Anyone facing an immigration issue in Montana should speak with a local <a href=\"https:\/\/lawyers.findlaw.com\/immigration-naturalization-law\/\" target=\"_blank\" rel=\"noopener\">immigration attorney<\/a> for up\u2011to\u2011date guidance.<\/span><\/p>\n<h2><a id=\"Presidential\"><\/a><strong>Montana Challenges Federal Immigration Policies<\/strong><\/h2>\n<p>In 2021,\u00a0<a href=\"https:\/\/montanafreepress.org\/2021\/03\/09\/montana-joins-deportation-lawsuit-against-biden-administration\/\" target=\"_blank\" rel=\"noopener\">Montana joined a lawsuit<\/a> filed against the U.S. government over its current immigration policies. The case, in which Arizona was the original plaintiff, took aim at the Biden administration&#8217;s January directive to suspend, in large part, deportations of noncitizens unless those noncitizens posed a threat to national security.<\/p>\n<p>Montana was concerned that this suspension of deportations would cause an overload of migrant detention facilities. It also cited concern that the suspension could contribute to <a href=\"https:\/\/www.findlaw.com\/criminal\/criminal-charges\/drug-trafficking-distribution.html\">drug trafficking<\/a> in the state.<\/p>\n<p>In its complaint, the Montana Department of Justice alleged that the Biden administration&#8217;s suspension of deportations violated agreements that the state had with the Trump administration. The state lost the lawsuit.<\/p>\n<h2><a id=\"Law\"><\/a>Law Enforcement and Immigration in Montana<\/h2>\n<p>A federal program once required law enforcement officers to fingerprint all arrestees. It also required that police run arrestees&#8217; names through a database that checked immigration status.<\/p>\n<p>But President Joe Biden revoked the Executive Order that former President Donald Trump used to renew the program. It expired in 2017. Under the new &#8220;<a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/criminal-alien-program\" target=\"_blank\" rel=\"noopener\">Criminal Apprehension Program<\/a>,&#8221; only convicts&#8217; names are entered into this system.<\/p>\n<p>Information in this system is shared with the FBI and the Department of Homeland Security (DHS). It can also go to <a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Immigration and Customs Enforcement<\/a> (ICE).<\/p>\n<p>Informatopin is typically only shared with ICE if a particularly flagrant immigration violation has occurred. This is usually the case only if a person poses a threat to national security.<\/p>\n<h2><a id=\"Employment\"><\/a>Employment and Immigration<\/h2>\n<p>For more information, refer to federal\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>. Also, refer to the requirements for Form I-9.<\/p>\n<h2><a id=\"E-Verify\"><\/a>Montana E-Verify Requirements<\/h2>\n<p>Employers in Montana must use the federal <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify system<\/a> to check that job applicants and new hires are authorized to work in the U.S.<\/p>\n<h2><a id=\"License\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>To get a <a href=\"https:\/\/mvdmt.gov\/new-driver-license\/drivers-new-to-montana\/\" target=\"_blank\" rel=\"noopener\">driver&#8217;s license in Montana<\/a>, immigrants must provide proof of:<\/p>\n<ul>\n<li>Legal presence in the U.S.<\/li>\n<li>Identity<\/li>\n<li>Residence in Montana<\/li>\n<\/ul>\n<p><a href=\"https:\/\/mvdmt.gov\/required-documents\/#residence\" target=\"_blank\" rel=\"noopener\">Examples of documents<\/a> accepted for proving state residence include utility bills, auto insurance statements, or rental leases.<\/p>\n<h2><a id=\"Benefits\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Under federal law, illegal immigrants may not get <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But they can get emergency services, health care, and other programs deemed &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>In-State Tuition Costs<\/h2>\n<p>Montana has no policy for in-state tuition for students without immigration documentation. This also applies to Deferred Action for Childhood Arrivals (DACA) recipients.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">DACA<\/a> protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p><a href=\"https:\/\/votemt.gov\/voter-identification\/\" target=\"_blank\" rel=\"noopener\">Montana voters<\/a> must present one of the following forms of identification:<\/p>\n<div class=\"elementor-element elementor-element-40327ab elementor-widget elementor-widget-hub_fancy_heading\" data-id=\"40327ab\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"hub_fancy_heading.default\">\n<div class=\"elementor-widget-container\">\n<div id=\"ld-fancy-heading-69bc3c4a698c6\" class=\"ld-fancy-heading pos-rel\">\n<ul>\n<li>Valid driver&#8217;s license or REAL ID<\/li>\n<li>State identification card<\/li>\n<li>Military ID<\/li>\n<li>Tribal photo ID<\/li>\n<li>U.S. passport<\/li>\n<li>MT concealed carry permit<\/li>\n<li>Montana university system card<\/li>\n<\/ul>\n<p>Voters without any form of ID listed above can still vote.
