Your status will help determine which family members are eligible to migrate to the United States. But to get the fianc\u00e9e visa, you and your fianc\u00e9e should marry within 90 days of the date they entered the United States.<\/p>\n<p>Also, you must have a <a href=\"https:\/\/www.findlaw.com\/immigration\/deportation-removal\/what-is-marriage-fraud.html\">bona fide marriage<\/a>, meaning you both intend to establish a married life together. And you and your fianc\u00e9 entered the marriage not merely to get immigration benefits.<\/p>\n<h2><a id=\"FianceApply\"><\/a>Can My Fiance Apply for a Green Card?<\/h2>\n<p>Yes. Your fianc\u00e9 can apply for permanent resident status if they marry you within 90 days of entering the United States with a\u00a0<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/temporary-visas.html\">K-1 nonimmigrant visa<\/a>. You must then file an Application to Register Permanent Residence or Adjust Status (<a href=\"https:\/\/www.uscis.gov\/i-485\" target=\"_blank\" rel=\"noopener\">Form I-485<\/a>). The USCIS will then review your application. If the USCIS needs more documents or information, they will mail a request for evidence to your address.<\/p>\n<p>After this, you and your now-spouse may need to appear for an <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/what-to-expect-at-a-stokes-interview.html\">interview with a USCIS officer<\/a>. If your Form I-485 is approved and you have been married for less than 2 years, USCIS will grant your spouse conditional LPR status. USCIS will issue a green card valid for 2 years.<\/p>\n<h2><a id=\"Conditional\"><\/a>Why Would a Foreign Spouse&#8217;s Permanent Resident Status Be Conditional?<\/h2>\n<p>A spouse&#8217;s permanent resident status will be conditional if the marriage is less than two years old from the date they became a permanent resident.<\/p>\n<p>To <a href=\"https:\/\/www.uscis.gov\/green-card\/after-we-grant-your-green-card\/conditional-permanent-residence\/removing-conditions-on-permanent-residence-based-on-marriage#:~:text=Your%20permanent%20resident%20status%20is%20conditional%20if%20it,your%20status%20to%20that%20of%20a%20permanent%20resident.\" target=\"_blank\" rel=\"noopener\">remove the conditions<\/a>, the spouse must establish that the purpose of the marriage was not to circumvent U.S. immigration laws.
