An exception to this rule applies if you were born to a foreign diplomat.<\/p>\n<p>In general, if you are born outside of the U.S., you may acquire U.S. citizenship by birth if you meet all of the following requirements at the time you were born:<\/p>\n<ul>\n<li>You were born of a U.S. citizen parent(s)<\/li>\n<li>The U.S. citizen parent met the residency or physical presence requirements in the U.S. before your birth<\/li>\n<li>You met all other requirements prescribed under the Sections 301 and 309 of the Immigration and Nationality Act<\/li>\n<\/ul>\n<p>In most cases, U.S. citizen parents can file a\u00a0<a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/international-travel\/while-abroad\/birth-abroad.html\" target=\"_blank\" rel=\"noopener\">Consular Report of Birth Abroad (CRBA)<\/a> to report the child&#8217;s birth. The U.S. Department of State issues the CRBA before the child turns 18. It will then <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/how-to-obtain-proof-of-citizenship.html\">serve as proof<\/a> of the U.S. citizenship of the child.\u00a0<\/p>\n<h2>What if I Was Not born a U.S. Citizen, Can I Become One?<\/h2>\n<p>Yes. If you are a non-U.S. citizen at birth, you can become a <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/the-basics-of-naturalization.html\">U.S. citizen through naturalization<\/a>. Here, the U.S. government grants U.S. citizenship to noncitizens born outside of the U.S. and do not have U.S. citizen parents.<\/p>\n<p>In general, you have to file the naturalization with the U.S. Citizenship and Immigration Services (USCIS). The USCIS will grant you U.S. Citizenship after <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/4-issues-that-will-affect-your-us-citizenship-application.html\">examining your application<\/a>. All applicants must comply with all the requirements provided by Congress. In most cases, you cannot be a naturalized U.S. citizen unless you have a lawful permanent resident (LPR) status or were lawfully admitted to the country for permanent residence.<\/p>\n<h2>What Are the Steps to Naturalization?<\/h2>\n<p>Understanding the <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/naturalization-process.html\">process of becoming a U.S. Citizen<\/a> through naturalization is crucial. The following are the 10 steps to keep in mind when looking at applying for naturalization:<\/p>\n<ol>\n<li>Check if you are already a U.S. citizen by birth or a derivative of U.S. citizenship from your parents.<\/li>\n<li>Assess your eligibility to apply for U.S. citizenship through naturalization.<\/li>\n<li>Prepare your Application for Naturalization (<a href=\"https:\/\/www.uscis.gov\/n-400\" target=\"_blank\" rel=\"noopener\">Form N-400<\/a>).<\/li>\n<li>Submit your application and pay the application fees.<\/li>\n<li>Attend your <a href=\"https:\/\/www.dhs.gov\/biometrics\" target=\"_blank\" rel=\"noopener\">biometrics<\/a> appointment. The USCIS will send you an appointment notice, which includes the date, time, and location of where you should go.<\/li>\n<li>Complete your naturalization interview. During the interview, the immigration officer will ask you questions related to your background and your application.<\/li>\n<li>Wait for the notice of decision from the USCIS. The USCIS will mail its decision to you. But you can also check the <a href=\"https:\/\/egov.uscis.gov\/\" target=\"_blank\" rel=\"noopener\">electronic notice online<\/a>. If the USCIS approves your petition, the next step is attending the naturalization ceremony and taking an oath.<\/li>\n<li>Receive your issuance of a certificate of naturalization. You can also pursue any of the following options if they deny your application for naturalization:<\/p>\n<ul>\n<li>Appeal the denial of your application for naturalization by filing a Request for a Hearing on a Decision in Naturalization Proceedings\u00a0<a href=\"https:\/\/www.uscis.gov\/n-336\" target=\"_blank\" rel=\"noopener\">(Form N-336)<\/a><\/li>\n<li>File a new application for naturalization<\/li>\n<li>File a Motion to Reopen and Reconsider<\/li>\n<\/ul>\n<p>If they deny your application for naturalization, we recommend that you seek legal advice from an immigration attorney. They can assist you in understanding the decision and looking at the best possible option, depending on your case.<\/p>\n<h2>How Can I Appeal the Denial of My Application for Naturalization?<\/h2>\n<p>The appeal begins by filing <a href=\"https:\/\/www.uscis.gov\/n-336\" target=\"_blank\" rel=\"noopener\">Form N-366<\/a> within 30 days from the date of denial of your application. You also must pay a filing fee along with the Form N-336. After you file everything, they will schedule you for a hearing within 180 days from the date of your appeal filing.