But an increasing number of local and county law enforcement officials are helping investigate or pursue suspected immigration-related offenses.<\/p>\n<p>A federal program once forced law enforcement officers to check arrestees&#8217; immigration statuses. It also required police to fingerprint arrestees. This program was &#8220;Secure Communities.&#8221; Former President Donald Trump revived the program, which had expired in 2017. In 2021, President Joe Biden revoked the executive order.<\/p>\n<p>Under the new program, only convicts&#8217; names go into this system. The new program is the &#8220;<a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/criminal-apprehension-program\" target=\"_blank\" rel=\"noopener\">Criminal Apprehension Program<\/a>.&#8221; Information is shared with:<\/p>\n<ul>\n<li>The Federal Bureau of Investigation (FBI)<\/li>\n<li>The Department of Homeland Security (DHS)\u00a0<\/li>\n<li>U.S. Immigration and Customs Enforcement (ICE)<\/li>\n<\/ul>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>Under federal law, employers should refer to federal\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>. They should also refer to the Form I-9 requirements.<\/p>\n<h2><a id=\"E-Verify\"><\/a>Maryland E-Verify Requirements<\/h2>\n<div class=\"pointer-events-none absolute bottom-0 w-full\">\n<div>\n<div>\n<div>\n<div>\n<div data-testid=\"chat-page\">\n<p data-pm-slice=\"1 1 []\">E\u2011Verify is a federal online system that lets employers confirm whether a worker is legally authorized to work in the United States.<\/p>\n<p data-pm-slice=\"1 1 []\">Maryland does not require private or public employers to use <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify<\/a>. But employers can choose to use the tool.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<h2><a id=\"Driver\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Applicants for\u00a0<a href=\"https:\/\/mva.maryland.gov\/drivers\/Pages\/md-drivers-license.aspx#mddlexchangingcountry\" target=\"_blank\" rel=\"noopener\">driver&#8217;s licenses in Maryland<\/a>\u00a0must show documents proving their identity, lawful presence in the country, Social Security number, and home address in the state.<\/p>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Under federal law, immigrants living here illegally may not get <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But they can get emergency services, health care, and other programs that are &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Restrictions<\/h2>\n<p>Maryland allows qualifying immigrants without documentation to pay in-state tuition at state schools.<\/p>\n<p>This benefit also extends to <a href=\"https:\/\/www.uscis.gov\/humanitarian\/consideration-of-deferred-action-for-childhood-arrivals-daca\/frequently-asked-questions\" target=\"_blank\" rel=\"noopener\">Deferred Action for Childhood Arrivals<\/a> (DACA) recipients. DACA\u00a0protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<p>U visa holders can also use these benefits. A\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/the-domestic-violence-green-card-immigrant-visa-petitions-for-vi.html\">U visa<\/a> gives work authorization in the same way that a green card does. Victims of certain crimes, like domestic violence and human trafficking, can get this type of visa.<\/p>\n<p>It is also available to family members of victims. For example, a U visa provides lawful residence as a special immigrant status to the children of victims.<\/p>\n<p>This visa can uphold basic human rights by providing noncitizen survivors with a safer, more stable foundation.<\/p>\n<h2><a id=\"Voter\"><\/a>Voter ID Rules<\/h2>\n<p>Maryland does not have state-issued voter ID requirements. But legislative efforts to address voter ID are ongoing. In the meantime, <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration\/hava-federal-voting-law.html\">baseline federal requirements<\/a> for ID apply to first-time voters and registrants.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p>State laws do not address whether landlords must check the immigration status of applicants and tenants.<span data-sheets-root=\"1\">\u00a0But property owners and landlords must adhere to <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-federal-laws.html\">federal fair housing laws<\/a>, which prohibit discrimination based on religion, race, national origin, ancestry, or other protected characteristics.<\/span><\/p>\n<h2><a id=\"Resources\"><\/a>Immigration in Maryland: Other Resources<\/h2>\n<ul>\n<li><a href=\"https:\/\/www.mdlab.org\/\" target=\"_blank\" rel=\"noopener\">Maryland Legal Aid<\/a> \u2014 With this resource, you can find free or low-cost legal services.<\/li>\n<li><a href=\"https:\/\/marylandimmigrantrightscoalition.org\/\" target=\"_blank\" rel=\"noopener\">Maryland Immigrant Rights Coalition<\/a> \u2014 This non-profit organization provides advocacy and other services to migrants. It has attorneys on staff, but can also connect you with an outside attorney. Interpreters are available.<\/li>\n<li><a href=\"https:\/\/cc-md.org\/programs\/esperanza-center\/\" target=\"_blank\" rel=\"noopener\">Esperanza Center<\/a> \u2014 This is one of many Catholic charities in the state that offers services to immigrants and migrants. Those with disabilities can find resources beneficial to people struggling with such challenges.<\/li>\n<\/ul>\n<p>There are also organizations in neighboring <a href=\"https:\/\/www.findlaw.com\/state\/dc-law\/free-legal-aid-in-washington-dc.html\">Washington, D.C.<\/a> that offer free or low-cost legal services to low-income immigrants and migrants.<\/p>\n<h2><a id=\"Attorney\"><\/a>Legal Help Is Available for Immigration\u00a0Issues in Maryland<\/h2>\n<p><span data-sheets-root=\"1\">It is natural to feel frustrated and lost in the immigration process.
