The <span data-term-id=\"58327430\">U.S. <\/span><span data-term-id=\"58327413\">Supreme Court<\/span> struck down key provisions, and later settlements further limited the law, especially those tied to mandatory immigration checks and concerns about <span data-term-id=\"58327419\">racial profiling<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<p>On April 23, 2010, <span data-term-id=\"58327405\">Arizona<\/span> <span data-term-id=\"58327429\">Governor Jan Brewer<\/span> signed into law\u00a0<span data-term-id=\"58327412\">Senate Bill 1070<\/span>. The bill aimed to prevent <span data-term-id=\"58327409\">illegal immigration<\/span>, significantly affecting the <span data-term-id=\"58327438\">Mexico<\/span>-bordering <span data-term-id=\"58327420\">state of <\/span><span data-term-id=\"58327405\">Arizona<\/span>. The law was titled \u201c<a href=\"https:\/\/www.azleg.gov\/legtext\/49leg\/2r\/summary\/s.1070pshs.doc.htm\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58327407\">Support Our Law Enforcement and Safe Neighborhoods Act<\/span><\/a>.\u201d<\/p>\n<p>This article provides information about S.B. 1070 in <span data-term-id=\"58327405\">Arizona<\/span>. Because immigration rules continue to evolve, anyone facing an immigration issue in <span data-term-id=\"58327405\">Arizona<\/span> should speak with a local <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a> for up\u2011to\u2011date guidance.<\/p>\n<h2>S.B. 1070: What Remains and What Doesn\u2019t<\/h2>\n<p>As a result of <span data-term-id=\"58327427\">legal challenges<\/span>, not all parts of the bill remain in effect. The original bill would have enlisted <span data-term-id=\"58327441\">local police<\/span> to enforce <span data-term-id=\"58327410\">federal <\/span><span data-term-id=\"58327406\">immigration laws<\/span> in the state. It required law enforcement to check the <span data-term-id=\"58327408\">immigration status<\/span> of any person they have \u201c<span data-term-id=\"58327418\">reasonable suspicion<\/span>\u201d of being in the U.S. illegally.<\/p>\n<p>But, a <span data-term-id=\"58327430\">U.S. <\/span><span data-term-id=\"58327413\">Supreme Court<\/span> ruling in 2012 and a settlement with plaintiffs in 2016 have gutted the law \u2014 including provisions related to the \u201c<span data-term-id=\"58327418\">reasonable suspicion<\/span>\u201d standard.<\/p>\n<p>For example, the cases removed a provision that would have charged immigrants with a\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/crimes\/criminal-overview\/misdemeanors.html\"><span data-term-id=\"58327416\">misdemeanor<\/span><\/a>\u00a0for failing to carry documentation of their legal status. While the law required police to ask for proof of legal residency status, it is now subject to the officer\u2019s discretion. It also forced migrants in <span data-term-id=\"58327405\">Arizona<\/span>\u00a0who remained for more than 30 days to register with the state. This part of the bill referred to certain \u201calien registration\u201d requirements.<\/p>\n<p>Keep reading for an overview of the legal implications of this law and its status after being challenged in court.<\/p>\n<h2>National, State, and Local Reaction to <span data-term-id=\"58327425\">Arizona<\/span><span data-term-id=\"58327425\"> S.B. 1070<\/span><\/h2>\n<p>The signing of <span data-term-id=\"58327425\">Arizona<\/span><span data-term-id=\"58327425\"> S.B. 1070<\/span> sparked an ongoing national debate from opponents and supporters over its legality. Opponents claimed the law was unconstitutional under <span data-term-id=\"58327414\">civil rights<\/span> laws. They believed it would lead to <span data-term-id=\"58327419\">racial profiling<\/span> and\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/crimes\/a-z\/harassment.html\">harassment<\/a>.<\/p>\n<p>Supporters of the measure claimed the law enforces what the <span data-term-id=\"58327411\">federal government<\/span> already requires. They argued that the law aims to keep neighborhoods and communities safe. They also argued that the bill is necessary in a state heavily affected by <span data-term-id=\"58327409\">illegal immigration<\/span>. In defense of the bill, they pointed to problems with <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/smuggling-and-customs-violations.html\">drug smuggling<\/a> and human trafficking in <span data-term-id=\"58327405\">Arizona<\/span>. Some say the law would help lead the charge for <span data-term-id=\"58327464\">immigration reform<\/span>.