Arizona changed the way police departments across the country behave. From New York to Los Angeles, police officers suddenly had to change the procedure by which they interrogate suspects in custody.&nbsp;This landmark ruling continues to protect the rights of criminal suspects today.<\/p>\n\n    <\/div>\n\n\n\n<p>In 1966, in\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/384\/436.html\" target=\"_blank\" rel=\"noopener\"><i>Miranda v. Arizona<\/i><\/a>, the United States Supreme Court issued a ruling that ushered in a period of safeguards and court-imposed restraints on law enforcement&#8217;s ability to interrogate criminal suspects it takes into custody.<\/p>\n<p>This criminal law case involved a young man, Ernesto Miranda, whom police were investigating for a suspected <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/rape.html\">rape<\/a> and <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/kidnapping.html\">kidnapping<\/a>. He confessed after law enforcement interrogated him for more than two hours. The lower courts convicted Ernesto. The U.S. Supreme Court reversed the decision, ruling that law enforcement should have informed the defendant of his rights when they took him into police custody.<\/p>\n<p>\u00a0The\u00a0<i>Miranda\u00a0<\/i>decision, thus, became one of the most significant criminal justice rulings handed down by the U.S. Supreme Court in the 20th century.<\/p>\n<p>Despite the <i>Miranda <\/i>ruling,\u00a0many individuals still face high-stakes legal situations without fully understanding their rights. It also explains what happens if the police commit a violation of the principles set forth in\u00a0<i>Miranda<\/i>.<\/p>\n<h2>What Is the Purpose of the Miranda Warning?<\/h2>\n<p>The right to have counsel present during a custodial interrogation protects the Fifth Amendment\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/fifth-amendment-right-against-self-incrimination.html\">privilege against self-incrimination<\/a>. Police must tell a suspect taken into custody for interrogation that they have the right to consult with a lawyer and have their lawyer with them during interrogation.<\/p>\n<p>The U.S. Supreme Court found it necessary to mandate this notice to defendants about their constitutional right to consult with an attorney. The court went one step further and declared that if a defendant has limited financial resources (indigent), the government <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/are-you-entitled-to-a-court-appointed-attorney.html\">must appoint a lawyer to represent them<\/a>.<\/p>\n<p>The court further instructed to police that if a suspect <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/invoking-the-right-to-remain-silent.html\">says they want a lawyer<\/a>, the officer must cease any interrogation or questioning until an attorney is present. Additionally, police must allow the suspect to confer with their attorney and have the attorney present during any subsequent interrogation if the suspect invokes their right to counsel.<\/p>\n<h2>Probable Cause and Police Questioning<\/h2>\n<p>Law enforcement can arrest you without reading you your Miranda rights.\u00a0<i>Miranda<\/i>\u00a0doesn&#8217;t protect you from being arrested. Rather, it helps prevent you from <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/fifth-amendment-right-against-self-incrimination.html\">unwittingly incriminating yourself<\/a> during police questioning.<\/p>\n<p>All law enforcement needs to arrest a person is\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\">probable cause<\/a>\u00a0to believe a suspect has committed a crime. But, if police wish to question a suspect in custody, they must first read them the Miranda warnings and <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/waiving-miranda-rights.html\">obtain a waiver<\/a> of their right to remain silent and\/or to have counsel present during the questioning.<\/p>\n<p>If law enforcement doesn&#8217;t follow these rules, the judge will likely deem the suspects&#8217; statements <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/evidence-the-concept-of-admissibility.html\">inadmissible<\/a>. The original arrest may still be perfectly legal and valid.<\/p>\n<h2>Questions Police May Ask Without a Miranda Warning<\/h2>\n<p>Police are allowed to ask certain questions without\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-warnings-and-police-questioning.html\">Mirandizing\u00a0a suspect<\/a>. These questions include:<\/p>\n<ul>\n<li>Name<\/li>\n<li>Address<\/li>\n<li>Date of birth<\/li>\n<li>Social Security number<\/li>\n<li>Other questions necessary to establish a person&#8217;s identity<\/li>\n<\/ul>\n<p>Police can also give alcohol and drug tests without giving Miranda warnings. But, individuals have a right to refuse to answer a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-rights.html\">police officer&#8217;s questions<\/a>.<\/p>\n<h2>Can a Suspect Waive Their Miranda Rights?<\/h2>\n<p>You may be surprised to learn that many suspects\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/waiving-miranda-rights.html\">waive their Miranda rights<\/a>. A suspect can waive this right at several points throughout their criminal case. In some cases, they waive the right to remain silent\u00a0simply by failing to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/invoking-the-right-to-remain-silent.html\">invoke it with the correct wording<\/a>.<\/p>\n<p>Rather than make self-incriminating statements, a suspect can demand the presence of an attorney. Or they may choose to stop answering questions altogether. But, per a <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/12-246.html\" target=\"_blank\" rel=\"noopener\">2013 Supreme Court ruling<\/a>, silence\u00a0can be used as evidence of guilt if a suspect does not explicitly invoke the right to remain silent.<\/p>\n<p>A suspect can waive the rights afforded by\u00a0<i>Miranda<\/i>\u00a0at the time of their arrest. Or they may wait to waive these rights until the middle of the police interrogation. A <a href=\"https:\/\/lawyers.findlaw.com\/criminal-law\/\" target=\"_blank\" rel=\"noopener\">criminal law attorney<\/a> can advise on whether it&#8217;s a good idea to waive Miranda rights.<\/p>\n<p>The critical thing to remember is that you can reinvoke your rights. For example, if an interrogation gets heated, you may decide to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-legal-help\/get-legal-help-with-a-criminal-law-matter.html\">call an attorney<\/a>. Perhaps you have no problem with answering questions at the crime scene but do not want to talk once you arrive at the police station. Statements made before you reinvoked your Miranda rights can still be used against you.<\/p>\n<p>Even if a suspect waives their\u00a0<i>Miranda<\/i>\u00a0rights, if they invoke them later, police must honor their request.
