The federal and local authorities implemented this program to boost their cooperative efforts. The effort is mainly for tracking immigrants living in the U.S. illegally who have criminal charges.<\/p>\n<p>Through 287(g), the federal immigration authorities and local agencies work with ICE to perform certain functions. The\u00a0<a href=\"https:\/\/corporate.findlaw.com\/law-library\/highlights-of-the-illegal-immigration-reform-and-immigrant.html\" target=\"_blank\" rel=\"noopener\">Illegal Immigration Reform and Immigrant Responsibility Act<\/a>\u00a0authorized the program in 1996. But enforcement became more active after 9\/11.<\/p>\n<p><span style=\"margin: 0px;padding: 0px\">In Kansas,\u00a0the <a href=\"https:\/\/www.ice.gov\/doclib\/287gMOA\/287gWSO_JacksonCoKS_07-23-2020.pdf\" target=\"_blank\" rel=\"noopener\">Jackson County Sheriff&#8217;s Office<\/a>\u00a0and the\u00a0<a href=\"https:\/\/www.ice.gov\/doclib\/287gMOA\/287gWSO_FinneyCoKs2020-03-17.pdf\" target=\"_blank\" rel=\"noopener\">Finney County Sheriff&#8217;s Office<\/a> participate in this program.<\/span><\/p>\n<p>\u201cSecure Communities&#8221; was similar to Section 287(g). The Donald Trump administration reinstated Secure Communities in 2017, but President Joe Biden revoked it in 2021.<\/p>\n<p>Under Secure Communities, local police would fingerprint the people they arrested. Those fingerprints went into a database that DHS and the FBI shared. DHS used this shared information to verify the immigration status of the person arrested. If the system flagged a person as an immigrant living here illegally, ICE could take action.<\/p>\n<p>A similar data-sharing arrangement still exists. But a person&#8217;s identity generally only enters the database once they have been convicted of a crime.<\/p>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>Under federal law, employers should refer to federal\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>. They should also look at the requirements for Form I-9.<\/p>\n<h2><a id=\"E-Verify\"><\/a>Kansas E-Verify Requirements<\/h2>\n<p>Kansas does not impose any <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify rules<\/a> on government or private employers. Certain contractors may choose to use the system.<\/p>\n<h2><a id=\"License\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Applicants for Kansas driver&#8217;s licenses must present certain documents. This includes proof of lawful presence in the United States. They must also show proof of identity. The Kansas Department of Revenue provides the state&#8217;s <a href=\"https:\/\/www.ksrevenue.gov\/dovproof.html\" target=\"_blank\" rel=\"noopener\">specific requirements<\/a>\u00a0for driver&#8217;s licenses.<\/p>\n<h2><a id=\"Benefits\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Federal law prohibits immigrants living in the U.S. illegally from getting certain <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But they can get emergency services. This includes health care and other programs identified as &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Restrictions<\/h2>\n<p>Kansas is among the states that allow in-state tuition benefits for qualified Kansas immigrants. The in-state tuition benefits also extend to <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals.html\">Deferred Action for Childhood Arrivals<\/a> (DACA) recipients. DACA protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<p>In 2004, the\u00a0<a href=\"https:\/\/www.k-state.edu\/diversity\/dreamers\/immigration-updates.html#:~:text=In%2Dstate%20Tuition,residency%20information%20page.\" target=\"_blank\" rel=\"noopener\">Kansas State Legislature<\/a>\u00a0passed House Bill 2145 into law. This law allowed eligible undocumented students to pay in-state tuition. They can use it to attend colleges or universities in Kansas.<\/p>\n<p>The law only requires certain criteria to be met to be <a href=\"https:\/\/www.k-state.edu\/admissions\/undergrad\/manhattan\/apply\/policies-requirements\/residency\/\" target=\"_blank\" rel=\"noopener\">eligible for this benefit<\/a>.\u00a0<\/p>\n<h2><a id=\"Voter\"><\/a>Voter ID Rules<\/h2>\n<p>Until recently, Kansas did not have its own state-mandated Voter ID law. But a strict new Voter ID law requires voters to present a photo ID before casting a ballot. Acceptable forms of ID include driver&#8217;s licenses, passports, student IDs, and more.<\/p>\n<p>A voter with an acceptable ID can still vote using a <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/voter-suppression-and-voter-id-laws.html\">provisional ballot<\/a>. But the voter must later submit proof of identity to authorities for the vote to count.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p>The federal <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-federal-laws.html\">Fair Housing Act<\/a> protects people&#8217;s rights to housing. These rules apply to people looking at renting, buying, selling, or seeking housing assistance. These rights are available regardless of their immigration status.
