Is it for business, tourism, visiting family members, studying, or are you seeking to reside in the U.S. permanently?<\/p>\n<p>Personal, familial, and professional circumstances change. Fortunately, so can your U.S. visa. After a few years, if an employer is willing, they could even gain a green card or permanent resident status.<\/p>\n<h3>Transitioning\u00a0From Temporary Work Visa to Permanent Resident<\/h3>\n<p>A foreign national coming to the U.S. as a professional with a <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/h-1b-visa-requirements.html\" target=\"_self\">temporary H-1B visa<\/a> could eventually settle in the U.S. They can ask their employer for sponsorship for lawful permanent resident status, and they could also qualify through marriage to a U.S. citizen. The <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/u-s-embassy-consulate-guide.html\">U.S. Embassy or Consulate<\/a> typically processes U.S. visas in the applicant&#8217;s home country and can issue various non-immigrant visas. However, certain foreign nationals do not need to apply for U.S. visas. They are citizens of countries participating in the <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/tourism-visit\/visa-waiver-program.html\" target=\"_blank\" rel=\"noopener\">Visa Waiver Program<\/a>\u00a0(VSP).<\/p>\n<p>Although many non-immigrant visas exist, the B-1\/B-2 visitor visas are the most common. B-1 visas are for business, and B-2 visas <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/temporary-visas.html\">are for tourism<\/a>. A combination of business and tourism is called a B-1\/B-2 visa.<\/p>\n<p>It is a good idea to seek the visa category that aligns with your intended purpose.\u00a0<\/p>\n<h2>Studying in the U.S.<\/h2>\n<p>With its top-tier educational institutions and diverse culture, the United States is one of the leading destinations for students worldwide. Whether seeking a degree at a renowned university or other training, obtaining a non-immigrant student visa is the first step to studying in the U.S. The main types of <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/non-immigrant-student-visas.html\">student visas<\/a> are F-1 and M-1 visas.<\/p>\n<p>F-1 visa allows you to come to the United States as a full-time student in any of the following accredited academic institutions:<\/p>\n<ul>\n<li>University<\/li>\n<li>College<\/li>\n<li>Conservatory<\/li>\n<li>Seminary<\/li>\n<li>Academic high school<\/li>\n<li>Elementary school<\/li>\n<li>Other academic institutions<\/li>\n<li>Language training program<\/li>\n<\/ul>\n<p>An M-1 visa allows you to come to the United States for vocational or nonacademic programs, except language training.<\/p>\n<p>The <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/study\/student-visa.html\" target=\"_blank\" rel=\"noopener\">visa application process<\/a> often requires the student to enroll in an academic program. The Immigration and Customs Enforcement (ICE) must approve the school through the Student and Exchange Visitors Program (SEVP). A successful visa interview with the U.S. consulate or U.S. embassy is also required. In addition, you should show your financial ability to support yourself during your study.<\/p>\n<h2>Working in the U.S.<\/h2>\n<p>The U.S. offers various work opportunities for skilled and talented professionals worldwide. Those wishing to <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/employment-based-visas.html\">work in the United States<\/a> may apply for one of several different kinds of employment-based immigrant or non-immigrant visas. Non-immigrant visas, such as the H-1B and other H visas, allow employment with certain employers for a specific position.<\/p>\n<p>Other employment-authorized visas include the <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/temporary-workers\/l-1a-intracompany-transferee-executive-or-manager\" target=\"_blank\" rel=\"noopener\">L visa for intra-company transferees<\/a>. Extraordinary artists, scientists, athletes, educators, and religious workers use the O, P, and R visas, respectively.<\/p>\n<p>Each type of employment-based visa has requirements you must meet. They require different documentation and qualifications depending on each case.<\/p>\n<h2>Becoming a U.S. Citizen Through Naturalization<\/h2>\n<p>Immigration refers to migrants seeking to enter the U.S. Naturalization is for immigrants already in the U.S. seeking citizenship.<\/p>\n<p>The federal government oversees naturalization, sanctioned by the Attorney General. It is the legal process by which a noncitizen becomes a U.S. citizen, as stated in the United States Code (U.S.C.). It occurs after fulfilling specific requirements imposed by Congress in the <a href=\"https:\/\/www.uscis.gov\/laws-and-policy\/legislation\/immigration-and-nationality-act\" target=\"_blank\" rel=\"noopener\">Immigration and Nationality Act (INA)<\/a>.