<\/p>\n<h2>The Supremacy Clause<\/h2>\n<p>The United States is a federalist system. States have some freedom in how they write and pass laws. But they must remain within specific parameters to not violate the U.S. Constitution, as only Congress can enact federal laws. <span data-term-id=\"58327443\">Local governments<\/span> may have some latitude in the laws of their jurisdictions. But mandates and ordinances from any jurisdiction cannot contradict U.S. constitutional law.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/the-supremacy-clause-and-the-doctrine-of-preemption.html\">Supremacy Clause<\/a>\u00a0of the U.S. Constitution requires that federal law \u201cpreempts\u201d (or trumps) <span data-term-id=\"58327415\">state law<\/span>.<\/p>\n<p><span data-term-id=\"58327406\">Immigration laws<\/span> and policies are federal. As a result, the <span data-term-id=\"58327422\">Arizona<\/span> <span data-term-id=\"58327406\">immigration law<\/span> was challenged as violating the Supremacy Clause. The U.S. 9th Circuit <span data-term-id=\"58327434\">Court of Appeals<\/span> upheld a lower federal court\u2019s injunction of the law, sending the matter to the <span data-term-id=\"58327430\">U.S. <\/span><span data-term-id=\"58327413\">Supreme Court<\/span>.<\/p>\n<h2>Challenges to the <span data-term-id=\"58327405\">Arizona<\/span> Law<\/h2>\n<p>In July 2010, the\u00a0<a href=\"https:\/\/www.justice.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Department of Justice (DOJ)<\/a>\u00a0filed a lawsuit in a federal court against the <span data-term-id=\"58327420\">state of <\/span><span data-term-id=\"58327405\">Arizona<\/span>. The DOJ argued that S.B. 1070 would interfere with federal enforcement of <span data-term-id=\"58327437\">U.S. <\/span><span data-term-id=\"58327406\">immigration<\/span><span data-term-id=\"58327406\"> law<\/span>. The complaint indicated that S.B. 1070 could compromise efforts by\u00a0<a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58327423\">Immigration and Customs Enforcement<\/span> (ICE)<\/a>. This could distract ICE from prioritizing actual national security threats.<\/p>\n<p>Among the claims by the D.O.J. was that S.B. 1070 would take resources in <span data-term-id=\"58327405\">Arizona<\/span> away from bigger priorities, such as fighting terrorism. The DOJ also argued that it would cause the harassment and detention of those in the United States legally, including <span data-term-id=\"58327454\">U.S. citizens<\/span>.<\/p>\n<p>After the federal court granted a preliminary injunction against certain parts of S.B. 1070, many parts of the bill were repealed. After that, federal authorities could operate the way they once had in <span data-term-id=\"58327405\">Arizona<\/span>.<\/p>\n<p>In a 5-3 ruling in 2012, the\u00a0<a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/11-182.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58327413\">Supreme Court<\/span> overturned three of the provisions of S.B. 1070<\/a>. But, the court allowed the provision requiring police to demand documentation of legal residency intact. SCOTUS justified this by citing the Supremacy Clause.<\/p>\n<p>In 2016, the state settled lawsuits with the National <span data-term-id=\"58327406\">Immigration Law<\/span> Center by dropping this provision. Other <span data-term-id=\"58327424\">immigrant rights<\/span> groups were involved in the lawsuit, as well. Along with the settlement, <span data-term-id=\"58327405\">Arizona<\/span> Attorney General Mark Brnovich issued the following statement:<\/p>\n<p>\u201cOfficers shall not prolong a stop, detention, or arrest solely to verify <span data-term-id=\"58327408\">immigration status<\/span>. Officers shall not contact, stop, detain or arrest an individual based on race, color, or <span data-term-id=\"58327440\">national origin<\/span>, except when it is part of a suspect description.\u201d<\/p>\n<h2><span data-term-id=\"58327419\">Racial Profiling<\/span><\/h2>\n<p><span data-term-id=\"58327419\">Racial profiling<\/span> uses race or nationality to identify a person as a suspect or potential suspect. Opponents believe S.B. 1070 would unfairly lead to <span data-term-id=\"58327419\">racial profiling<\/span> among residents or visitors within the state. They believed this because the new law would allow police to arrest people they suspect of being in <span data-term-id=\"58327405\">Arizona<\/span> illegally.