But state and federal laws place limits on gun purchases, sales, and who may have them.<\/p>\n<p>Federal law requires licensed firearms dealers (also known as &#8220;federal firearms license dealers&#8221; or FFLs) to do background checks on prospective unlicensed buyers. But whether a private party can sell another private party a firearm without a background check depends on state laws.<\/p>\n<p>Some states require background checks for private sales, usually through a licensed intermediary. For example, Illinois requires a private party who wants to sell a firearm to another person to get a\u00a0<a href=\"https:\/\/isp.illinois.gov\/Foid\/Foid\" target=\"_blank\" rel=\"noopener\">Firearms Owner&#8217;s Identification Card<\/a>\u00a0and show it to law enforcement before selling or transferring a firearm. Other states, like Wyoming, have no regulations on private gun sales.<\/p>\n<p>The\u00a0<a href=\"https:\/\/codes.lp.findlaw.com\/uscode\/18\/I\/44\/922\" target=\"_blank\" rel=\"noopener\">Brady Handgun Violence Protection Act<\/a>\u00a0bans certain people from becoming gun owners. For example, people under protective orders for\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/domestic-violence.html\">domestic violence<\/a>, felons, and certain people who have specific mental health diagnoses can&#8217;t own firearms. A prohibited person who has a firearm may face steep criminal penalties, and so may the transferee.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.atf.gov\/file\/58681\/download\" target=\"_blank\" rel=\"noopener\">Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF)<\/a>\u00a0notes that an unlicensed person may sell or transfer a firearm to another unlicensed person in the same state only if they believe the buyer can own firearms. The ATF gives a list of categories that ban people from having a firearm. (<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-922\/#\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 922(g) and (n)<\/a>).<\/p>\n<p>Also, a private party generally can&#8217;t directly sell or transfer a firearm to an out-of-state person. Instead, they typically must use an FFL in the buyer&#8217;s state to complete the transfer.<\/p>\n<p>Below is a list of private gun sale laws by state, including background check rules. Anyone who transfers a firearm violating the law may be held strictly liable for any civil damages caused by the buyer&#8217;s use of the weapon. These rules do not apply to transfers that are gifts or loans between immediate family members, among other exemptions. (C.R.S. \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-12-112.html\" target=\"_blank\" rel=\"noopener\">18-12-112<\/a>)<\/p>\n<\/td>\n<td>\n<p>Unlawfully engaging in a handgun sale or otherwise providing one to a minor is a Class 4 felony. Unlawfully providing any firearm other than a handgun to a minor without their parent or guardian&#8217;s consent is a Class 1 misdemeanor. (C.R.S. \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-12-108-7\/\" target=\"_blank\" rel=\"noopener\">18-12-108.7<\/a>)<\/p>\n<p>A person who knowingly gets a firearm on a prohibited person&#8217;s behalf, knowing (or when they reasonably should know) that the person cannot have a firearm, is guilty of a Class 4 felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-12-111.html\" target=\"_blank\" rel=\"noopener\">18-12-111<\/a>)<\/p>\n<p>A private seller who sells a firearm to a buyer and violates \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-12-112.html\" target=\"_blank\" rel=\"noopener\">18-12-112<\/a>\u00a0is guilty of a Class 2 misdemeanor. Upon conviction, the court will ban them from having a firearm for two years. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/co\/title-18-criminal-code\/co-rev-st-sect-18-12-112\/\" target=\"_blank\" rel=\"noopener\">18-12-112(9)(a)<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/connecticut-law\/connecticut-gun-control-laws.html\">Connecticut<\/a><\/td>\n<td>\n<p>A private seller who wishes to sell a pistol, revolver, or a long gun (e.g., a rifle or shotgun) to a private buyer must get authorization from the\u00a0<a href=\"http:\/\/www.ct.gov\/despp\/site\/default.asp\" target=\"_blank\" rel=\"noopener\">Commissioner of Emergency Services and Public Protection<\/a>, who will perform a background check. The buyer must present an appropriate gun eligibility certificate before the background check. (Conn. Gen. