Emergencies like hurricanes, pandemics, terrorist attacks, and wildfires create dire need. Access to necessities like drinking water and medical supplies becomes urgent. It can even make the difference between life and death.<\/p>\n<p>Some retailers and other businesses may try to take advantage of these situations. They might see an opportunity to maximize profits by using unfair tactics. Charging much higher prices during an emergency could be illegal price gouging.<\/p>\n<p>Federal consumer protection laws don&#8217;t address price gouging, but your state laws might. Price gouging is an <a href=\"https:\/\/www.findlaw.com\/state\/consumer-laws\/deceptive-trade-practices.html\">unfair or deceptive trade practice<\/a> in most states.\u00a0But price gouging laws can be very different from place to place.<\/p>\n<p>These laws exist to <a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/buying-goods.html\">protect consumers<\/a>, so they typically set civil penalties for price gouging. The state\u2019s office of the attorney general enforces them. Some state laws also add criminal penalties for price gouging in their penal codes.<\/p>\n<h2>Do High Prices Indicate Price Gouging?<\/h2>\n<p>No, steep price increases are not always price gouging. State laws set specific criteria to measure whether high prices are illegal.<\/p>\n<p>To identify price gouging, the government usually checks factors like:<\/p>\n<ul>\n<li>The product or service in question<\/li>\n<li>How much the price increased<\/li>\n<li>When the price increased<\/li>\n<li>Why the seller or provider raised the price<\/li>\n<li>Whether the governor declared a state of emergency<\/li>\n<\/ul>\n<p>Retailers can raise the price of their products as <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-operations\/law-of-supply-and-demand-definition.html\">supply and demand<\/a> change. For example, a deadly virus may lower the supply of chickens, leading to higher costs of eggs.<\/p>\n<p>People might use the term \u201cprice gouging\u201d to describe these new price spikes. Yet, the legal definition is more specific. Most laws also consider whether the seller had a good reason to raise prices during the emergency.<\/p>\n<h3>High Prices of Essential Goods and Services<\/h3>\n<p>Goods and services often suspected of price gouging include:<\/p>\n<ul>\n<li>Groceries<\/li>\n<li>Medical supplies<\/li>\n<li>Gasoline<\/li>\n<li>Roof and window repair services<\/li>\n<li><a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/protection-for-tenants-rent-control.html\">Rent for properties<\/a> near the affected area<\/li>\n<li>Water, electricity, and <a href=\"https:\/\/www.findlaw.com\/legalblogs\/law-and-life\/what-can-you-do-about-surprise-utility-bills\/\">other utilities<\/a><\/li>\n<li>Tree removal services<\/li>\n<\/ul>\n<p>State laws often say which things can\u2019t get more expensive during an emergency. For example, almost all such laws ban selling food and fuel at unfairly high prices. Yet, an attorney general may have discretion for what counts as essential. Keeping prices stable ensures they stay as affordable as possible for everyone.<\/p>\n<h2>How Do State Laws Define Price Gouging?<\/h2>\n<p>Price gouging is generally based on average prices in an area before an emergency. A look-back period, such as 30 days, measures how high prices rose during the emergency.\u00a0<\/p>\n<p>Price increases of 10% to 15% often count as excessive price hikes. Sellers who raise prices that high without a justifiable reason could face civil or criminal penalties.<\/p>\n<p>Many <a href=\"https:\/\/www.findlaw.com\/state\/consumer-laws.html\">state laws<\/a> use nonspecific terms like &#8220;gross disparity&#8221; instead of an exact percentage. This vague description leaves price gouging open for interpretation. The state\u2019s consumer protection authority\u00a0determines whether prices rose too much.<\/p>\n<h3>Example Price Gouging Case<\/h3>\n<p>In 2020, the New York attorney general\u00a0<a href=\"https:\/\/ag.ny.gov\/press-release\/2020\/attorney-general-james-stops-three-amazon-sellers-price-gouging-hand-sanitizer\" target=\"_blank\" rel=\"noopener\">penalized hand sanitizer sellers<\/a>\u00a0for price gouging.<\/p>\n<p>The companies sold products for around $20 to $35 before the coronavirus pandemic. During the public health crisis, they charged customers around $80 to $130 for the same products.<\/p>\n<p>This price difference of about 400% during an emergency violated the state&#8217;s price gouging statute.<\/p>\n<h2>State Price Gouging Laws and Penalties<\/h2>\n<p>Below are summaries of state laws prohibiting acts of price gouging in the event of a declared emergency.