<\/p>\n<p>S.B. 1070 would have given <span data-term-id=\"58327442\">local <\/span><span data-term-id=\"58327436\">law enforcement<\/span><span data-term-id=\"58327436\"> officials<\/span> in the state far too many powers to violate the <span data-term-id=\"58327414\">civil rights<\/span> of <span data-term-id=\"58327454\">U.S. citizens<\/span>. By requiring that <span data-term-id=\"58327415\">state <\/span><span data-term-id=\"58327417\">law<\/span><span data-term-id=\"58327417\"> enforcement officers<\/span> check the citizenship status of \u201csuspicious\u201d people, S.B. 1070 would encourage <span data-term-id=\"58327419\">racial profiling<\/span>. Many advocacy groups, like the <span data-term-id=\"58327432\">ACLU<\/span>, condemned the parts of S.B. 1070 that facilitated <span data-term-id=\"58327419\">racial profiling<\/span>.<\/p>\n<p>The <span data-term-id=\"58327432\">ACLU<\/span> once said it had filed its lawsuit, given that the bill encouraged \u201c<span data-term-id=\"58327419\">racial profiling<\/span> of <span data-term-id=\"58327449\">Latinos<\/span> and others who may look or sound \u2018foreign,\u2019 including many <span data-term-id=\"58327454\">U.S. citizens<\/span> who have lived in America their entire lives.\u201d Similarly, it could affect <span data-term-id=\"58327454\">US citizens<\/span> who have undergone the <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/naturalization-process.html\"><span data-term-id=\"58327462\">naturalization<\/span> process<\/a>.<\/p>\n<p>Attorneys for the <span data-term-id=\"58327432\">ACLU<\/span> argued that these parts of the bill would violate citizens\u2019 rights to equal protection under the 14th Amendment to the U.S. Constitution.<\/p>\n<p>To learn more about the relationship between racial discrimination and equal protection,\u00a0<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/race-discrimination-u-s-supreme-court-cases.html\">review FindLaw\u2019s page on the issue<\/a>.<\/p>\n<h2>National <span data-term-id=\"58327435\">Immigration Policies<\/span><\/h2>\n<p>Many national <span data-term-id=\"58327464\">immigration reform<\/span> advocates hoped the controversy surrounding <span data-term-id=\"58327405\">Arizona<\/span>\u2019s law would help emphasize the need for a comprehensive federal reform law. But such reform has yet to be introduced. While the bill has sparked numerous <span data-term-id=\"58327427\">legal challenges<\/span>, deficiencies remain in the <a href=\"https:\/\/www.findlaw.com\/immigration.html\"><span data-term-id=\"58327437\">U.S. immigration<\/span> system<\/a>.<\/p>\n<h2><span data-term-id=\"58327433\">Public Safety<\/span> Concerns<\/h2>\n<p>Because of fears the law would discourage immigrants from reporting criminal activity, there was a concern over <span data-term-id=\"58327433\">public safety<\/span>. Unauthorized residents who fear prosecution could have put others at risk by not reporting such activities.<\/p>\n<h2>States With Similar Laws to S.B. 1070<\/h2>\n<p>After <span data-term-id=\"58327405\">Arizona<\/span> passed S.B.\u00a01070, other states passed similar laws. This\u00a0included:<\/p>\n<ul>\n<li>Alabama<\/li>\n<li>Georgia<\/li>\n<li>Indiana<\/li>\n<li><span data-term-id=\"58327452\">South Carolina<\/span><\/li>\n<li>Utah<\/li>\n<\/ul>\n<p>These laws also attempt to address <span data-term-id=\"58327409\">illegal immigration<\/span> at the state level.<\/p>\n<p>The following are some of the <span data-term-id=\"58327415\">state laws<\/span> similar to SB 1070. All faced court challenges, especially following the <span data-term-id=\"58327413\">Supreme Court<\/span>\u2019s decision in\u00a0<em><span data-term-id=\"58327450\">Arizona<\/span><span data-term-id=\"58327450\"> v. United States<\/span><\/em>. Some of their provisions remain in place.