States often regulate drone use for law enforcement, privacy, and specific activities like hunting. Federal law requires FAA registration and a Remote Pilot Certificate for commercial drone use. State-specific rules may include restrictions near critical infrastructure, schools, or public events. It&#8217;s essential to understand both federal and state laws before flying drones.<\/p>\n\n    <\/div>\n\n\n\n<p>Consumer and commercial drones are more accessible than ever. But flying a drone requires you to know and obey state laws like driving a car.<\/p>\n<p>People often use drones to take aerial photos and videos. But the government must balance allowing hobbies and business interests with protecting public safety.<\/p>\n<p>Most states have passed laws regulating the use of drones, but each state&#8217;s laws are different. You&#8217;ll need to learn the rules for drone flying whenever you move to a new state or travel.<\/p>\n<h2>Federal Laws vs. State Laws<\/h2>\n<p>Most drone rules come from\u00a0<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/federal-drone-registration-regulations.html\" target=\"_blank\" rel=\"noopener\">federal drone regulations<\/a>. The Federal Aviation Administration (FAA) has authority over the airspace in all states. As a result, states&#8217; ability to create laws for in-air activities, such as where you can or can&#8217;t fly, is limited.<\/p>\n<p>The FAA also manages nationwide drone registration and licensing through the\u00a0<a href=\"https:\/\/faadronezone-access.faa.gov\/\" target=\"_blank\" rel=\"noopener\">FAADroneZone<\/a>. For example, you need a Remote Pilot Certificate from the FAA to fly a drone commercially anywhere in the United States. Recreational drone pilots must also pass the FAA&#8217;s basic safety and knowledge test.<\/p>\n<h2>Common Ways States Regulate Drones<\/h2>\n<p>Alongside FAA regulations, states often create drone laws for the following topics:<\/p>\n<ul>\n<li>State agencies and law enforcement officers&#8217; use of drones<\/li>\n<li>Drone video, photography, and surveillance activities<\/li>\n<li>Drone programs in public schools and state universities<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/state\/state-fish-and-game-laws.html\" target=\"_blank\" rel=\"noopener\">Hunting and fishing<\/a>\u00a0activities with drones<\/li>\n<li>Agricultural use of drones<\/li>\n<\/ul>\n<p>Many laws refer to drones as &#8220;unmanned aircraft systems (UAS) &#8220;or &#8220;unmanned aerial vehicles (UAV). &#8220;<\/p>\n<p>Certain state laws apply to drones without mentioning them specifically. For example, states generally prohibit any activity that impedes emergency responses. A drone flight could break the law if it obstructs a police search, rescue, or wildfire control efforts.<\/p>\n<h2>State Laws for Drones<\/h2>\n<p>Find your state to learn more about its regulation of commercial and recreational drones. The chart below features select rules across state aviation, criminal, and environmental laws.<\/p>\n<p>Remember that more rules could apply. Local governments may pass ordinances affecting specific cities or municipalities. State parks often restrict drone activities.<\/p>\n<h2>Where Can I Fly Drones in My State?<\/h2>\n<p>You can find drone flight locations through the FAA&#8217;s website or mobile app,\u00a0<a href=\"https:\/\/www.faa.gov\/uas\/getting_started\/b4ufly\" target=\"_blank\" rel=\"noopener\">B4UFly<\/a>. Several companies offer programs using the B4UFly service.<\/p>\n<p>The patchwork of FAA regulations, state laws, and local restrictions can be confusing. Areas near airports and government buildings often ban drones. Other areas, like state parks, may ban drone launches and landings unless you get a permit.<\/p>\n<h2>Ask About the Drone Laws in Your State<\/h2>\n<p>Technology is rapidly evolving, and savvy consumers tend to buy new devices as soon as they hit the market. During a criminal investigation, police can use drones if they have a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/search-warrant-requirements.html\">valid search warrant<\/a>\u00a0or an exception to the warrant rule.<\/p>\n<p><a href=\"https:\/\/www.akleg.gov\/basis\/aac.asp#5.33.398\" target=\"_blank\" rel=\"noopener\">5 AAC \u00a7 33.398<\/a>: Commercial drone operators can&#8217;t use a UAS to locate salmon from one hour before open fishing begins until one hour after it ends.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Arizona<\/th>\n<td><a href=\"https:\/\/codes.findlaw.com\/az\/title-13-criminal-code\/az-rev-st-sect-13-3729\/\" target=\"_blank\" rel=\"noopener\">ARS \u00a7 13-3729<\/a>: Violating FAA requirements or interfering with emergency services using a drone or model aircraft is a Class 1 misdemeanor. Using a drone to photograph or fly above a &#8220;critical facility,&#8221; such as a power station or prison, is a felony.<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Arkansas<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/ar\/title-5-criminal-offenses\/ar-code-sect-5-16-101\/\" target=\"_blank\" rel=\"noopener\">AR Code \u00a7 5-16-101<\/a>: The use of drones to commit video voyeurism (<a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/what-is-invasion-of-privacy-.html\">invasion of privacy<\/a>) is a Class B misdemeanor. The crime rises to a Class A misdemeanor if you send the images to someone else or post them online.