States partake of <span data-term-id=\"56193614\">federal forfeiture<\/span> law through the <span data-term-id=\"56193640\">Department of Justice<\/span>\u2019s <a href=\"https:\/\/www.justice.gov\/criminal\/criminal-mnf\/equitable-sharing-program\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56193620\">Equitable Sharing Program<\/span><\/a> and subsequent <span data-term-id=\"56193621\">state laws<\/span>.<\/p>\n<p>Forfeiture actions come with considerable controversy and allegations of abuse. If state or federal agents seize your property in a <span data-term-id=\"56193636\">civil <\/span><span data-term-id=\"56193594\">forfeiture case<\/span>, you must act quickly to recover your property.<\/p>\n<h2>Types of Forfeiture Actions<\/h2>\n<p>There are two types of <a href=\"https:\/\/www.justice.gov\/afp\/types-federal-forfeiture\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56193614\">federal forfeiture<\/span> actions<\/a>. These actions exist at the <span data-term-id=\"56193618\">state level<\/span>, but city and county jurisdictions may have other types of cases.<\/p>\n<ul>\n<li><span data-term-id=\"56193610\">Criminal forfeiture<\/span> is an action against the person (<em><span data-term-id=\"56193633\">in personam<\/span>). <\/em>The case begins with a criminal indictment that includes a notice of intent to seize property.<\/li>\n<li>Civil forfeiture is an action against the property itself (<em><span data-term-id=\"56193604\">in rem<\/span>)<\/em>. A <span data-term-id=\"56193602\">law enforcement<\/span><span data-term-id=\"56193602\"> officer<\/span> can seize property if they believe it is part of or the result of <span data-term-id=\"56193590\">criminal activity<\/span>. A judicial forfeiture occurs when the owner contests the seizure, while an <span data-term-id=\"56193643\">administrative forfeiture<\/span> occurs when no one contests it, and the agency moves to take ownership.<\/li>\n<\/ul>\n<p>After a civil asset seizure, federal, state, and <span data-term-id=\"56193625\">local <\/span><span data-term-id=\"56193599\">law enforcement<\/span><span data-term-id=\"56193599\"> agencies<\/span> may use or dispose of the <span data-term-id=\"56193611\">seized property<\/span> if the owner cannot or does not prove a claim to it. <span data-term-id=\"56193622\">Federal law<\/span> restricts the disposal of the <span data-term-id=\"56193598\">forfeited property<\/span>.<\/p>\n<h2>Federal Asset Forfeiture<\/h2>\n<p>At the <span data-term-id=\"56193638\">federal level<\/span>, <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-981.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56193591\">civil asset forfeiture<\/span><\/a> is a proceeding to seize the title or ownership of money or property. Regardless of whether the court alleges that the owner of an item is a criminal, it may find that the property itself is the product of an illegal act. For purposes of the forfeiture, the property becomes the \u201cdefendant\u201d in the legal action. <span data-term-id=\"56193594\">Forfeiture cases<\/span> often have captions like \u201cUnited States vs. $500,000 in cash\u201d or \u201cU.S. vs. A 1993 Pontiac.\u201d<\/p>\n<p>The owner must contest the seizure in civil court. The government is operating under a lower <span data-term-id=\"56193608\">burden of proof<\/span> than in a <span data-term-id=\"56193624\">criminal proceeding<\/span>. The process is as follows:<\/p>\n<ul>\n<li>The government may seize property with <span data-term-id=\"56193616\">probable cause<\/span> that it is the proceeds of or used to facilitate crime<\/li>\n<li>The government must send notice of the seizure to potential owners of the property<\/li>\n<li>Owners must file a formal claim to the property within a specific deadline, usually 30 days<\/li>\n<li>If no one files a claim, the government proceeds with an <span data-term-id=\"56193643\">administrative forfeiture<\/span><\/li>\n<li>If someone files a claim, the case goes to a civil trial<\/li>\n<li>The government must prove by a <span data-term-id=\"56193607\">preponderance of the evidence<\/span> that the property is connected to <span data-term-id=\"56193590\">criminal activity<\/span><\/li>\n<\/ul>\n<p>If the agency proves that the property was obtained illegally, it has a good chance of a successful forfeiture.