This means their\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/criminal-trial.html\"><span data-term-id=\"56734520\">criminal trial<\/span><\/a>\u00a0must happen within a reasonably short time of their arrest. The purpose of guaranteeing a defendant a <span data-term-id=\"56734531\">speedy trial<\/span> is to ensure that the government doesn\u2019t subject them to unfair or indefinite <span data-term-id=\"56734564\">pretrial<\/span> incarceration.<\/p>\n<p>For federal cases, the time limit to commence a <span data-term-id=\"56734520\">criminal trial<\/span> is 70 days from the defendant\u2019s indictment or first appearance. This time limit is dictated by the <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-3161\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56734531\">Speedy Trial<\/span> Act of 1974<\/a>, which not only limits the time in which a trial must commence but also demands that a defendant\u2019s indictment or information take place within 30 days of their arrest.<\/p>\n<p>The <span data-term-id=\"56734531\">Speedy Trial<\/span> Act applies only to federal cases, not state cases. State <span data-term-id=\"56734531\">speedy trial<\/span> requirements vary, with some requiring trials within 30 days for <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-law-basics\/misdemeanors.html\"><span data-term-id=\"56734545\">misdemeanor<\/span> cases<\/a> and within 180 days for <span data-term-id=\"56734565\">felony cases<\/span>. If they choose to do so, they must submit it, in writing, to the judge handling their case.<\/p>\n<h3>Right to an <span data-term-id=\"56734540\">Impartial Jury<\/span><\/h3>\n<p>Another <span data-term-id=\"56734532\">constitutional right<\/span> that applies to <span data-term-id=\"56734522\">criminal defendants<\/span> is the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-right-to-a-jury-trial.html\">right to a <span data-term-id=\"56734533\">trial by jury<\/span><\/a>. This right, while not absolute, ensures that a jury is composed of one\u2019s peers and is impartial. An <span data-term-id=\"56734540\">impartial jury<\/span> is one composed of people who have no bias toward either the state or the defendant.<\/p>\n<p>Whether a defendant has a right to a jury trial depends on the seriousness of their <span data-term-id=\"56734526\">criminal charges<\/span> and the potential penalty for the crime. For example, if the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/criminal-sentencing.html\">maximum penalty<\/a> for a crime is less than six months in jail or prison, they are generally <em>not <\/em>entitled to a jury trial.<\/p>\n<p>The prosecutor and <span data-term-id=\"56734521\">defense attorney<\/span> both play a role in <span data-term-id=\"56734539\">jury selection<\/span>, each hoping to empanel a jury that will look favorably on their case. They do this through a process called \u201c<a href=\"https:\/\/www.findlaw.com\/legalblogs\/strategist\/3-voir-dire-tips-from-aurora-shooting-trials-5-jury-dismissals\/\">voir dire<\/a>.\u201d Each side can ask potential jurors a series of questions to determine whether they would be beneficial to their case.<\/p>\n<p>The voir dire process can vary by state. In general, the court will exclude potential jurors for an inherent bias or conflict. For example, if a juror says that they are related to the victim, the prosecutor can ask the judge to dismiss the juror \u201c<a href=\"https:\/\/defendermanuals.sog.unc.edu\/sites\/default\/files\/pdf\/25.4%20Excusing%20Jurors%20for%20Cause.pdf\" target=\"_blank\" rel=\"noopener\">for cause<\/a>.\u201d<\/p>\n<p>In addition to jurors who are dismissed due to cause, the defense lawyer and prosecutor each have a specific number of \u201cperemptory challenges.\u201d These are jurors that the attorney can dismiss for no reason at all. In federal court, each side is limited to three <a href=\"https:\/\/dictionary.findlaw.com\/definition\/challenge.html\" target=\"_blank\" rel=\"noopener\">peremptory challenges<\/a>. The number of peremptory challenges a party has in state cases varies.<\/p>\n<p>The jury must find the defendant guilty\u00a0beyond a <span data-term-id=\"56734527\">reasonable doubt<\/span>\u00a0to convict them. If the jury fails to reach a\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/must-all-jury-verdicts-be-unanimous.html\">unanimous verdict<\/a>, it results in a &#8220;hung jury.&#8221; In that case, the judge may declare a <span data-term-id=\"56734559\">mistrial<\/span>. The prosecutor may then call for a new trial.<\/p>\n<h3>Right To Be Notified of <span data-term-id=\"56734526\">Criminal Charges<\/span><\/h3>\n<p>It makes sense that a <span data-term-id=\"56734522\">criminal defendant<\/span> would have the right to know which crime the state is accusing them of. Not only does this put the defendant on notice, but it also gives them a chance to prepare their defense. It\u2019s impossible to devise a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-legal-help\/criminal-defense-strategies.html\">defense strategy<\/a> if you don\u2019t clearly understand the state\u2019s claim.