The database checked arrestees&#8217; immigration statuses. This program was &#8220;Secure Communities.&#8221;<\/p>\n<p>In 2021, President Joe Biden revoked the Executive Order by which former President Trump had renewed Secure Communities. The &#8220;Criminal Apprehension Program&#8221; replaced Secure Communities. Under that program, only convicts&#8217; names are run through the database that checks immigration status.<\/p>\n<p>Information collected during these checks is shared with:<\/p>\n<ul>\n<li>The Federal Bureau of Investigation (FBI)<\/li>\n<li>The Department of Homeland Security (DHS)<\/li>\n<li><a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Immigration and Customs Enforcement<\/a> (ICE)<\/li>\n<\/ul>\n<p>But this is only usually the case if a particularly flagrant detection of <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/how-does-an-arrest-affect-immigration-status.html\">immigration violations<\/a> occurs. This typically only occurs when a migrant poses a threat to national security.<\/p>\n<h2><a id=\"Employment\"><\/a>Employment and Immigration<\/h2>\n<p>For more information, refer to the federal <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/employment-eligibility-verification.html\">employment eligibility verification rules<\/a> and\u00a0requirements for Form I-9.<\/p>\n<h2><a id=\"E-Verify\"><\/a>Maine E-Verify Requirements<\/h2>\n<p>Under Maine law, employers are not required to use E-Verify for checking employees&#8217; status.\u00a0<a href=\"http:\/\/e-verify.gov\/\" target=\"_blank\" rel=\"noopener\">E-Verify<\/a>\u00a0is a government system employers can use to determine the immigration status of job applicants and workers.<\/p>\n<h2><a id=\"License\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Immigrants must provide proof of legal presence in the U.S to get a Maine driver\u2019s license or state ID. They also must show <a href=\"https:\/\/www.maine.gov\/sos\/bmv\/visit-your-bmv-branch\/how-to-prove-legal-presence-for-a-non-united-states-citizen\" target=\"_blank\" rel=\"noopener\">proof of Maine residency<\/a>. Examples of documents accepted for proving Maine residency are utility bills or rental agreements.<\/p>\n<h2><a id=\"Benefits\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Under federal law, immigrants without legal status are barred from receiving most <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But they are allowed to use emergency services. They are also allowed to get health care and other programs that are &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Checks<\/h2>\n<p>Students in the U.S. without documentation do not qualify for in-state tuition. Some public universities will allow qualifying <a href=\"https:\/\/www.uscis.gov\/humanitarian\/consideration-of-deferred-action-for-childhood-arrivals-daca\/frequently-asked-questions\" target=\"_blank\" rel=\"noopener\">Deferred Action for Childhood Arrivals<\/a> (DACA) recipients to pay in-state tuition.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">DACA<\/a>\u00a0protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<p>Some public universities may extend in-state tuition benefits to\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/the-domestic-violence-green-card-immigrant-visa-petitions-for-vi.html\">U visa holders<\/a>. Under the Violence Against Women Act (VAWA), abuse victims are given an easier way toward legal presence in the United States \u2014\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/federal-domestic-violence-legislation-the-violence-against-women.html\">U visas<\/a>. Included within those eligible for such visas are victims of human trafficking and domestic violence.<\/p>\n<p>Family members of victims are also eligible for U visas. <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/asylum-and-refugees-overview.html\">Asylum seekers<\/a> can also benefit from U visas if they prove they&#8217;ve been the victim of abuse in their country of origin.<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p>There are no <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/voter-suppression-and-voter-id-laws.html\">voter identification requirements<\/a> specific to Maine.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p>Maine laws do not address whether landlords must check the immigration status of applicants or tenants<span data-sheets-root=\"1\">.
