More Americans fly to expanded destinations at relatively affordable ticket prices than ever before. But this wasn&#8217;t always the case. One of the main contributors to air travel financial accessibility was a federal law called the&nbsp;<a href=\"https:\/\/www.transportation.gov\/policy\/aviation-policy\/small-community-rural-air-service\/essential-air-service\" target=\"_blank\" rel=\"noopener\">Airline Deregulation Act of 1978<\/a>.<\/p>\r\n<p>Still, most consumers don&#8217;t consider air travel cheap and efficient. Aspects of air travel can be arduous \u2014 from arriving at the airport at least two hours before takeoff to&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/air-travel-carry-on-items-luggage-and-security-screening.html\">getting through security<\/a>.<\/p>\r\n<p>This article discusses how airline deregulation influenced the commercial air services we use today. This is generally good for consumers because it encourages a competitive market. For example, suppose all airlines charge around $400 for a one-way trip to Boston, but one airline starts charging $350. This puts pressure on other airlines to reduce fares to compete.<\/p>\r\n<p>You can see this in action when airlines offer features and services like:<\/p>\r\n<ul>\r\n<li>Lower fares<\/li>\r\n<li>Comfortable seating options, like extra legroom<\/li>\r\n<li>No&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/lost-baggage-compensation-and-the-law.html\">baggage fees<\/a><\/li>\r\n<li>Flexible booking policies<\/li>\r\n<li>Frequent flyer programs<\/li>\r\n<\/ul>\r\n<p>This wasn&#8217;t always the case in the airline industry. From the 1930s on, the Civil Aeronautics Board (CAB) regulated U.S. airlines. The CAB heavily regulated aspects of the airline industry we now think of as business practices, including:<\/p>\r\n<ul>\r\n<li>Setting the price of air travel at levels guaranteeing profitability for existing airlines<\/li>\r\n<li>Approving new routes between cities<\/li>\r\n<li>Requiring new airlines to complete a complex approval process that often prevented them from operating<\/li>\r\n<\/ul>\r\n<p>Congress and most experts believed this arrangement benefited airlines at the public&#8217;s expense. Before deregulation, only 20% of Americans traveled by plane. A one-way flight between New York and Los Angeles then cost the equivalent of around $775 today.<\/p>\r\n<h2>The Airline Deregulation Act of 1978<\/h2>\r\n<p>The issues above prompted Congress to take action. In 1978, it passed the&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/95th-congress\/senate-bill\/2493\" target=\"_blank\" rel=\"noopener\">Airline Deregulation Act<\/a>. The law aimed to improve the airline industry by opening it up to competitive market forces. The act banned several practices, including:<\/p>\r\n<ul>\r\n<li>Government-set airfare prices<\/li>\r\n<li>Preapproval for new routes<\/li>\r\n<li>Entry barriers that prevented new airlines from operating and offering new options<\/li>\r\n<\/ul>\r\n<p>Deregulation also cleared the way for airlines to make better use of secondary hub airports in large metropolitan areas. Examples include:<\/p>\r\n<ul>\r\n<li>Chicago Midway International Airport (MDW), secondary to O&#8217;Hare International Airport (ORD) in Chicago<\/li>\r\n<li>Baltimore\/Washington International Thurgood Marshall Airport (BWI), secondary to Washington Dulles International Airport (IAD) and Ronald Reagan Washington National Airport (DCA) in Washington, D.C.<\/li>\r\n<li>John Wayne Airport (SNA), secondary to Los Angeles International Airport (LAX) in Los Angeles<\/li>\r\n<\/ul>\r\n<p>These features are now staples of modern air transportation services.<\/p>\r\n<p>The Airline Deregulation Act also stripped the Civil Aeronautics Board of its powers and disbanded the agency. Some regulation of air travel remained in place, though. The&nbsp;<a href=\"https:\/\/www.faa.gov\/\" target=\"_blank\" rel=\"noopener\">Federal Aviation Administration<\/a>&nbsp;(FAA) continues to regulate aviation safety and administer the nation&#8217;s air traffic control system. The FAA is a division of the&nbsp;<a href=\"https:\/\/www.transportation.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Department of Transportation<\/a>&nbsp;(DOT).