It protects <span data-term-id=\"55863284\">criminal defendants<\/span> from being tried for the same crime more than once. The <span data-term-id=\"55863286\">double jeopardy<\/span><span data-term-id=\"55863286\"> protection<\/span> applies in both\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/federal-vs-state-courts-key-differences.html\">state and <span data-term-id=\"55863295\">federal courts<\/span><\/a>.<\/p>\n<p>The protections afforded by the\u00a0<span data-term-id=\"55863272\">double jeopardy<\/span><span data-term-id=\"55863272\"> clause<\/span>\u00a0only extend to\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights.html\"><span data-term-id=\"55863284\">criminal defendants<\/span><\/a>\u00a0who are \u201cin <span data-term-id=\"55863277\">jeopardy of life<\/span> or limb.&#8221; Courts interpret this to mean any <span data-term-id=\"55863303\">criminal proceeding<\/span> in which someone faces the possibility of conviction and punishment, including felonies, misdemeanors, and juvenile delinquency cases.<\/p>\n<h2>When Does Jeopardy Attach?<\/h2>\n<p>It\u2019s important to be aware of when jeopardy \u201cattaches,\u201d or goes into effect, during a trial. Jeopardy does not attach immediately upon arrest or when the prosecutor <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/how-are-criminal-charges-brought-against-someone.html\">files <span data-term-id=\"55863281\">criminal charges<\/span><\/a>. Instead, it attaches at specific stages of a trial.<\/p>\n<p>Jeopardy can attach at one of the following stages:<\/p>\n<ul>\n<li>In a <a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/judge-versus-jury-trials.html\"><span data-term-id=\"55863285\">jury trial<\/span><\/a>: When the court swears in the jurors<\/li>\n<li>In a <span data-term-id=\"55863291\">bench trial<\/span>: When the court swears in the first witness (a <span data-term-id=\"55863291\">bench trial<\/span> is when a judge, instead of a jury, hears the case and makes the final decision)<\/li>\n<li>In a <a href=\"https:\/\/www.findlaw.com\/criminal\/juvenile-justice\/juvenile-court-procedure.html\">juvenile proceeding<\/a>: When the court first hears evidence<\/li>\n<li>In a plea bargain: When the court accepts a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/plea-bargain.html\">plea agreement<\/a><\/li>\n<\/ul>\n<p>Once a jury acquits a <span data-term-id=\"55863284\">criminal defendant<\/span>, their case is over. The state cannot try them again for the same crime. An\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/appeals-appellate-courts-and-costs.html\"><span data-term-id=\"55863299\">appellate court<\/span><\/a>\u00a0can\u2019t overturn\u00a0a judgment of <span data-term-id=\"55863268\">acquittal<\/span>, even if there is overwhelming proof of guilt or the trial judge commits\u00a0reversible error. This rule applies to both straightforward and implicit <span data-term-id=\"55863268\">acquittals<\/span>.<\/p>\n<p>A jury can\u00a0implicitly acquit\u00a0a defendant by convicting them of a <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/what-is-a-lesser-included-offense.html\"><span data-term-id=\"55863302\">lesser-included\u00a0offense<\/span><\/a>. By electing not to convict the defendant of the greater crime, the jury effectively prevents the state from prosecuting the individual a <span data-term-id=\"55863307\">second time<\/span>.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/reversing-a-conviction.html\">Conviction<\/a> and sentencing terminate jeopardy, preventing a re-prosecution. The <span data-term-id=\"55863305\">state government<\/span> only gets one chance to convict a person of the charged criminal offense. If the defendant is accused of a different crime, they must face prosecution for that specific offense.<\/p>\n<p>The termination of jeopardy doesn\u2019t prevent a defendant from filing an appeal. A person convicted of a crime can file an appeal long after the judge sentences them.