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ar\/title-5-criminal-offenses\/ar-code-sect-5-60-103\/\" target=\"_blank\" rel=\"noopener\">AR Code \u00a7 5-60-103<\/a>: Using drones for surveillance and gathering information on &#8220;critical infrastructure&#8221; (oil refinery, chemical manufacturing facility, power plant, etc.) is illegal without written consent.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">California<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/civil-code\/civ-sect-1708-8.html\" target=\"_blank\" rel=\"noopener\">CA Civil Code \u00a7 1708.8<\/a>: Using a drone to capture video or sound recordings of another person without their consent (invasion of privacy) is illegal. Violators are liable for up to three times the damages related to the violation and a civil fine of between $5,000 and $50,000.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/penal-code\/pen-sect-402.html\" target=\"_blank\" rel=\"noopener\">CA Penal Code \u00a7 402<\/a>: Flying a drone to look at the scene of an emergency is a misdemeanor.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-853\/\" target=\"_blank\" rel=\"noopener\">CA Government Code \u00a7 853 to 853.5<\/a>: Public employees are not liable for damaging drones interfering in an emergency response.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/penal-code\/pen-sect-4577.html\" target=\"_blank\" rel=\"noopener\">CA Penal Code \u00a7 4577<\/a>: Flying a drone above a correctional facility is an infraction with a $500 fine.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/fish-and-game-code\/fgc-sect-10501-5.html\" target=\"_blank\" rel=\"noopener\">CA Fish and Game Code \u00a7 10501.5<\/a>: No aircraft can fly under 3,000 feet above the Sespe Condor Sanctuary. No aircraft can fly under 1,000 feet in several other wildlife areas, including the Santa Barbara Islands and the Farallon Islands National Wildlife Refuge. Drone flights in these areas need a permit.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/ca\/fish-and-game-code\/fgc-sect-3003-5\/\" target=\"_blank\" rel=\"noopener\">CA Fish and Game Code \u00a7 3003.5<\/a>: Drones and other aircraft can&#8217;t herd or pursue wildlife except in limited circumstances.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Colorado<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-8-104\/\" target=\"_blank\" rel=\"noopener\">CRS \u00a7 18-8-104<\/a>: It is illegal to obstruct law enforcement and emergency responders by using a drone. Getting permission and following the responder or officer&#8217;s instructions offers an exception to this rule.<\/p>\n<p><a href=\"https:\/\/www.sos.state.co.us\/CCR\/GenerateRulePdf.do?ruleVersionId=11447\" target=\"_blank\" rel=\"noopener\">CO Code of Regulations Rule 2, 406-0 #004<\/a>: Using drones to scout and detect wildlife while hunting is against the law.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Connecticut<\/th>\n<td>None<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">District of Columbia<\/th>\n<td><a href=\"https:\/\/www.uscp.gov\/sites\/evo-subsites\/www.uscp.gov\/files\/documents\/Capitol%20Police%20Board%20US%20Capitol%20Grounds%20Traffic%20Regulations%20-%20For%20Public%20Release.pdf\" target=\"_blank\" rel=\"noopener\">Traffic Regulations \u00a716.2.90<\/a>: Model aircraft and drones are prohibited on Capitol grounds. Under federal law, the FAA has designated a 30-mile radius around the District of Columbia as a\u00a0<a href=\"https:\/\/www.faa.gov\/newsroom\/restricted-airspace-0\" target=\"_blank\" rel=\"noopener\">Special Flight Rules Area<\/a>\u00a0(SFRA), or &#8220;no-drone zone.&#8221;<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Delaware<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/de\/title-11-crimes-and-criminal-procedure\/de-code-sect-11-1334\/\" target=\"_blank\" rel=\"noopener\">DE Code \u00a7 11-1334<\/a>: Drone operators cannot fly over &#8220;critical infrastructure,&#8221; emergency scenes, or events with more than 1,500 attendees. It&#8217;s also illegal to fly drones in a way that harasses someone or violates their privacy on private property. Offenses are misdemeanors or Class B misdemeanors for repeat offenses. The crime is a Class A misdemeanor if it caused injury or property damage.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/de\/title-11-crimes-and-criminal-procedure\/de-code-sect-11-1256.html\" target=\"_blank\" rel=\"noopener\">DE Code \u00a7 11-1256<\/a>: Delivering contraband to a prison using a drone is a Class F felony.<\/p>\n<p><a href=\"https:\/\/regulations.delaware.gov\/AdminCode\/title7\/9000\/9200%20Operation%20and%20Maintenance%20Section\/9201.shtml\" target=\"_blank\" rel=\"noopener\">DE Administrative Code 7-9000-9200-13<\/a>: State parks ban launching, flying, and voluntarily landing drones except in designated areas.