Instead, they discover a baggie of marijuana. Unfortunately for you, weed isn\u2019t legal in your state.<\/p>\n<p>Whether the officer acted within the law in this scenario depends on whether the court will characterize the search as a &#8220;<span data-term-id=\"56246461\">stop and frisk<\/span>.&#8221; A <span data-term-id=\"56246461\">stop and frisk<\/span> occurs when a <span data-term-id=\"56246463\">police officer<\/span> stops you for questioning and pats down your clothing to see if you\u2019re carrying a gun, knife, or other weapon. Although the U.S. <span data-term-id=\"56246465\">Supreme Court<\/span> has upheld this practice,\u00a0<a href=\"https:\/\/www.fletc.gov\/sites\/default\/files\/imported_files\/training\/programs\/legal-division\/downloads-articles-and-faqs\/research-by-subject\/4th-amendment\/terryfriskupdate.pdf\" target=\"_blank\" rel=\"noopener\">there are still boundaries that police cannot cross<\/a>.<\/p>\n<p>This article describes the laws and limitations surrounding <span data-term-id=\"56246461\">stop-and-frisk<\/span> procedures. An attorney can determine whether the elements of a <span data-term-id=\"56246461\">stop and frisk<\/span> were legal, including whether the police had <span data-term-id=\"56246462\">reasonable suspicion<\/span> to stop you.<\/p>\n<h2>When <span data-term-id=\"56246461\">Stop and Frisk<\/span> IS Legal<\/h2>\n<p>A <span data-term-id=\"56246463\">police officer<\/span> on patrol may become suspicious of two individuals he observes staring into a store window, believing be casing the store for a robbery. When the officer approaches them, they ask one of the individuals a question. The person mumbles a response. Can the officer forcefully spin them around and <span data-term-id=\"56246475\">pat down<\/span> their <span data-term-id=\"56246491\">outer clothing<\/span> to check for dangerous weapons?<\/p>\n<p>These were the basic facts of\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/392\/1.html\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"56246466\">Terry v. Ohio<\/span><\/em><\/a>. This precedent-setting 1968 <span data-term-id=\"56246465\">Supreme <\/span><span data-term-id=\"56246487\">Court<\/span><span data-term-id=\"56246487\"> case<\/span> settled the law regarding searches during a <span data-term-id=\"56246461\">stop and frisk<\/span>.<\/p>\n<p>The United States <span data-term-id=\"56246465\">Supreme Court<\/span> justices held that <span data-term-id=\"56246469\">law enforcement<\/span> officer\u00a0Martin McFadden\u00a0did not violate a defendant\u2019s <span data-term-id=\"56246464\">Fourth Amendment<\/span> rights when he chose to approach John Terry and Richard Chilton while they were loitering outside a closed store and conduct what is\u00a0now referred to as a <span data-term-id=\"56246461\">stop and frisk<\/span>.<\/p>\n<p>The court held that, while investigating suspicious behavior, an officer may lawfully <span data-term-id=\"56246475\">pat down<\/span> the <span data-term-id=\"56246491\">outer clothing<\/span> of someone they reasonably believe to be armed and dangerous. A <span data-term-id=\"56246475\">pat down<\/span> aims to discover weapons that the person can use to assault the officer or someone nearby.<\/p>\n<p>The Court concluded that a <span data-term-id=\"56246461\">stop and frisk<\/span> doesn\u2019t violate the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-and-seizure-and-the-fourth-amendment.html\"><span data-term-id=\"56246464\">Fourth Amendment<\/span><\/a>, which prohibits <span data-term-id=\"56246472\">unreasonable searches and seizures<\/span>. Because of the name of this landmark decision, many people now refer to a <span data-term-id=\"56246461\">stop and frisk<\/span> as a &#8220;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/terry-stop.html\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span><\/a>.&#8221;<\/p>\n<p>The point of a\u00a0<em><span data-term-id=\"56246476\">Terry\u00a0<\/span><\/em><span data-term-id=\"56246476\">stop<\/span> is to ensure officer and <span data-term-id=\"56246488\">public safety<\/span>. The <span data-term-id=\"56246465\">Supreme Court<\/span> reasoned that holding evidence inadmissible because it was discovered while frisking for weapons would not deter police misconduct. Any <span data-term-id=\"56246485\">contraband<\/span> officers find during the weapons <span data-term-id=\"56246475\">pat-down<\/span>, such as <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/types-of-drug-crimes.html\">illegal drugs<\/a>, can usually be used against you in court, but it will depend on the circumstances.<\/p>\n<p>For example, if an officer feels a hard container\u00a0that could reasonably hold a weapon, the officer would be permitted to open it to ensure a gun is not inside.