<\/span> by the government.<\/p>\n<p>Courts have established several circumstances in which <span data-term-id=\"55882272\">warrantless searches<\/span> are constitutional. These exceptions balance <span data-term-id=\"55882268\">law enforcement<\/span> needs with individual privacy rights. Some allow searches with consent. Others address emergencies or recognize the practical realities of policing.<\/p>\n<p>This article explains the major exceptions to the <span data-term-id=\"55882279\">warrant requirement<\/span>, including when police can search during arrests, traffic stops, and emergencies. For information on <span data-term-id=\"55882279\">warrant requirements<\/span> and how police obtain warrants, see our article on <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\"><span data-term-id=\"55882265\">search w<\/span><span data-term-id=\"55882279\">arrant<\/span><span data-term-id=\"55882279\"> requirements<\/span><\/a>.<\/p>\n<h2>The <span data-term-id=\"55882279\">Warrant Requirement<\/span><\/h2>\n<p>In most instances, the <span data-term-id=\"55882263\">Fourth Amendment<\/span> requires government officials to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\">obtain an arrest warrant or <span data-term-id=\"55882265\">search warrant<\/span><\/a> to execute a valid search and seizure. A <span data-term-id=\"55882266\">police officer<\/span> must fill out an\u00a0affidavit\u00a0and present it to a neutral judge or\u00a0magistrate\u00a0to obtain a warrant.<\/p>\n<p>The officer must make a showing of\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\"><span data-term-id=\"55882262\">probable cause<\/span><\/a>\u00a0and explain why they believe the search will yield evidence of <span data-term-id=\"55882275\">criminal activity<\/span>. The judge or magistrate will then decide whether to issue the warrant.<\/p>\n<p>Many searches performed without first obtaining a warrant are unconstitutional. If <span data-term-id=\"55882268\">law enforcement<\/span> obtains evidence illegally, the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-fourth-amendment-and-the-exclusionary-rule.html\"><span data-term-id=\"55882298\">exclusionary rule<\/span><\/a>\u00a0applies. This rule prevents the prosecution from using illegally obtained evidence in a\u00a0criminal trial, but there are some exceptions to the <span data-term-id=\"55882279\">warrant requirement<\/span>.<\/p>\n<h2>What Is a <span data-term-id=\"55882272\">Warrantless Search<\/span>?<\/h2>\n<p>Any governmental search of a person or property without a warrant is a\u00a0<span data-term-id=\"55882272\">warrantless search<\/span>. As already mentioned, the <span data-term-id=\"55882263\">Fourth Amendment<\/span> <a href=\"https:\/\/constitution.findlaw.com\/amendment4\/annotation06.html\" target=\"_blank\" rel=\"noopener\">protects against <span data-term-id=\"55882272\">warrantless searches<\/span><\/a>. There are exceptions to the <span data-term-id=\"55882279\">warrant requirement<\/span> to be aware of.<\/p>\n<p>The warrant exceptions strike a balance among:<\/p>\n<ul>\n<li>The government\u2019s interests<\/li>\n<li>The practical realities of daily police work<\/li>\n<li>The right of the people to privacy and freedom<\/li>\n<\/ul>\n<p>If the law always required <span data-term-id=\"55882266\">police officers<\/span> to complete a warrant application before they could search or <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-and-seizure-law.html\">seize a suspect or evidence<\/a>, it would require them to appear before a judge and wait for the judge&#8217;s decision on the warrant. A possible result could be the <span data-term-id=\"55882284\">destruction of evidence<\/span> or suspects disappearing.<\/p>\n<p>The circumstances under which the law deems a <span data-term-id=\"55882272\">warrantless search<\/span>, seizure, or arrest reasonable generally fall within the following seven categories:<\/p>\n<ul>\n<li>For a felony arrest in a public place<\/li>\n<li>When directly related to a <span data-term-id=\"55882296\">lawful arrest<\/span><\/li>\n<li>During a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/can-the-police-legitimately-search-my-vehicle-without-a-warrant.html\">traffic stop<\/a> for <span data-term-id=\"55882273\">reasonable suspicion<\/span><\/li>\n<li>With someone suspected of ongoing <span data-term-id=\"55882275\">criminal activity<\/span><\/li>\n<li>Under so-called <span data-term-id=\"55882269\">exigent circumstances<\/span><\/li>\n<li>At certain <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/traffic-stops-and-roadblocks.html\">roadside checkpoints<\/a><\/li>\n<li>When made in good faith under a warrant later ruled invalid<\/li>\n<\/ul>\n<p>Some of these categories can overlap. Let\u2019s take a closer look at each one.<\/p>\n<h3>Felony Arrest in a Public Place<\/h3>\n<p><span data-term-id=\"55882268\">Law enforcement<\/span> does not need a warrant to arrest a suspect for a felony in a public place. If the officer has <span data-term-id=\"55882262\">probable cause<\/span> that the suspect committed a crime, the officer may make a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-is-an-arrest-a-legal-arrest.html\">valid arrest<\/a>.