This is when an <span data-term-id=\"58412009\">asylum-seeker<\/span> is a <span data-term-id=\"58412038\">foreign national<\/span> currently residing in the U.S.<\/p>\n<p>The general process of\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/affirmative-asylum-applications-vs-defensive-asylum-applications.html#:~:text=their%20home%20country.-,Affirmative%20Asylum%20Applications,a%20decision%20independent%20of%20the%20past%20decisions%20made%20by%20the%20USCIS.,-Defensive%20Asylum%20Applications\"><span data-term-id=\"58412020\">affirmative <\/span><span data-term-id=\"58411988\">asylum<\/span><span data-term-id=\"58412020\"> application<\/span><\/a>\u00a0in the U.S. involves the following steps.<\/p>\n<ol>\n<li>\n<p><strong>Apply for Asylum and <span data-term-id=\"58411987\">Withholding of Removal<\/span>.\u00a0<\/strong>You should submit\u00a0<a href=\"https:\/\/www.uscis.gov\/i-589\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58412005\">Form I-589<\/span><\/a>\u00a0to\u00a0<a href=\"https:\/\/www.uscis.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58412041\">U.S. Citizenship and Immigration Services<\/span> (<span data-term-id=\"58411995\">USCIS<\/span>)<\/a>. There is a <span data-term-id=\"58412021\">one-year<\/span> deadline for filing <span data-term-id=\"58411988\">asylum applications<\/span>. The <span data-term-id=\"58412040\">USCIS<\/span> <span data-term-id=\"58411996\">asylum officer<\/span> may also ask for additional information to confirm your identity and run background checks.<\/p>\n<\/li>\n<li>\n<p><strong>Receive notice of an interview with an <span data-term-id=\"58411996\">asylum officer<\/span> at the <span data-term-id=\"58411995\">USCIS<\/span> field office.<\/strong>\u00a0The <span data-term-id=\"58411995\">USCIS<\/span> will schedule an interview at the <span data-term-id=\"58411995\">USCIS<\/span> field office. The notice will contain important information about the date, time, and location of your interview.<\/p>\n<\/li>\n<li>\n<p><strong>Attend the visa interview.\u00a0<\/strong><a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-overview\/immigration-interview-do-s-and-don-ts.html\">During the interview<\/a>, an <span data-term-id=\"58411996\">asylum officer<\/span> will determine whether you qualify for asylum protection. They may ask you certain questions and check additional documentation supporting your <span data-term-id=\"58412017\">asylum claim<\/span>.<\/p>\n<\/li>\n<li>\n<p><strong>Receive the determination of the <span data-term-id=\"58411996\">asylum officer<\/span>.\u00a0<\/strong>At the end of the interview, the <span data-term-id=\"58411996\">asylum officer<\/span> will assess whether you are qualified for asylum. Other immigration officials, such as the supervisory <span data-term-id=\"58411996\">asylum officer<\/span>, will also conduct further review.<\/p>\n<\/li>\n<li>\n<p><strong>Receipt of the decision.<\/strong>\u00a0The decision on your <span data-term-id=\"58412023\">application for asylum<\/span> is often available two weeks after your interview. This period may vary depending on certain circumstances.<\/p>\n<\/li>\n<\/ol>\n<p>Note that in some cases, the <span data-term-id=\"58411996\">asylum officer<\/span> may refer your case to an <span data-term-id=\"58411986\">immigration judge<\/span>. This will explain why your court case is being referred to an <span data-term-id=\"58411986\">immigration judge<\/span>.<\/p>\n<p>In most instances, the <span data-term-id=\"58411986\">immigration judge<\/span> orally <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/types-of-asylum-decisions.html\">grants or denies <span data-term-id=\"58411988\">asylum applications<\/span><\/a> after the final <span data-term-id=\"58412016\">Merits Hearing<\/span>. You may also appeal the judge\u2019s decision to the <span data-term-id=\"58412030\">Board of Immigration Appeals<\/span> within 30 days.<\/p>\n<p>At certain points along the process, you may receive notice of a hearing that\u2019s not on the above list. You also can request certain hearings. Below are some common hearings you may encounter either as part of your application or under other circumstances where you might be facing removal from the U.S.