But an increasing number of local and county law enforcement officials are now helping with this. They are also starting to investigate or pursue suspected immigration-related offenses. Federal and local law enforcement officials may coordinate efforts to address potential immigration violations.<\/p>\n<p>The &#8220;Secure Communities&#8221; federal program once required that all arrestees&#8217; names be entered into a database. The database was used to check immigration statuses. Former President Donald Trump renewed the program by executive order in 2017. But President Joe Biden revoked that executive order in 2021.<\/p>\n<p>Today, another program is in effect. The\u00a0<a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/criminal-apprehension-program\" target=\"_blank\" rel=\"noopener\">Criminal Apprehension Program<\/a> doesn&#8217;t apply to arrestees. It only applies to people convicted of crimes. When people are convicted, their information is entered into the database, which then checks their immigration status.<\/p>\n<p>Information in this system may be shared with:<\/p>\n<ul>\n<li>The\u00a0<a href=\"https:\/\/www.fbi.gov\/\" target=\"_blank\" rel=\"noopener\">Federal Bureau of Investigation<\/a>\u00a0(FBI)<\/li>\n<li>The\u00a0<a href=\"https:\/\/www.dhs.gov\/\" target=\"_blank\" rel=\"noopener\">Department of Homeland Security<\/a>\u00a0(DHS)<\/li>\n<li><a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Immigration and Customs Enforcement<\/a>\u00a0(ICE)<\/li>\n<\/ul>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>Under federal law, employers should refer to federal employment\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">eligibility verification rules<\/a>. They should also refer to the Form I-9 requirements.<\/p>\n<h2>Michigan E-Verify Requirements<\/h2>\n<p>Most Michigan employers do not have to use the <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify system<\/a> to check the immigration statuses of applicants or employees. But in state transportation jobs, applicants and workers must undergo these checks before hiring contractors or subcontractors. The following three counties do those employment-based checks:<\/p>\n<ul>\n<li>Ingham County<\/li>\n<li>Macomb County<\/li>\n<li>Oakland County<\/li>\n<\/ul>\n<h2><a id=\"Drivers\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Generally, applicants for a new driver&#8217;s license or ID must show documents with their Social Security number. Applicants can show proof of legal presence in the United States. They must also prove Michigan residency.<\/p>\n<p>See the\u00a0<a href=\"http:\/\/www.michigan.gov\/sos\/0,1607,7-127-1627---,00.html\" target=\"_blank\" rel=\"noopener\">Michigan Department of State website<\/a>\u00a0for more information. It details the specific types of documents required for each category.<\/p>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Under federal law, most immigrants can&#8217;t get most <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But they can get emergency services. They are also allowed to get health care and other programs that are &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Restrictions and Tuition Costs<\/h2>\n<p>Michigan law doesn&#8217;t dictate whether state schools must charge students without documentation in-state or out-of-state tuition. But some colleges in the state offer\u00a0<a href=\"https:\/\/michiganimmigrant.org\/sites\/default\/files\/Understanding%20Tuition.pdf\" target=\"_blank\" rel=\"noopener\">reduced tuition<\/a> to qualifying students. They may also offer this to <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">Deferred Action for Childhood Arrivals<\/a> (DACA) recipients and U visa holders.<\/p>\n<p>DACA protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.\u00a0<\/p>\n<p><a href=\"https:\/\/www.uscis.gov\/humanitarian\/victims-of-criminal-activity-u-nonimmigrant-status\" target=\"_blank\" rel=\"noopener\">U visas<\/a> are available to victims of human trafficking and grant temporary\u00a0protected status. Those in Michigan under a U visa can get in-state tuition.<\/p>\n<p>If you&#8217;re a victim of domestic violence, you can seek a green card under the\u00a0<a href=\"https:\/\/www.findlaw.com\/family\/domestic-violence\/federal-domestic-violence-legislation-the-violence-against-women.html\">Violence Against Women Act<\/a> (VAWA). If you think a U visa or VAWA applies to you, an immigration attorney can guide you through the process.<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p>Michigan has a <a href=\"https:\/\/www.michigan.gov\/sos\/faqs\/elections-and-campaign-finance\/elections-and-voting\" target=\"_blank\" rel=\"noopener\">strict photo ID law<\/a> requiring voters to present a driver&#8217;s license or state ID card.
