While undocumented residents can obtain drive\u2011only licenses and may qualify for in\u2011state tuition if they meet specific requirements, they remain ineligible for most public benefits.<\/p>\n\n    <\/div>\n\n\n\n<p data-pm-slice=\"1 1 []\">Immigration laws are primarily enforced by federal agencies. But states have their own rules that affect the daily life of immigrants and the services they can access. These rules and regulations vary by state.<\/p>\n<p>This article explains some of the fundamental rights and protections available to immigrants in Connecticut. A local <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a> can provide up-to-date information and help you understand available protections.<\/p>\n<h2><a id=\"Law\"><\/a>Law Enforcement and Immigration in Connecticut<\/h2>\n<p>The U.S. government works through a series of federal agencies that enforce immigration laws in the country. Some of the main government entities that handle immigration law are:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.dhs.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Department of Homeland Security (DHS)<\/a><\/li>\n<li><a href=\"https:\/\/www.uscis.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Citizenship and Immigration Services (USCIS)<\/a><\/li>\n<li><a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Immigration and Customs Enforcement (ICE)<\/a><\/li>\n<li><a href=\"https:\/\/www.cbp.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Customs and Border Protection (CBP)<\/a><\/li>\n<\/ul>\n<p>While the federal government and federal courts primarily administer immigration laws, state authorities also play a vital role in law enforcement. The <a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/criminal-apprehension-program\" target=\"_blank\" rel=\"noopener\">Criminal Apprehension Program (CAP)<\/a>\u00a0highlighted this collaboration between state and federal governments.<\/p>\n<p>CAP helps federal authorities identify, arrest, and remove non-U.S. citizens. Particularly those who pose threats to communities. The program focuses on immigrants who have committed violent crimes or are at large.<\/p>\n<p>A comparable effort was in operation in 2017, called the &#8220;<a href=\"https:\/\/www.ice.gov\/secure-communities\" target=\"_blank\" rel=\"noopener\">Secure Communities<\/a>&#8221; initiative. Like CAP, Secure Communities promoted collaboration between federal and state authorities. The DHS shared information about arrested people with the <a href=\"https:\/\/www.fbi.gov\/investigate\" target=\"_blank\" rel=\"noopener\">Federal Bureau of Investigation<\/a> (FBI) through this action. This information-sharing mechanism enabled them to determine whether to remove or deport the person from the country.<\/p>\n<p>President Joe Biden revoked Secure Communities in January 2021. There are still various programs in place that carry on similar objectives.<\/p>\n<h2><a id=\"E-Verify\"><\/a>Connecticut Employment and E-Verify Requirements<\/h2>\n<p>\u00a0E-Verify is an online system administered by the federal government that allows employers to verify employees&#8217; employment eligibility. While some states mandate its use, in Connecticut, <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\" target=\"_blank\" rel=\"noopener\">E-Verify<\/a>\u00a0is voluntary for employers, meaning they can choose to use it when hiring employees.<\/p>\n<p>Note that in 2009, the Connecticut General Assembly <a href=\"https:\/\/www.cga.ct.gov\/2009\/TOB\/s\/pdf\/2009SB-00221-R00-SB.pdf\" target=\"_blank\" rel=\"noopener\">proposed Bill No. 221<\/a>. It sought to require all employers with three or more employees to verify the employment eligibility of newly hired employees through E-Verify.<\/p>\n<p>Due to the changing laws, it is best to stay updated. If in doubt, seek legal advice from an <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a>.<\/p>\n<h2><a id=\"Drivers\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Immigrants living illegally in Connecticut can get driver&#8217;s licenses. This was made possible by\u00a0<a href=\"https:\/\/www.cga.ct.gov\/2013\/ACT\/PA\/2013PA-00089-R00HB-06495-PA.htm\" target=\"_blank\" rel=\"noopener\">Public Act (P.A.) 2013-89<\/a>, enacted on\u00a0June 6, 2013. The act allowed immigrants living in Connecticut illegally to receive &#8220;Drive-Only Licenses.&#8221; But they must meet certain requirements before its issuance. The requirements include:<\/p>\n<ul>\n<li>Proof of identity (such as passport or birth certificate)<\/li>\n<li>Proof of residency in the state (such as utility bills)<\/li>\n<li>Affidavit stating an intention to legalize the stay in the U.S. as soon as eligible<\/li>\n<\/ul>\n<p>Also, New Haven started the\u00a0<a href=\"https:\/\/www.newhavenct.gov\/government\/departments-divisions\/vital-statistics-division\/elm-city-resident-card\" target=\"_blank\" rel=\"noopener\">identification resident card program<\/a>\u00a0in 2007. The program allows New Haven residents to get local government-issued IDs. It covers immigrants living in New Haven illegally.