<\/p>\n<p>It\u2019s essential that you understand this right from a practical perspective. When <span data-term-id=\"56734529\">law enforcement<\/span> <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/chronology-the-arrest-process.html\">arrests someone<\/a>, they should tell them what crime they suspect them of committing. However, this isn\u2019t always the case. Other times, the police officer doesn\u2019t explain what the charges mean.<\/p>\n<p>The right to be notified of charges requires that the state formally inform a <span data-term-id=\"56734522\">criminal defendant<\/span> of their charges. They do this through an <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/arraignment.html\"><span data-term-id=\"56734550\">arraignment<\/span><\/a> or first appearance. This is where the defendant tells the judge how they plead.<\/p>\n<h3>The <span data-term-id=\"56734563\">Right To Confront Witnesses<\/span><\/h3>\n<p>Another <span data-term-id=\"56734518\">Sixth Amendment<\/span> right <span data-term-id=\"56734522\">criminal defendants<\/span> enjoy is to present evidence and call witnesses on their own behalf. They also have a right to confront any of the prosecution\u2019s witnesses. This right is also referred to as\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-6th-amendment-s-confrontation-clause.html\">the confrontation clause<\/a>.<\/p>\n<p>The confrontation clause allows defendants to <span data-term-id=\"56734549\">cross-examine<\/span><span data-term-id=\"56734549\"> witnesses<\/span> regarding in-court and out-of-court statements. It also allows defendants to challenge these statements for bias, truthfulness, and validity, among other things.<\/p>\n<p>In addition to cross-examining the state\u2019s witnesses, defendants also have the right to call their own witnesses. If a witness refuses to testify, your attorney can ask the judge to <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/what-is-a-subpoena.html\">issue a subpoena<\/a>, a court order requiring the individual to testify at trial.<\/p>\n<h3>The Right to Counsel<\/h3>\n<p>The <span data-term-id=\"56734546\">Sixth Amendment<\/span><span data-term-id=\"56734546\"> guarantees<\/span> that every defendant in a <span data-term-id=\"56734517\">criminal case<\/span> has the <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/right-to-counsel.html\">right to <span data-term-id=\"56734555\">legal counsel<\/span><\/a>. This right applies to all critical stages of a <span data-term-id=\"56734543\">criminal proceeding<\/span>, but it doesn\u2019t apply in all cases.<\/p>\n<p>The <span data-term-id=\"56734530\">Supreme Court<\/span> has held that the right to <span data-term-id=\"56734554\">legal representation<\/span> applies only in cases where imprisonment is a potential penalty, including both felonies and many <span data-term-id=\"56734545\">misdemeanors<\/span>. If the court determines at the outset that it will not impose jail time regardless of the outcome, appointed counsel may not be required.<\/p>\n<p>The <span data-term-id=\"56734518\">Sixth Amendment<\/span> right to counsel attaches at an\u00a0<span data-term-id=\"56734550\">arraignment<\/span> hearing, where the defendant gets notified of the charges against them. The court will appoint one if a defendant <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-legal-help\/public-defenders-by-state.html\">can\u2019t afford an attorney<\/a>. Such a defendant is considered\u00a0\u201cindigent,\u201d or unable to\u00a0pay for <span data-term-id=\"56734554\">legal representation<\/span> on their own.<\/p>\n<h3>Protection Against <span data-term-id=\"56734528\">Double Jeopardy<\/span><\/h3>\n<p>In addition to the other constitutional protections we\u2019ve discussed, you also have a right not to face prosecution for the same crime more than once. This is called \u201c<span data-term-id=\"56734528\">double jeopardy<\/span>.\u201d<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/reasons-for-double-jeopardy-protection.html\"><span data-term-id=\"56734528\">double jeopardy<\/span> protection<\/a>\u00a0arises from the\u00a0<span data-term-id=\"56734519\">Fifth Amendment<\/span>\u00a0to the\u00a0<span data-term-id=\"56734537\">U.S. Constitution<\/span>. It prevents the government from endlessly prosecuting a defendant and furthers judicial efficiency.<\/p>\n<p><span data-term-id=\"56734528\">Double jeopardy<\/span>\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-double-jeopardy-protection-applies.html\">applies in all <span data-term-id=\"56734517\">criminal cases<\/span><\/a> and generally attaches\u00a0when the jury is sworn in. In a\u00a0<span data-term-id=\"56734558\">bench trial<\/span>, where the judge is the fact finder, jeopardy attaches when the court swears in the first witness.<\/p>\n<p>Some\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-double-jeopardy-protection-applies.html\">actions do not trigger<\/a>\u00a0<span data-term-id=\"56734528\">double jeopardy<\/span> protection. For example, if the judge dismisses a case without prejudice, the state can file a new indictment.
