This section gave ICE the authority to allow state law enforcement agencies to perform certain immigration functions. These functions include:<\/p>\n<ul>\n<li>Identifying and processing the removal of arrested immigrants without legal documentation, particularly those with criminal charges.<\/li>\n<li>Serving and executing administrative warrants to immigrants<\/li>\n<\/ul>\n<p>In Nebraska, the Dakota County Sheriff&#8217;s Office\u00a0participates in implementing Section 287(g).<\/p>\n<p>The federal government agencies that administer the immigration laws in the country are:<\/p>\n<p><b>The Department of Homeland Security (DHS)<\/b>\u00a0\u2014\u00a0A\u00a0<a href=\"https:\/\/www.dhs.gov\/\" target=\"_blank\" rel=\"noopener\">federal government agency<\/a>\u00a0tasked with ensuring the safety and security of the country from domestic and foreign threats. It oversees border security and immigration enforcement and coordinates emergency response. The DHS and its components also manage different aspects of immigration.<\/p>\n<p><b>U.S. Citizenship and Immigration Services (USCIS)<\/b>\u00a0\u2014\u00a0The\u00a0<a href=\"https:\/\/www.uscis.gov\/\" target=\"_blank\" rel=\"noopener\">USCIS<\/a> is a part of the DHS and manages and oversees immigration in the United States. It processes visa applications and immigration benefits such as:<\/p>\n<ul>\n<li>Legal Permanent Residency or green card application<\/li>\n<li>Helping people become U.S. citizens or naturalization<\/li>\n<li>Other U.S. visas<\/li>\n<\/ul>\n<p><b>U.S. Immigration and Customs Enforcement (ICE)\u00a0<\/b><span style=\"background-color: transparent\">\u2014 <a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">ICE<\/a> is a federal agency within DHS. It ensures public safety by enforcing customs, trade, and border control laws. It&#8217;s also tasked with investigating, detaining, and deporting people who violate immigration laws. This agency also handles matters related to smuggling and human trafficking.<\/span><\/p>\n<p><b>Federal Bureau of Investigation (FBI)\u00a0<\/b><span style=\"background-color: transparent\">\u2014 The bureau has a <a href=\"https:\/\/www.fbi.gov\/investigate\" target=\"_blank\" rel=\"noopener\">wide range of responsibilities<\/a>. It works as an intelligence agency and an investigative body. In immigration law, it works with crimes like the smuggling of people, human trafficking, and visa fraud.<\/span><\/p>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>In Nebraska, DHS requires employers and contractors to use\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify<\/a>. E-Verify verifies an applicant&#8217;s employment eligibility in the United States. This became law through <a href=\"https:\/\/nebraskalegislature.gov\/FloorDocs\/101\/PDF\/Slip\/LB403.pdf\" target=\"_blank\" rel=\"noopener\">Legislative Bill 403<\/a>\u00a0on April 8, 2009, and took effect on Oct. 1, 2009.<\/p>\n<p>The bill also asks employers to check the legal status of applicants seeking public benefits.<\/p>\n<h2><a id=\"Driver\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Nebraska does not allow immigrants living here illegally to get driver&#8217;s licenses or Nebraska identification cards. But the system may allow <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">Deferred Action for Childhood Arrival<\/a>\u00a0(DACA) recipients to get identification cards.<\/p>\n<p>If you want to apply for a Nebraska driver&#8217;s license, you need to show the following:<\/p>\n<ul>\n<li>One document showing your full name and date of birth<\/li>\n<li>Two documents showing your address in Nebraska<\/li>\n<li>Proof of your Social Security number<\/li>\n<\/ul>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>The United States does not extend <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a> to immigrants without proper documentation. They can&#8217;t use the following benefits:<\/p>\n<ul>\n<li>Supplemental Security Income (SSI)<\/li>\n<li>Regular Medicaid<\/li>\n<li>Temporary Assistance for Needy Families (TANF)<\/li>\n<li>Supplemental Nutrition Assistance Program (SNAP)<\/li>\n<\/ul>\n<p>Despite this, immigrants may use necessary health care services to protect life and safety. These services include the following:<\/p>\n<ul>\n<li>Emergency medical benefits<\/li>\n<li>Short-term emergency disaster relief<\/li>\n<li>Access to treatment in emergency rooms<\/li>\n<\/ul>\n<h2><a id=\"Education\"><\/a>Education Checks and Tuition Costs<\/h2>\n<p><a href=\"https:\/\/nebraskalegislature.gov\/bills\/view_bill.php?DocumentID=44154\" target=\"_blank\" rel=\"noopener\">Legislative Bill 239<\/a> (L.B. 239) passed on April 13, 2006. It touched on the eligibility of undocumented immigrants in Nebraska for education benefits. L.B. 239 allows undocumented students, <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals.html\">Deferred Action for Childhood Arrivals<\/a> (DACA) recipients, and asylees or refugees to access in-state tuition. But to qualify, the student must have:\u00a0<\/p>\n<ul>\n<li>Lived with a parent or guardian while attending school in Nebraska<\/li>\n<li>Graduated from a private or public high school in Nebraska or gained a GED from the state<\/li>\n<li>Lived in the state for three years before graduating from high school or getting a GED<\/li>\n<li>Registered as an applicant for college in Nebraska<\/li>\n<li>Filed an affidavit declaring that they will file for permanent residency at the earliest possible time<\/li>\n<\/ul>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p>Nebraska signed\u00a0<a href=\"https:\/\/sos.nebraska.gov\/elections\/voter-id\" target=\"_blank\" rel=\"noopener\">Legislative Bill 514<\/a> (L.B. 514) into law on June 1, 2023. The law demands voter identification. The voter ID requirement was first used during the statewide primary election on May 14, 2024.\u00a0<\/p>\n<p>There are several <a href=\"https:\/\/sos.nebraska.gov\/voter-id\" target=\"_blank\" rel=\"noopener\">forms of acceptable ID<\/a> voters can use, including:<\/p>\n<ul>\n<li>Nebraska driver&#8217;s license or state ID<\/li>\n<li>Nebraska college ID<\/li>\n<li>Military ID<\/li>\n<li>U.S passport<\/li>\n<li>Tribal ID<\/li>\n<\/ul>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p>The U.S.\u00a0<a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\" target=\"_blank\" rel=\"noopener\">Fair Housing Act<\/a>\u00a0protects people&#8217;s rights to fair housing. The act bans discrimination in housing activities such as buying, renting, getting a mortgage, or using housing assistance.