<\/p>\n<h3>Alabama House Bill 56<\/h3>\n<p>Alabama legislators enacted House Bill 56 in 2011. The bill modified\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/alabama-state-immigration-laws.html\">Alabama <span data-term-id=\"58327406\">immigration law<\/span><\/a>\u00a0by introducing measures that:<\/p>\n<ul>\n<li>Allowed law enforcement authorities to check the <span data-term-id=\"58327408\">immigration status<\/span> of people they detained<\/li>\n<li>Required employers to verify the legal status of every new hire<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.nilc.org\/2012\/07\/02\/nr070212\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58327414\">Civil rights<\/span> groups<\/a>\u00a0challenged the constitutionality of HB 56, citing the <span data-term-id=\"58327413\">Supreme Court<\/span>\u2019s ruling in\u00a0<em><span data-term-id=\"58327450\">Arizona<\/span><span data-term-id=\"58327450\"> v. United States<\/span>.<\/em>\u00a0They argued that HB 56 leads to <span data-term-id=\"58327419\">racial profiling<\/span>, unlawful interrogations, and arrests in violation of the\u00a0<a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-rights\/u-s-constitution-fourth-amendment.html\">4th Amendment of the U.S. Constitution<\/a>.<\/p>\n<p>By October 2013, most of the provisions of HB 56 were struck down. The only one to survive\u00a0was\u00a0the\u00a0<a href=\"https:\/\/www.splcenter.org\/news\/2021\/06\/25\/cruel-legacy-alabama-anti-immigrant-law-remembered#:~:text=By%20October%202013,workers%20are%20documented.\" target=\"_blank\" rel=\"noopener\">requirement\u00a0for verification of authority to work<\/a>\u00a0in the country.<\/p>\n<h3>Georgia House Bill 87<\/h3>\n<p>In 2011,\u00a0<a href=\"https:\/\/www.ajc.com\/news\/local\/georgia-lawmakers-pass-illegal-immigration-crackdown\/dvEcDeIuAOvpGvoHzCVodN\/\" target=\"_blank\" rel=\"noopener\">Georgia passed House Bill 87<\/a>. The bill expanded\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/georgia-state-immigration-laws.html\">Georgia <span data-term-id=\"58327406\">immigration law<\/span><\/a>\u00a0by giving <span data-term-id=\"58327436\">law enforcement officials<\/span> the power to:<\/p>\n<ul>\n<li>Check the <span data-term-id=\"58327408\">immigration status<\/span> of certain people<\/li>\n<li>Penalize people who transport or harbor undocumented immigrants<\/li>\n<\/ul>\n<p>The bill faced a series of criticisms suggesting\u00a0that it promoted <span data-term-id=\"58327419\">racial profiling<\/span> and conflicted\u00a0with federal law.<\/p>\n<p>In March 2013, the U.S. <span data-term-id=\"58327434\">Court of Appeals<\/span> 11th Circuit issued a permanent injunction blocking multiple provisions of HB 87. Included among the provisions blocked was the one that criminalized harboring or transporting undocumented immigrants.<\/p>\n<h3>Indiana Senate Bill 590<\/h3>\n<p>In 2011,\u00a0<a href=\"https:\/\/archive.iga.in.gov\/2011\/bills\/billinfo6efe.html?doctype=SB&amp;docno=0590\" target=\"_blank\" rel=\"noopener\">Indiana passed Senate Bill 590<\/a>. The bill added several new provisions to\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/indiana-state-immigration-laws.html\">Indiana <span data-term-id=\"58327406\">immigration law<\/span><\/a>, including:<\/p>\n<ul>\n<li>Allowing warrantless arrest of immigrants with removal orders or a notice of action from the Department of <span data-term-id=\"58327453\">Homeland Security<\/span><\/li>\n<li>Requiring employment verification for all new hires<\/li>\n<li>Subjecting employers who hire undocumented immigrants to criminal charges<\/li>\n<\/ul>\n<p>A federal judge blocked the\u00a0provisions of SB 590 that authorized warrantless arrest and the criminalization of hiring undocumented immigrants\u00a0through a preliminary injunction.\u00a0The district court\u00a0ruled that these provisions violated due process rights and that <span data-term-id=\"58327410\">federal <\/span><span data-term-id=\"58327406\">immigration law<\/span> preempts <span data-term-id=\"58327415\">state law<\/span>.<\/p>\n<h3><span data-term-id=\"58327452\">South Carolina<\/span> Senate Bill 20<\/h3>\n<p>In 2011, lawmakers in\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/south-carolina-state-immigration-laws.html\"><span data-term-id=\"58327452\">South Carolina<\/span><\/a>\u00a0passed SB 20. The law was modeled after <span data-term-id=\"58327425\">Arizona<\/span><span data-term-id=\"58327425\">\u2019s SB 1070<\/span> and faced similar <span data-term-id=\"58327427\">legal challenges<\/span>. It required law enforcement to demand proof of citizenship where they had a <span data-term-id=\"58327418\">reasonable suspicion<\/span> that someone was in the country illegally. It also criminalized providing aid to people who were undocumented.