<\/p>\n<p>Citizenship, <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/u-s-citizenship-through-parents-or-by-birth.html\">when not acquired by birth<\/a>, is available to lawful permanent residents of good moral character through the &#8220;naturalization&#8221; process. Depending on the applicant&#8217;s circumstances, the period required after obtaining residency varies. Spouses of U.S. citizens may apply for citizenship after three years as a permanent resident. Most others must accrue five years of permanent residency before applying for citizenship.<\/p>\n<p>Most applicants must be proficient in English and able to pass a short <a href=\"https:\/\/www.findlaw.com\/immigration\/citizenship\/what-to-expect-on-the-naturalization-test.html\">civics test<\/a> on the history and governance of the United States. However, there are exceptions for the disabled and elderly. All applicants must be willing to swear an oath of loyalty to the country.<\/p>\n<h2>United States: A Nation of Immigrants<\/h2>\n<p>Millions of foreign nationals worldwide have immigrated to the United States. Between 1900 and 1914, massive waves of immigrants arrived at Ellis Island in New York. Migrants and noncitizens from different national origins made the U.S. a cultural melting pot that contributed to its thriving economy.<\/p>\n<p>But attitudes toward immigrants have continuously changed for more than two centuries. Immigrants are often looked upon favorably and, at other times, met with hostility. And <a href=\"https:\/\/www.findlaw.com\/immigration.html\">immigration laws<\/a> have often reflected these changing attitudes.<\/p>\n<h2>History of Immigration Laws in the U.S.<\/h2>\n<p>The\u00a0<a href=\"https:\/\/immigrationhistory.org\/item\/1790-nationality-act\/\" target=\"_blank\" rel=\"noopener\">Naturalization Act of 1790<\/a> was the first U.S. immigration law to establish uniform rules for granting U.S. citizenship through naturalization.<\/p>\n<p>Following this act, significant legislation placed restrictions on U.S. immigration. The <a href=\"https:\/\/www.history.com\/topics\/19th-century\/chinese-exclusion-act-1882\" target=\"_blank\" rel=\"noopener\">1882 Chinese Exclusion Act<\/a> placed a quota on Chinese Immigrants to the United States. This became the first significant federal legislation restricting U.S. immigration. It was also the first to restrict <a href=\"https:\/\/daily.jstor.org\/the-chinese-exclusion-act-annotated\/\" target=\"_blank\" rel=\"noopener\">immigration based on race or country of origin<\/a>. Quotas and immigration acts of all types followed.<\/p>\n<p>Over the following decades, immigration grew. By 1906, the U.S. government reformed the path to U.S. citizenship and established the Bureau of Immigration. The Bureau of Immigration oversaw the naturalization process.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/basic-immigration-laws.html\">Immigration and Nationality Act<\/a>\u00a0(INA) of 1952 is part of the United States Code (U.S.C.). It is a collection of laws that sets guidelines for various aspects of immigration. This law covers:<\/p>\n<ul>\n<li>Naturalization<\/li>\n<li>International students<\/li>\n<li>Temporary workers<\/li>\n<li>Humanitarian protections such as asylum and refugee admissions<\/li>\n<\/ul>\n<p>Over a decade later, the INA of 1965 ended admissions policies based on race and ethnicity. The act changed the admissions policy to emphasize immigrants&#8217; skills and relationships with family members in the U.S. or immigrants who are already in the U.S.<\/p>\n<p>Then, the Immigration Act of 1990 increased the U.S. government&#8217;s limits on the number of immigrants entering the country. From 1992 to 1994, the cap for this annual limit was 700,000. After that, in fiscal year 1995, the limit dropped to 675,000.<\/p>\n<p>Today, many immigrants in the U.S. come from Asia and Latin America. More recently, the\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-deferred-action-for-childhood-arrivals-.html\">Deferred Action for Childhood Arrivals<\/a> (DACA) program\u00a0was created under the Obama administration. It protects\u00a0some undocumented people\u00a0brought here as children from deportation and allows them to get work permits. But it&#8217;s limited to a certain time period.<\/p>\n<p>In 2017, the Trump administration attempted to end DACA through an executive order. But the U.S. Supreme Court overruled the attempt. The DACA program was later renewed under the Biden administration.<\/p>\n<p>The <a href=\"https:\/\/www.findlaw.com\/coronavirus-laws.html\">COVID-19 pandemic<\/a> brought new rules in response to public health concerns.