<\/p>\n<h2>Exceptions to the <span data-term-id=\"55863283\">Double Jeopardy<\/span><span data-term-id=\"55863283\"> Rule<\/span><\/h2>\n<p>In general, once <span data-term-id=\"55863314\">double jeopardy<\/span><span data-term-id=\"55863314\"> attaches<\/span>, the government cannot call for a <span data-term-id=\"55863287\">second prosecution<\/span> or <span data-term-id=\"55863274\">retrial<\/span> for the same criminal offense. There are exceptions, such as when a person faces<a href=\"https://www.findlaw.com/static/f/files\/pdf\/criminal\/criminal.findlaw.com_criminal-charges_view-all-criminal-charges.pdf\" target=\"_blank\" rel=\"noopener\"><u> <\/u><u><span data-term-id=\"55863281\">criminal charges<\/span><\/u><\/a>\u200b in two different states for the same crime.<\/p>\n<p>Some of the other exceptions to the <span data-term-id=\"55863283\">double jeopardy<\/span><span data-term-id=\"55863283\"> rule<\/span> include:<\/p>\n<ul>\n<li><strong><span data-term-id=\"55863269\">Mistrials<\/span><\/strong>: If the judge <a href=\"https:\/\/archive.findlaw.com\/blog\/legalese-101-what-is-a-mistrial\/\" target=\"_blank\" rel=\"noopener\"><u>declares a <span data-term-id=\"55863269\">mistrial<\/span><\/u><\/a>\u200b due to manifest necessity (such as juror misconduct or an emergency), the state can often retry the defendant. If a <span data-term-id=\"55863269\">mistrial<\/span> is declared at the defendant&#8217;s request or with their consent, a <span data-term-id=\"55863274\">retrial<\/span> is normal. When the prosecution deliberately causes a\u00a0<span data-term-id=\"55863269\">mistrial<\/span>\u00a0to gain a tactical advantage,\u00a0<span data-term-id=\"55863265\">double jeopardy<\/span>\u00a0may bar\u00a0a\u00a0<span data-term-id=\"55863274\">retrial<\/span>.<\/li>\n<li><strong>Deadlocked or \u201chung\u201d jury<\/strong>:\u00a0If the jury <a href=\"https:\/\/www.findlaw.com\/legalblogs\/criminal-defense\/what-happens-when-a-jury-is-deadlocked\/\">cannot reach a unanimous verdict<\/a> in the <span data-term-id=\"55863282\">first trial<\/span>, the prosecutor can retry the defendant in a <span data-term-id=\"55863318\">second trial<\/span>. In some instances, they may determine that meeting the bar for a conviction is too high to merit another trial.<\/li>\n<li><strong>Separate crimes arising from the <span data-term-id=\"55863317\">same act<\/span><\/strong>: The <span data-term-id=\"55863317\">same act<\/span> can give rise to multiple distinct crimes. For example, if a defendant robs someone at gunpoint, they can be prosecuted for both robbery and illegal weapons possession, as each crime has different elements that must be proven. However, they cannot be prosecuted twice for the same robbery.<\/li>\n<li><strong>Multiple jurisdictions<\/strong>: A person may face <a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/state-court-cases-how-to-determine-where-your-suit-will-be-heard.html\"><span data-term-id=\"55863281\">criminal charges<\/span> in two states for the same <span data-term-id=\"55863312\">criminal act<\/span><\/a>. A defendant who stole cars in <span data-term-id=\"55863301\">New York<\/span>, drove them over the George Washington Bridge, and sold them in New Jersey could face charges for grand theft auto in both states.<\/li>\n<li><strong><span data-term-id=\"55863297\">Separate sovereigns<\/span> doctrine<\/strong>: A person may be tried in <span data-term-id=\"55863296\">state court<\/span> and <span data-term-id=\"55863295\">federal court<\/span> for the same criminal offense. This is known as <span data-term-id=\"55863304\">dual sovereignty<\/span>.<\/li>\n<li><strong>Dismissals<\/strong>: In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/437\/82.html\" target=\"_blank\" rel=\"noopener\"><em><u>United States v. Scott<\/u><\/em><\/a><em><u>,<\/u><\/em>\u200b the <span data-term-id=\"55863280\">U.S. Supreme Court<\/span> ruled that if a judge dismisses charges at the defendant&#8217;s request for reasons unrelated to guilt or innocence (such as prosecutorial misconduct or pre-indictment delay), the state may retry the defendant. A dismissal of charges for insufficient evidence constitutes an <span data-term-id=\"55863268\">acquittal<\/span> and bars <span data-term-id=\"55863274\">retrial<\/span>.<\/li>\n<\/ul>\n<p><span data-term-id=\"55863265\">Double jeopardy<\/span> still applies to cases where <span data-term-id=\"55863311\">new evidence<\/span>\u200b emerges that wasn&#8217;t available during the <span data-term-id=\"55863282\">first trial<\/span>.
