This federal cooling-off period&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/how-to-get-out-of-a-car-purchase.html\">does not apply to automotive purchases<\/a>&nbsp;due to how quickly vehicles depreciate.<\/p>\r\n<p>The right to return the car for a refund exists only if the dealer grants this privilege to buyers. Dealers may phrase the right to cancel as a&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/canceling-a-sale-the-cooling-off-period.html\">cooling-off period<\/a>, a money-back guarantee, or a &quot;no questions asked&quot; return policy. Before you purchase from a dealer, ask about the dealer&#8217;s return policy and get it in writing.<\/p>\r\n<h2>The Federal Trade Commission&#8217;s Buyers Guide<\/h2>\r\n<p>The FTC&#8217;s&nbsp;<a href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/rules\/used-car-rule\" target=\"_blank\" rel=\"noopener\">Used Car Rule<\/a>&nbsp;requires dealers to post a&nbsp;<a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/plain-language\/cfr_buyers_guides_english.pdf\" target=\"_blank\" rel=\"noopener\">Buyers Guide<\/a>&nbsp;on every used car they offer for sale. This includes:<\/p>\r\n<ul>\r\n<li>Light-duty trucks and vans<\/li>\r\n<li>Demonstrators (unsold motor vehicles used for test drives)<\/li>\r\n<li>Program cars (low-mileage, current-model-year vehicles returned from short-term leases or rentals)<\/li>\r\n<\/ul>\r\n<p>Dealers do not have to post Buyers Guides on motorcycles and most recreational vehicles. Those who sell less than six cars a year don&#8217;t have to post a Buyers Guide. This is the case for most&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/private-used-car-sales.html\">private sellers<\/a>.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/plain-language\/cfr_buyers_guides_english.pdf\" target=\"_blank\" rel=\"noopener\">Buyers Guide<\/a>&nbsp;must disclose:<\/p>\r\n<ul>\r\n<li>Whether the vehicle is being sold&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/what-does-caveat-emptor-mean-.html\">as is<\/a>&nbsp;or with a warranty<\/li>\r\n<li>What percentage of the repair costs a dealer will pay under the warranty<\/li>\r\n<li>That&nbsp;<a href=\"http:\/\/findlaw.com\/consumer\/consumer-transactions\/warranty-vs-guarantee-what-you-need-to-know.html\" target=\"_blank\" rel=\"noopener\">spoken guarantees<\/a>&nbsp;are difficult to enforce and to get all promises in writing<\/li>\r\n<li>To keep the Buyers Guide for reference after the sale<\/li>\r\n<li>The major mechanical and electrical systems on the car, including some of the major problems to look out for<\/li>\r\n<li>Your right to ask for a&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/car-inspection-laws.html\">car inspection<\/a>&nbsp;by an independent mechanic before you buy<\/li>\r\n<\/ul>\r\n<p>When you&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/tips-for-buying-a-used-car.html\">buy a used car<\/a>&nbsp;from a dealer, get the original Buyers Guide posted on the vehicle or a copy. The Guide must reflect any negotiated changes in warranty coverage. It also becomes part of your&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-contracts-forms\/sample-sales-contract.html\">sales contract<\/a>&nbsp;and overrides any contrary provisions.<\/p>\r\n<p>For example, if the Buyers Guide says the car comes with a warranty and the contract says the car sale is&nbsp;as is,&nbsp;the dealer must give you the warranty described in the Guide.<\/p>\r\n<h2>No Vehicle Warranty, or Buying&nbsp;As Is<\/h2>\r\n<p>When the dealer offers a vehicle&nbsp;as&nbsp;is,&nbsp;they must check the box next to the &quot;As Is &#8211; No Warranty&quot; disclosure on the Buyers Guide. If the dealer checks this box but promises to repair the vehicle or cancel the sale if you&#8217;re unsatisfied, make sure the dealer includes this in writing on the Buyers Guide. Otherwise, you may have difficulty getting the dealer to follow through on the guarantee.<\/p>\r\n<p>Some states don&#8217;t allow&nbsp;as-is&nbsp;sales for many used vehicles. These states include:<\/p>\r\n<ul>\r\n<li>Connecticut<\/li>\r\n<li>Kansas<\/li>\r\n<li>Maine<\/li>\r\n<li>Maryland<\/li>\r\n<li>Massachusetts<\/li>\r\n<li>Minnesota<\/li>\r\n<li>Mississippi<\/li>\r\n<li>New Jersey<\/li>\r\n<li>New York<\/li>\r\n<li>Rhode Island<\/li>\r\n<li>Vermont<\/li>\r\n<li>West Virginia<\/li>\r\n<li>The District of Columbia<\/li>\r\n<\/ul>\r\n<p>Louisiana, New Hampshire, and Washington&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/disclosures.html\" target=\"_blank\" rel=\"noopener\">require disclosures<\/a>&nbsp;different from those on the Buyers Guide.<\/p>\r\n<p>If the dealer fails to provide proper state disclosures, the sale is not&nbsp;as is.&nbsp;To learn what disclosures your state requires for&nbsp;as-is&nbsp;sales, contact&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/credit-banking-finance\/what-consumer-protection-agencies-do.html\">your state attorney general&#8217;s office.