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ct\/title-29-public-safety-and-state-police\/ct-gen-st-sect-29-33.html\" target=\"_blank\" rel=\"noopener\">29-33(a)<\/a>)<\/p>\n<p>Selling a pistol or revolver to a person under 21 is a Class C felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ct\/title-29-public-safety-and-state-police\/ct-gen-st-sect-29-34.html\" target=\"_blank\" rel=\"noopener\">29-34(b)<\/a>)<\/p>\n<p>Selling a long gun to a prohibited person is a Class D felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ct\/title-29-public-safety-and-state-police\/ct-gen-st-sect-29-37a.html\" target=\"_blank\" rel=\"noopener\">29-37a<\/a>)<\/p>\n<p>Anyone who knowingly transfers a firearm to a prohibited person is strictly liable for any injuries that person causes with that firearm. (<a href=\"https:\/\/codes.findlaw.com\/ct\/title-52-civil-actions\/ct-gen-st-sect-52-571f.html\" target=\"_blank\" rel=\"noopener\">Conn. Gen. Stat. \u00a7 52-571(f)<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/delaware-law\/delaware-gun-control-laws.html\">Delaware<\/a><\/td>\n<td>\n<p>An unlicensed seller of firearms must conduct a background check on the prospective buyer through a licensed firearms dealer. (<a href=\"https:\/\/codes.findlaw.com\/de\/title-11-crimes-and-criminal-procedure\/de-code-sect-11-1445.html\" target=\"_blank\" rel=\"noopener\">Title 11 \u00a7 1445<\/a>)<\/p>\n<p>A person engages in a firearms transaction on another person&#8217;s behalf if they buy or get a firearm on behalf of a person who is not legally qualified to buy, own, or possess a firearm (or to sell, give, or otherwise transfer a firearm to a\u00a0<a href=\"https:\/\/codes.findlaw.com\/de\/title-11-crimes-and-criminal-procedure\/de-code-sect-11-1448.html\" target=\"_blank\" rel=\"noopener\">prohibited person<\/a>). A violation of this law is a Class E felony. (<a href=\"https:\/\/codes.findlaw.com\/de\/title-11-crimes-and-criminal-procedure\/de-code-sect-11-1455.html\" target=\"_blank\" rel=\"noopener\">Title 11 \u00a7 1455<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td>\n<p><a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/district-of-columbia-gun-control-laws.html\">District of Columbia<\/a><\/p>\n<\/td>\n<td>A private seller must have a valid registration certificate to sell a firearm. (<a href=\"https:\/\/codes.findlaw.com\/dc\/division-i-government-of-district\/dc-code-sect-7-2502-01\/\" target=\"_blank\" rel=\"noopener\">DC Code \u00a7 7\u20132505.01<\/a>) Generally, the seller must arrange for a licensed gun dealer to sell a firearm to a private party. The FFL must run a background check on the prospective buyer before completing the sale or transfer.<\/td>\n<td>\n<p>No person can sell a pistol to a person whom they believe (or has reasonable cause to believe) is not of sound mind, is\u00a0<a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-4503.html\" target=\"_blank\" rel=\"noopener\">prohibited from possessing a pistol<\/a>, or is under 21 years of age (unless the person who sells the pistol is the 21-year-old&#8217;s parent or guardian). (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/dc\/division-iv-criminal-law-and-procedure-and-prisoners\/dc-code-sect-22-4507\/\" target=\"_blank\" rel=\"noopener\">22-4507<\/a>)<\/p>\n<p>A person who buys a firearm must register it with the D.C. Metropolitan Police Department. (<a href=\"https:\/\/codes.findlaw.com\/dc\/division-i-government-of-district\/dc-code-sect-7-2502-07a\/\" target=\"_blank\" rel=\"noopener\">\u00a7 7-2502.07a<\/a>)<\/p>\n<p>It&#8217;s illegal to fail to establish proof of the buyer&#8217;s residence or fail to follow D.C.&#8217;s registration and waiting rules before delivering a firearm. