Often, they suffer persecution from their <span data-term-id=\"58412213\">home countries<\/span> because of their religion, race, nationality, <span data-term-id=\"58412223\">political opinion<\/span>, or membership in a <span data-term-id=\"58412234\">particular social group<\/span>. Then, you should file your application one year after you arrive in the United States. A\u00a0<span data-term-id=\"58412222\">defensive <\/span><span data-term-id=\"58412196\">asylum<\/span><span data-term-id=\"58412196\"> application<\/span>\u00a0applies if you undergo <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/overview-of-removal-procedures.html\"><span data-term-id=\"58412200\">removal proceedings<\/span><\/a> and meet the criteria for an <span data-term-id=\"58412214\">asylee<\/span>. It also applies if facing a <span data-term-id=\"58412203\">deportation<\/span> order from the <span data-term-id=\"58412197\">immigration court<\/span>.<\/p>\n<h2>Grant of Asylum<\/h2>\n<p>If you are looking to apply for <span data-term-id=\"58412237\">asylum status<\/span>, you aim to receive a grant of asylum. Here, <span data-term-id=\"58412198\">USCIS<\/span> determines your <span data-term-id=\"58412205\">eligibility<\/span> for asylum. Afterward, you will receive a Form I-94 or an\u00a0<a href=\"https:\/\/www.uscis.gov\/forms\/all-forms\/form-i-94-arrivaldeparture-record-information-for-completing-uscis-forms\" target=\"_blank\" rel=\"noopener\">Arrival Departure Record<\/a>. This indicates that you have been <span data-term-id=\"58412210\">granted asylum<\/span> under the <span data-term-id=\"58412245\">Immigration and Nationality Act<\/span> (INA).<\/p>\n<p>After one year of holding\u00a0<span data-term-id=\"58412214\">asylee<\/span>\u00a0status, you may <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/seeking-lawful-permanent-resident-lpr-status.html\">apply for\u00a0<span data-term-id=\"58412206\">permanent residence<\/span>\u00a0(a\u00a0<span data-term-id=\"58412202\">green card<\/span>)<\/a>. On top of the one-year residency, you must also meet other criteria and submit documents to qualify for <span data-term-id=\"58412206\">permanent residence<\/span> status.<\/p>\n<p>The grant of <span data-term-id=\"58412237\">asylum status<\/span> includes you as the principal applicant and may also include your dependents in the United States. Your dependents are immediate <span data-term-id=\"58412207\">family members<\/span> such as your spouse and <span data-term-id=\"58412241\">minor children<\/span>. However, for them to be <span data-term-id=\"58412210\">granted asylum<\/span>, they should meet the following requirements:<\/p>\n<ul>\n<li>They have physical presence in the United States.<\/li>\n<li>They were included in your <span data-term-id=\"58412239\">application for asylum.<\/span><\/li>\n<li>You qualified their relationship with them.<\/li>\n<\/ul>\n<p>A grant of asylum is not permanent. The U.S. government may terminate your <span data-term-id=\"58412237\">asylum status<\/span> after your circumstances have changed. For instance, you no longer experience a <span data-term-id=\"58412248\">well-founded <\/span><span data-term-id=\"58412211\">fear<\/span><span data-term-id=\"58412211\"> of persecution<\/span> because of a\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/asylum-applications-what-are-changed-circumstances.html\">change of circumstances<\/a>. Or you received protection from another country.<\/p>\n<p>The government may also terminate your <span data-term-id=\"58412237\">asylum status<\/span> if you have committed certain crimes or engaged in activities that violate U.S. criminal and <a href=\"https:\/\/www.findlaw.com\/immigration.html\"><span data-term-id=\"58412218\">immigration laws<\/span><\/a>. These circumstances make you ineligible to keep your <span data-term-id=\"58412237\">asylum status<\/span>.<\/p>\n<h3>Application for Work Authorization Pending <span data-term-id=\"58412238\">Asylum Decision<\/span><\/h3>\n<p>You can begin working in the United States immediately if <span data-term-id=\"58412210\">granted <\/span><span data-term-id=\"58412237\">asylum<\/span><span data-term-id=\"58412237\"> status<\/span>. However, some <span data-term-id=\"58412196\">asylum applicants<\/span> opt to apply for an Employment Authorization Document for identification and convenience.<\/p>\n<p>You and your dependents may apply for work authorization while your\u00a0<span data-term-id=\"58412196\">asylum application<\/span>\u00a0is being processed, before\u00a0<span data-term-id=\"58412198\">USCIS<\/span> makes a <span data-term-id=\"58412242\">final decision<\/span>. You may apply for an\u00a0<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/employment-authorization-document\" target=\"_blank\" rel=\"noopener\">Employment Authorization Document (EAD)<\/a>\u00a0or file a\u00a0<a href=\"https:\/\/www.uscis.gov\/i-765\" target=\"_blank\" rel=\"noopener\">Form I-765<\/a>.