<\/a><\/p>\r\n<h2>Implied Warranty of Merchantability<\/h2>\r\n<p>The most common type of implied warranty is the&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/what-is-the-warranty-of-merchantability.html\">warranty of merchantability<\/a>. This warranty means the seller promises the product offered for sale will do what it&#8217;s expected to. An example of a warranty of merchantability is that a car will start, run, and be drivable. This promise applies to the basic functions of a car and&nbsp;does not cover every mechanical issue that could happen.<\/p>\r\n<p>Breakdowns and other problems after the sale don&#8217;t prove the seller&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/breach.html\" target=\"_blank\" rel=\"noopener\">breached the warranty<\/a>&nbsp;of merchantability. A breach occurs only if the buyer can prove that a defect existed at the time of purchase. A problem that occurs after the sale may result from a defect that existed at the time of the sale or not. As a result,&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/liability-and-insurance\/liability-definition.html\">a dealer&#8217;s liability<\/a>&nbsp;is judged case-by-case.<\/p>\r\n<h2>Warranty of Fitness for a Particular Purpose<\/h2>\r\n<p>A&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/warranty.html\" target=\"_blank\" rel=\"noopener\">warranty of fitness<\/a>&nbsp;for a particular purpose applies when you buy a vehicle based on the dealer&#8217;s advice that it will work for a particular use. For example, a dealer who suggests you buy a specific vehicle for hauling a trailer is essentially promising the vehicle will be suitable for that purpose.<\/p>\r\n<p>If your written warranty doesn&#8217;t cover your vehicle&#8217;s issue, you still may have coverage through&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/what-is-an-implied-warranty-.html\">implied warranties<\/a>. When a dealer sells a vehicle with a written warranty or service contract, implied warranties are automatically included. The dealer can&#8217;t delete this protection. The&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/what-are-express-and-implied-warranties.html\">written warranty<\/a>&nbsp;must include any limit on an implied warranty&#8217;s time.<\/p>\r\n<p>In states that don&#8217;t allow&nbsp;as-is&nbsp;sales, the&nbsp;Buyers&nbsp;Guide&nbsp;prints an &quot;Implied Warranties Only&quot; disclosure in place of the &quot;As Is&quot; disclosure. The dealer must check the box beside this disclosure if they sell the car without a written warranty.<\/p>\r\n<p>In states that do allow&nbsp;as-is&nbsp;sales, the &quot;Implied Warranties Only&quot; disclosure should appear on the Buyers Guide if the dealer sells a vehicle&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/what-are-express-and-implied-warranties.html\">with implied warranties and no written warranty<\/a>.<\/p>\r\n<p>Dealers who offer a written warranty must complete the warranty section of the&nbsp;Buyers Guide. Because terms and conditions vary, comparing and negotiating coverage may be helpful.<\/p>\r\n<h2>Full Warranties vs Limited Warranties<\/h2>\r\n<p>Dealers may offer a&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/difference-between-a-full-warranty-and-a-limited-warranty.html\">full or limited warranty<\/a>&nbsp;on all or some of a vehicle&#8217;s systems or components. Most used car warranties are limited, and their coverage varies. A full warranty includes the following terms and conditions:<\/p>\r\n<ul>\r\n<li>Anyone who owns the vehicle during the warranty period can use the warranty service<\/li>\r\n<li>The dealer will provide warranty service free of charge, including costs for removing and reinstalling a covered system<\/li>\r\n<li>You have the option of a replacement or a full refund if the dealer cannot repair the vehicle or a covered system after a reasonable number of attempts<\/li>\r\n<li>You only have to tell the dealer that you need warranty service to get it, unless the dealer can prove that it is reasonable to require you to do more<\/li>\r\n<li><a href=\"https:\/\/dictionary.findlaw.com\/definition\/warranty.html\" target=\"_blank\" rel=\"noopener\">Implied warranties<\/a>&nbsp;have no time limits<\/li>\r\n<\/ul>\r\n<p>If any of these statements don&#8217;t apply, you have a limited warranty.<\/p>\r\n<p>A full or limited warranty doesn&#8217;t have to cover the entire vehicle. The dealer may specify that the warranty only covers certain systems or parts. A full warranty may cover some parts or systems, while a limited warranty covers others.<\/p>\r\n<p>The dealer must check the appropriate box on the&nbsp;Buyers&nbsp;Guide&nbsp;to indicate whether the warranty is full or limited. They also must include the following information in the &quot;Warranty&quot; section:<\/p>\r\n<ul>\r\n<li>The percentage of the repair cost that the dealer will pay<\/li>\r\n<li>The specific parts and systems\u2014such as the frame, body, or brake system\u2014the warranty covers. The back of the Buyers Guide lists the major systems where problems may occur.