<\/p>\n<p>Felony arrests in places not open to the public often require a warrant. A <span data-term-id=\"55882266\">police officer<\/span> cannot enter a suspect\u2019s home and arrest them without a warrant. If the officer is in\u00a0<span data-term-id=\"55882283\">hot pursuit<\/span>\u00a0of a fleeing\u00a0felon, they may\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/387\/294.html\" target=\"_blank\" rel=\"noopener\">enter a residence<\/a>\u00a0without a warrant. The <span data-term-id=\"55882263\">Fourth Amendment<\/span> also allows warrantless arrests for\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-distinguishes-a-misdemeanor-from-a-felony.html\">misdemeanors\u00a0<\/a>committed in an officer\u2019s presence.<\/p>\n<h3>Searches Directly Related to a <span data-term-id=\"55882296\">Lawful Arrest<\/span><\/h3>\n<p>Police do not require a warrant for searches incident\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/searches-and-seizures-the-limitations-of-the-police.html#SearchIncidentToArrest\">to a <span data-term-id=\"55882296\">lawful arrest<\/span><\/a>. If a <span data-term-id=\"55882266\">police officer<\/span> makes a <span data-term-id=\"55882296\">lawful arrest<\/span>, the <span data-term-id=\"55882263\">Fourth Amendment<\/span> permits them to search the following:<\/p>\n<ul>\n<li>The suspect\u2019s person<\/li>\n<li>The suspect\u2019s clothing<\/li>\n<li>All areas within the suspect\u2019s immediate reach<\/li>\n<\/ul>\n<p>A <span data-term-id=\"55882277\">search incident to arrest<\/span> allows <span data-term-id=\"55882266\">police officers<\/span> to protect themselves from suspects who may be armed with a hidden weapon. Officers may only seize items from the area in the arrestee\u2019s immediate control.<\/p>\n<h3>Traffic Stops for <span data-term-id=\"55882273\">Reasonable Suspicion<\/span><\/h3>\n<p>An officer may <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/getting-pulled-over.html\">stop a motor vehicle<\/a> if they have a <span data-term-id=\"55882281\">reasonable belief<\/span> that the motorist has violated a law. The \u201c<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/can-the-police-legitimately-search-my-vehicle-without-a-warrant.html\"><span data-term-id=\"55882300\">automobile exception<\/span><\/a>\u201d permits the officer to search the vehicle\u2019s interior so long as they have <span data-term-id=\"55882262\">probable cause<\/span>. Such a search may include the vehicle\u2019s glove compartment. <span data-term-id=\"55882297\">Law enforcement<\/span><span data-term-id=\"55882297\"> officers<\/span> typically <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/when-can-the-police-search-your-car-.html\">cannot search the vehicle\u2019s trunk<\/a> unless they have <span data-term-id=\"55882262\">probable cause<\/span> to believe it contains <span data-term-id=\"55882282\">contraband<\/span> or evidence of <span data-term-id=\"55882275\">criminal activity<\/span>.<\/p>\n<p>Once <span data-term-id=\"55882268\">law enforcement<\/span>\u00a0<a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/when-can-police-impound-your-car\/\">impounds a vehicle<\/a>, they may inventory its contents without a warrant. This includes the trunk\u2019s contents. Police may also seize <span data-term-id=\"55882282\">contraband<\/span> that is in\u00a0<span data-term-id=\"55882264\">plain view<\/span>. <span data-term-id=\"55882264\">Plain view<\/span> means that the officer easily observes incriminating evidence under the following circumstances:<\/p>\n<ul>\n<li>The officer must be lawfully present at the location where they have a view of the item<\/li>\n<li>The incriminating nature of the item must be immediately apparent<\/li>\n<li>The officer must have a lawful right of access to the item<\/li>\n<\/ul>\n<p>The <span data-term-id=\"55882266\">police officer<\/span> must be acting in accordance with proper procedure. For example, if they notice an open duffel bag displaying what appears to be illegal drugs in the back seat of the vehicle they pulled over, they can seize the bag.<\/p>\n<h3>Suspicion of Ongoing <span data-term-id=\"55882275\">Criminal Activity<\/span><\/h3>\n<p>An officer who reasonably believes <span data-term-id=\"55882275\">criminal activity<\/span> is afoot in a public place is authorized to stop any person they suspect of participating in it. The police may conduct a carefully\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/what-is-stop-and-frisk-.html\">limited search of the suspect\u2019s outer clothing<\/a>\u00a0for weapons that may be used against the officer.<\/p>\n<p>Such a stop is also known as a stop-and-frisk or a Terry stop, after the <span data-term-id=\"55882293\">U.S. <\/span><span data-term-id=\"55882271\">Supreme Court<\/span> case\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/392\/1.html\" target=\"_blank\" rel=\"noopener\"><em>Terry v. Ohio<\/em><\/a>\u00a0(1968). A Terry stop is designed to protect officers from hidden weapons. Accordingly, <span data-term-id=\"55882268\">law enforcement<\/span> can only seize weapons during such a search. They cannot legally seize anything else, even if it turns out to be <span data-term-id=\"55882282\">contraband<\/span>.