Arizona<\/i><\/a><i>\u00a0<\/i>(1966).<\/p>\n<p>The Fifth Amendment used to apply only to federal government actions. But, the Fourteenth Amendment extended it to the states. Therefore, the Fifth Amendment privileges apply to state and federal government actions.<\/p>\n<p>The Fifth Amendment under the United States Constitution provides fundamental constitutional rights that protect individuals. These rights are relevant in both civil and criminal legal proceedings and are listed as follows:<\/p>\n<ul>\n<li>The right against\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/fifth-amendment-right-against-self-incrimination.html\">self-incrimination<\/a><\/li>\n<li>Protection against\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/double-jeopardy.html\">double jeopardy<\/a><\/li>\n<li>The right to due process before being deprived of life, liberty, or property<\/li>\n<li>The Right to grand jury indictment for federal cases<\/li>\n<li>The right to\u00a0<a href=\"https:\/\/www.findlaw.com\/realestate\/land-use-laws\/what-is-just-compensation-in-eminent-domain-cases.html\">just compensation<\/a>\u00a0when the government\u00a0takes private property\u00a0for public use<\/li>\n<\/ul>\n<h2>Privilege Against Self-Incrimination<\/h2>\n<p>Miranda rights, also known as the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/miranda-rights-and-the-fifth-amendment.html\">Miranda warning<\/a>, appear in many TV shows and crime dramas. The warning gets its name from the Supreme Court case\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/384\/436.html\" target=\"_blank\" rel=\"noopener\"><i>Miranda v. Arizona<\/i><\/a>. In that case, the Court held that evidence obtained in violation of the defendant&#8217;s Fifth and\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-sixth-amendment.html\">Sixth Amendment<\/a>\u00a0rights is inadmissible at trial.<\/p>\n<p>Although law enforcement does not need to read the rights verbatim, the rights generally are as follows:<\/p>\n<p>\u201cYou have the right to remain silent. Anything you say can and will be used against you in court. You are entitled to an attorney. If you cannot afford an attorney, one will be appointed to you.&#8221;<\/p>\n<p>The rights apprise a suspect of their Fifth Amendment right against self-incrimination and their\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/the-miranda-case-and-the-right-to-counsel.html\">right to a defense attorney<\/a>. It prevents the government from endlessly\u00a0prosecuting\u00a0a criminal defendant for the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/double-jeopardy-what-constitutes-the-same-offense.html\">same crime<\/a>. The protection generally applies regardless of the severity of the\u00a0criminal charges.<\/p>\n<p>The constitutional right against double jeopardy exists for several reasons:<\/p>\n<ul>\n<li>It preserves the finality of a criminal prosecution and proceeding.<\/li>\n<li>It limits the government&#8217;s ability to bring endless criminal trials against defendants.<\/li>\n<li>It protects criminal defendants from the stress and financial repercussions of multiple prosecutions.<\/li>\n<\/ul>\n<p>The protection against double jeopardy has\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/when-double-jeopardy-protection-applies.html\">limits and exceptions<\/a>. For example, if a defendant is never in danger of\u00a0life and limb,\u00a0the protection does not apply to them. Jeopardy typically attaches at the following times:<\/p>\n<ul>\n<li>In a\u00a0jury trial, when the court swears in the\u00a0jurors<\/li>\n<li>In a bench trial, when the court swears in the first\u00a0witness<\/li>\n<\/ul>\n<p>Suppose a court\u00a0dismisses\u00a0an\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/what-is-an-indictment.html\">indictment<\/a>\u00a0before the trial begins. In that case, double jeopardy did not attach to the defendant. Therefore, prosecutors may try the same defendant for the same offense later.<\/p>\n<p>If the court declares a\u00a0mistrial, the government can prosecute the defendant in a\u00a0new trial. The court may declare a mistrial if, for example, the jury cannot reach a\u00a0verdict. You can also learn more about the\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment5\/annotation03.html\" target=\"_blank\" rel=\"noopener\">protection&#8217;s scope and when it does and does not apply<\/a>.<\/p>\n<h2>Indictment By Grand Jury<\/h2>\n<p>The Fifth Amendment guarantees that a\u00a0<a href=\"https:\/\/dictionary.findlaw.com\/definition\/grand-jury.html\" target=\"_blank\" rel=\"noopener\">grand jury<\/a>\u00a0must charge a defendant with a\u00a0felony\u00a0in federal court when appropriate. A grand jury comprises a panel of citizens who consider the evidence and determine whether to indict a defendant.\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment5\/annotation01.html\" target=\"_blank\" rel=\"noopener\">The Fifth Amendment Indictment By Grand Jury annotation<\/a>\u00a0describes the grand jury process, including its history and rationale. It also summarizes military exceptions to the grand jury requirement.<\/p>\n<h2>Due Process of Law and Eminent Domain<\/h2>\n<p>The Fifth Amendment protects people from the government&#8217;s deprivation of their life, liberty, and property without the\u00a0due process of law. The Due Process Clause applies to all government takings, whether to infringe on one&#8217;s life and liberty in a criminal prosecution or taking their property through\u00a0<a href=\"https:\/\/www.justice.gov\/enrd\/condemnation\/land-acquisition-section\/history-federal-use-eminent-domain\" target=\"_blank\" rel=\"noopener\">eminent domain<\/a>.<\/p>\n<p>The government may deprive someone of life, liberty, or property\u00a0if it also affords the individual due process of law. The government can put someone in jail for the rest of their life, but it can only do so if it follows criminal procedure and affords the individual a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/what-is-a-fair-trial-.html\">fair trial<\/a>. The Due Process Clause is one of several constitutional guarantees that ensure defendants receive a fair trial.<\/p>\n<p>The government may also take someone&#8217;s property to convert it to public use. But it cannot do so unless it provides fair compensation for the property. For example, the government decides to create a new highway to increase interstate commerce, but the proposed highway runs through a farmer&#8217;s field. The government has the right to acquire the property for its plans, but they have a constitutional duty to compensate the farmer for the acquisition.<\/p>\n<p>This process is known as eminent domain, which comes from the Fifth Amendment&#8217;s Takings Clause.
