With <span data-term-id=\"55739500\">blended sentencing<\/span>, a <span data-term-id=\"55739492\">juvenile offender<\/span> starts in a <span data-term-id=\"55739498\">juvenile detention<\/span> center and, as they approach the <span data-term-id=\"55739518\">age of majority<\/span>, is transferred to <span data-term-id=\"55739504\">adult jails<\/span>.<\/p>\n<p>There are five basic models of <span data-term-id=\"55739500\">blended sentencing<\/span>:<\/p>\n<ul>\n<li><strong>Juvenile inclusive<\/strong>: The <span data-term-id=\"55739495\">juvenile courts<\/span> simultaneously impose both adult and juvenile correctional <span data-term-id=\"55739525\">sanctions<\/span>, but\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-procedure\/suspended-sentences.html\">suspend the adult <span data-term-id=\"55739525\">sanction<\/span><\/a> until (and if) an offender violates the terms of their <span data-term-id=\"55739507\">juvenile sentence<\/span><\/li>\n<li><strong>Juvenile exclusive<\/strong>: The <span data-term-id=\"55739495\">juvenile courts<\/span> can impose both juvenile and <span data-term-id=\"55739537\">adult sentences<\/span>.<\/li>\n<li><strong>Juvenile contiguous<\/strong>: <span data-term-id=\"55739495\">Juvenile courts<\/span> impose a juvenile correctional sentence that stays in force beyond the age of extended jurisdiction (In certain states, a <span data-term-id=\"55739495\">juvenile court<\/span> can issue a <span data-term-id=\"55739535\">waiver<\/span> <a href=\"https:\/\/www.findlaw.com\/criminal\/juvenile-justice\/juvenile-waiver-transfer-to-adult-court.html\" target=\"_blank\" rel=\"noopener\">that transfers the case<\/a> to the adult correctional system)<\/li>\n<li><strong>Criminal inclusive<\/strong>: The criminal court imposes both adult and juvenile correctional <span data-term-id=\"55739525\">sanctions<\/span>, but suspends the <span data-term-id=\"55739537\">adult sentence<\/span> unless the individual commits a new offense or <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/probation-violation.html\">violates a condition of probation<\/a><\/li>\n<li><strong>Criminal exclusive<\/strong>: The criminal court can impose either an adult or a juvenile correctional sentence<\/li>\n<\/ul>\n<p>These <span data-term-id=\"55739500\">blended sentencing<\/span> rules reflect ongoing innovation and debate, primarily focusing on how to punish\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/juvenile-justice\/juvenile-delinquents.html\"><span data-term-id=\"55739492\">juvenile offenders<\/span><\/a>\u00a0while ensuring their mental health.<\/p>\n<h2>What Are the Maximum Sentences for Juvenile Defendants?<\/h2>\n<p>Each state has its own <span data-term-id=\"55739533\">sentencing laws<\/span> for <span data-term-id=\"55739492\">juvenile offenders<\/span>. Just as state laws dictate the maximum penalties in adult cases, they do the same thing for <span data-term-id=\"55739532\">juvenile cases<\/span>. These laws have changed in recent years. Until 2005, some states allowed the courts to sentence juveniles to death. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/543\/551.html\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"55739536\">Roper v. Simmons<\/span><\/em><\/a>, the <span data-term-id=\"55739516\">U.S. <\/span><span data-term-id=\"55739494\">Supreme Court<\/span> held that the states could not apply the death penalty to defendants under the age of 18.<\/p>\n<p>The <span data-term-id=\"55739494\">Supreme Court<\/span> has also limited the states&#8217; ability to impose sentences of <span data-term-id=\"55739513\">life without parole<\/span> (LWOP) on young people. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/08-7412.html\" target=\"_blank\" rel=\"noopener\"><em>Graham v. Florida<\/em><\/a> (2010), the <span data-term-id=\"55739494\">Supreme Court<\/span> held that courts limited sentencing a juvenile to <span data-term-id=\"55739513\">life without parole<\/span> in cases involving homicide. In 2012, <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/10-9646.html\" target=\"_blank\" rel=\"noopener\"><em><span data-term-id=\"55739520\">Miller v.