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">Deferred Action for Childhood Arrivals<\/a> (DACA) recipients in Connecticut can also get state IDs and driver&#8217;s licenses.<\/p>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Immigrants living in Connecticut illegally can&#8217;t access most <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>.\u00a0But they can access help that is necessary for health care and safety, which includes the following:<\/p>\n<ul>\n<li>Child Care Development Fund<\/li>\n<li>Nutrition Program for Women, Infants, and Children (WIC)<\/li>\n<li>Emergency Medicaid<\/li>\n<li>Emergency shelter<\/li>\n<li>Disaster relief<\/li>\n<\/ul>\n<p>The public benefits a person can use vary depending on their immigration status. You can see more information detailing these benefits in this\u00a0<a href=\"https:\/\/niwaplibrary.wcl.american.edu\/wp-content\/uploads\/CT-Public-Benefits-Screening-Chart-9.5.2022.pdf\" target=\"_blank\" rel=\"noopener\">chart from American University<\/a>.<\/p>\n<h2><a id=\"Education\"><\/a>Educational Benefits for Immigrants<\/h2>\n<p><a href=\"https:\/\/www.cga.ct.gov\/2015\/TOB\/h\/pdf\/2015HB-06844-R00-HB.pdf\" target=\"_blank\" rel=\"noopener\">House Bill (H.B.) 6844<\/a> passed in 2015. This Bill allowed students without documentation in Connecticut to access in-state tuition to public universities and colleges in the state. DACA recipients can get these benefits. But students without documentation and DACA recipients must meet certain requirements to qualify for <a href=\"https:\/\/www.higheredimmigrationportal.org\/state\/connecticut\/#:~:text=valid%20work%20authorization.-,Driver%20Licenses,also%20allowed%20to%20obtain%20a%20driver%20license%20or%20state%20identification%20card.,-Source%3A%20NILC\" target=\"_blank\" rel=\"noopener\">in-state tuition<\/a>. These requirements include:<\/p>\n<ol>\n<li>Residency in Connecticut<\/li>\n<li>Completed at least two years of high school or equivalent in Connecticut<\/li>\n<li>Enrolled or registered at a public institution of higher education in the state of Connecticut.<\/li>\n<li>Filed an affidavit with the institution stating that the undocumented student applied to legalize their status. Or, they will apply as soon as they are eligible.<\/li>\n<\/ol>\n<p>Meanwhile, refugees are eligible for in-state tuition after meeting the domicile or residency rule. This is in\u00a0<a href=\"https:\/\/www.cga.ct.gov\/2011\/act\/pa\/pdf\/2011PA-00043-R00HB-06390-PA.pdf\" target=\"_blank\" rel=\"noopener\">Substitute House Bill No. 6390<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.cga.ct.gov\/current\/pub\/chap_185.htm#sec_10a-29\" target=\"_blank\" rel=\"noopener\">Section 10a-29<\/a>\u00a0of the Connecticut State Statute.<\/p>\n<p>A refugee establishes residency in Connecticut after six months of employment. Or after one year, if the refugee is a dependent of a person employed in Connecticut.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p>Connecticut\u00a0<a href=\"https:\/\/offcampus.uconn.edu\/ct-fair-housing-laws\/\" target=\"_blank\" rel=\"noopener\">fair housing laws<\/a> prohibit discrimination based on religion, national origin, and ancestry. Being deprived of fair housing based on a person&#8217;s immigration status is illegal.<\/p>\n<h2><a id=\"Resources\"><\/a>Immigration in Connecticut: Related Resources<\/h2>\n<p>Various nonprofit organizations in Connecticut offer help and legal resources to immigrants and noncitizens:<\/p>\n<ul>\n<li><a href=\"https:\/\/cirict.org\/\" target=\"_blank\" rel=\"noopener\">Connecticut Institute for Refugees and Immigrants<\/a> (CIRI) gives economic, linguistic, legal, and social services to refugees and immigrants in Connecticut. It also helps victims of human trafficking, torture, and unaccompanied minors in Connecticut.<\/li>\n<li><a href=\"https:\/\/ctlegal.org\/\" target=\"_blank\" rel=\"noopener\">Connecticut Legal Services<\/a> helps low-income people facing homelessness and lack of health care, and those who are victims of domestic violence.<\/li>\n<li><a href=\"https:\/\/www.immigrationadvocates.org\/nonprofit\/legaldirectory\/organization.392722-Greater_Hartford_Legal_Aid_Inc\" target=\"_blank\" rel=\"noopener\">Greater Hartford Legal Aid<\/a> provides free legal services. They give aid, in particular, to low-income residents of the greater Hartford area. It helps migrants with naturalization, change of legal status, and more.<\/li>\n<li><a href=\"https:\/\/cca-ct.org\/our-work\/immigration\/\" target=\"_blank\" rel=\"noopener\">Center for Children&#8217;s Advocacy<\/a> is a nonprofit law firm offering legal representation and advocacy for at-risk youth and children in Connecticut. Its services are available statewide.