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/dc\/division-i-government-of-district\/dc-code-sect-7-2531-01.html\" target=\"_blank\" rel=\"noopener\">7-2531.01(4)(A)-(B)<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/florida-law\/florida-gun-control-laws.html\">Florida<\/a><\/td>\n<td>\n<p>Florida does not require background checks for the sale of a firearm between private parties. But county governments have the authority to require background checks and a three- to five-day waiting period for private firearms transfers. (<a href=\"http:\/\/www.leg.state.fl.us\/Statutes\/index.cfm?Mode=Constitution&amp;Submenu=3&amp;Tab=statutes#A8S05\" target=\"_blank\" rel=\"noopener\">Fla. Const. art. (<a href=\"https:\/\/codes.findlaw.com\/id\/title-18-crimes-and-punishments\/id-st-sect-18-8505.html\" target=\"_blank\" rel=\"noopener\">\u00a7 18-8505<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/illinois-law\/illinois-gun-control-laws.html\">Illinois<\/a><\/td>\n<td>\n<p>A buyer must have a valid\u00a0<a href=\"https:\/\/www.ispfsb.com\/Public\/FOID.aspx\" target=\"_blank\" rel=\"noopener\">FOID<\/a>\u00a0or a license to carry a concealed firearm, which requires them to undergo a background check. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-430-public-safety\/il-st-sect-430-65-3\/\" target=\"_blank\" rel=\"noopener\">65\/3(a-5)<\/a>). The seller must also provide police with the buyer&#8217;s FOID.<\/p>\n<\/td>\n<td>\n<p>A person who sells or delivers a firearm commits a criminal offense if they knowingly do any of the following (<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-24-3\/#\" target=\"_blank\" rel=\"noopener\">ILCS 720 \u00a7 5\/24-3<\/a>):<\/p>\n<ul>\n<li>Sells or gives a firearm, the size of which one could conceal, to a minor (i.e., under 18)<\/li>\n<li>Sells or gives a firearm to a person under 21 who has a prior misdemeanor conviction (other than a traffic offense or they were adjudged delinquent)<\/li>\n<li>Sells or gives a firearm to a person addicted to narcotics<\/li>\n<li>Sells or gives a firearm to a person who has a felony conviction in Illinois or any other jurisdiction<\/li>\n<li>Sells or gives a firearm to a person who was a patient in a mental institution within the past five years<\/li>\n<li>Sells or gives any firearms to any person who has an intellectual disability.<\/li>\n<li>Delivers a firearm after a completed sale without withholding its delivery for at least 72 hours (subject to several exceptions per\u00a0<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-24-3\/#\" target=\"_blank\" rel=\"noopener\">ILCS 720 \u00a7 5\/24-3(g)<\/a>)<\/li>\n<li>Sells or gives a firearm to anyone under 18 who does not have a valid FOID.<\/li>\n<li>Sells or gives a firearm while selling firearms without being a licensed federal firearms dealer per\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-923\/#\" target=\"_blank\" rel=\"noopener\">18 U.S.C. \u00a7 923<\/a><\/li>\n<li>Sells or transfers ownership of a firearm to a person who does not show them a valid FOID or license to carry a concealed firearm<\/li>\n<li>Failing to determine the validity of a buyer&#8217;s FOID<\/li>\n<\/ul>\n<p>A person who transfers three or more firearms violating\u00a0<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-24-3\/#\" target=\"_blank\" rel=\"noopener\">\u00a7 5\/24-3<\/a>\u00a0is guilty of gunrunning, a Class 1 or Class X felony, depending on the circumstances. (<a href=\"https:\/\/codes.findlaw.com\/il\/chapter-720-criminal-offenses\/il-st-sect-720-5-24-3a\/\" target=\"_blank\" rel=\"noopener\">\u00a7 5\/24-3A<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/indiana-law\/indiana-gun-control-laws.html\">Indiana<\/a><\/td>\n<td>None<\/td>\n<td>\n<p>A person may not sell, give, or otherwise transfer ownership or possession of a handgun or machine gun to a minor (unless the minor is their child or ward). The offense is a Level Five felony. But if the person they sold the weapon to commits murder with it, it is a Level Three felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-47-2-7.html?\/\" target=\"_blank\" rel=\"noopener\">35-47-2-7(d)(1)-(2)<\/a>)<\/p>\n<p>A private seller may not sell a handgun violating Chapter 35. They also can&#8217;t sell a handgun if they don&#8217;t personally know the buyer or until they get clear evidence of the buyer&#8217;s identity. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/in\/title-35-criminal-law-and-procedure\/in-code-sect-35-47-2-16\/\" target=\"_blank\" rel=\"noopener\">35-47-2-16<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/iowa-law\/iowa-gun-control-laws.html\">Iowa<\/a><\/td>\n<td>\n<p>A buyer must get a permit to own or carry weapons before owning a handgun, which includes a background check. (Iowa Code \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-724-15.html\" target=\"_blank\" rel=\"noopener\">724.15(1)<\/a>)<\/p>\n<p>A permit to acquire is subject to an annual review. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-724-17\/\" target=\"_blank\" rel=\"noopener\">724.17<\/a>)<\/p>\n<\/td>\n<td>\n<p>A private seller may not transfer firearms to someone they know (or reasonably should know) is\u00a0<a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-724-26.html\" target=\"_blank\" rel=\"noopener\">prohibited from owning them<\/a>. Violating this law is a Class D felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-724-16\/\" target=\"_blank\" rel=\"noopener\">724.16<\/a>) A person who sells, loans, gives, or makes available a rifle or shotgun (or ammunition for those firearms) to a minor commits a serious misdemeanor. A second or subsequent offense is a Class D felony. But the minor&#8217;s parent, guardian, or adult spouse may allow them to have the rifle, shotgun, or ammunition. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-724-22\/\" target=\"_blank\" rel=\"noopener\">724.22(1), (3)<\/a>)<\/p>\n<p>A person who sells, loans, or gives a pistol or revolver (or ammunition for a firearm) to someone under 21 commits a serious misdemeanor for a first offense (a Class D felony for a subsequent offense). (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ia\/title-xvi-criminal-law-and-procedure-chs-687-916\/ia-code-sect-724-22\/\" target=\"_blank\" rel=\"noopener\">724.22(2)<\/a>)<\/p>\n<p>Several exceptions apply for those 18 to 20 years old, including if they are on military duty or they are a peace officer. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ky\/title-l-kentucky-penal-code\/ky-rev-st-sect-527-110\/?_gl=1*yiwjo2*_gcl_au*MTg1MTI3NjQzNS4xNzIwNDQ4ODMy\" target=\"_blank\" rel=\"noopener\">527.110<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/louisiana-law\/louisiana-gun-control-laws.html\">Louisiana<\/a><\/td>\n<td>None<\/td>\n<td>\n<p>A person may not give, sell, or otherwise transfer a firearm or ammunition to someone they know is a felon and\u00a0<a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-14-sect-95-1.html\" target=\"_blank\" rel=\"noopener\">prohibited from possessing a firearm<\/a>. If convicted, the seller faces up to five years in prison and a fine of up to $5,000. (La. Rev. Stat. Upon conviction, the seller faces up to one year of jail time and a fine of up to $2,500. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/la\/revised-statutes\/la-rev-stat-tit-14-sect-95-1-4.html\" target=\"_blank\" rel=\"noopener\">95.1.4<\/a>)<\/p>\n<p>A person may not knowingly make a firearm available to a client of any treatment facility. If convicted, they face up to two years in prison and a fine of up to $500. (\u00a7\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/public-safety\/md-code-public-safety-sect-5-125\/\" target=\"_blank\" rel=\"noopener\">5-125<\/a>,\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/public-safety\/md-code-public-safety-sect-5-128.html\" target=\"_blank\" rel=\"noopener\">5-128<\/a>)<\/p>\n<p>A private seller may not sell, rent, loan, or transfer a regulated firearm to another person whom they know (or they have reasonable cause to believe) is any of the following (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/public-safety\/md-code-public-safety-sect-5-134\/\" target=\"_blank\" rel=\"noopener\">5-134<\/a>):<\/p>\n<ul>\n<li>Under 21, unless they meet the exceptions noted in \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/public-safety\/md-code-public-safety-sect-5-133.html\" target=\"_blank\" rel=\"noopener\">5-133(d)<\/a><\/li>\n<li>Was convicted of a disqualifying crime<\/li>\n<li>Was convicted of a conspiracy to commit a felony<\/li>\n<li>Was convicted of a common law crime and got a prison sentence of more than two years<\/li>\n<li>Is a fugitive<\/li>\n<li>Is a &#8220;habitual drunkard&#8221;<\/li>\n<li>Is addicted to a controlled dangerous substance (or they habitually use a controlled dangerous substance)<\/li>\n<li>Suffers from a mental disorder (defined in \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/health-general\/md-code-health-gen-sect-10-101.html\" target=\"_blank\" rel=\"noopener\">10-101(i)(2) of the Health\u2014General Article<\/a>) and has a history of violent behavior against another (unless they have a physician&#8217;s certificate declaring them capable of having a regulated firearm)<\/li>\n<li>Was confined for more than 30 days consecutively