In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/391\/145.html\" target=\"_blank\" rel=\"noopener\"><em>Duncan v. <span data-term-id=\"56192140\">Louisiana<\/span><\/em><\/a> (1968), however, the <span data-term-id=\"56192145\">U.S. <\/span><span data-term-id=\"56192119\">Supreme Court<\/span> held that the <a href=\"https:\/\/constitution.findlaw.com\/amendment14.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56192144\">Fourteenth Amendment<\/span>&#8216;s<\/a>\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment14\/annotation03.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56192156\">due process clause<\/span><\/a>\u00a0extended this right to state <span data-term-id=\"56192124\">criminal cases<\/span>.<\/p>\n<h3><span data-term-id=\"56192146\">Serious Offense<\/span> Requirement<\/h3>\n<p><a href=\"https:\/\/supreme.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">The <span data-term-id=\"56192119\">Supreme Court<\/span><\/a> has always interpreted this <span data-term-id=\"56192155\">Sixth Amendment<\/span><span data-term-id=\"56192155\"> right<\/span> to apply only to trials for <span data-term-id=\"56192146\">serious offenses<\/span> and not petty crimes. New York<\/span><\/em><\/a> (1970).<\/p>\n<p>The Court established that the <span data-term-id=\"56192122\">constitutional right<\/span> to a jury trial applies only to <span data-term-id=\"56192146\">serious offenses<\/span> punishable by more than six months in jail. It doesn&#8217;t apply to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/infractions.html\"><span data-term-id=\"56192137\">petty offenses<\/span><\/a> carrying <span data-term-id=\"56192160\">maximum sentences<\/span> of six months or less.<\/p>\n<p><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/489\/538.html\" target=\"_blank\" rel=\"noopener\">Later cases<\/a>, however, clarified that the right to a jury trial can apply if a <span data-term-id=\"56192137\">petty offense<\/span> carries additional severe penalties that make it more serious.<\/p>\n<h3>No Right for Juveniles<\/h3>\n<p>In 1971, the <span data-term-id=\"56192119\">Supreme Court<\/span> determined that the <span data-term-id=\"56192155\">Sixth Amendment<\/span><span data-term-id=\"56192155\"> right<\/span> to a jury trial doesn&#8217;t extend to juveniles. The Court reasoned in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/403\/528.html\" target=\"_blank\" rel=\"noopener\"><em>McKeiver v. Pennsylvania<\/em><\/a> (1971) that juvenile courts were designed to be flexible, rehabilitative, and informal. It cautioned that juries would make the system too adversarial.<\/p>\n<h3>Federal\/State Standards<\/h3>\n<p>So, if you&#8217;re an adult facing <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges.html\">criminal charges<\/a> in state or <span data-term-id=\"56192132\">federal court<\/span> for an offense punishable by more than six months in jail, you have the right to a jury trial. This is the minimum federal standard.<\/p>\n<p>The states are free to offer greater protections. In fact, many <span data-term-id=\"56192134\">state constitutions<\/span> grant jury trials to <span data-term-id=\"56192136\">criminal defendants<\/span> facing charges of lesser crimes. <a href=\"https:\/\/codes.findlaw.com\/co\/title-16-criminal-proceedings\/co-rev-st-sect-16-10-109\/\" target=\"_blank\" rel=\"noopener\">Colorado<\/a> and <a href=\"https:\/\/www.mass.gov\/rules-of-criminal-procedure\/criminal-procedure-rule-19-trial-by-jury-or-by-the-court\" target=\"_blank\" rel=\"noopener\">Massachusetts<\/a>, for example, guarantee a jury trial for some misdemeanors that don&#8217;t meet the federal standard.<\/p>\n<h2>Additional Constitutional Provisions<\/h2>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendments.html\" target=\"_blank\" rel=\"noopener\">Fifth and <span data-term-id=\"56192123\">Seventh Amendments<\/span><\/a> also protect the role of <span data-term-id=\"56192132\">federal court<\/span> juries in both criminal and <span data-term-id=\"56192130\">civil cases<\/span>. We briefly explore these safeguards against government overreach below.