You might also reach a solution in a matter of days rather than months. Instead, you and the retailer hire an arbitrator to decide your dispute. The arbitrator is usually a lawyer and often a former judge. The arbitrator does not represent the retailer&#8217;s interests. Their role is to be a neutral third party.<\/p>\n<p>The process involves streamlined steps:<\/p>\n<ol>\n<li>You have a hearing in front of the arbitrator, which may be in person or online with a video conference program like Zoom.<\/li>\n<li>You can call witnesses and submit documents, and the other side can do the same.<\/li>\n<li>The arbitrator considers the materials submitted, then decides.<\/li>\n<li>You and the retailer are bound to the arbitrator&#8217;s decision.<\/li>\n<\/ol>\n<p>You do not have a jury trial. You give up your right to appeal. You also give up any right to bring an action with a group of other customers with similar claims (a\u00a0<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/what-is-the-warranty-of-merchantability.html\">class action lawsuit<\/a>). Yet, you may resolve the dispute more quickly than in court.<\/p>\n<h2>Taking a Tech Retailer to Small Claims Court<\/h2>\n<p>Most retailers that require arbitration make an exception for\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/going-to-court\/small-claims-court.html\">small claims court<\/a>.<\/p>\n<p>States place limits on the amount you can recover in small claims court. In Rhode Island and Kentucky, it&#8217;s as low as $2,500. In Delaware and Tennessee, it&#8217;s as much as $25,000. The maximum depends on where you are.<\/p>\n<p>Check your local court&#8217;s website to see if your case falls within your state&#8217;s small claims limit. If so, this option may be an inexpensive, effective way to resolve your dispute with a tech retailer.