to a facility (defined in \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/health-general\/md-code-health-gen-sect-10-101.html\" target=\"_blank\" rel=\"noopener\">10-101(i)(2)<\/a>) unless they have a physician&#8217;s certificate declaring them capable of possessing a regulated firearm<\/li>\n<li>Is a respondent against whom a court has entered a current non-ex parte\u00a0<a href=\"https:\/\/www.findlaw.com\/state\/maryland-law\/maryland-protective-orders-laws.html#\">civil protective order<\/a><\/li>\n<li>Is under 30 at the time of the sale and has been adjudicated delinquent by a juvenile court for an act that would disqualify an adult from having a regulated firearm<\/li>\n<li>Is visibly under the influence of alcohol or drugs<\/li>\n<li>Is a participant in a straw purchase<\/li>\n<li>Has not completed a certified firearms safety training course from the\u00a0<a href=\"https:\/\/mpctc.dpscs.maryland.gov\/\" target=\"_blank\" rel=\"noopener\">Maryland Police Training and Standards Commission<\/a><\/li>\n<li>Intends to use the regulated firearm to commit a crime or cause harm to another person<\/li>\n<\/ul>\n<p>A private seller may not sell, give, or transfer a firearm to a minor. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/md\/public-safety\/md-code-public-safety-sect-5-134\/\" target=\"_blank\" rel=\"noopener\">5-134(d)<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/massachusetts-law\/massachusetts-gun-control-laws.html\">Massachusetts<\/a><\/td>\n<td>None. But any person who sells a firearm must report the sale to the\u00a0<a href=\"https:\/\/mircs.chs.state.ma.us\/fa10\/action\/home?app_context=home&amp;app_action=presentHome#https:\/\/mircs.chs.state.ma.us\/fa10\/action\/home?app_context=home&amp;app_action=presentHome\" target=\"_blank\" rel=\"noopener\">Department of Criminal Justice Information Services Firearms Records Bureau (FRB)<\/a>. This includes providing the following to the FRB:\n<ul>\n<li>A detailed description of the transferred weapon (serial number\/make\/model\/caliber, etc.)<\/li>\n<li>The seller\/transferor&#8217;s license information<\/li>\n<li>The buyer\/transferee&#8217;s license information<\/li>\n<\/ul>\nAlso, the state recommends sellers require buyers to show a valid firearm identification card (FID) or a license to carry (LTC) license validation certificate before a sale.<\/td>\n<td>\n<p>A private seller must have a firearm identification card or a license to carry firearms (unless they are exempt under\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-129c\/\" target=\"_blank\" rel=\"noopener\">Mass. Gen. Law \u00a7 129C<\/a>\u00a0and the buyer has a permit to buy a firearm and an FID or LTC). (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-128a\/\" target=\"_blank\" rel=\"noopener\">128A<\/a>)<\/p>\n<p>Selling, renting, or leasing a firearm, rifle, shotgun, or machine gun violating Chapter 140 is punishable by at least one year of imprisonment (up to 10 years) and a fine of at least $1,000 (up to $10,000). (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-128\/\" target=\"_blank\" rel=\"noopener\">128<\/a>)<\/p>\n<p>A person may only sell, give away, loan, or otherwise transfer a rifle or shotgun (or their ammunition) in the following situations (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-129c\/\" target=\"_blank\" rel=\"noopener\">129C<\/a>):<\/p>\n<ul>\n<li>By operation of law<\/li>\n<li>To an exempt person (as described in (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-129c\/\" target=\"_blank\" rel=\"noopener\">129C(a)-(u)<\/a>)<\/li>\n<li>To a licensed dealer<\/li>\n<li>To a person who displayed their FID or LTC<\/li>\n<\/ul>\n<p>A private seller must report any firearm transfer to the Commissioner of the\u00a0<a href=\"https:\/\/www.mass.gov\/orgs\/department-of-criminal-justice-information-services\" target=\"_blank\" rel=\"noopener\">Department of Criminal Justice Information Services (DCJIS)<\/a>\u00a0within seven days of the transfer. