Donovan\u00a0<a href=\"https:\/\/ago.vermont.gov\/blog\/2020\/01\/15\/attorney-generals-office-facilitates-settlement-lawsuit-brought-migrant-justice\" target=\"_blank\" rel=\"noopener\">settled a lawsuit against the Department of Motor Vehicles<\/a>. The\u00a0<a href=\"https:\/\/www.acluvt.org\/en\/press-releases\/migrant-justice-settles-discrimination-lawsuit-dmv\" target=\"_blank\" rel=\"noopener\">American Civil Liberties Union (ACLU)<\/a>\u00a0and immigrant rights groups sued the department in this case. It had shared information about migrants with\u00a0U.S. Immigration and Customs Enforcement (ICE). ICE had collected the data from driver&#8217;s licenses and other public records.<\/p>\n<p>The suit alleged <a href=\"https:\/\/www.findlaw.com\/civilrights\/civil-rights-overview\/have-your-civil-rights-been-violated.html\">violations of civil rights<\/a>, including racial profiling. As a result of the settlement, the department paid penalties and was prohibited from sharing information in this way. This settlement shows that Vermont is more favorable to immigrants&#8217; rights. Like other blue states, such as Colorado and Connecticut, Vermont offers migrants greater protection against abuse.<\/p>\n<h2><a id=\"Law\"><\/a>Law Enforcement and Immigration in Vermont<\/h2>\n<p>While most immigration issues are enforced by the federal government in Washington, D.C., more local governments are getting involved.<\/p>\n<p>Under a federal program, convicts&#8217; names are entered into a database that checks immigration statuses. This is the &#8220;<a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/criminal-apprehension-program\" target=\"_blank\" rel=\"noopener\">Criminal Apprehension Program<\/a>.&#8221; The system shares information with:<\/p>\n<ul>\n<li><span style=\"font-size: revert;color: initial\">The Federal Bureau of Investigation (FBI) <\/span><\/li>\n<li><span style=\"font-size: revert;color: initial\">The Department of Homeland Security (DHS)<\/span><\/li>\n<li>U.S. Immigration and Customs Enforcement (ICE)<\/li>\n<\/ul>\n<p><span style=\"font-size: revert;color: initial\"> It&#8217;s essential to know how agencies collect and share your information.<\/span><\/p>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>Refer to federal\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>\u00a0and the requirements for Form I-9.<\/p>\n<h3><a id=\"E-Verify\"><\/a>Vermont E-Verify Requirements<\/h3>\n<p>Vermont has no requirement to use\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify<\/a> to check employees&#8217; immigration statuses. <span data-sheets-root=\"1\">E-Verify is a federally-operated system that allows employers to verify that applicants are legally authorized to work in the U.S.<\/span><\/p>\n<h2><a id=\"Driver\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Vermont law allows residents without lawful presence in the U.S. to obtain a <a href=\"https:\/\/dmv.vermont.gov\/licenses\/identity-documents\" target=\"_blank\" rel=\"noopener\">standard driver&#8217;s license only<\/a>. Applicants must submit proof of legal status to qualify for a REAL ID or Enhanced ID.<\/p>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Low-income immigrants who are ineligible for certain federal benefits can get state benefit supplements.<\/p>\n<p>Under federal law, immigrants living here illegally can&#8217;t get most <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But they can use emergency services and health care that is &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Checks and In-State Tuition<\/h2>\n<p>There is no state policy on in-state tuition for students without proper documentation.<\/p>\n<p>Each state school may decide whether to allow a student to pay in-state tuition. This also applies\u00a0<span style=\"margin: 0px;padding: 0px\">to<a href=\"https:\/\/www.uscis.gov\/humanitarian\/consideration-of-deferred-action-for-childhood-arrivals-daca\/frequently-asked-questions\" target=\"_blank\" rel=\"noopener\"> Deferred<\/a><\/span><a href=\"https:\/\/www.uscis.gov\/humanitarian\/consideration-of-deferred-action-for-childhood-arrivals-daca\/frequently-asked-questions\" target=\"_blank\" rel=\"noopener\">\u00a0Action for Childhood Arrivals<\/a> (DACA) recipients.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">DACA<\/a> was created under the Obama administration in 2012. It protects eligible young adults from deportation after their parents brought them to the United States as children. DACA also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<p>The lack of a policy concerning in-state tuition benefits for migrants also applies to U visa holders.\u00a0 <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/u-visas.html\">U visas<\/a> are available to victims of domestic violence and human trafficking crimes. A U visa gives work authorization in the same way a green card does. U visas offer many of the same benefits as lawful permanent residence.<\/p>\n<p>U visas are also available to the family members of victims. The children of victims get temporary protected status, along with the U visa holder. To the children of victims, it provides special immigrant juvenile status.<\/p>\n<p>Victims of human trafficking may be eligible for a\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/t-visas.html\">T visa<\/a>. A T visa is specifically for victims of trafficking in persons. This is also known as a T nonimmigrant visa.<\/p>\n<p>Migrants should check each school&#8217;s policies to learn what a school will cost based on their immigration status. DACA recipients and other visa-holders should also know what their status offers them.<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p>Vermont has no state-mandated identification law for voters.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p><span data-sheets-root=\"1\">There are no special housing ordinances for immigrants in Vermont.