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Florida<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/fl\/title-xlvii-criminal-procedure-and-corrections\/fl-st-sect-934-50\/\" target=\"_blank\" rel=\"noopener\">FL Criminal Code \u00a7 934.50<\/a>:\u00a0Drones may not be used for surveillance in violation of another party&#8217;s reasonable expectation of privacy, including for law enforcement. But, police may use drones with a valid search warrant. Violators may have to pay legal fees and compensatory damages, and the victims may seek injunctive relief.<\/p>\n<p><a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0300-0399\/0330\/Sections\/0330.41.html\" target=\"_blank\" rel=\"noopener\">FL Aviation Code \u00a7 330.41<\/a>: The Unmanned Aircraft Systems Act bans flying drones over a &#8220;critical infrastructure facility&#8221; without written permission. Drones also must not interfere with the facility&#8217;s operations or come into contact with it. First-time violations are second-degree misdemeanors. Repeat offenses are first-degree misdemeanors.<\/p>\n<p><a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;Search_String=&amp;URL=0300-0399\/0330\/Sections\/0330.411.html\" target=\"_blank\" rel=\"noopener\">FL Aviation Code \u00a7 330.411<\/a>: Weapons, explosives, and ammunition can&#8217;t be attached to a drone. This rule applies to possessing and flying the drone.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Georgia<\/th>\n<td>None<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Hawaii<\/th>\n<td>\n<p><a href=\"https:\/\/www.capitol.hawaii.gov\/hrscurrent\/Vol03_Ch0121-0200D\/HRS0188\/HRS_0188-0023_0005.htm\" target=\"_blank\" rel=\"noopener\">HRS \u00a7188-23.5<\/a>: Using a drone for fishing activities requires a permit.<\/p>\n<p><a href=\"https:\/\/dlnr.hawaii.gov\/dsp\/park-rules\/\" target=\"_blank\" rel=\"noopener\">Hawaii state park regulations<\/a>\u00a0prohibit using drones.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Idaho<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/id\/title-21-aeronautics\/id-st-sect-21-213\/\" target=\"_blank\" rel=\"noopener\">ID Code \u00a7 21-213<\/a>: Surveillance and recording of another person or their property via drone is prohibited without their written consent. The target of the surveillance or recording can sue a drone operator who violates this law. This statute also specifies when and how the police, emergency services, and government agencies may use drones.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/id\/title-36-fish-and-game\/id-st-sect-36-1101.html\" target=\"_blank\" rel=\"noopener\">ID Code \u00a7 36-1101<\/a>: Using drones to locate, drive, or shine light on wildlife for hunting is illegal. Violations are misdemeanor crimes.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Illinois<\/th>\n<td>\n<p><a href=\"https:\/\/codes.findlaw.com\/il\/chapter-725-criminal-procedure\/il-st-sect-725-167-1.html\" target=\"_blank\" rel=\"noopener\">725 ILCS \u00a7 167\/1<\/a>\u00a0to 167\/40 (The Freedom from Drone Surveillance Act): Law enforcement can&#8217;t use drones to surveil citizens except in limited circumstances. A few examples of the exceptions include responding to terrorist attack risks, reasonable suspicion of imminent threats, and destruction of evidence. A valid search warrant may allow drone surveillance. The police may also use drones to take pictures of a crime scene.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-48-3.html\" target=\"_blank\" rel=\"noopener\">720 ILCS \u00a7 5\/48-3<\/a>: Using a drone to interfere with someone else&#8217;s hunting or fishing activities is a public nuisance. Violations are Class A misdemeanors.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/il\/chapter-520-wildlife\/il-st-sect-520-5-2-33\/\" target=\"_blank\" rel=\"noopener\">520 ILCS \u00a7 5\/2.33<\/a>: Disturbing, pursuing, hunting, and shining light on wildlife using a drone is illegal.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/il\/chapter-620-air-transportation\/il-st-sect-620-5-42-1.html\" target=\"_blank\" rel=\"noopener\">620 ILCS \u00a7 5\/42.1<\/a>: Drone regulations are only at the state level. But cities with more than a million residents can pass local drone ordinances.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<th style=\"text-align: left\" scope=\"row\">Indiana<\/th>\n<td>\n<p>IAC 312 8-2-8 (i): Drones can&#8217;t land and launch on Indiana Department of National Resources properties without a permit.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-42-4-12-5\/\" target=\"_blank\" rel=\"noopener\">IN Code \u00a7 35-42-4-12.5<\/a>: Convicted sex offenders can&#8217;t use a drone to record, follow, or contact someone. This crime can be a Class A misdemeanor or a level 6 felony.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/in\/title-14-natural-and-cultural-resources\/in-code-sect-14-22-6-16\/\" target=\"_blank\" rel=\"noopener\">IN Code \u00a7 14-22-6-16<\/a>: Hunters can&#8217;t use drones to find wild game.\u00a0<a href=\"https:\/\/trackbill.com\/bill\/indiana-senate-bill-189-locating-and-recovering-wild-game\/2471635\/\" target=\"_blank\" rel=\"noopener\">Senate Bill 189<\/a>\u00a0amended the law to allow infrared drones to recover an animal already legally hunted.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-33-5-9\/\" target=\"_blank\" rel=\"noopener\">IN Code 35-33-5-9<\/a>: Indiana police officers need a search warrant to surveil or record photos and videos on private property.
