Some of the federal agencies that handle immigration matters are:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.dhs.gov\/\" target=\"_blank\" rel=\"noopener\">Department of Homeland Security (DHS)<\/a><\/li>\n<li><a href=\"https:\/\/www.uscis.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Citizenship and Immigration Services (USCIS)<\/a><\/li>\n<li><a href=\"https:\/\/www.ice.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Immigration and Customs Enforcement (ICE)<\/a><\/li>\n<li><a href=\"http:\/\/fbi.gov\" target=\"_blank\" rel=\"noopener\">Federal Bureau of Investigation (FBI)<\/a><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/287g\" target=\"_blank\" rel=\"noopener\">ICE added section 287(g)<\/a> in the Immigration and Nationality Act (INA). This section authorized ICE to delegate certain functions to local law enforcement agencies. It aims to enhance collaboration between federal and local authorities to identify immigrants without proper documentation who are facing criminal charges.<\/p>\n<p>The 287(g) program identifies and processes non-U.S. citizens arrested for criminal acts. Once identified, authorities assess these non-U.S. citizens for possible removal or deportation.<\/p>\n<p>ICE provides a full list of participating agencies on its\u00a0<a href=\"https:\/\/www.ice.gov\/identify-and-arrest\/287g\" target=\"_blank\" rel=\"noopener\">Delegation of Immigration Authority Section 287(g) Immigration and Nationality Act webpage<\/a>. Scroll down the page until you see a button titled \u201cView\u00a0287(g) Participating Agencies.\u201d<\/p>\n<p>In 2017, E.O. 13768, called &#8220;<a href=\"https:\/\/www.ice.gov\/secure-communities\" target=\"_blank\" rel=\"noopener\">Secure Communities<\/a>,&#8221; was in effect. President Joe Biden revoked the executive order in 2021. But before its revocation, it advocated a similar concept to section 287(g). It verified and identified undocumented immigrants charged with criminal offenses.<\/p>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>Refer to federal\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>\u00a0and the requirements for Form I-9.<\/p>\n<h2><a id=\"E-Verify\"><\/a>Virginia E-Verify Requirements<\/h2>\n<p>Effective December 1, 2012, all state agencies in Virginia must use <a href=\"https:\/\/cis.org\/Report\/Overview-EVerify-Policies-State-Level\" target=\"_blank\" rel=\"noopener\">E-Verify<\/a>. <span data-sheets-root=\"1\">E-Verify is a federally-operated system that allows employers to verify that applicants are legally authorized to work in the U.S.<\/span><\/p>\n<h2><a id=\"Driver\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Applicants must show proof of U.S. citizenship or legal residence to get a <a href=\"https:\/\/www.dmv.virginia.gov\/licenses-ids\/license\/applying\" target=\"_blank\" rel=\"noopener\">driver&#8217;s license or state ID in Virginia<\/a>.<\/p>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Under federal law, immigrants without documentation can&#8217;t get most <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But, they can use emergency services, health care, and other programs &#8220;necessary to protect life and safety.&#8221;<\/p>\n<p>In <a href=\"https:\/\/www.pwcva.gov\/\" target=\"_blank\" rel=\"noopener\">Prince William County<\/a>, immigrants without documentation also can&#8217;t access community services.<\/p>\n<h2><a id=\"Education\"><\/a>Education Checks<\/h2>\n<p>Virginia\u00a0<a href=\"https:\/\/www.higheredimmigrationportal.org\/state\/virginia\/\" target=\"_blank\" rel=\"noopener\">offers\u00a0<\/a><span style=\"margin: 0px;padding: 0px\"><a href=\"https:\/\/www.higheredimmigrationportal.org\/state\/virginia\/\" target=\"_blank\" rel=\"noopener\">in-state tuition<\/a> to<\/span>\u00a0students without proper documentation. The Virginia state legislature passed Senate Bill 1387 to make this possible. The bill took effect in July 2020 and allowed undocumented students in Virginia access to in-state tuition rates. The student must meet specific criteria:<\/p>\n<ul>\n<li>Attended high school in the country for at least two years<\/li>\n<li>Have proof of income tax returns for parents or guardians of the dependent student, unless exempted by law<\/li>\n<\/ul>\n<p>In-state tuition is available for students without documentation and\u00a0<a href=\"https:\/\/www.uscis.gov\/DACA\" target=\"_blank\" rel=\"noopener\">Deferred Action for Childhood Arrivals (DACA)<\/a>\u00a0recipients.<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p><a href=\"https:\/\/www.elections.virginia.gov\/\" target=\"_blank\" rel=\"noopener\">Virginia Department of Elections<\/a> requires voters to show one form of identification to cast a vote. The following are some of the acceptable forms of identification:<\/p>\n<ul>\n<li>Virginia driver&#8217;s license<\/li>\n<li>Valid student ID<\/li>\n<li>Valid employee card<\/li>\n<li>Government-issued ID card<\/li>\n<li>U.S. passport or passport card<\/li>\n<li>Valid tribal enrollment or other tribal ID<\/li>\n<li>Voter ID card<\/li>\n<li>Nursing home resident ID<\/li>\n<\/ul>\n<p>The state also allows non-photo identification documents. These documents include the following:<\/p>\n<ul>\n<li>Current utility bill<\/li>\n<li>Bank statement<\/li>\n<li>Government check<\/li>\n<li>Paycheck with the name and address of the voter<\/li>\n<li>Any government document with the name and address of the voter<\/li>\n<\/ul>\n<p>The non-photo identification document must have been issued within the past 12 months. These are acceptable in either electronic or physical form.<\/p>\n<h2><a id=\"Housing\"><\/a>Housing Ordinances and Immigration<\/h2>\n<p><span data-sheets-root=\"1\">There are no special housing ordinances for immigrants in Virginia. But the <\/span><a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\" target=\"_blank\" rel=\"noopener\">U.S. Fair Housing Act<\/a>, a federal law, protects people&#8217;s rights to federal housing, regardless of immigration status.<\/p>\n<h2><a id=\"Lawyer\"><\/a>Immigration Issue in Virginia?