<\/li>\r\n<li>The vehicle warranty term for each covered system. For example, &quot;30 days or 1,000 miles, whichever comes first&quot;<\/li>\r\n<li>Whether there&#8217;s a&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/deductible.html\" target=\"_blank\" rel=\"noopener\">deductible<\/a>&nbsp;and, if so, how much<\/li>\r\n<\/ul>\r\n<p>You have the right to see a copy of the dealer&#8217;s warranty before you buy. Review it carefully to determine what it covers. The warranty gives detailed information, such as how to get repairs for a covered system or part. It also tells who is legally responsible for fulfilling the warranty terms. Get a copy of the dealer&#8217;s warranty document for your records.<\/p>\r\n<p>If it&#8217;s a third party, investigate their reputation and whether they&#8217;re insured. Find out the insurer&#8217;s name and verify the information. Check out the third-party company with your local&nbsp;<a href=\"https:\/\/www.bbb.org\/bbb-directory\" target=\"_blank\" rel=\"noopener\">BBB<\/a>.<\/p>\r\n<h2>Unexpired Original Manufacturer&#8217;s Warranties<\/h2>\r\n<p>If the&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/automobile-warranties-and-other-buyer-protections.html\">manufacturer&#8217;s warranty<\/a>&nbsp;is still in effect, the dealer may include it in the &quot;Systems Covered&quot; and \u201cDuration&quot; sections of the&nbsp;Buyers&nbsp;Guide.<\/p>\r\n<p>To ensure you can take advantage of the coverage, ask the dealer for the car&#8217;s warranty documents. Call the manufacturer&#8217;s zone office to verify the information, including:<\/p>\r\n<ul>\r\n<li>What the warranty covers<\/li>\r\n<li>Expiration date and mileage<\/li>\r\n<li>All necessary paperwork<\/li>\r\n<\/ul>\r\n<p>Have the&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/vin.html\" target=\"_blank\" rel=\"noopener\">Vehicle Identification Number<\/a>&nbsp;(VIN) ready when you call.<\/p>\r\n<h2>Used Car Extended Warranties<\/h2>\r\n<p>When buying a used vehicle, the dealer will likely offer you an extended warranty for an additional cost. Extended warranties are optional add-ons that function more like a service or maintenance contract than an actual warranty.<\/p>\r\n<p>Extended warranties can be expensive. If you&#8217;re financing your vehicle, the lender will factor in the service contract to your loan, making your&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/credit-banking-finance\/managing-personal-finances-overview.html\">monthly payment higher<\/a>. Weigh the coverage cost against potential benefits. Research your vehicle&#8217;s reliability and average cost of repairs to see if an&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/consumer-warranty-basics.html\">extended warranty<\/a>&nbsp;is worth the price.<\/p>\r\n<p>Both authorized dealers and third-party companies sell extended warranties and service contracts. If you purchase from a third-party provider, research customer reviews and its&nbsp;<a href=\"https:\/\/www.bbb.org\/search\" target=\"_blank\" rel=\"noopener\">BBB listing<\/a>&nbsp;first.<\/p>\r\n<h2>Used Car Lemon Laws<\/h2>\r\n<p>In general,&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law.html\">lemon laws<\/a>&nbsp;apply to new cars under their original manufacturer warranty. Some states&#8217; lemon laws also&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/secret-warranties-recalls-and-lemons.html\">protect used vehicles<\/a>&nbsp;with time left of their original warranty.<\/p>\r\n<p>The details vary by jurisdiction, but most states define a lemon as a vehicle with a substantial defect that remains unresolved after a reasonable number of repair attempts.&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/lemon-laws-state-specific-information.html\">Each state&#8217;s lemon statute<\/a>&nbsp;defines what type of defect is&nbsp;substantial&nbsp;and how many repair attempts are reasonable.&nbsp;Check&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/lemon-laws-state-specific-information.html\">your state law<\/a>&nbsp;to see specifics on what its lemon law covers.<\/p>\r\n<p>The&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/consumer-transactions\/warranty-laws-and-the-magnuson-moss-warranty-act-.html\">Magnuson-Moss Warranty Act<\/a>&nbsp;is a federal law that protects most consumer purchases with a written warranty. This&nbsp;includes&nbsp;vehicles. Although it doesn&#8217;t solely apply to motor vehicles, it is recognized as the federal lemon law.<\/p>\r\n<p>Consumers who&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/lemon-law-basics.html\">purchase a lemon<\/a>&nbsp;are entitled to legal remedies, including a replacement vehicle or a refund of the full purchase price, including taxes, registration, and other incurred costs (like attorney fees or rental car costs).<\/p>\r\n<p>If a dealer repurchases a vehicle as part of a&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/lemon-law\/how-the-new-car-lemon-law-can-help-you.html\">lemon law claim<\/a>, they can&nbsp;resell the lemon vehicle.