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-129c\/\" target=\"_blank\" rel=\"noopener\">129C<\/a>)<\/p>\n<p>Whoever sells or furnishes a rifle, shotgun, or ammunition to the following people faces up to 10 years in state prison (or two-and-a-half years in a house of correction) and at least a $1,000 fine (up to $10,000) (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-130\/\" target=\"_blank\" rel=\"noopener\">130<\/a>):<\/p>\n<ul>\n<li>An alien over 18 who does not hold a permit card under \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/ma\/part-i-administration-of-the-government-ch-1-182\/ma-gen-laws-ch-140-sect-131h\/\" target=\"_blank\" rel=\"noopener\">131H<\/a><\/li>\n<li>An alien under age 19<\/li>\n<li>A person under 21<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/michigan-law\/michigan-gun-control-laws.html\">Michigan<\/a><\/td>\n<td>\n<p>A buyer must have a pistol license (e.g., a purchase license or concealed carry license) before they buy one. (MCL \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-28-michigan-state-police\/mi-comp-laws-28-422\/\" target=\"_blank\" rel=\"noopener\">28.422<\/a>) These licenses require a background check. (\u00a7\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-28-michigan-state-police\/mi-comp-laws-28-425b\/\" target=\"_blank\" rel=\"noopener\">28-425b<\/a>,\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-28-michigan-state-police\/mi-comp-laws-28-426\/\" target=\"_blank\" rel=\"noopener\">28-426<\/a>)<\/p>\n<p>A conviction for a violation of \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-28-michigan-state-police\/mi-comp-laws-28-422\/\" target=\"_blank\" rel=\"noopener\">28.422<\/a>\u00a0is a misdemeanor. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-223\/\" target=\"_blank\" rel=\"noopener\">750-223(1)<\/a>)<\/p>\n<\/td>\n<td>\n<p>The seller must fill out license forms for any firearm they sell. Required information on the form includes:<\/p>\n<ul>\n<li>A description of the firearm<\/li>\n<li>The date of sale or acquisition<\/li>\n<li>The seller&#8217;s signature and note that they sold the firearm to the buyer (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-28-michigan-state-police\/mi-comp-laws-28-422\/\" target=\"_blank\" rel=\"noopener\">28.422(5)<\/a>)<\/li>\n<\/ul>\n<p>A person who knowingly sells a firearm more than 26 inches long to a minor commits a misdemeanor. A second offense is a felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-223\/\" target=\"_blank\" rel=\"noopener\">750-223(2)<\/a>)<\/p>\n<p>Per \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-223\/\" target=\"_blank\" rel=\"noopener\">750-223<\/a>, a person commits a felony if they sell firearms or ammunition to a person they know is either:<\/p>\n<ul>\n<li>Under indictment for a felony or<\/li>\n<li>Banned from having a firearm under \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-224f.html\" target=\"_blank\" rel=\"noopener\">750.224f<\/a><\/li>\n<\/ul>\n<p>A person who sells, offers for sale, has, or manufactures the following commits a felony (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-224\/\" target=\"_blank\" rel=\"noopener\">750-224(1)<\/a>):<\/p>\n<ul>\n<li>A machine gun or firearm that automatically shoots (or is designed to automatically shoot) more than one shot by a single function of the trigger without manual reloading<\/li>\n<li>A muffler or silencer<\/li>\n<li>A short-barreled shotgun or rifle (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-224b\/\" target=\"_blank\" rel=\"noopener\">750-224b<\/a>)<\/li>\n<li>Armor-piercing ammunition (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-224c\/\" target=\"_blank\" rel=\"noopener\">750-224c<\/a>)<\/li>\n<li>A device designed or intended to convert a semiautomatic firearm into a fully automatic firearm (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mi\/chapter-750-michigan-penal-code\/mi-comp-laws-750-224e\/\" target=\"_blank\" rel=\"noopener\">750-224e<\/a>)<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/minnesota-law\/minnesota-gun-control-laws.html\">Minnesota<\/a><\/td>\n<td>\n<p>Any person who buys a handgun or semiautomatic assault-style rifle from a private seller must show proof of a\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7131\/\" target=\"_blank\" rel=\"noopener\">transferee permit<\/a>\u00a0(i.e., a permit to buy or a\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-714.html\" target=\"_blank\" rel=\"noopener\">permit to carry firearms<\/a>). The person must undergo a background check to get one of these permits. (Minn. Stat. \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7131\/\" target=\"_blank\" rel=\"noopener\">624.7131<\/a>)<\/p>\n<p>If the buyer\/transferee shows a valid transferee permit or permit to carry, the seller\/transferor does not have to file a transfer report. