An experienced attorney can help enforce these fundamental rights.<\/p>\r\n<p>The following is a summary of the&nbsp;Eighth Amendment&nbsp;and criminal punishment, emphasizing the&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights.html\">rights of the accused<\/a>.<\/p>\r\n<h2>The Text of the Eighth Amendment<\/h2>\r\n<p><i>Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.<\/i><\/p>\r\n<h2>The Eighth Amendment Explained<\/h2>\r\n<p>The Eighth Amendment is part of the&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">U.S. Constitution&#8217;s<\/a>&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/bill-of-rights.html\" target=\"_blank\" rel=\"noopener\">Bill of Rights<\/a>. It is an essential restraint on the government&#8217;s ability to cause harm to individuals. It protects against the infliction of certain physical and economic punishments.<\/p>\r\n<p>Originally, the Eighth Amendment only applied to the federal government and federal court cases. However, the&nbsp;<a href=\"https:\/\/constitution.findlaw.com\/amendment14.html\" target=\"_blank\" rel=\"noopener\">Fourteenth Amendment<\/a>&nbsp;extended it to the states.<\/p>\r\n<h2>Excessive Bail<\/h2>\r\n<p>As the text of the Eighth Amendment states, the government cannot require excessive bail from criminal defendants. The U.S. Supreme Court has determined that courts cannot set bail that is&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/481\/739.html\" target=\"_blank\" rel=\"noopener\">excessive to the alleged wrongdoing<\/a>.<\/p>\r\n<p><a href=\"https:\/\/dictionary.findlaw.com\/definition\/bail.html\" target=\"_blank\" rel=\"noopener\">Bail<\/a>&nbsp;refers to when detention centers, such as jails, temporarily release prisoners in exchange for security. The accused often&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/posting-bail.html\">posts bail<\/a>&nbsp;by paying the court a designated amount or taking a court-ordered action.<\/p>\r\n<p>For example, a person may have to surrender any firearms they possess. The government may release the defendant from&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/detention.html\" target=\"_blank\" rel=\"noopener\">detention<\/a>&nbsp;in exchange for their security and a promise to appear at a later hearing. The court can temporarily hold their passport if flight to another country is a concern.<\/p>\r\n<p>But a person does not have an absolute right to bail. For example, if the&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/defendant.html\" target=\"_blank\" rel=\"noopener\">defendant<\/a>&nbsp;is accused of a serious crime or the court determines they present a significant threat to the community, it may refuse to set bail.&nbsp;<a href=\"https:\/\/open.mitchellhamline.edu\/cgi\/viewcontent.cgi?referer=&amp;httpsredir=1&amp;article=2570&amp;context=wmlr\" target=\"_blank\" rel=\"noopener\">The Bail Reform Act of 1984<\/a>&nbsp;sets out other circumstances where courts may deny bail, such as when the defendant faces a possible&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/sentence.html\" target=\"_blank\" rel=\"noopener\">life sentence<\/a>.<\/p>\r\n<p>The Eighth Amendment protects against the court setting disproportionate bail. The judge or magistrate sets the defendant&#8217;s bail. Factors the judge considers when determining proportionality include the following, among others:<\/p>\r\n<ul>\r\n<li>The nature and seriousness of the crime<\/li>\r\n<li>The amount of danger the defendant poses to society<\/li>\r\n<li>The weight of the&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/evidence.html\" target=\"_blank\" rel=\"noopener\">evidence<\/a><\/li>\r\n<li>Whether the defendant is a flight risk<\/li>\r\n<\/ul>\r\n<p>Based on its analysis, the court will typically set a bail proportionate to the alleged crimes. Specifically, the court cannot set bail disproportionate to \u2014 or more excessive than \u2014 necessary to prevent the wrongdoing.<\/p>\r\n<p>For example, a bail amount of $1 million for&nbsp;<a href=\"https:\/\/www.findlaw.com\/traffic\/traffic-tickets\/jaywalking.html\">jaywalking<\/a>&nbsp;would undoubtedly be unconstitutional. However, this amount of bail for&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/murder.html\" target=\"_blank\" rel=\"noopener\">first-degree murder<\/a>&nbsp;may be constitutional.<\/p>\r\n<h2>Excessive Fines<\/h2>\r\n<p>The Eighth Amendment prohibits the government&#8217;s imposition of&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/fines.html\">excessive fines<\/a>. The excessive fines clause is similar to the prohibition against excessive bail. The court must balance the fine versus the nature of the offense. This protection applies to both&nbsp;<a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/civil-cases-vs-criminal-cases-key-differences.html\">civil and criminal cases<\/a>.