At one time, law enforcement checked arrestees&#8217; names. But the law has changed. This type of check now only applies to those convicted of crimes.<\/p>\n<h2><a id=\"Employment\"><\/a>Employment Checks<\/h2>\n<p>Refer to federal\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-employer\/employment-employer-other\/developments-on-verifying-eligibility.html\">employment eligibility verification rules<\/a>\u00a0and the requirements for Form I-9.<\/p>\n<h2><a id=\"E-Verify\"><\/a>West Virginia E-Verify Requirements<\/h2>\n<p>West Virginia has no rule\u00a0<span style=\"margin: 0px;padding: 0px\">requiring employers to use\u00a0<a href=\"https:\/\/www.e-verify.gov\/\" target=\"_blank\" rel=\"noopener\">E-Verify<\/a> to verify<\/span> employees&#8217; status. <span data-sheets-root=\"1\">E-Verify is a federally-operated system that allows employers to verify that applicants are legally authorized to work in the U.S.<\/span><\/p>\n<h2><a id=\"Driver\"><\/a>Driver&#8217;s License and ID Requirements<\/h2>\n<p>Applicants must show proof of U.S. citizenship or legal status to get a <a href=\"https:\/\/transportation.wv.gov\/DMV\/Pages\/default.aspx\" target=\"_blank\" rel=\"noopener\">West Virginia driver&#8217;s license or state ID<\/a>.<\/p>\n<h2><a id=\"Benefit\"><\/a>Public Benefits Restrictions<\/h2>\n<p>Specific categories of immigrants can&#8217;t benefit from the <a href=\"https:\/\/bfa.wv.gov\/page\/wv-works\" target=\"_blank\" rel=\"noopener\">West Virginia Works<\/a> program.<\/p>\n<p>Immigrant children are eligible for the\u00a0<a href=\"https:\/\/chip.wv.gov\/Pages\/default.aspx\" target=\"_blank\" rel=\"noopener\">West Virginia Children&#8217;s Health Insurance Program (CHIP)<\/a> if they entered the U.S. before August 22, 1996, and obtained legal status, or entered after August 22, 1996, and obtained legal status for five consecutive years.<\/p>\n<p>Under federal law, immigrants without documentation can&#8217;t get most <a href=\"https:\/\/www.findlaw.com\/family\/child-support\/state-public-assistance-welfare-information.html\">public benefits<\/a>. But, they can use emergency services, health care, and other programs that are &#8220;necessary to protect life and safety.&#8221;<\/p>\n<h2><a id=\"Education\"><\/a>Education Checks and In-State Tuition<\/h2>\n<p>West Virginia does not have a policy on in-state tuition for undocumented students or <a href=\"https:\/\/www.uscis.gov\/humanitarian\/consideration-of-deferred-action-for-childhood-arrivals-daca\/frequently-asked-questions\" target=\"_blank\" rel=\"noopener\">Deferred Action for Childhood Arrivals<\/a>\u00a0(DACA) recipients.<\/p>\n<p><a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">DACA<\/a>\u00a0protects eligible young adults from deportation after their parents brought them to the United States as children. It also gives these young adults work authorization for limited periods. Those periods of work authorization are renewable.<\/p>\n<h2><a id=\"Voting\"><\/a>Voting ID Rules<\/h2>\n<p><a href=\"https:\/\/sos.wv.gov\/FormSearch\/Elections\/Informational\/Flyer%20Version%20of%20Be%20Registered%20%20Be%20Ready%202.pdf\" target=\"_blank\" rel=\"noopener\">West Virginia voters<\/a> must present an approved form of identification at the polls to vote. You can also find immigration services and other advocacy services.<\/li>\n<\/ul>\n<p>It&#8217;s a good idea for asylees to seek the help of groups like these. Asylees are migrants in the United States who cannot return to their country of origin for many reasons. As <a href=\"https:\/\/www.findlaw.com\/immigration\/asylum-refugee\/asylum-and-refugees-overview.html\">asylum seekers<\/a>, they may be too vulnerable to persecution to return to their home countries.