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7132.html\" target=\"_blank\" rel=\"noopener\">624.7132, subd. 8<\/a>) People do not need a permit to buy non-assault-style rifles (e.g., hunting rifles and shotguns).<\/p>\n<\/td>\n<td>\n<p>A person who engages in the following is guilty of a gross misdemeanor:<\/p>\n<ul>\n<li>Transfers a pistol or semiautomatic military-style assault weapon violating \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7132.html\" target=\"_blank\" rel=\"noopener\">624-7132, subds. 1-13<\/a><\/li>\n<li>Transfers a pistol or semiautomatic military-style assault weapon to someone whom they know (or has reason to know) made false statements to become a transferee<\/li>\n<li>Transfers a pistol or semiautomatic military-style assault weapon to someone whom they know was denied a permit to carry due to their ineligibility to have these firearms (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7141\/\" target=\"_blank\" rel=\"noopener\">624.7141<\/a>)<\/li>\n<li>Transfers a pistol or semiautomatic military-style assault weapon to someone whom they know is disqualified under \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-713.html\" target=\"_blank\" rel=\"noopener\">624.713<\/a>\u00a0from having these firearms (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7141\/\" target=\"_blank\" rel=\"noopener\">624.7141<\/a>)<\/li>\n<li>Knowingly becomes a transferee violating \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7132.html\" target=\"_blank\" rel=\"noopener\">624-7132, subds. 1-13<\/a><\/li>\n<li>Knowingly makes a false statement to become a transferee of a pistol or semiautomatic military-style assault weapon<\/li>\n<li>Transfers a pistol or semiautomatic military-style assault weapon to another person without following the transfer rules of \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7132.html\" target=\"_blank\" rel=\"noopener\">624.7132<\/a>, the transferee used the weapon in a violent felony within a year of the transfer, and the transferee was prohibited from having the weapon at the time of the transfer per \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-713.html\" target=\"_blank\" rel=\"noopener\">624.713<\/a>, or it was reasonably foreseeable at the time of the transfer that they were likely to use or possess it in a felony crime of violence. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-609-66.html\" target=\"_blank\" rel=\"noopener\">609.66, subd. 1f<\/a>)<\/li>\n<\/ul>\n<p>A person who engages in the following is guilty of a felony:<\/p>\n<ul>\n<li>Transfers a pistol or semiautomatic military-style assault weapon to someone under 18 violating \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7132.html\" target=\"_blank\" rel=\"noopener\">624-7132, subds. 1-13<\/a><\/li>\n<li>Transfers a pistol or semiautomatic military-style assault weapon to someone under 18 whom they know made a false statement to become a transferee<\/li>\n<li>Furnishes a firearm, airgun, or ammunition to a minor without the minor&#8217;s parent or guardian consent (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-609-66.html\" target=\"_blank\" rel=\"noopener\">609.66<\/a>)<\/li>\n<li>Transfers a pistol or semiautomatic military-style assault weapon violating \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7141\/\" target=\"_blank\" rel=\"noopener\">624.7141<\/a>, and the transferee commits a violent crime with the firearm within one year of the transfer<\/li>\n<\/ul>\n<p>People engaged in hunting or target shooting may loan a firearm to another person for no more than 12 hours. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mn\/crimes-expungement-victims-ch-609-624\/mn-st-sect-624-7132.html\" target=\"_blank\" rel=\"noopener\">624.7132, subd. 12(6)<\/a>)<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/mississippi-law\/mississippi-gun-control-laws.html\">Mississippi<\/a><\/td>\n<td>None<\/td>\n<td>\n<p>A private seller may not sell, give, or lend a deadly weapon to a minor or someone who is intoxicated. Stat. \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mo\/title-xxxviii-crimes-and-punishment-peace-officers-and-public-defenders\/mo-rev-st-571-060\/?