<\/p>\n<p>The <span data-term-id=\"58412198\">USCIS<\/span> has the so-called\u00a0<a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/notices\/Applicant-Caused-Delays-in-Adjudications-of-Asylum-Applications-and-Impact-on-Employment-Authorization.pdf\" target=\"_blank\" rel=\"noopener\">180-Day Asylum EAD Clock<\/a>. This system tracks how long your <span data-term-id=\"58412196\">asylum application<\/span> has been processed with <span data-term-id=\"58412198\">USCIS<\/span> or an <span data-term-id=\"58412197\">immigration court<\/span>. It counts the days from when you first filed your application and 150 days after submitting it.<\/p>\n<p>You may apply for a work permit. However, even if you applied for EAD after 150 days, you won\u2019t be able to work or will not receive your work authorization until your application is pending for 180 days. The 180-day period is crucial for the <span data-term-id=\"58412198\">USCIS<\/span> to decide if you are eligible for EAD while waiting for the <span data-term-id=\"58412242\">final decision<\/span> on your <span data-term-id=\"58412196\">asylum application<\/span>.<\/p>\n<h2>Denial of <span data-term-id=\"58412196\">Asylum Application<\/span><\/h2>\n<p>If the <span data-term-id=\"58412198\">USCIS<\/span> denies your <span data-term-id=\"58412196\">asylum application<\/span>, the consequences will depend on your <span data-term-id=\"58412204\">immigration status<\/span> and whether you are in the United States legally or illegally. The following are scenarios that typically occur when your application is denied.<\/p>\n<h3>Denial by the <span data-term-id=\"58412198\">USCIS<\/span><\/h3>\n<p><strong>If You Are Lawfully Present in the U.S.:<\/strong>\u00a0If the <span data-term-id=\"58412198\">USCIS<\/span> denies your application and you have a valid U.S. visa \u2014 for example, a <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/non-immigrant-student-visas.html\">student visa<\/a> or work visa \u2014 you can stay in the U.S. under your current visa status. But you cannot access the protections and benefits of an <span data-term-id=\"58412214\">asylee<\/span>.<\/p>\n<p><strong>If You Are Unlawfully Present in the U.S.:\u00a0<\/strong>You will be subject to <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/deportation-basics.html\"><span data-term-id=\"58412235\">expedited <\/span><span data-term-id=\"58412200\">removal<\/span><span data-term-id=\"58412200\"> proceedings<\/span><\/a> if you do not have valid authority to be in the United States and your <span data-term-id=\"58412196\">asylum application<\/span>. Here, <span data-term-id=\"58412198\">USCIS<\/span> will refer your case to the <span data-term-id=\"58412197\">immigration court<\/span>, where you will be given the chance to present your case.<\/p>\n<h3>Denial by the <span data-term-id=\"58412197\">Immigration Court<\/span><\/h3>\n<p>If an <span data-term-id=\"58412195\">immigration judge<\/span> denies your <span data-term-id=\"58412196\">asylum application<\/span>, you may appeal the decision to the\u00a0<a href=\"https:\/\/www.justice.gov\/eoir\/board-of-immigration-appeals\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58412220\">Board of Immigration Appeals<\/span> (<span data-term-id=\"58412224\">BIA<\/span>)<\/a>\u00a0within 30 days from the decision date. While the appeal is pending, you may stay in the United States. The <span data-term-id=\"58412224\">BIA<\/span> is a part of the <span data-term-id=\"58412250\">Department of Justice<\/span> that interprets and applies U.S. <span data-term-id=\"58412218\">immigration laws<\/span>. It also reviews decisions of <span data-term-id=\"58412197\">immigration courts<\/span> and certain orders issued by <span data-term-id=\"58412198\">USCIS<\/span>. The <span data-term-id=\"58412224\">BIA<\/span> has the authority to affirm, remand, or <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/is-it-possible-for-a-deportation-order-to-be-reversed.html\">reverse the decision<\/a> of an <span data-term-id=\"58412195\">immigration judge<\/span>.<\/p>\n<p>Rulings of the <span data-term-id=\"58412224\">BIA<\/span> are binding to all <span data-term-id=\"58412246\">Department of Homeland Security<\/span> (<span data-term-id=\"58412208\">DHS<\/span>) officers and <span data-term-id=\"58412195\">immigration judges<\/span>. However, the Attorney General or federal courts can review and override the decision.<\/p>\n<h3>Referral to an <span data-term-id=\"58412197\">Immigration Court<\/span><\/h3>\n<p>If the <span data-term-id=\"58412198\">USCIS<\/span> does not approve your <span data-term-id=\"58412196\">asylum application<\/span> and you are physically present in the United States illegally, the <span data-term-id=\"58412198\">USCIS<\/span> will refer your case to an <span data-term-id=\"58412197\">immigration court<\/span>. The referral will include your immediate <span data-term-id=\"58412207\">family members<\/span> in your <span data-term-id=\"58412196\">asylum application<\/span> who are likewise illegally present in the United States.