<\/p>\n<p>During the hearing, you can present additional information to help overturn the denial of your citizenship application. Included among the evidence you can present are briefs, written statements, or evidence that could help counter the denial. Note that the immigration officer will have discretion in assessing the new evidence you present and how they will determine your application.\u00a0<\/p>\n<p>You don&#8217;t need a lawyer for this, but having legal help on your side can make it\u00a0far less stressful. An <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a> can review the reasons for your denial, help you gather stronger evidence, and represent you at the hearing to improve your chances of success.\u00a0<\/p>\n<h2>Do I Need To Disclose My Criminal History on My Citizenship Application?<\/h2>\n<p>Yes. It is essential to d<a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/4-issues-that-will-affect-your-us-citizenship-application.html\">eclare all types of criminal records or arrests<\/a> that you have had. This declaration applies regardless of whether the previous record was expunged or deleted. So, make sure to declare any of the following if it applies to your case:<\/p>\n<ul>\n<li>Arrests,\u00a0including those by police, immigration officers, and other federal agents<\/li>\n<li>Convictions,\u00a0even if they have been expunged<\/li>\n<li>Crimes you have committed,\u00a0regardless of whether you were <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/how-does-an-arrest-affect-immigration-status.html\">arrested or convicted<\/a><\/li>\n<\/ul>\n<p>Even if you have committed a minor crime, USCIS may deny your application if you do not tell the Immigration officer about the incident, and they somehow find out about it.<\/p>\n<h2>What Are the Naturalization Requirements for Those Married to U.S. Citizens?<\/h2>\n<p>The <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/bringing-a-spouse-to-live-in-the-u-s.html\">spouse of a U.S. Citizen<\/a> residing in the United States may apply for naturalization based on\u00a0their\u00a0marriage. The general requirement for eligibility is continuous residence in the U.S. after acquiring a green card or LPR status.<\/p>\n<p>Here, the noncitizen spouse must have lived in the US as a permanent resident for at least three years immediately before filing the naturalization application. The <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/green-card-marriage-interview-faq-s.html\">noncitizen spouse<\/a> should also have maintained the marital union with the U.S. citizen spouse during the three years.<\/p>\n<p>The following are the criteria the noncitizen spouse needs to meet to qualify for United States Citizenship:<\/p>\n<ul>\n<li>18 years of age or older when filing for naturalization application<\/li>\n<li>Permanent resident holder or green card holder at the time of filing for naturalization application<\/li>\n<li>Living in a marital relationship with the U.S. Citizen spouse for at least three years as a permanent resident before the filing of the application<\/li>\n<li>Continuously resided in the U.S. as a permanent resident for at least three years immediately before the filing of the application<\/li>\n<li>Physically present in the U.S. for at least 18 months out of the three years before the date of filing for the application<\/li>\n<li>Lived within the USCIS district or the state with jurisdiction over the place of residence of the noncitizen at least three months before filing<\/li>\n<li>Showed proficiency in the English language, including the ability to read, speak, and write English words in ordinary usage<\/li>\n<li>Demonstrated understanding and knowledge of the fundamental principles of the U.S. government and U.S. history<\/li>\n<li>Maintained <a href=\"https:\/\/www.uscis.gov\/policy-manual\/volume-12-part-d-chapter-9\" target=\"_blank\" rel=\"noopener\">good moral character<\/a> for at least three years immediately before filing and until the time of naturalization<\/li>\n<\/ul>\n<p>The requirements for naturalization may differ depending on each case. The spouses of members of the U.S. armed forces may also be eligible for naturalization outside of the United States.<\/p>\n<h2>What Is the Naturalization Test?<\/h2>\n<p>During your interview, the USCIS officer will ask you questions related to your application and your background. However, there are certain cases where an applicant may be exempted from taking the test.