_gl=1*1mbd5eh*_gcl_au*MTg1MTI3NjQzNS4xNzIwNDQ4ODMy\" target=\"_blank\" rel=\"noopener\">571.060<\/a>):<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/mo\/title-xxxviii-crimes-and-punishment-peace-officers-and-public-defenders\/mo-rev-st-562-016.html\" target=\"_blank\" rel=\"noopener\">Knowingly<\/a>\u00a0sells, leases, loans, gives away, or delivers a firearm or ammunition to a person whom is banned from having a firearm or ammunition per \u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/mo\/title-xxxviii-crimes-and-punishment-peace-officers-and-public-defenders\/mo-rev-st-571-070\/?_gl=1*kj0y1j*_gcl_au*MTg1MTI3NjQzNS4xNzIwNDQ4ODMy\" target=\"_blank\" rel=\"noopener\">571.070<\/a><\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/mo\/title-xxxviii-crimes-and-punishment-peace-officers-and-public-defenders\/mo-rev-st-562-016.html\" target=\"_blank\" rel=\"noopener\">Recklessly<\/a>\u00a0selling, leasing, loaning, giving away, or delivering a firearm to a minor without their parent&#8217;s or guardian&#8217;s consent<\/li>\n<li>Recklessly selling, leasing, loaning, giving away, or delivering a firearm or ammunition to an intoxicated person.<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<tr>\n<td><a href=\"https:\/\/www.findlaw.com\/state\/montana-law\/montana-gun-control-laws.html\">Montana<\/a><\/td>\n<td>None<\/td>\n<td>A person is guilty of transferring illegal articles if they knowingly or purposely transfer a weapon to someone they know is subject to official detention. The FFL must conduct a background check of the buyer\/transferee before completing the transaction. (Oregon Rev. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/vt\/title-13-crimes-and-criminal-procedure\/vt-st-tit-13-sect-4019.html\" target=\"_blank\" rel=\"noopener\">4019(c)(1)-(2)<\/a>)<\/td>\n<td>\n<p>A private seller may not transfer a firearm to a person until 72 hours after the licensed dealer who agrees to handle the transfer gets a unique identification number from the NCIS (or seven business days elapse after the dealer contacts NCIS to initiate a background check, whichever is shorter). (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/vt\/title-13-crimes-and-criminal-procedure\/vt-st-tit-13-sect-4019a.html\" target=\"_blank\" rel=\"noopener\">4019a(a)<\/a>)<\/p>\n<p>A person may not transfer firearms or ammunition to minors under 16 (parents and guardians are exempt). (<a href=\"https:\/\/codes.findlaw.com\/va\/title-18-2-crimes-and-offenses-generally\/va-code-sect-18-2-308-2-1.html\" target=\"_blank\" rel=\"noopener\">Va. Code Ann. \u00a7 18.2-308.2:5<\/a>)<\/p>\n<p>If the private seller intends to sell a firearm at a gun show and has a determination from the Virginia State Police that the buyer is not banned from having a firearm, they do not need to get said verification from a licensed firearms dealer. (<a href=\"https:\/\/codes.findlaw.com\/va\/title-18-2-crimes-and-offenses-generally\/va-code-sect-18-2-308-2-1.html\" target=\"_blank\" rel=\"noopener\">\u00a7 18.2-308.2:5(B)(2)<\/a>)<\/p>\n<\/td>\n<td>\n<p>It is a felony to knowingly transfer firearms to someone who can&#8217;t, under state law, have or transport firearms. (<a href=\"https:\/\/codes.findlaw.com\/va\/title-18-2-crimes-and-offenses-generally\/va-code-sect-18-2-308-2-1.html\" target=\"_blank\" rel=\"noopener\">Va. Code Ann. \u00a7 18.2-308.2:1<\/a>)<\/p>\n<p>A person who sells or transfers the following firearms is guilty of a Class 6 felony (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/va\/title-18-2-crimes-and-offenses-generally\/va-code-sect-18-2-308-8\/\" target=\"_blank\" rel=\"noopener\">18.2-308.8<\/a>):<\/p>\n<ul>\n<li>A Strike 12 (a \u201cstreet sweeper&#8221;)<\/li>\n<li>A semiautomatic folding stock shotgun with a spring tension drum magazine capable of holding 12 shotgun shells<\/li>\n<\/ul>\n<p>A person who sells, barters, gives, or furnishes a handgun to a minor, having good cause to believe they are a minor, is guilty of a Class 6 felony. (\u00a7\u00a0<a href=\"https:\/\/codes.findlaw.com\/va\/title-18-2-crimes-and-offenses-generally\/va-code-sect-18-2-309\/\" target=\"_blank\" rel=\"noopener\">18.2-309(B)<\/a>)<\/p>\n<p>This does not apply to transfers between family members or if the person transfers the handgun for a sporting or hunting activity.<\/p>\n<p>State police must be available at gun shows to conduct voluntary background checks for private firearm transfers.