<\/p>\n<h2>Bond Re-Determination Hearings<\/h2>\n<p>An undocumented migrant may be detained by the U.S.\u00a0<a href=\"https:\/\/www.dhs.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58412013\">Department of Homeland Security<\/span> (<span data-term-id=\"58412000\">DHS<\/span>)<\/a>. If so, the <span data-term-id=\"58412000\">DHS<\/span> will set a bond so you can be temporarily released from custody.<\/p>\n<p>A bond is money or property you give to the government as a promise to comply with all government requests, such as attending all <span data-term-id=\"58412032\">court hearings<\/span> for your <span data-term-id=\"58412019\">asylum case<\/span>. If you fulfill your end of the bargain, you get the money or property back. A bond re-determination hearing allows you to challenge the amount of bond initially set.<\/p>\n<p>A bond re-determination hearing isn\u2019t part of <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/overview-of-removal-procedures.html\"><span data-term-id=\"58411989\">removal proceedings<\/span><\/a>. The <span data-term-id=\"58411989\">removal proceeding<\/span> determines your <span data-term-id=\"58411990\">eligibility<\/span> to stay in the United States. The bond re-determination hearing focuses on the amount the detainee should give for their temporary release. The result of the bond hearing doesn\u2019t affect the <span data-term-id=\"58411988\">asylum application<\/span>. But failing to meet your obligations upon your release can affect your case.<\/p>\n<p>You can request that an <span data-term-id=\"58411986\">immigration judge<\/span> conduct a\u00a0<a href=\"https:\/\/www.justice.gov\/eoir\/reference-materials\/ic\/chapter-9\/3\" target=\"_blank\" rel=\"noopener\">bond hearing.<\/a>\u00a0Here, the <span data-term-id=\"58411986\">immigration judge<\/span> has the authority to reassess the amount set by the <span data-term-id=\"58412000\">DHS<\/span>. Some factors that the <span data-term-id=\"58411986\">immigration judge<\/span> may look into when considering the amount of bond include:<\/p>\n<ul>\n<li>Criminal history<\/li>\n<li>Immigration history<\/li>\n<li>Potential risk to public safety<\/li>\n<li>Ties to the community<\/li>\n<\/ul>\n<p>You would request a bond re-determination hearing if you feel the bond was set too high.<\/p>\n<h2>Rescission Hearings<\/h2>\n<p>A rescission hearing does not happen in every <span data-term-id=\"58412019\">asylum case<\/span>. Instead, a rescission hearing occurs when there is doubt that an immigrant obtained their status lawfully. During\u00a0rescission proceedings, an <span data-term-id=\"58411986\">immigration judge<\/span> determines whether a person can keep their\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigration-through-adjustment-of-immigrant-status.html\"><span data-term-id=\"58412029\">lawful permanent resident<\/span> (LPR)<\/a>\u00a0status.<\/p>\n<p><a href=\"https:\/\/www.justice.gov\/eoir\/policy-manual-eoir\/part-II\/icpm\/chapter-6-3\" target=\"_blank\" rel=\"noopener\">Rescission hearings<\/a> often arise in cases where there are indications that the person obtained their permanent resident status by fraud, misrepresentation, or violating <span data-term-id=\"58412022\">immigration laws<\/span>. An example is when a person falsifies information while seeking asylum or doesn\u2019t disclose crucial facts that would affect their <span data-term-id=\"58411990\">eligibility<\/span> for LPR status.<\/p>\n<p>If you\u2019ve held a permanent resident status for more than five years, authorities can\u2019t rescind it through a rescission hearing.<\/p>\n<h2>Withholding-Only Proceedings<\/h2>\n<p>Withholding-only proceedings occur when you face removal but express a <span data-term-id=\"58412002\">credible <\/span><span data-term-id=\"58412003\">fear<\/span><span data-term-id=\"58412003\"> of persecution<\/span> if sent back to your <span data-term-id=\"58411997\">home country<\/span>. This proceeding often occurs for those seeking\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/affirmative-asylum-applications-vs-defensive-asylum-applications.html#:~:text=by%20the%20USCIS.