\u00a0If\u00a0drugs were\u00a0found when the container was opened,\u00a0they would likely be admissible\u00a0because a weapon could reasonably have been found in the container.\u00a0<\/p>\n<h2>When <span data-term-id=\"56246461\">Stop and Frisk<\/span> Is NOT Legal<\/h2>\n<p>While an officer doesn\u2019t need\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/probable-cause.html\"><span data-term-id=\"56246473\">probable cause<\/span><\/a>\u00a0to stop you, they must have\u00a0<span data-term-id=\"56246462\">reasonable suspicion<\/span>\u00a0that <span data-term-id=\"56246484\">criminal activity<\/span> is occurring. In addition, they can only frisk you if they reasonably believe you are armed and dangerous.<\/p>\n<p>A <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span> is not lawful at any other time. <span data-term-id=\"56246469\">Law enforcement<\/span> cannot perform <span data-term-id=\"56246475\">pat-downs<\/span> for no reason. Some examples of unlawful <span data-term-id=\"56246476\">Terry stops<\/span> include:<\/p>\n<ul>\n<li>Stops that pre-emptively target <span data-term-id=\"56246482\">minorities<\/span> or any other protected class<\/li>\n<li>Searches that go beyond the permitted grounds of a <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span><\/li>\n<li>Searches that lack a reasonable belief that the individual may be armed<\/li>\n<li>Routine <span data-term-id=\"56246504\">traffic stops<\/span><\/li>\n<\/ul>\n<p>During a routine <span data-term-id=\"56246504\">traffic stop<\/span>, police cannot search your vehicle <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-to-know-about-plain-view-doctrine-for-car-searches\/\">without <span data-term-id=\"56246473\">probable cause<\/span> or consent<\/a>. However, they may frisk you for weapons if they reasonably suspect you&#8217;re armed and dangerous, just as in any <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span>.<\/p>\n<p>Police may sometimes carry out a \u201cpretext stop\u201d and pull vehicles over for minor violations when the purpose is to see if the driver is intoxicated or impaired. They\u2019ll then often ask for consent to search. These \u201cvehicle <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stops<\/span>\u201d have the same limitations as a personal <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span>.<\/p>\n<h2>\u201cPlain Feel\u201d Doctrine<\/h2>\n<p>The \u201cplain feel\u201d doctrine is an extension of the \u201cplain view\u201d doctrine, which states that if <span data-term-id=\"56246485\">contraband<\/span> is in plain sight, an officer does not need a warrant to seize the item. This was established in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/508\/366.html\" target=\"_blank\" rel=\"noopener\"><em>Minnesota v. Dickerson<\/em><\/a>. In that case, a subject left a known drug house, and officers conducted a <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span>. While searching the subject, the officer claimed to feel a lump in the suspect\u2019s pocket, which they believed was a \u201clump of crack cocaine.\u201d On removing it, the officers found it was a baggie of cocaine, and arrested the subject for possession.<\/p>\n<p>The U.S. <span data-term-id=\"56246465\">Supreme Court<\/span> ultimately reversed the conviction for possession, holding that while the <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stop<\/span> was reasonable under the circumstances, and that officers could seize any readily identifiable weapons or narcotics, they could not seize any unidentifiable items. In this case, the \u201clump\u201d was not identifiable as cocaine until it was removed. The Court ruled that officers cannot squeeze or manipulate objects to determine their substance. They can only locate an object and identify it as a weapon or <span data-term-id=\"56246485\">contraband<\/span> immediately.<\/p>\n<p>Let\u2019s go back to the bus-stop example we opened this article with. The officer feels a soft, pliable baggie in your pocket during the <span data-term-id=\"56246475\">pat-down<\/span>. Under <em>Dickerson<\/em>, the officer cannot open or remove that baggie just because they feel it. A baggie is not immediately identifiable as <span data-term-id=\"56246485\">contraband<\/span>, as it could contain anything from marijuana to a peanut butter sandwich. The officer would need to manipulate or open it to determine the contents, which exceeds the scope of a lawful <em>Terry <\/em>frisk.<\/p>\n<p>However, if the officer feels a hard object shaped like a gun or knife, they could remove it immediately because weapons are what the frisk is designed to detect. The marijuana would only be admissible if the officer had <span data-term-id=\"56246473\">probable cause<\/span> to arrest you for another reason and then searched you as part of that lawful arrest.