<\/p>\n<p><a href=\"https:\/\/www.aclu.org\/cases\/lowcountry-immigration-coalition-et-al-v-nikki-haley\" target=\"_blank\" rel=\"noopener\">A lawsuit by the <span data-term-id=\"58327432\">ACLU<\/span><\/a>\u00a0and several other <span data-term-id=\"58327414\">civil rights<\/span> groups led to a preliminary injunction blocking most of this law from taking effect. Eventually, they reached an agreement with the state government to permanently ban key provisions of the law. It also established strict guidelines for law enforcement when requesting someone\u2019s immigration documents.<\/p>\n<h3>Utah House Bill 497<\/h3>\n<p>In 2011, Utah passed\u00a0<a href=\"https:\/\/le.utah.gov\/~2011\/bills\/static\/HB0497.html\" target=\"_blank\" rel=\"noopener\">House Bill 497<\/a>. Some provisions of the bill allowed <span data-term-id=\"58327439\">police officers<\/span> to ask immigrants for documents showing their lawful <span data-term-id=\"58327408\">immigration status<\/span>. The law also compels all immigrants to carry their\u00a0immigration documents at all times.<\/p>\n<p>The National <span data-term-id=\"58327406\">Immigration Law<\/span> Center and the <span data-term-id=\"58327432\">ACLU<\/span> filed a lawsuit to stop HB 497 from taking effect. They argued that the bill violated the constitutional protection against unreasonable search and seizure and infringed on federal immigration authority.<\/p>\n<p>In 2014, a federal judge struck down several provisions of HB 497. It limited the authority of <span data-term-id=\"58327439\">police officers<\/span> and <span data-term-id=\"58327436\">law enforcement officials<\/span> to detain individuals solely based on their <span data-term-id=\"58327408\">immigration status<\/span> verification. They claimed they were required to enforce a law that could expose them to liability.\u00a0<\/p>\n<h3>Department of Justice Challenge<\/h3>\n<p>In July 2010, the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/citing-conflict-federal-law-department-justice-challenges-arizona-immigration-law\" target=\"_blank\" rel=\"noopener\">Department of Justice (DOJ) challenged S.B. 1070<\/a>. The <span data-term-id=\"58327420\">state of <\/span><span data-term-id=\"58327405\">Arizona<\/span> appealed, but the Ninth Circuit of the <span data-term-id=\"58327434\">Court of Appeals<\/span> rejected the state\u2019s arguments. He noted that <span data-term-id=\"58327405\">Arizona<\/span> undertook duties meant for the <span data-term-id=\"58327411\">federal government<\/span>, which made much of S.B. 1070 unconstitutional.<\/p>\n<p>However, the <span data-term-id=\"58327413\">Supreme Court<\/span> allowed <span data-term-id=\"58327405\">Arizona<\/span> to keep the \u201cShow Me Your Papers\u201d provision. This\u00a0allowed\u00a0<span data-term-id=\"58327442\">local <\/span><span data-term-id=\"58327444\">law enforcement<\/span><span data-term-id=\"58327444\"> agencies<\/span> to check the <span data-term-id=\"58327408\">immigration status<\/span> of persons they stop if the officer has <span data-term-id=\"58327418\">reasonable suspicion<\/span> to believe that the person might be in the U.S. illegally.<\/p>\n<p>In September 2012, the same coalition filed for another injunction to block the \u201cShow Me Your Papers\u201d provision. They argued that leaving it in place would lead to <span data-term-id=\"58327419\">racial profiling<\/span>. Authorities could question someone\u2019s <span data-term-id=\"58327408\">immigration status<\/span> based on their race or assumed <span data-term-id=\"58327440\">national origin<\/span>. This goes against the\u00a0<a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\" target=\"_blank\" rel=\"noopener\">14th Amendment of the U.S. Constitution<\/a>. Among other things, the 14th Amendment requires that everyone be treated equally under the law, regardless of their race.<\/p>\n<p>Judge Susan Bolton rejected the injunction and preserved the provision. This allowed law enforcement authorities to stop or detain people if there was <span data-term-id=\"58327418\">reasonable suspicion<\/span> and ask for immigration documentation.<\/p>\n<h2>Other Important Parts of S.B. 1070<\/h2>\n<p>S.B. 1070 also required employers to use\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/using-e-verify.html\"><span data-term-id=\"58327431\">E-Verify<\/span><\/a>.