-,Defensive%20Asylum%20Applications,DHS%20also%20files%20a%20charging%20document%20with%20the%20EOIR%27s%20immigration%20court.,-FINDLAW%20NEWSLETTERS\">defensive asylum<\/a>.<\/p>\n<p>The <span data-term-id=\"58412000\">DHS<\/span> has a specific procedure to follow during withholding-only hearings. When you receive a removal order, and you express reasonable <span data-term-id=\"58412003\">fear of persecution<\/span> or torture, the <span data-term-id=\"58412000\">DHS<\/span> should refer you to an <span data-term-id=\"58411996\">asylum officer<\/span> who will conduct a <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/credible-fear-interview-three-key-issues.html\"><span data-term-id=\"58412042\">credible fear<\/span><span data-term-id=\"58412042\"> interview<\/span><\/a>.<\/p>\n<p>Here, the <span data-term-id=\"58411996\">asylum officer<\/span> decides whether your fear is reasonable. If the <span data-term-id=\"58411996\">asylum officer<\/span> decides your fear is reasonable, they will forward your case to an <span data-term-id=\"58411986\">immigration judge<\/span>. An <span data-term-id=\"58411986\">immigration judge<\/span> will then hold a withholding-only proceeding to assess your <span data-term-id=\"58411990\">eligibility<\/span> for <span data-term-id=\"58411987\">withholding of removal<\/span> or if you are eligible for protection under the\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/convention-against-torture-and-other-cruel-inhuman-or-degrading\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58411993\">Convention Against Torture<\/span>.<\/a><\/p>\n<p>If the <span data-term-id=\"58411996\">asylum officer<\/span> decides your fear is unreasonable, you may still ask an <span data-term-id=\"58411986\">immigration judge<\/span> to review the decision. This is particularly important for those wrongfully placed under <span data-term-id=\"58412006\">expedited removal<\/span> procedures. You can show evidence to support your claim if you\u2019re going through a claimed status review. This may include your\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/u-s-citizenship-naturalization-overview.html\">naturalization<\/a>\u00a0documents,\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/green-card.html\"><span data-term-id=\"58412001\">green card<\/span><\/a>,\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee.html\">refugee or asylum<\/a>\u00a0approval letters, or birth certificate.<\/p>\n<p>If the <span data-term-id=\"58411986\">immigration judge<\/span> finds your claim credible, they can release you from the <span data-term-id=\"58412006\">expedited <\/span><span data-term-id=\"58411989\">removal<\/span><span data-term-id=\"58411989\"> proceeding<\/span>. But if they find your claim unsubstantiated, the <span data-term-id=\"58412006\">expedited <\/span><span data-term-id=\"58412035\">removal<\/span><span data-term-id=\"58412035\"> process<\/span> may continue, which could <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/can-a-lawyer-stop-deportation.html\">lead to your <span data-term-id=\"58411998\">deportation<\/span><\/a>.<\/p>\n<h2>In <span data-term-id=\"58412027\">Absentia<\/span> Hearings<\/h2>\n<p>This type of <span data-term-id=\"58411985\">immigration <\/span><span data-term-id=\"58412031\">court<\/span><span data-term-id=\"58412031\"> proceeding<\/span> addresses cases where a respondent failed to appear for their scheduled immigration hearing. There are also limited cases where a person can challenge an order <a href=\"https:\/\/www.justice.gov\/eoir\/reference-materials\/ic\/chapter-5\/9\" target=\"_blank\" rel=\"noopener\">given in <span data-term-id=\"58412027\">absentia<\/span><\/a>. For example, you have to prove that you didn\u2019t receive proper <span data-term-id=\"58411991\">notice to appear<\/span>.<\/p>\n<p>In some cases, if you received an order in <span data-term-id=\"58412027\">absentia<\/span>, you may file a motion to rescind the removal order.