<\/p>\n<h3>Fifth Amendment<\/h3>\n<p>Though it doesn&#8217;t address jury trials, the <a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment establishes a <span data-term-id=\"56192152\">grand jury<\/span> requirement<\/a> for serious federal criminal charges. It says, &#8220;No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a <span data-term-id=\"56192152\">Grand Jury<\/span>\u2026&#8221;<\/p>\n<p>This generally means that federal felony charges require a <span data-term-id=\"56192152\">grand jury<\/span> indictment before charges can be filed. However, a defendant can waive indictment and proceed by information in non-capital cases.<\/p>\n<h3><span data-term-id=\"56192123\">Seventh Amendment<\/span><\/h3>\n<p>The <span data-term-id=\"56192123\">Seventh Amendment<\/span> includes a <a href=\"https:\/\/constitution.findlaw.com\/amendment7.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56192148\">jury trial provision<\/span> addressing certain <span data-term-id=\"56192130\">civil cases<\/span><\/a>. It says, &#8220;In Suits at <span data-term-id=\"56192125\">common law<\/span>, where the value in controversy shall exceed twenty dollars, the <span data-term-id=\"56192147\">right of <\/span><span data-term-id=\"56192120\">trial by jury<\/span> shall be preserved\u2026&#8221; This guarantees the right to a jury trial in <span data-term-id=\"56192132\">federal court<\/span> for limited <span data-term-id=\"56192163\">civil trials<\/span>.<\/p>\n<p>While criminal jury trials are the focus of our discussion, this right illustrates the <span data-term-id=\"56192159\">framers<\/span>&#8216; commitment to citizen participation in the <span data-term-id=\"56192149\">justice system<\/span>.<\/p>\n<p>In the following section, we review key concepts tied to a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-sixth-amendment.html#:~:text=violates%20the%20right.-\"><span data-term-id=\"56192136\">criminal defendant<\/span>&#8216;s right to a jury trial<\/a>.<\/p>\n<h2>What Is a Jury?<\/h2>\n<p>A jury is a group of citizens who evaluate evidence in a trial and decide the facts of the case. They are what&#8217;s called the\u00a0trier of fact\u00a0in a jury trial.<\/p>\n<p>Juries in federal <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/criminal-trial.html\"><span data-term-id=\"56192139\">criminal trials<\/span><\/a> typically consist of 12 jurors. <span data-term-id=\"56192138\">State courts<\/span> may use six-person juries for non-capital cases. State <span data-term-id=\"56192139\">criminal trials<\/span> where the death penalty is possible, however, often use 12 jurors, but the exact jury size depends on state law. Juries with fewer than six jurors in a <span data-term-id=\"56192139\">criminal trial<\/span>, according to the <span data-term-id=\"56192119\">Supreme Court<\/span>, are unconstitutional.<\/p>\n<p>The <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/what-is-the-role-of-a-jury-in-a-criminal-case.html\">jury&#8217;s job in any <span data-term-id=\"56192124\">criminal case<\/span><\/a> is to determine the defendant&#8217;s <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-different-degrees-of-guilt.html\">guilt\u00a0or\u00a0innocence<\/a> based on whether the prosecution proved its case beyond a reasonable doubt. This determination is the\u00a0jury verdict.<\/p>\n<h2>Must a Jury Verdict Be Unanimous?<\/h2>\n<p>In <span data-term-id=\"56192139\">criminal trials<\/span>, yes.<\/p>\n<p><span data-term-id=\"56192132\">Federal courts<\/span> have always required <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/must-all-jury-verdicts-be-unanimous.html\">unanimous verdicts<\/a> in criminal jury trials. Until 2020, however, <span data-term-id=\"56192140\">Louisiana<\/span> and Oregon allowed convictions even when one or two jurors disagreed.<\/p>\n<p>The <span data-term-id=\"56192119\">Supreme Court<\/span> changed that in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/18-5924.html\" target=\"_blank\" rel=\"noopener\"><em>Ramos v. <span data-term-id=\"56192140\">Louisiana<\/span><\/em><\/a> (2020). In <em>Ramos<\/em>, the Court held that the <span data-term-id=\"56192122\">constitutional right<\/span> to a criminal jury trial includes the right to a unanimous verdict. Accordingly, all state <span data-term-id=\"56192124\">criminal cases<\/span> in which the <span data-term-id=\"56192121\">Sixth Amendment<\/span> requires a jury now require that all jurors agree before finding a defendant guilty.