<\/p>\r\n<p>The federal act also&nbsp;<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/the-supremacy-clause-and-the-doctrine-of-preemption.html\">preempted many state laws<\/a>&nbsp;regulating the airline industry. This includes state-based consumer protection claims for airline passengers. While the law and airlines made many small changes, the act focused on making the airline industry more like a business.<\/p>\r\n<h2>Was the Airline Deregulation Act a Response to the 1970s Energy Crisis?<\/h2>\r\n<p>No, the Airline Deregulation Act of 1978 was not a direct response to the&nbsp;<a href=\"https:\/\/www.federalreservehistory.org\/essays\/oil-shock-of-1973-74\" target=\"_blank\" rel=\"noopener\">1970s energy crisis<\/a>. But the period&#8217;s economic conditions did contribute to the decision to consider and implement deregulation.<\/p>\r\n<p>Economic pressures of the &#8217;70s included:<\/p>\r\n<ul>\r\n<li>High inflation<\/li>\r\n<li>Stagnant economic growth<\/li>\r\n<li>Rising unemployment rates<\/li>\r\n<\/ul>\r\n<p>Oil embargoes and rising fuel prices significantly increased operating expenses for airlines. This lead to financial strain on the airline service industry. Further, advocates viewed deregulation as a means to&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-operations\/competitive-analysis.html\">promote competition<\/a>&nbsp;and make air travel more efficient \u2014 helping airlines better manage increasing fuel costs.<\/p>\r\n<p>The political climate of the &#8217;70s favored less economic regulation in several industries, including transportation. Many believed deregulation would encourage airline innovation and&nbsp;<a href=\"https:\/\/www.findlaw.com\/hirealawyer\/choosing-the-right-lawyer\/consumer-law.html\">benefit consumers<\/a>.<\/p>\r\n<h2>Pros and Cons of Airline Deregulation<\/h2>\r\n<p>Most view airline deregulation as a success. The following changes are examples of how deregulation shaped the&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/air-travel-rules-faq.html\">air travel<\/a>&nbsp;industry today:<\/p>\r\n<ul>\r\n<li>Airlines compete to attract customers<\/li>\r\n<li>Fares are competitive<\/li>\r\n<li>Airlines fly more routes between more cities than they did before deregulation<\/li>\r\n<\/ul>\r\n<p>Because airfare costs significantly less than pre-deregulation, more Americans can afford to travel via air. Air travel has continued to grow and innovate; many cite deregulation as the driving reason for this trend.<\/p>\r\n<p>Deregulation also placed a greater emphasis on consumer rights<i>.&nbsp;<\/i>Some of these advancements include:<\/p>\r\n<ul>\r\n<li>Compensation for&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/lost-baggage-compensation-and-the-law.html\">lost baggage<\/a><\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/consumer\/travel-rules-and-rights\/plane-ticket-refunds-and-the-law.html\">Guidelines on reimbursement<\/a>&nbsp;for flight delays and cancelations<\/li>\r\n<li>Rules for overbooking flights<\/li>\r\n<li>Required disclosures on pricing and surcharges<\/li>\r\n<\/ul>\r\n<p>Still, some commentators question the benefits of deregulation. The boom in air travel coincided with a period of low fuel prices and overall economic growth.<\/p>\r\n<p>Deregulation undoubtedly brought pain to the airlines as well. The end of federal government-mandated minimum fares made existing airlines less profitable. Due to slimmer profit margins, airlines now offer fewer amenities and frills.<\/p>\r\n<p>Further, investors can be wary of investing in airlines.&nbsp;<a href=\"https:\/\/www.findlaw.com\/bankruptcy\/business-bankruptcy.html\">Bankruptcies<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-finances\/mergers.html\">mergers<\/a>&nbsp;are more common as U.S. carriers can struggle to remain profitable.<\/p>\r\n<p>Newer, low-cost carriers also changed the air travel business, including:<\/p>\r\n<ul>\r\n<li>Spirit Airlines<\/li>\r\n<li>Frontier Airlines<\/li>\r\n<li>Southwest Airlines<\/li>\r\n<\/ul>\r\n<p>Other airlines (like Delta) expanded their destinations to compete with more prominent air carriers.<\/p>\r\n<p>Luxury, high-priced service has given way to a more&nbsp;<a href=\"https:\/\/www.findlaw.com\/consumer\/credit-banking-finance\/sample-budget.html\">budget-conscious<\/a>&nbsp;present.
