Title 42 created more lenient restrictions on border crossings.\u00a0Following its ending, the Department of Homeland Security (DHS) <a href=\"https:\/\/www.dhs.gov\/archive\/news\/2023\/04\/27\/fact-sheet-us-government-announces-sweeping-new-actions-manage-regional-migration\" target=\"_blank\" rel=\"noopener\">released a statement<\/a> announcing &#8220;sweeping new measures to further reduce unlawful migration across the Western Hemisphere.&#8221;<\/p>\n<p>The end of Title 42 marked a <a href=\"https:\/\/www.ecfr.gov\/current\/title-8\" target=\"_blank\" rel=\"noopener\">return to Title 8.<\/a> This means:<\/p>\n<ul>\n<li>People crossing the border in an unauthorized way will be subject to &#8220;expedited removal authority in a matter of days.&#8221;<\/li>\n<li>People doing so &#8220;will be barred from reentry to the United States for at least five years if ordered removed.&#8221;<\/li>\n<li>People attempting such crossings are &#8220;ineligible for asylum under the proposed\u00a0<a href=\"https:\/\/www.dhs.gov\/news\/2023\/05\/11\/fact-sheet-circumvention-lawful-pathways-final-rule\" target=\"_blank\" rel=\"noopener\">Circumvention of Lawful Pathways<\/a> regulation.&#8221;<\/li>\n<\/ul>\n<p>Certain exceptions apply in rare circumstances in the latter provision of Title 8.\u00a0<\/p>\n<h2><a id=\"Law\"><\/a>Law Enforcement and Immigration in North Carolina<\/h2>\n<p>Various local governments in North Carolina work with federal immigration authorities to manage and enforce immigration-related matters. They do so in the <a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/287g\" target=\"_blank\" rel=\"noopener\">287(g) Immigration and Customs Enforcement (ICE) ACCESS Program<\/a>.<\/p>\n<p>Some North Carolina localities and agencies share information with ICE to assist in enforcing federal immigration laws. The ICE website provides a downloadable Excel document <a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/287g\" target=\"_blank\" rel=\"noopener\">listing all participating agencies<\/a>.<\/p>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>The state government screens new hires to verify their legal residence. Also, refer to federal <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>\u00a0and the requirements for Form I-9.<\/p>\n<h2><a id=\"E-Verify\"><\/a>North Carolina E-Verify Requirements<\/h2>\n<p>State employers must use\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify<\/a>. Private employers with more than six employees must use E-Verify (beginning October 2012).<\/p>\n<h2><a id=\"Driver\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>To get a driver&#8217;s license in North Carolina, applicants must <a href=\"https:\/\/www.ncdot.gov\/dmv\/help\/Pages\/proving-legal-presence.aspx\" target=\"_blank\" rel=\"noopener\">prove their legal presence<\/a> in the U.S. Applicants also must show:<\/p>\n<ul>\n<li>One document proving identity and date of birth\u200b<\/li>\n<li>Social Security card or\u00a0other document proving Social Security number<\/li>\n<li>One document\u00a0verifying physical address in North Carolina (two are required if getting a REAL ID)<\/li>\n<li>A printed document\u00a0proving liability insurance coverage\u00a0<\/li>\n<\/ul>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Under federal law, immigrants here illegally can&#8217;t get most public benefits. But they can use emergency services and other services &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Checks and In-State Tuition<\/h2>\n<p>North Carolina requires students without proper documentation and <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">Deferred Action for Childhood Arrivals (DACA) recipients<\/a>\u00a0to pay out-of-state tuition. It also bars them from state-funded financial aid. When enrolling in a state school, students without proper documentation may need to disclose their immigration statuses.<\/p>\n<p>DACA\u00a0protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<p>State schools maintain compliance with relevant laws by collecting students&#8217; status. But they only collect this information to determine tuition costs or financial aid eligibility.\u00a0<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p>Voters must show identification when <a href=\"https:\/\/www.nc.gov\/living\/voting\" target=\"_blank\" rel=\"noopener\">voting in North Carolina<\/a>. You may use a driver&#8217;s license as identification. But North Carolina also accepts other forms of photo identification.<\/p>\n<p>All voters can vote with or without an ID. If a voter doesn&#8217;t have a photo ID, they may still vote by filling out an ID Exception Form. Voters must mail their ballots.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p>North Carolina has no special housing ordinances on immigration.<span data-sheets-root=\"1\">\u00a0But property owners and landlords must adhere to <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-federal-laws.html\">federal fair housing laws<\/a>, which prohibit discrimination based on religion, race, national origin, ancestry, or other protected characteristics.<\/span><\/p>\n<h2><a id=\"Attorney\"><\/a>Get Legal Help With Your\u00a0 Immigration Issue<\/h2>\n<p><span data-sheets-root=\"1\">Dealing with immigration on your own is very difficult and stressful.