<\/p>\n<p>Depending on the jurisdiction, <span data-term-id=\"56246467\">police <\/span><span data-term-id=\"56246480\">stop<\/span><span data-term-id=\"56246480\">-and-frisk<\/span><span data-term-id=\"56246480\"> practices<\/span> have been justified to find individual crack rocks, LSD blotters, and marijuana joints. Many of these cases are overturned on appeal. Specific state criminal procedure laws also limit the scope of a <span data-term-id=\"56246461\">stop-and-frisk<\/span>.<\/p>\n<h2><span data-term-id=\"56246470\">Racial Profiling<\/span> Concerns<\/h2>\n<p>There\u2019s an ongoing debate concerning how to prevent <span data-term-id=\"56246469\">law enforcement<\/span> from engaging in <span data-term-id=\"56246470\">racial profiling<\/span> when deciding whom\u00a0to <span data-term-id=\"56246461\">stop and frisk<\/span>. The\u00a0<a href=\"https:\/\/www.aclu.org\/\" target=\"_blank\" rel=\"noopener\">American <span data-term-id=\"56246490\">Civil Liberties<\/span> Union (<span data-term-id=\"56246478\">ACLU<\/span>)<\/a>\u00a0and other groups have claimed that the police violate the Constitution by using race to judge whether a person appears suspicious or dangerous.<\/p>\n<p>Critics scored a\u00a0<a href=\"https:\/\/civilrights.org\/edfund\/resource\/nypds-infamous-stop-and-frisk-policy-found-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">major victory<\/a>\u00a0when a <span data-term-id=\"56246486\">federal judge<\/span> ruled that\u00a0<a href=\"https:\/\/www.nyc.gov\/site\/ccrb\/investigations\/stop-question-and-frisk.page\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56246468\">New York City<\/span>\u2019s\u00a0<span data-term-id=\"56246477\">stop-and-frisk<\/span><span data-term-id=\"56246477\"> policy<\/span><\/a>\u00a0was\u00a0unconstitutional in 2013. The court based its decision on statistical evidence that suggested that officers were disproportionately targeting people of color. Although a federal appeals court blocked the judge\u2019s decision from taking effect, <span data-term-id=\"56246468\">New York City<\/span>\u2019s mayor announced a plan to reform controversial <span data-term-id=\"56246479\">police practices<\/span> to ensure that police do not conduct <em><span data-term-id=\"56246476\">Terry <\/span><\/em><span data-term-id=\"56246476\">stops<\/span> in a discriminatory manner.<\/p>\n<p>While <span data-term-id=\"56246483\">civil rights<\/span> activists have successfully challenged <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/police-misconduct-and-civil-rights.html\"><span data-term-id=\"56246474\">police department<\/span> policies<\/a>, <span data-term-id=\"56246461\">stop and frisk<\/span> remains lawful and widely used throughout the United States. Officers must remain within constitutional boundaries and comply with local police guidelines. When the court suspects discrimination, the judge will carefully scrutinize the officer\u2019s actions.<\/p>\n<h2>What To Do During a <span data-term-id=\"56246461\">Stop-and-Frisk<\/span><\/h2>\n<p>If you are the subject of a <span data-term-id=\"56246461\">stop-and-frisk<\/span> action, your first response is likely to be anger and fear. Try to stay calm and follow the officer\u2019s orders. Do not physically resist, and avoid any urges to yell or become verbally abusive. Anything you say can be used against you, even if you are not under arrest yet.<\/p>\n<p>Police can only conduct a <span data-term-id=\"56246461\">stop-and-frisk<\/span> <span data-term-id=\"56246475\">patdown<\/span> if they reasonably believe that a crime has been or is about to be committed and you are involved in some way. It\u2019s to your benefit to cooperate at this point. Utilizing these tactics can help you achieve the best possible outcome:<\/p>\n<ul>\n<li><strong>Do not resist<\/strong>: Do what the police request, such as putting your hands against a wall. If they ask your name, tell them. Police can only briefly detain you during a <span data-term-id=\"56246476\">Terry stop<\/span>. In some states, refusing to identify yourself during a lawful stop can lead to additional legal complications and an arrest.<\/li>\n<li><strong>Do not voluntarily consent to a search<\/strong>: Say out loud in a calm voice, \u201cI do not consent to a search, I am invoking my right to remain silent, and I want a lawyer if I am arrested.\u201d Don\u2019t make any other elaborate statements or say that you \u201cknow your rights.\u201d<\/li>\n<li><strong>Ask to leave<\/strong>: When the search appears to be over, ask, \u201cAm I free to go?\u201d If the officer says yes, walk away. Do not prolong the encounter or make any other comments. If they say no, ask, \u201cAm I under arrest?\u201d<\/li>\n<\/ul>\n<p>If they won\u2019t clarify whether you are free or being detained, assume you\u2019ve been arrested. Ask a passerby or a friend if you\u2019re with someone to contact an attorney for you.