<\/p>\n<p>Note that referring your case to <span data-term-id=\"58412197\">immigration court<\/span> does not amount to a denial of your application. It is an action for your case to be further reviewed by an <span data-term-id=\"58412195\">immigration judge<\/span>. If <span data-term-id=\"58412198\">USCIS<\/span> cannot approve your <span data-term-id=\"58412225\">asylum claim<\/span>, you will receive a letter explaining why it was denied. Together with the letter is a <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-to-do-after-getting-a-notice-to-appear-in-immigration-court.html\"><span data-term-id=\"58412217\">Notice to Appear<\/span><\/a> (Form I-862), which shows the time and date you should appear in <span data-term-id=\"58412197\">immigration court<\/span>. You don\u2019t have to refile your <span data-term-id=\"58412196\">asylum application<\/span>.<\/p>\n<p>After the <span data-term-id=\"58412198\">USCIS<\/span> refers your case to the <span data-term-id=\"58412197\">immigration court<\/span>, the <span data-term-id=\"58412195\">immigration judge<\/span> will independently assess your <span data-term-id=\"58412225\">asylum claim<\/span>. They are also not required to base their decision on decisions previously made by <span data-term-id=\"58412198\">USCIS<\/span>.<\/p>\n<h2>Notice of Intent To Deny<\/h2>\n<p>If the <span data-term-id=\"58412198\">USCIS<\/span> <span data-term-id=\"58412209\">asylum officer<\/span> finds you ineligible for asylum, the <span data-term-id=\"58412198\">USCIS<\/span> will mail you a <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-7-part-a-chapter-11\" target=\"_blank\" rel=\"noopener\">Notice of Intent to Deny<\/a>. The letter will show the reason for the denial of your application. After receipt of the notice, you have 16 days to file a rebuttal or new evidence. If you respond within 16 days, the <span data-term-id=\"58412209\">asylum officer<\/span> will carefully consider the rebuttal and approve or deny your claim.<\/p>\n<p>The applicant cannot appeal the decision of the <span data-term-id=\"58412198\">USCIS<\/span> <span data-term-id=\"58412209\">asylum officers<\/span>. The denial includes any dependents in the <span data-term-id=\"58412196\">asylum application<\/span>. Any employment authorization issued to the applicant due to a pending <span data-term-id=\"58412196\">asylum application<\/span> will expire 60 days from the Final Denial letter date or on the EAD expiration date, whichever period is longer.<\/p>\n<h2>Traveling Outside of the United States<\/h2>\n<p><span data-term-id=\"58412215\">Asylum seekers<\/span> and their immediate families may travel outside the United States or visit their <span data-term-id=\"58412236\">country of origin<\/span>. However, there are specific measures you have to take before going on a trip.<\/p>\n<h3>For <span data-term-id=\"58412196\">Asylum Applicants<\/span><\/h3>\n<p>Before <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/can-i-travel-without-a-green-card.html\">traveling out of the U.S<\/a>., you must apply for advanced parole. This allows you to travel back to the U.S. without securing a new U.S. visa. If you fail to secure an advance parole, the U.S. government will presume you abandoned your <span data-term-id=\"58412196\">asylum application<\/span>. So, you should secure your advance parole documents before traveling abroad. But despite your advance parole, you must still undergo inspection by <span data-term-id=\"58412251\">U.S. Customs and Border Protection<\/span> (<span data-term-id=\"58412231\">CBP<\/span>) officers at the <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-overview\/immigration-glossary-and-acronyms.html\"><span data-term-id=\"58412240\">port of entry<\/span><\/a>.<\/p>\n<h3>For <span data-term-id=\"58412214\">Asylees<\/span><\/h3>\n<p>If you already have <span data-term-id=\"58412237\">asylum status<\/span>, you may travel outside of the U.S. after prior approval by the <a href=\"https:\/\/www.dhs.gov\/topics\/secretary-homeland-security\" target=\"_blank\" rel=\"noopener\">Secretary of <span data-term-id=\"58412208\">DHS<\/span><\/a>. The prior approval comes as a travel document for refugees and is valid for a year. The <span data-term-id=\"58412208\">DHS<\/span> may issue the travel document to <span data-term-id=\"58412214\">asylees<\/span> and refugees in the U.S. who want to take a temporary trip abroad.<\/p>\n<p>You should get the refugee travel document before you leave the United States. However, specific regulations may also allow the issuing of such documents outside of the U.S. under specific circumstances. Like advance parole, the refugee travel document does not guarantee admission into the United States. You should still go through the inspection by a <span data-term-id=\"58412231\">CBP<\/span> officer.<\/p>\n<h2>Filing an <span data-term-id=\"58412196\">Asylum Application<\/span>?