<\/p>\n<h2>What If the Jurors Can&#8217;t Agree?<\/h2>\n<p>When a jury can&#8217;t all agree on a verdict, it&#8217;s called a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-happens-when-a-jury-is-deadlocked\/\">hung jury<\/a>.<\/p>\n<p>The judge will usually ask a hung jury to keep talking and try again. If they still can&#8217;t reach a unanimous decision, the judge will declare a mistrial. This doesn&#8217;t mean the defendant is guilty or innocent. Instead, the case is left unresolved.<\/p>\n<p>After a mistrial, the prosecutor must decide what to do next. They might offer a plea deal, retry the case, or even withdraw the charges altogether. <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/double-jeopardy.html\">Double jeopardy<\/a> doesn&#8217;t block a retrial after a hung jury because the first trial never produced a final verdict.<\/p>\n<h2>Criteria for Juror Eligibility<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-jury-duty-like.html\">Serving as a juror<\/a> is a\u00a0civic\u00a0duty. To serve as a juror in <span data-term-id=\"56192132\">federal court<\/span>, a person must:<\/p>\n<ul>\n<li>\n<p>Be a U.S. citizen<\/p>\n<\/li>\n<li>\n<p>Be at least 18 years old<\/p>\n<\/li>\n<li>\n<p>Reside within the <a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/court-role-and-structure\/about-us-district-courts\" target=\"_blank\" rel=\"noopener\">federal judicial district<\/a><\/p>\n<\/li>\n<li>\n<p>Be able to read, write, speak, and understand English<\/p>\n<\/li>\n<li>\n<p>Have no disqualifying mental or physical conditions<\/p>\n<\/li>\n<li>\n<p>Not currently charged with a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/felonies.html\">felony<\/a><\/p>\n<\/li>\n<li>\n<p>Not have a felony conviction unless their civil rights have been restored<\/p>\n<\/li>\n<\/ul>\n<p>Exact eligibility rules for <span data-term-id=\"56192138\">state court<\/span> vary by jurisdiction.<\/p>\n<p>If the court calls someone to <span data-term-id=\"56192161\">jury duty<\/span>, they&#8217;ll typically report for jury selection.<\/p>\n<h2>Jury Selection<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-potential-jurors-selected.html\">Jury selection<\/a>\u00a0is also called <em>voir dire<\/em>.<\/p>\n<p>During jury selection, the\u00a0judge\u00a0and the attorneys question potential jurors to assess whether they can serve as a juror in a particular case. These questions may <a href=\"https:\/\/constitution.findlaw.com\/amendment6\/annotation05.html\" target=\"_blank\" rel=\"noopener\">reveal\u00a0biases<\/a>\u00a0that could affect the case&#8217;s outcome. The attorneys may each\u00a0strike\u00a0potential jurors if they believe the juror cannot render a fair and impartial verdict.<\/p>\n<h2>What&#8217;s the Alternative to a Jury Trial?<\/h2>\n<p>A\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/judge-versus-jury-trials.html\">bench trial<\/a>, where a judge presides over the case and determines guilt or innocence.<\/p>\n<p>Bench trials can be helpful if your case involves technical or legal issues that a judge may be able to understand better than ordinary citizens. However, it removes the chance that at least one juror might disagree and block a conviction.<\/p>\n<p>Jury trials can also be desirable if you think a group of peers might be more open to your story. But juries can be unpredictable and may misunderstand complex evidence.<\/p>\n<p>Both options offer different risks and benefits depending on the case. If you and your attorney determine a bench trial may be most advantageous, you must formally <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/can-you-choose-not-to-have-a-jury-trial\/\">waive your right to a jury trial<\/a>.<\/p>\n<h2>Waiving the Right to a Jury Trial<\/h2>\n<p>In <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/us-federal-court-system.html\"><span data-term-id=\"56192132\">federal court<\/span><\/a>, you must first clearly tell the judge that you wish to waive your right to a jury trial.