<\/p>\r\n<p>In the criminal law context, courts consider the following when determining fines:<\/p>\r\n<ul>\r\n<li>The defendant&#8217;s financial situation<\/li>\r\n<li>The amount of other statutory fines<\/li>\r\n<li>The fine&#8217;s effect on the defendant&#8217;s finances<\/li>\r\n<\/ul>\r\n<p>For more information about excessive bail and fines, visit&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights.html\">FindLaw&#8217;s Criminal Rights section<\/a>.<\/p>\r\n<h2>Cruel and Unusual Punishment<\/h2>\r\n<p>The Eight Amendment&#8217;s cruel and unusual punishment clause&nbsp;protects criminal defendants against the government&#8217;s imposition of&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/cruel-and-unusual-punishment.html\">cruel and unusual punishments<\/a>. The Amendment&#8217;s text does not explain what cruel and unusual means, though.<\/p>\r\n<p>Instead, the Supreme Court has noted that what constitutes such punishment evolves. In a 1958 case, Chief Justice Earl Warren wrote that the protection &quot;must draw its meaning from the&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/356\/86.html\" target=\"_blank\" rel=\"noopener\">evolving standards of decency<\/a>&nbsp;that mark the progress of a maturing society.&quot;<\/p>\r\n<p>The Supreme Court&#8217;s interpretation of cruel and unusual punishment has changed over the years. In 2010, the Supreme Court described cruel and unusual punishments as those that are &quot;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/8-10914.html\" target=\"_blank\" rel=\"noopener\">repugnant to the conscience of mankind.<\/a>&quot; Of course, what society considers repugnant changes over time.<\/p>\r\n<h3>The Death Penalty<\/h3>\r\n<p>A prominent example of society&#8217;s changing view of cruel and unusual punishment is the&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/death-penalty.html\">death penalty<\/a>. The death penalty, perhaps the&nbsp;<a href=\"https:\/\/deathpenaltyinfo.org\/facts-and-research\/history-of-the-death-penalty\/early-history-of-the-death-penalty\" target=\"_blank\" rel=\"noopener\">most ancient form of punishment<\/a>, is a divisive topic in American society. Proponents of capital punishment argue it is the ultimate deterrence tactic. Critics say that it is not only inhumane but also brutalizes civilized society.<\/p>\r\n<p>Unsurprisingly,&nbsp;the Supreme Court&nbsp;has wrestled with the death penalty many times. For example, in 1972, the Supreme Court effectively&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/temporary-abolition-of-the-death-penalty.html\">banned it<\/a>, although only temporarily, in&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/408\/238.html\" target=\"_blank\" rel=\"noopener\"><i>Furman v. Georgia<\/i><\/a>. The ban lasted approximately four years.<\/p>\r\n<p>In 1976, the Supreme Court decided the&nbsp;<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/428\/153.html\" target=\"_blank\" rel=\"noopener\"><i>Gregg v. Georgia<\/i><\/a>&nbsp;case, which lifted the death penalty ban. In&nbsp;<i>Gregg<\/i>, the Supreme Court set out the requirements for states that wished to reinstate capital punishment.<\/p>\r\n<h2>The Eighth Amendment and Deliberate Indifference<\/h2>\r\n<p>In addition to physical injuries, there are also situations where government inaction can violate the Eighth Amendment. Such inaction is also known as &quot;<a href=\"https:\/\/www.findlaw.com\/legalblogs\/seventh-circuit\/no-actual-knowledge-court-dismisses-deliberate-indifference-claim\/\">deliberate indifference<\/a>.&quot; For example, failing to provide needed medical care to an individual in custody can constitute cruel and unusual punishment.<\/p>\r\n<p>To bring a&nbsp;<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/42-u-s-code-section-1983.html\">civil rights claim<\/a>&nbsp;in such an instance, the prisoner must show the following:<\/p>\r\n<ul>\r\n<li>The offender was aware of some danger or risk of harm<\/li>\r\n<li>The offender chose not to take any steps to remedy the problem;<\/li>\r\n<li>This resulted in harm to the&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/plaintiff.html\" target=\"_blank\" rel=\"noopener\">plaintiff<\/a><\/li>\r\n<\/ul>\r\n<p>Although it is a short sentence, the Eighth Amendment packs many important individual protections.<\/p>\r\n<h2>The Eighth Amendment and Criminal Punishment: Annotations<\/h2>\r\n<p>The &quot;annotations&quot; section details a given legal code&#8217;s various rights, protections, exceptions, and history.