<\/p>\n<h2>State Asset Forfeiture Laws<\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/asset-forfeiture-laws-by-state.html\">State forfeiture laws<\/a> resemble <span data-term-id=\"56193622\">federal laws<\/span>. The <span data-term-id=\"56193620\">Equitable Sharing Program<\/span> allocates up to 80% of funds recovered through\u00a0<span data-term-id=\"56193614\">federal forfeiture<\/span>\u00a0to <span data-term-id=\"56193621\">state <\/span><span data-term-id=\"56193599\">law<\/span><span data-term-id=\"56193599\"> enforcement<\/span><span data-term-id=\"56193599\"> agencies<\/span>. The program restricts what those agencies can spend the money on. State programs may not limit their own forfeitures.<\/p>\n<p>Due to abuse of asset forfeiture, some states have changed their laws. Maine, Nebraska, and New Mexico have abolished all <span data-term-id=\"56193591\">civil asset forfeiture<\/span>. They allow <span data-term-id=\"56193610\">criminal forfeiture<\/span>\u00a0but require a\u00a0<span data-term-id=\"56193597\">criminal conviction<\/span>\u00a0before property can be seized. Thirteen other states require a <span data-term-id=\"56193597\">criminal conviction<\/span> before civil forfeiture can proceed, which provides greater protection for <span data-term-id=\"56193609\">innocent owners<\/span>.<\/p>\n<h2>Evidence and Disposition of Assets<\/h2>\n<p><span data-term-id=\"56193601\">Civil asset forfeiture<\/span><span data-term-id=\"56193601\"> laws<\/span> vary from state to state. Although all states except Maine, Nebraska, and New Mexico permit civil forfeiture, each jurisdiction requires different burdens of proof to keep the property. They also differ on the disposition of the seized assets. Examples include:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/ar\/title-5-criminal-offenses\/ar-code-sect-5-64-505.html\" target=\"_blank\" rel=\"noopener\">Arkansas<\/a>: Police must show a <span data-term-id=\"56193607\">preponderance of the evidence<\/span> to justify a seizure. They may keep a certain percentage of the proceeds for their local department. The remaining portion, by statute, goes to the state.<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/co\/title-16-criminal-proceedings\/co-rev-st-sect-16-13-311\/\" target=\"_blank\" rel=\"noopener\">Colorado<\/a>: Police must show clear and convincing evidence\u00a0for a seizure. They may keep up to 75%\u00a0of the proceeds for <span data-term-id=\"56193589\">law enforcement<\/span>\u2019s use.<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvii-criminal-procedure-and-corrections\/fl-st-sect-932-704.html\" target=\"_blank\" rel=\"noopener\">Florida<\/a>: <span data-term-id=\"56193589\">Law enforcement<\/span>\u2019s <span data-term-id=\"56193608\">burden of proof<\/span> is beyond a <span data-term-id=\"56193627\">reasonable doubt<\/span>. All proceeds go to <span data-term-id=\"56193589\">law enforcement<\/span>. <a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?mode=View%20Statutes&amp;SubMenu=1&amp;App_mode=Display_Statute&amp;Search_String=932.7055&amp;URL=0900-0999\/0932\/Sections\/0932.7055.html\" target=\"_blank\" rel=\"noopener\">If an agency receives over $15,000 in a fiscal year<\/a>, it must donate 25%\u00a0of the proceeds to one of several state programs.<\/li>\n<\/ul>\n<p>For a full list of each state\u2019s asset forfeiture rules, see\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/asset-forfeiture-laws-by-state.html\">FindLaw\u2019s Asset Forfeiture Laws By State<\/a>.<\/p>\n<h2>Constitutional Questions About Asset Forfeiture<\/h2>\n<p>The stated purpose of <span data-term-id=\"56193591\">civil asset forfeiture<\/span> is to deter crime. The U.S. <span data-term-id=\"56193640\">Department of Justice<\/span> claims that denying would-be lawbreakers access to\u00a0<span data-term-id=\"56193605\">real estate<\/span>,\u00a0<span data-term-id=\"56193642\">bank accounts<\/span>, and valuable\u00a0<span data-term-id=\"56193628\">personal property<\/span> prevents <span data-term-id=\"56193590\">criminal activity<\/span> and deters future crime. Critics have argued that since police seize the property before filing charges against the <span data-term-id=\"56193593\">property owners<\/span>, any deterrence is minimal at best.<\/p>\n<p>There are serious constitutional questions against <span data-term-id=\"56193591\">civil asset forfeiture<\/span>.<\/p>\n<ul>\n<li><strong>An <span data-term-id=\"56193609\">innocent owner<\/span><\/strong>: What happens when you lend your car to a friend and they use it to transport drugs? Police can seize it and sell it. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/516\/442.html\" target=\"_blank\" rel=\"noopener\"><em>Bennis v. Michigan<\/em><\/a> (1996), the U.S. <span data-term-id=\"56193631\">Supreme Court<\/span> ruled that there was no violation of the <span data-term-id=\"56193609\">innocent owner<\/span>\u2019s <span data-term-id=\"56193595\">due process<\/span> in these cases. Courts did not have to provide the owner any compensation or offset for their loss.