<\/p>\n<p>An exception is if they seize a container large enough to hold a weapon. If a\u00a0<span data-term-id=\"55882266\">police officer<\/span>\u00a0opens the container and, instead of a weapon, finds\u00a0<span data-term-id=\"55882282\">contraband<\/span>, they may seize\u00a0it and charge the individual.<\/p>\n<p>The officer may also\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/faqs-police-interrogations.html\">ask for identification<\/a>\u00a0during a stop-and-frisk. The suspect does not have to produce it, but a suspect\u2019s refusal, together with surrounding events, may create\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/ca-court-of-appeal\/1842401.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55882262\">probable cause<\/span> to arrest<\/a>.<\/p>\n<h3><span data-term-id=\"55882269\">Exigent Circumstances<\/span><\/h3>\n<p><span data-term-id=\"55882272\">Warrantless searches<\/span>, seizures, and arrests may be justified by\u00a0<span data-term-id=\"55882269\">exigent circumstances<\/span>. To determine whether police conduct was justified, a court reviews the totality of the circumstances. For example, it may include an analysis of the underlying offense and whether the suspect was fleeing or trying to escape. The surrounding circumstances must be tantamount to an emergency.<\/p>\n<p>For example, courts have considered the following circumstances as exigent:<\/p>\n<ul>\n<li>Gunshots<\/li>\n<li>Screaming<\/li>\n<li>Fire emanating from inside a building<\/li>\n<\/ul>\n<p>In such situations, <span data-term-id=\"55882266\">police officers<\/span> may dispense with the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-the-fourth-amendment-applies.html\"><span data-term-id=\"55882263\">Fourth Amendment<\/span>\u2019s <span data-term-id=\"55882279\">warrant requirement<\/span><\/a>.<\/p>\n<h3>Certain Roadside Checkpoints<\/h3>\n<p>The <span data-term-id=\"55882293\">U.S. <\/span><span data-term-id=\"55882271\">Supreme Court<\/span> has upheld brief, warrantless seizures at certain fixed roadside checkpoints. These include searches aimed at intercepting\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/496\/444.html\" target=\"_blank\" rel=\"noopener\">drunk drivers<\/a>\u00a0and\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/428\/543.html\" target=\"_blank\" rel=\"noopener\">illegal border crossings<\/a>.<\/p>\n<p><span data-term-id=\"55882268\">Law enforcement<\/span> must tailor <a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-stops\/can-the-police-set-up-roadblocks-for-any-reason-.html\">roadside checkpoints<\/a> to remedy specific problems. The problems must be ones that they cannot effectively address through more traditional means. For example, problems with policing the nation\u2019s borders and ensuring roadway safety are valid reasons for using checkpoints. When a checkpoint\u2019s primary purpose is to detect ordinary <span data-term-id=\"55882275\">criminal activity<\/span>, the\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/531\/32.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"55882271\">Supreme Court<\/span> has declared<\/a>\u00a0that it violates the <span data-term-id=\"55882263\">Fourth Amendment<\/span>.<\/p>\n<h3>Reasonable Searches and Good Faith<\/h3>\n<p>Government searches, seizures, and arrests made pursuant to a defective warrant may be justified if the officer was proceeding in <a href=\"https:\/\/dictionary.findlaw.com\/definition\/good-faith.html\" target=\"_blank\" rel=\"noopener\">good faith<\/a>.<\/p>\n<p>The <span data-term-id=\"55882271\">Supreme Court<\/span> said in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/468\/897.html\" target=\"_blank\" rel=\"noopener\"><em>United States v. Leon<\/em>\u00a0(1984)<\/a>\u00a0that <span data-term-id=\"55882268\">law enforcement<\/span>\u2019s search pursuant to a warrant that a court later declares invalid (i.e., it fails to meet the requirements for a valid warrant) is still considered reasonable if both of the following elements are met:<\/p>\n<ul>\n<li>A neutral judge or magistrate issued the warrant<\/li>\n<li>The police did not willfully deceive the judge or magistrate<\/li>\n<\/ul>\n<p>This exception to the <span data-term-id=\"55882279\">warrant requirement<\/span> was created to protect honest <span data-term-id=\"55882266\">police officers<\/span> who did nothing wrong while acting on a warrant that was ostensibly valid.<\/p>\n<h2>Protect Your <span data-term-id=\"55882263\">Fourth Amendment<\/span> Rights With Legal Counsel<\/h2>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-fourth-amendment.html\"><span data-term-id=\"55882263\">Fourth Amendment<\/span> <\/a><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-fourth-amendment.html\">provides significant protections<\/a>\u00a0against\u00a0<span data-term-id=\"55882268\">law enforcement<\/span> abuse.