<\/li>\n<li><strong>Double jeopardy<\/strong>: The <a href=\"https:\/\/constitution.findlaw.com\/amendment5.html\" target=\"_blank\" rel=\"noopener\">Fifth Amendment<\/a> prevents courts from trying a defendant twice for the same offense. However, the Court has held that civil forfeiture following a\u00a0<span data-term-id=\"56193603\">criminal case<\/span>\u00a0does not violate the Double Jeopardy Clause.<\/li>\n<li><strong><span data-term-id=\"56193634\">Financial incentives<\/span> and excessive fines<\/strong>: Since police and <span data-term-id=\"56193622\">federal <\/span><span data-term-id=\"56193599\">law<\/span><span data-term-id=\"56193599\"> enforcement<\/span><span data-term-id=\"56193599\"> agencies<\/span> can keep the <span data-term-id=\"56193611\">seized property<\/span>, they have a <span data-term-id=\"56193634\">financial incentive<\/span> to do so. Although the law requires that the seizure be \u201cproportionate to the offense,\u201d this determination is often made after a judicial hearing.<\/li>\n<li><strong>Right to counsel<\/strong>: In civil proceedings, <span data-term-id=\"56193641\">claimants<\/span> do not have a Sixth Amendment right to counsel as they do in <span data-term-id=\"56193603\">criminal cases<\/span>. A <span data-term-id=\"56193641\">claimant<\/span> can hire their own attorney if they can afford one, but poor or indigent <span data-term-id=\"56193641\">claimants<\/span> may not have the funds to do so.<\/li>\n<\/ul>\n<p>The <span data-term-id=\"56193629\">federal government<\/span> argues that <span data-term-id=\"56193591\">civil asset forfeiture<\/span> is a <span data-term-id=\"56193637\">powerful tool<\/span> against gangs and <span data-term-id=\"56193635\">criminal organizations<\/span> like drug cartels. <span data-term-id=\"56193600\">Police departments<\/span> insist that they need the additional funds provided by <span data-term-id=\"56193596\">forfeiture proceedings<\/span> to carry out their duties. The question remains as to whether the harm done to <span data-term-id=\"56193609\">innocent owners<\/span> and minor criminals is worth the larger gain.<\/p>\n<h2>Asset <span data-term-id=\"56193626\">Forfeiture Reform<\/span><\/h2>\n<p>In 2019, <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/17-1091.html\" target=\"_blank\" rel=\"noopener\">Tyson <span data-term-id=\"56193630\">Timbs<\/span><\/a> pleaded guilty to the sale of heroin and theft. At the time of his arrest, police seized his $42,000 Land Rover, claiming <span data-term-id=\"56193630\">Timbs<\/span> used it to transport the heroin. <span data-term-id=\"56193630\">Timbs<\/span> had purchased the vehicle with funds from his late father\u2019s life insurance policy. The trial court refused to impose an\u00a0<span data-term-id=\"56193643\">administrative forfeiture<\/span>, noting that the maximum fine for the criminal offense was only $10,000, less than a quarter of the vehicle\u2019s value.<\/p>\n<p>The <span data-term-id=\"56193631\">Supreme Court<\/span> agreed, holding that the <span data-term-id=\"56193612\">Excessive Fines clause<\/span> of the <span data-term-id=\"56193632\">Eighth Amendment<\/span> applied to <span data-term-id=\"56193591\">civil asset forfeiture<\/span>. If the purpose of a forfeiture is \u201cto deter and to punish\u201d (<em>Austin v. U.S.)<\/em>, then it must be proportionate to the offense. How this will affect future civil forfeitures remains to be seen.<\/p>\n<h2>Changes to the <span data-term-id=\"56193620\">Equitable Sharing Program<\/span><\/h2>\n<p>Many of these concerns have led to changes in the federal <span data-term-id=\"56193620\">Equitable Sharing Program<\/span>. The program was the subject of dual Executive Orders. One was issued in 2022, but was rescinded by another in 2025.<\/p>\n<p>The principal financial effects of the 2022 Executive Order involved:<\/p>\n<ul>\n<li>Restricting the sale or transfer of military-style equipment to <span data-term-id=\"56193625\">local <\/span><span data-term-id=\"56193599\">law enforcement<\/span><span data-term-id=\"56193599\"> agencies<\/span><\/li>\n<li>Requiring the use of bodycams by federal agents<\/li>\n<li>Creation of the National <span data-term-id=\"56193589\">Law Enforcement<\/span> Database, which would track officer misconduct reports, terminations, resignations, and transfers<\/li>\n<\/ul>\n<p>This Executive Order was partially rescinded on January 20, 2025.
